    Dr. Butler made a motion, seconded by Dr. Retterbush, to approve the tentative agenda of the

    March 7-8, 2013 meeting. The motion carried unanimously.

    Dr. Butler made a motion, seconded by Dr. Retterbush to approve the February 7, 2013 minutes.

    BOARD RECOGNITION

    Dr. Butler recognized Sharon Cloud for her 18 years as a breast cancer survivor.

    UPDATES

    Donald J. Palmisano, Jr., Executive Director and CEO of Medical Associates of Georgia, gave a

    legislative update for the Board members.

    NEW EMPLOYEE

    Ms. Hughes introduced the new investigator Jason O’Toole to the Board members.

    Dr. Weil made a motion to amend the January minutes: Investigative file 20110724 Board

    approved Private Consent Order. Dr. Retterbush seconded the motion and it carried unanimously.

    PRESENTATION

    Gene G. Able, M.D. and Funmilayo Rachal, M.D. with the Behavioral Medicine Institute of

    Atlanta gave a presentation regarding dealing with physicians involved in professional sexual

    misconduct (PSM). They gave an overview of their facility and the treatment for physicians

    involved in PSM. The Board members asked questions concerning the treatment methods and

    Physicians Able and Rachal responded.

    RULES HEARING The Board held a Public Hearing concerning amending Rules by amending Chapter 360-5-11,

    entitled ―Standards for Physician Assistant Practice.‖

    Dr. Butler announced the Public Hearing and asked if anyone was present to address the Board on

    the posted Rule for amendment. No one was present.

    Dr. White moved to amend Chapter 360-5-11, entitled ―Standards for Physician Assistant

    Practice.‖ That the Board find the formulation and adoption of these rules do not impose excessive

    regulatory cost on any licensee and any cost to comply with the proposed rule cannot be reduced

    by a less expensive alternative that fully accomplishes the objectives of the applicable laws. That

    the Board find that it is not legal or feasible to met the objectives of the applicable laws to adopt or

    implement differing actions for businesses as listed at O.C.G.A § 50-13-4(a)(3)(A),(B),(C) and

    (D).

    Dr. Gross seconded the motion and it carried unanimously.

    EXECUTIVE DIRECTOR’S REPORT

    LaSharn Hughes, Executive Director, presented the following information for the Board’s review:

    1. For information only – Map showing where APRN practice in the United States..

    2. Board reviewed the application process for the Nurse Practitioner, and approved to raise

    the application fee to $200.00.

    3. Letter from Dana Ruzicka – asking the legality of physicians, Physician Assistants,

    APRNs to escort patients through Georgia by air; Board approved.

    4. Email from Sherilyn Bottoms regarding urine screens. Board advised that is governed by

    the insurance companies; The Board referred to the Rules Committee.

    5. For information only – Telemedicine information from ATA.

    6. For information only – CTel – Electronic Examination for Telemedicine Prescribing.

    7. Julia Thorne – can an APRN perform peripheral nerve injections? Advised may be

    approved under a protocol.

    8. Questions concerning advertisement of a Chiropractor. Board advised refer email to

    Chiropractic Board.

    CLOSED MEETING

    Dr. White made a motion, seconded by Dr. Retterbush, to go into closed session to discuss

    pending litigation, Investigative and Wellness matters. The motion carried unanimously.

    Dr. Butler declared the meeting in Open Session

    The Board took the following actions:

    1. Approved Policies Concerning Receipt of Board Orders and Voluntary Surrenders

    ADJOURNED

    Dr. Retterbush moved to go into Executive Session to conduct Investigative Interviews. Dr. White

    seconded, the motion and it carried unanimously. Dr. Butler then declared the meeting would be

    open session upon completion of the investigative interviews for the purpose of holding committee

    meetings.

    RULES COMMITTEE

    Dr. White presented the report of the Rules Committee. Dr. Retterbush seconded the Committee’s

    motion, and it carried unanimously.

    The Board reviewed and made changes to Rule 360-3-.07 ―Practice Through Electronic or Other

    Such Means.‖ Motion Dr. Gross, seconded Dr. Retterbush and motion carried to send to the

    Office of the Attorney General for review and approval before posting.

    Rule 360-3-.06 ―Pain Management‖ was reviewed for possible changes to the Rules. The Board

    tabled this discussion for a second draft of proposed changes at the next meeting. The Board will

    also change the format of the FAQs and review at the next meeting.

    Dr. White motioned to go into Closed Session Dr. Weil seconded the motion and it carried

    unanimously.

    Dr. Butler declared Open Session

    Totada Shantha, M.D. requested an appearance before the Board regarding the denial of his

    reinstatement of his license. Dr. Shanta made a presentation for the reinstatement of his license.

    The Board members asked questions. Dr. Shanta responded to their questions and made closing

    arguments.

    Dr. Gross moved to go into Closed Session. Dr. White seconded the motion and it carried

    unanimously.

    Dr. Butler declared Open Session.

    Dr. White moved to deny Dr. Shantha’s request for reinstatement. Dr.

    Gross seconded the motion and it carried unanimously.

    Joseph Jimenez, M.D. requested an appearance to ask the Board to reconsider his application. To

    revisit and examine facts concerning his military service obligation, hardship of residency life

    psychological and medical issues, and his positive academic accomplishments. Attorney Melvin

    M. Goldstein, P.C accompanied him. Dr. Jimenez made his presentation to the Board and the

    Board members asked him questions. Dr. Retterbush moved to go into closed session and Dr.

    Deloach seconded the motion. It carried unanimously.

    Dr. Butler declared Open Session.

    Dr. Gross moved to accept the Puerto Rico board scores in lieu of the USMLE Step 3 requirement.

    But uphold the previous decision of the Physician Licensure Committee to require the following,

    (1) Complete a Physician and Mental Evaluation and (2) complete Clinical Skills testing at a

    Board approved facility.

    ADJOURNMENT

    There being no further business, Dr. White made a motion, seconded by Dr. Retterbush to adjourn

    the meeting.
