BIDDING: Each animal will be sold to the highest bid-der without reserve. The auctioneer will settle any dis-putes as to bids, and his decision will be final.

TERMS: All terms are cash or check. Settlement mustbe made to the clerk at the conclusion of the auction.

PURCHARSER’S RISK: Each animal becomesthe risk of the purchaser as soon as sold, but will not bedelivered until settlement has been made.

CERTIFICATE OF REGISTRY: When full settle-ment has been made, a certificate of registration will befurnished and transferred to the purchaser on those lotsthat are registered. Give full name and address to sec-retary when making payment so the certificate of reg-istry will be transferred properly.

HEALTH: All animals where possession is sold are eli-gible for interstate shipment except as otherwiseannounced. The cattle have been tested for Bangs dis-ease within thirty (30) days of the sale date or comefrom a Brucellosis Certified Free Herd. A health certifi-cate will be furnished.

ANNOUNCEMENTS: Announcements from theauction block will take precedence over the printed mat-ter in this catalog. All cattle will be sold by lot numbersas announced by the auctioneer.

BREEDING GUARANTEE: (A) All animals areguaranteed to be breeders with the exception of: (1)injury or disease occurring after sale; (2) negligence orwillful misconduct on the part of the purchaser. (B) Anyfemale is considered a breeder if she is pregnant at thetime of the sale and/or she has a calf at side. The seller reserves the right and priv-ilege of trying for a period of six (6) months to prove theanimal a breeder. If proven a breeder, the animal will bereturned at the buyer’s expense. Should the animal failto breed, the buyer, at his option may either demandreturn of the purchase price or replacement of the ani-mal with another of equal value. (C) Any animalreturned must have a veterinarian’s certificate that it ishealthy and free of Bangs and Tuberculosis.

RIGHTS AND OBLIGATIONS: (A) The aboveterms and conditions of the sale shall constitute a con-tract between the buyer and seller of each animal andshall be equally binding upon both. (B) All persons whoattend the sale do so at their own risk and neither theowners nor any other person connected with the man-agement of the sale assume any liability, legal or other-wise, for any accidents which may occur.
