If you have been tracking it, you will notice that in many cases over the years the companies’ volume has increased along with a significant increase in the loss ratio.

And other companies have introduced new underwriting tools that help them better understand policyholders, household structures and vehicle utilization.

These new underwriting tools have added to the sophistication of rate making, raised the speed and standard of field underwiting, but also added greatly to the cost of doing business.

For example, some companies spend $50 - $60 per application in Georgia just on quote and point of sale customer data. They verify current carrier information, score financial responsibility, pre-fill driver and vehicle information, and run MVR / CLUE for every customer. It doesn’t take long for those costs to add up.

So what is a company to do?

Some of the more sophisticated companies have introduced eSignature platforms that allow customers to “point & click” their way through an application while in the agency.

These enhancements should represent a substantial savings in time, paper, ink, storage, as well as a reduced E&O exposure for agencies.

Assuming, of course, that your agency has embraced the digital changes and do not continue to hold fast to the old way of conducting business.

Some of the company management teams will vote to reduce the number of agency appointments in order to restore business back to a more profitable position.

Other will reduce commission paid to the agency.

Why wouldn’t a company simply raise fees and premium to offset the increased cost of doing business?

Enjoyed visiting with you by phone earlier this week. As I remember you asked about contracts with Companies. This is one that may interest you.

____ is a company that only sells property insurance in a few states but the market being what it is and no mention ever made regarding production we joined them two years ago. Earlier this year they threatened us with termination for lack of production. I protested that we had never been told they expected five applications per month and the relented and we agreed to step up production.

A few weeks ago in an effort to produce more business for them we appointed a member of another agency in another town. We did not appoint the agency but one of the agents. They began submitting business and I felt we were doing a good job until I receive a message that the company had received a call from the agent and the company’s caller ID referenced another agency.

I readily admitted, yes, we appointed this agent but not his agency. When I was told we could not do this, I asked how to resolve the problem. I knew we needed to terminate the agent but what about his business? I was informed I was being terminated for this action. I objected to no good.

When I review the contract Item C Page 2 of paragraph C states:

Without prior consent. You have no authority to, and agree that You will not:

a. Grant binding authority to, or accept business subject to this Agreement from, anyone other than Your duly licensed and appointed employees.

Actually, we have no employees in our agency as we are small. We submitted contracting for this agent and the company approved the appointment. I never thought that we were doing anything wrong. If I had been accepting business from this agent and submitting from our agency, it appears we would have been legal by the company’s standards.

Now that we are being terminated without any chance to correct our mistake. The Georgia representative is going to the producer we had appointed and she is appointing his agency to represent the company. If the appointment of this agent is processed by the company, I am considering seeking a legal opinion as to the legality of the way this matter was handled.

Feel free to share this information with your reader so maybe another agent will not be caught as I was.

Broker in more ways than one

Hi, Broker.

This is common contract wording in the P&C business; almost all of them do not allow you to use a broker agent. This contract refers to employees, and specifically prohibits you from brokering business. (I know that in the life industry it is common, but the P&C business worries about fraud and accuracy on applications.)

I would not sue them if you signed this contract as it will just cost you more money. I agree appointing the agent down the street is rotten, but they are thinking with an "agent of record" letter they can terminate you yet maintain the business on the books.

You are also prohibited from showing this contract or the underwriting guide to outside parties even after termination. I will not use any names when comparing features in contract wording by carriers. This is a contract written by the company for the company. It is an example that I was looking for.

In my previous life as the Marketing Rep., my agents usually signed my contracts without reading them. Did you read this before signing?

Things which are obvious but widely ignored:

Who owns the business?

Is this a contract between the agent (agency) and the company or a contract between a broker and an agent or MGA? This also speaks to the ownership of the business.

If the relationship fails what are the rules for the run off and the commissions? Are they enforceable?

Is the agent or the agency personally financially responsible for the handling of the company's premium due? Some of these contracts cut through corporate protection to make the owner financially responsible.

Always remember the contract was written by the company's lawyer for the company's benefit!

Applicant Screening & Access to Social Media Pages Q&A

Social media sites contain all sorts of interesting information about your applicants that might be relevant to the hiring process. But, should you require potential employees to provide access to their private social media accounts?

Q: We would like to look at applicants’ Facebook and other social media pages as part of our hiring process. Can we do this? Should we?

A: You certainly are not alone in wanting to check up on your applicants’ use of social media. A 2012 survey from CareerBuilder found that 37% of responding employers use social networking sites to research job candidates. According to the survey, most employers check social media to see if candidates present themselves professionally (65%), while 51% check to see if the applicant will be a good fit for their corporate culture. Forty-five percent indicated they were looking for more information about the candidate’s qualifications, and 35% want to see if their applicants are well-rounded. Only 12% admitted they were looking for “reasons not to hire” the candidate. However, checking an applicant’s social media may be a little risky, especially if you go beyond public searches and request an applicant’s password to access their private pages, for example on Facebook. Although no federal law addresses asking applicants for their social media passwords, at least five states (California, Illinois, Maryland, Michigan, and Utah) specifically prohibit employers from requiring applicants and employees to provide their social network passwords or to display private portions of their social networking pages to employers. The laws generally do allow employers to check information that is available in the public domain of the Internet and social media sites. Several other states also are considering similar legislation, and both the House of Representatives and the Senate have introduced federal privacy protections for applicants’ and employees’ social media sites.

In addition, most applicants will view a request for access to their protected social media pages as an intrusion into their private lives and some may even withdraw their application because of the request. And, Facebook now makes the solicitation of another person’s Facebook password a violation of the terms and conditions of use of the social networking site. So, clearly it is prudent to limit any search of social media sites to information in the public domain.

Even if you are searching only for information that is publically available on the Internet, you also should be aware of other potential problems that can arise from material you find online. For example, you may find out about an applicant’s membership in protected classes that could lead to a discrimination claim if you do not hire the individual. While protected classes such as race and sex may be evident in a face-to-face interview, other protected classes such as disability, national origin, and sexual orientation (protected under many state discrimination laws) may not be. Further, if you do not hire someone because of their participation in a legal off-duty activity, their political views, or the fact that they smoke, you could be violating state laws prohibiting basing employment decisions on these actions.

In spite of these potential risks, many employers still find the Internet a valuable resource for researching applicants. The CareerBuilder survey indicates that employers discovered both positive and negative information about candidates on the Internet that affected their hiring decisions. Thirty-four percent of the hiring managers surveyed indicated that negative information they found on social media about a candidate resulted in a decision not to hire. The most damaging applicant postings indicated provocative or inappropriate behavior, poor communication skills, and bad-mouthing their employers. However, 29% discovered positive information on the social media sites that led to a job offer, including that the sites supported the applicant’s professional credentials and qualifications. So, if you are going to check out your candidates online, you should follow these five simple rules: 1. Notify your applicants that you will be investigating them on publically accessible Internet and social media sites and get their permission to do so. 2. Look only at information posted publically. Do not ask for personal passwords or try to “friend” a candidate surreptitiously. 3. If you use an outside party to conduct the research, make sure you are following the Fair Credit Reporting Act’s (FCRA) comprehensive notice, consent, and disclosure obligations both prior to doing the checks and after the results of the checks are reported. (As a reminder, the FCRA applies whenever you use outside agencies to perform credit or other background checks (including criminal, reference, or driving record checks) on your candidates and employees.)

4. If you discover information about an applicant’s protected class or legally protected activities, make sure you do not use that information as part of your decision-making process. For example, do not provide this type of information to hiring managers. Any information from social media that you consider should be job-related and business-related only. 5. Document your search and include the information in the applicant’s file. You want to be able to show that any inappropriate information was not considered in the hiring process.

Addressing behavior and performance issues

I believe that almost all employees want to do a good job. And for the most part, they do. Even so, we do from time to time end up with someone who isn't meeting our expectations. Here are several ways I see managers and owners address that issue.

* Never say anything to the employee, but silently become more and more frustrated. Nothing like a resentment to turn around an employee's performance! The employee thinks he's doing fine, but his manager is getting an ulcer. People aren't mind readers. Managers have to say something if they're going to improve someone's performance.

* Complain to others about the employee, but never say anything to the person him/herself. Hey, at least they're talking about it! Too bad it's to the wrong people. I'm sure the manager's spouse, friends, or even his/her dog or cat would appreciate it if the manger stopped talking to them and started actually doing something about the employee.

* Say something to the employee, but sugarcoat it so much the employee thinks they're doing okay. This happened to me once. When I was in college I was working full-time, going to school full-time, and partying full-time. I was a very busy guy. When my store manager was transferred I was sure I was going to be promoted. When I went in for what I thought was an interview I got fired. Let me tell you, that was a shock! The manager tried to say that he told me my job was in jeopardy, but if he did he so sugarcoated it I never heard what I needed to hear.

The only way to truly address an employee issue is this.

* Meet one-on-one with the employee, and be direct and tactful about his/her behavior or performance. People deserve to hear when they're failing to meet their manager's expectations. They also have the right to know the consequences for failing to change or improve.

Sure, you might be uncomfortable having this conversation, but the alternatives simply don't work. Most people who struggle to have these kinds of sit-downs hate confrontation. Well, it's not confrontation. It's not about the person at all. It's about his/her behaviors, actions, or performance that are falling short of what's required in the job. By meeting and working with the person you're (hopefully) going to be able to help her improve so she's able to continue in the role.

But remember, there is a difference between

addressing a behavioral issue or one that is about job performance.

A sales or service performance issue does require some time to improve. Chances are the employee needs some additional time and training to be able to get his/her performance to the level that's required. In that case it might make sense to give the employee 30-60 days to turn it around.

A behavior issue is different. The employee should be expected to change his/her behaviors immediately. If he doesn't, he should be on the fast track to a new job somewhere else.

Too often managers aren't willing to draw that line in the sand. Or they do, but then keep redrawing it further out. I once met a retailer who cut an employee's hours because she was so miserable to customers and colleagues. Great. Now she only hurt the store ten hours a week instead of twenty!

Another storeowner I know gave an employee thirty days to quit being rude. She should have been given thirty seconds, if that. Expect people with behavioral issues to change immediately, and if they don't they should be gone. You might need to document and follow a process, but that doesn't require a certain amount of time. It requires action on your part.

So let me ask, in which one of these do you see yourself? The good news is that any manager can learn to be direct and tactful. It just requires taking action, and maybe putting yourself in an uncomfortable situation.

Good afternoon, Eddie

As you may already be aware, a former Velox Insurance employee, Pablo Navas, was arrested yesterday. This individual acted outside the scope of his authority and he was terminated as soon as we found out. We discovered that Navas pocketed one payment and he was fired immediately on May 11th. The following business day we found more customers affected by his acts, and we called the insurance department and the police in order to prosecute him. We have since discovered more cases, and we are diligently working with the investigators. Velox Insurance has been committing and will continue to commit its resources and efforts towards the goal of reimbursing customers who made payments which Navas did not apply to the company.

This unfortunate situation is the act of an individual and it does not by any means reflect on Velox Insurance. Running Velox Insurance with integrity and protecting our customers is our top priority. We were proactive in resolving this situation as soon as we found out, and we took measures internally and externally to prevent this from happening again and to bring this individual to justice.

HUDGENS: FORMER INSURANCE AGENT ARRESTED FOR FRAUD

Atlanta – Insurance Commissioner Ralph Hudgens announced today that an investigation

by his office has resulted in a former Cobb County insurance agent being arrested on

insurance fraud charges.

Juan Pablo Navas, 30, of Mableton, has been charged with six counts of insurance

fraud, three counts of financial transaction card fraud and four counts of forgery for

allegedly keeping premiums paid to him for insurance coverage. Navas was arrested this

morning in Cobb County and transported to the Gwinnett County Jail for booking.

Commissioner Hudgens said Navas was working for Velox Insurance Agency located

at 5261 Buford Highway, Norcross, Ga., at the time the alleged crimes occurred.

Numerous clients of the agency complained that they were getting cancellation notices

from their insurers, claiming lack of payment for automobile policies and workers’

compensation coverage though the clients had paid their premiums directly to Navas and

received paperwork verifying coverage.

“Our investigation has turned up numerous victims of this scam and we expect for

additional charges to be filed,” Commissioner Hudgens said. “Velox Insurance has made

good on all the missing payments, so their clients now have the coverage they paid for.”

Hudgens urges anyone who believes they have purchased insurance from Navas, to

contact his Consumer Services Division at 404-656-2070. Hudgens will also have staff at

Velox Insurance on June 3-4 from 10 a.m. until 7 p.m. to meet with Velox clients with

questions about this investigation.

Insurance fraud is a felony with a penalty of two to 10 years in prison and/or a fine

of up to $10,000.

Wayne Hooper Reports: The Best Barbecue (barbeque) or BBQ Restaurants in Georgia per an FYI survey

The seed for this article came from a conversation with several marketing people during a break at a recent Georgia / South Carolina agent's convention. One of the reps suggested I survey the marketing Rep.'s and agents for their favorite BBQ restaurants. Obviously, whole books and TV shows work on this subject, so I asked about their favorite "pork" BBQ places. My initial list is at the end of this article. I eliminated many good neighborhood favorites simply because they were not outstanding. This is a never ending list so if you have a favorite you want to add, please send the information to [email protected] to share with our readers.

Barbecue as defined in Wikipedia

Most etymologists believe that barbecue derives from the word barabicu found in the language of the Taíno people of the Caribbean and the Timucua of Florida, and entered European languages in the form barbacoa. The word translates as "sacred fire pit."

[1] The word describes

a grill for cooking meat, consisting of a wooden platform resting on sticks.

Traditional barbacoa involves digging a hole in the ground and placing some meat (usually a whole goat) with a pot underneath it, so that the juices can make a hearty broth. It is then covered with maguey leaves and coal and set alight. The cooking process takes a few hours.

It has been suggested that both the word and cooking technique migrated out of the Caribbean and into other languages and cultures, with the word (barbacoa) moving from Caribbean dialects into Spanish, then Portuguese, French, and English. The Oxford English Dictionary cites the first recorded use of the word in the English language as a verb in 1661, in Edmund Hickeringill's Jamaca Viewed: "Some are slain,

And their flesh forthwith Barbacu'd and eat." It also appears as a verb in the published writings of John Lederer, following his travels in the American southeast in 1672.

in 1697 by the British buccaneer William Dampier. In his New Voyage Round the World, Dampier writes: And lay there all night, upon our Borbecu's, or frames of Sticks, raised about 3-foot (0.91 m) from the Ground.

Samuel Johnson's 1756 dictionary gave the following definitions:

"To Barbecue – a term for dressing a whole hog" (attestation to Pope)

"Barbecue – a hog dressed whole"

While the standard modern English spelling of the word is barbecue, local variations like barbeque and truncations such as bar-b-q or bbq may also be found.

The spelling barbeque is given in Merriam-Webster OnLine as a variant spelling,

Dictionary states that barbecue is "often misspelled as barbeque".

In the southeastern United States, the word barbecue is used predominantly as a noun referring to roast pork, while in the southwestern states cuts of beef are often cooked.

In British usage, barbecuing refers to a fast cooking process directly over high heat, while grilling refers to cooking under a source of direct, high heat—known in the United States and Canada as broiling. In American English usage, however, grilling refers to a fast process over high heat, while barbecuing refers to a slow process using indirect heat and/or hot smoke (very similar to some forms of roasting). For example, in a typical U.S. home grill, food is cooked on a grate directly over hot charcoal, while in a U.S. barbecue, the coals are dispersed to the sides or at significant distance from the grate. Its South American versions are the southern Brazilian churrasco and the Argentine asado.

Alternatively, an apparatus called a smoker with a separate fire box may be used. Hot smoke is drawn past the meat by convection for very slow cooking. This is essentially how barbecue is cooked in most U.S. "barbecue" restaurants, but nevertheless, many consider this to be a distinct cooking process called hot smoking.

In the southern United States, barbecue initially revolved around the cooking of pork.

century, pigs were a low-maintenance food source that could be released to forage for themselves in forests and woodlands. When food or meat supplies were low, these semi-wild pigs could then be caught and eaten.

It was the Spanish who first introduced the pig into the Americas and to the American Indians. The Indians, in turn, introduced the Spanish to the concept of true slow cooking with smoke. The Spanish colonists came to South Carolina in the early 16th century and settled at Santa Elena. It was in that early American colony that Europeans first learned to prepare and to eat "real" barbecue.

According to estimates, prior to the American Civil War, Southerners ate around five pounds of pork for every one pound of beef they consumed.

the poverty of the southern United States at this time, every part of the pig was eaten immediately or saved for later (including the ears, feet, and other organs).

Because of the effort to capture and cook these wild hogs, pig slaughtering became a time for celebration, and the neighborhood would be invited to share in the largesse.

boucheries.] These feasts are sometimes called 'pig

pickin's.' The traditional Southern barbecue grew out of these gatherings.

Each Southern locale has its own particular variety of barbecue, particularly concerning the sauce. North Carolina sauces vary by region; eastern North Carolina uses a vinegar-based sauce, the center of the state enjoys Lexington-style barbecue, which uses a combination of ketchup and vinegar as their base, and western North Carolina uses a heavier ketchup base. Lexington boasts of being "The Barbecue Capital of the World" and it has more than one BBQ restaurant per 1,000 residents.

] South Carolina is the only state that

includes all four recognized barbecue sauces, including mustard-based, vinegar-based, and light and heavy tomato-based.

[10] Memphis barbecue is best known for

tomato- and vinegar-based sauces.[12]

In some Memphis establishments

[12] and in Kentucky, meat is rubbed with

dry seasoning (dry rubs) and smoked over hickory wood without sauce; the finished barbecue is then served with barbecue sauce on the side.

The barbecue of Alabama, Georgia, and Tennessee is almost always pork served with a sweet tomato-based sauce. However, several regional variations exist as well. Alabama is particularly known for its distinctive white sauce, a mayonnaise- and vinegar-based sauce, originating in northern Alabama, used predominantly on chicken and pork. A popular item in North Carolina and Memphis is the pulled pork sandwich served on a bun and often topped with coleslaw. Pulled pork is prepared by shredding the pork after it has been barbecued.

Kansas City-style barbecue is characterized by its use of different types of meat (including pulled pork, pork ribs, burnt ends, smoked sausage, beef brisket, beef ribs, smoked/grilled chicken, smoked turkey, and sometimes fish), a variety attributable to Kansas City's history as a center for meat packing in the U.S. Hickory is the primary wood used for smoking in KC, while the sauces are typically tomato based with sweet, spicy and tangy flavor profiles. Burnt ends, the flavorful pieces of meat cut from the ends of a smoked beef or pork brisket, are popular in many Kansas City-area barbecue restaurants.

Pit-beef prevails in Maryland and is often enjoyed at large outdoor "bull roasts", which are common for club or association fundraising events. Maryland-style pit-beef is not the product of barbecue cookery in the strictest sense, as there is no smoking of the meat involved; rather, it involves grilling the meat over a high heat. The meat is typically served rare, with a strong horseradish sauce as the preferred condiment.

The state of Kentucky, particularly Western Kentucky, is unusual in its barbecue cooking, in that the preferred meat is mutton. This kind of mutton barbecue is often used in communal events in Kentucky, such as political rallies, county fairs and church fund-raising events.

In much of the world outside of the American South, barbecue has a close association with Texas. Many barbecue restaurants outside the United States claim to serve "Texas barbecue", regardless of the style they actually serve. Texas barbecue is often assumed to be primarily beef. This assumption, along with the inclusive term "Texas barbecue", is an oversimplification. Texas has four main styles, all with different flavors, different cooking methods, different ingredients, and different cultural origins.

In the midwest, Chicago-style is popular and involves seasoning the meat with a dry rub, searing over a hot grill and a long slow cook in an oven. The meat, typically ribs, are then finished with a sweet-tangy sauce.

Events and gatherings

The word barbecue is also used to refer to a social gathering where food is served, usually outdoors in the late afternoon or evening. In the southern United States, outdoor gatherings are not typically called "barbecues" unless barbecue itself will actually be on the menu, instead generally favoring the word "cookouts". The device used for cooking at a barbecue is commonly referred to as a "barbecue", "barbecue grill", or "grill". In North Carolina, however, "barbecue" is a noun primarily referring to the food and never used by native North Carolinians to describe the act of cooking or the device on which the meat is cooked.

held each October in Kansas City, Missouri. This event comprises two distinct competitions held over the course of four days. The first contest is the Invitational Contest, with competing teams being required to obtain an invitation by winning other qualifying contests throughout the year. The second competition is an open contest that any team can compete in. This open contest is the largest championship barbecue competition in the world, with the 2007 event attracting 496 teams.

The World Championship Barbecue Cooking Contest is held annually in Memphis, Tennessee, during the Memphis in May festival.

Other barbecue competitions are held in virtually every state in the United States during the warmer months, usually beginning in April and going through September. These events feature keen competitions between teams of cooks and are divided into separate competitions for the best pork, beef and poultry barbecue and for the best barbecue sauces.

Techniques

Barbecuing encompasses four or five distinct types of cooking techniques. The original technique is cooking using smoke at lower temperatures (usually around 240–270 °F or 115–125 °C) and significantly longer cooking times (several hours), known as smoking. Another technique is baking, utilizing a masonry oven or any other type of baking oven, which uses convection to cook meats and starches with moderate temperatures for an average cooking time (about an hour plus a few extra minutes). Yet another technique is braising, which combines direct dry heat charbroiling on a ribbed surface with a broth-filled pot for moist heat, cooking at various speeds throughout the duration (starting fast, slowing down, then speeding up again, lasting for a few hours). Finally, grilling is done over direct dry heat, usually over a hot fire (i.e., over 500 °F (260 °C)) for a short time (minutes). Grilling may be done over wood, charcoal, gas (natural gas or propane), or electricity.
