INTRODUCTION

Puerto Rico was a Spanish possession from the time of its discovery on Nomveber 19, 1493, until

it was ceded by Spain to the United States on December 10, 1898. The Treaty of Paris closing the

Spanish-American War provided that the cession of Puerto Rico to the United States also include the

cession of such rights as the Crown of Spain and its authorities possessed with respect to the "official

archive~ and records" in the island. The United States, in turn, agreed to "carefully preserve" the Puerto

Rican records and to make them available to users.

Shortly after the United States gained control of Puerto Rico, it became necessary to give

attention to the care of the records of the Spanish administration. The Superintendent of the

Manuscript Department of the Library of Congress, Herbert Friedenwald, visited Puerto Rico in 1899

with this problem uppermost in his mind. During this visit he met Cayetano Coll y Toste, Puerto Rican

scholar employed by the American administration in a post which brought him in close contact with the

records of the Spanish regime. Dr. Coll y Toste reported that the records were in very bad condition.

Friedenwald, who had brought along a "disinfector," was able to give him sorne help. Friedenweld

recommended to American military authorities that part of these records be transferred to the Library

of Congress. When this recommendation was approved, Dr. Coll y Toste was placed in charge of

segregating the materia Is. Those records considered necessary to the administration of the government

were kept in Puerto Rico; the other records were shipped to the Library of Congress. The transfer of

records to the Library of Coignress began on June 13, 1899, and was completed by March 6, 1900. A

total of 2,246 legajos (bundles), in 289 packing cases, was transferred. The contents of these cases are

described in detail in the Coll y Toste inventory, which is included in this record group.

The records in the 289 cases were screened in the Library of Congress, and any material of

importance for administrative purposes was again segregated for return to Puerto Rico. In the Report of

the Librarin of Congress for the fiscal year Ending June 30, 1901 (p. 19), the Librarían makes the

following statement:

The material received from the Government offices at San Juan during the year 1899 consisted

of 2,246 bundles in 289 large cases. lt has been roughly sorted, and about two-thirds returned to Porto

Rico as having more appropriate service there.

Actually 200 packing cases containing archives of the Spanish Government of Puerto Rico were

returned by the Library of Congress and were received by the Quartermaster Department in San Juan

from the transport McClellan on April 8, 1901. The remaining 89 cases of printed and archiva! materials

were retained by the Library of Congress. Most of the printed materials (pg 2) became a part of the

Library's regular collections. The archiva! materials were placed in the custody of the Division of

Manuscripts, where they remained until their transfer to the National Archives in 1943. In 1957 the

Congress of the United States approved an act authorizing the return of Puerto Rican archives now in

possession of the National Archives to the Commonwealth of Puerto Rico (71 Stat. 400).

This inventory describes all records in the National Archives in Record Group 186, Records of the

Spanish Governors of Puerto Rico. These records, in Spanish, amount to 134 cubic feet. They were

received from the Library of Congress.

Closely related records are in the Library of Congress, the Archivo General de Puerto Rico, the

Archivo General de Indias in Seville, and the Archivo Histórico Nacional in Madrid.

Records Relating to Fiscal Affairs, 1782-1896

These records consist of 56 series bearing such titles as contraband, tariff duties, taxes, usury,

financia! reports, budgets, counterfeiting, debts, lottery tickets, royal, income, fines, and publica

expenditures. The records also include (1) sorne correspondence signed by Alejandro Ramírez, the

Puerto Rican official responsible for the planning and establishment of an efficient fiscal system for the

island, 1813-16; (2) correspondence of Manuel de los Reyes and of Juan Patiño, 1800-1805; and (3) an

expediente (case file) on the dispute in 1793 between the acting Governor, Francisco Torralbo, and the

lntendent, Juan Francisco Creagh, over authority to license vessels sailing between Puerto Rico and

Santo Domingo.

Records Relating to Military Affairs, 1761-1890

The following 36 series bear such titles as artillery, cavalry military conduct, defense, deserters,

fortifications, military decorations, prisoners, and volunteers. Two of the largest series are titled "Militar

generales" and "Presidio (La Puntilla)." The records are arranged alphabetically by name of series and

there under for the most part chronologically. Most of the series have gaps.

Records From Municipalities, 1765-1898

These records were received by the Office of the Governor from mayors and other officiales

from about 75 towns in Puerto Rico. The records are arranged alphabetically by name of town and

t here under chronologically. The quantity of records generally increases with each successive decade

until about 1860 or 1870, and thereafter it decreases.

Through their correspondence, the municipal officials kept the central government informed

about all important events taking place in their particular jurisdiction. More over,

Central authorities had the right to request needed information on any topic. Transmitted with the

correspondence are copies of resolutions adopted by the town council; tax lists; proposed budgets; lists

of inhabitants; reports relating to passes and passports issued; reports on health conditions, mcluding

the number of individuals vaccinated; and reports on fines, storms, and many other subjects. There are

a numbcr of expedientes that contain information concerning repair of public buildings, construction of

bridges and roads, and similar projects of interest to local historians.
