    The followinghas been drafted to provideCouncilwithplanningcommentsconcerningthe above-notedrezoning application:

    The subject propertyis located alongConcession Road 6 The site comprises 8.4hectares

    ofland and contains

    a house, barn and acces$ory buildings.Approximately

    6.67 hectares of the site are cash-cropped Gamblane Farms Ltd.wishes to purchasethe agricultural landsbut not the house or farmbuildings, and thereforehad recentlysubmitteda severance applicationin this regard. The severed parcel, comprisingthe6.67 hectares of farm land, are to be merged on titlewith theadjacent 48.35 hectares ofland also owned by Gamblane FarmsLtd The house and barn wouldremain on the'1.73 hectare retainedparcel. Thisseverance is considered a lot addition rather than thecreationof a new lot.

    As Councilwillrecall, this severancewas approved conditionallyon December 17,2014As a condition ofconsent, the proposed parcelcontainingthe exieting house andbarn isrequiredto be rezoned to allowfor a reduced lot areaand frontage. ln this regard, anapplication hasbeen filedto reduce the minimumlot area and frontage requirements from20 hectares and 180 metres to 1.73 hecatres and 158 metres respectively.

    The submitted applicationis also requesting permissionto utilizethe existing barntoaccommodate livestock not exceeding two nutrientunits. Typically,the '41' zone doesnot permitany livestockon parcels under 2 hectares insize. ln this particularinstance,the applicant hasmade the argument that this new, non-farm residential lot couldhaveexceeded the two hectare minimum requirementfor livestock activity,but was reduced to

    1.73 hectares in orderto keep allactive farmland withthe farmproperty;and, therefore,special considerationshould begiven to allowingfor the existingbarn to be used foraccommodating somelivestock.The Committeeof Adjustment, when dealing withtheseverance, accepted this argumentand stipulated as another conditionof consent thatthe ZoningBy-law Amendment should allowfor livestockwithin the existing barn,but to amaximum oftwo nutrientunits (e.9. twomedium-frame horses).ln terms of evaluatingthis rezoning application,it is importantto note that the recentseverances were deemed to conformwiththe CountyOfficialPlan and the ProvincialPolicyStatement, and therefore, the proposal to reduce the lotarea and frontagerequirementsof the '41' zone should also bedeemed to complywith these landusedocuments. Withregard to the proposal to allowfor livestock equivalentto twonutrientunits onthe property,it is importantto note that neither the County OfficialPlan nor theProvincialPolicy$tatement speak to this issue. Similarprovisionsare found inotherBy-lawsthroughthe County,but they aren't backedby any policyln this particularinstance, the applicant'srequest seems reasonable.

    Based on the foregoing,the proposed By-lawshould begiven favourableconsiderationby Council.

    Thisopinionis providedwithout thebenefit of havingreceivedcomments fromany otheragency or any adjacent land owners. Should new informationarise regardingthisproposal,Councilis advised to take such informationinto accountwhen consideringtheapplication.

The severance wasapproved recently.The Amendmentwillalso stipulate that the maximumnumber oflivestock animals kept on siteshall be 2 nutrientunits.

    The lands subject to rezoning are locatedwithinthe 'Rural'designation of the CountyofGrey OfficialPlan.
