A BILL
To amend title 49, United States Code, to reduce the fuel
economy obligations of automobile manufacturers whose
fleets contain at least 50 percent fuel choice enabling
vehicles, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled,2
SECTION 1. SHORT TITLE.3
This Act may be cited as the ‘‘Fuel Choice for Amer-4
ican Prosperity and Security Act of 2015’’.5

SEC. 2. FUEL CHOICE ENABLING MANUFACTURERS.1
(a) IN GENERAL.—Chapter 329 of title 49, United2
States Code, is amended by adding at the end the fol-3
lowing:4
‘‘§ 32920. Fuel choice enabling manufacturers5
‘‘(a) C ALCULATION OF A VERAGE FUEL ECONOMY .—6
The average fuel economy of a fuel choice enabling manu-7
facturer is the sum of—8
‘‘(1) the average fuel economy of such manufac-9
turer determined under section 32904; and10
‘‘(2) 4 miles per gallon.11
‘‘(b) DEEMED COMPLIANCE W ITH GREENHOUSE G AS 12
EMISSION STANDARDS.—If a fuel choice enabling manu-13
facturer is in compliance with all applicable standards pre-14
scribed under section 32902 for a model year, the auto-15
mobiles manufactured by such manufacturer in such16
model year are deemed to be in compliance with the stand-17
ards for emissions of greenhouse gases promulgated under18
section 202(a) of the Clean Air Act (42 U.S.C. 7521(a)).19
‘‘(c) DEFINITIONS.—In this section:20
‘‘(1) BIODIESEL.—The term ‘biodiesel’ means21
diesel fuel which has been produced from a non-pe-22
troleum feedstock and which meets the specifications23
of the ASTM D6751–03 standard.24
‘‘(2) E85.—The term ‘E85’ means a fuel mix-25
ture that contains up to 85 percent ethanol and26

meets the specifications of the ASTM D5798 stand-1
ard.2
‘‘(3) FLEXIBLE FUEL VEHICLE.—The term3
‘flexible fuel vehicle’ means a vehicle that has been4
warranted by its manufacturer to operate on gaso-5
line, E85, and M85.6
‘‘(4) FUEL CHOICE ENABLING MANUFAC-7
TURER.—The term ‘fuel choice enabling manufac-8
turer’ means a manufacturer whose total fleet of9
automobiles manufactured in a model year for sale10
in the United States contains at least 50 percent11
fuel choice enabling vehicles.12
‘‘(5) FUEL CHOICE ENABLING VEHICLE.—The13
term ‘fuel choice enabling vehicle’ means an auto-14
mobile that—15
‘‘(A) has been warranted by its manufac-16
turer to operate on natural gas, hydrogen, pro-17
pane, or biodiesel;18
‘‘(B) is a flexible fuel vehicle;19
‘‘(C) is a plug-in electric drive vehicle;20
‘‘(D) is propelled solely by a fuel cell that21
can produce power without the use of petroleum22
or a petroleum-based fuel; or23
‘‘(E) is propelled solely by something other24
than an internal combustion engine and is war-25

ranted by its manufacturer to operate on some-1
thing other than petroleum-based fuel.2
‘‘(6) GREENHOUSE GAS.—The term ‘greenhouse3
gas’ means carbon dioxide, nitrous oxide, methane,4
hydrofluorocarbons, perfluorocarbons, sulfur hexa-5
fluoride, or any other substance subject to regulation6
under section 202(a) of the Clean Air Act (427
U.S.C. 7521(a)) to address climate change.8
‘‘(7) M85.—The term ‘M85’ means a fuel mix-9
ture that contains up to 85 percent methanol and10
meets the specifications of the ASTM D5797 stand-11
ard.12
‘‘(8) PLUG-IN ELECTRIC DRIVE VEHICLE.—The13
term ‘plug-in electric drive vehicle’ has the meaning14
given such term in section 508(a) of the Energy Pol-15
icy Act of 1992 (42 U.S.C. 13258(a)).’’.16
(b) A VERAGE FUEL ECONOMY DEFINED.—Para-17
graph (5) of section 32901(a) of title 49, United States18
Code, is amended—19
(1) by striking the period at the end and insert-20
ing ‘‘; or’’;21
(2) by striking ‘‘means average’’ and inserting22
the following: ‘‘means—23
‘‘(A) average’’; and24
(3) by adding at the end the following:25

‘‘(B) in the case of a fuel choice enabling1
manufacturer (as defined in section 32920), av-2
erage fuel economy determined under such sec-3
tion.’’.4
(c) CLERICAL A MENDMENT.—The analysis for chap-5
ter 329 of title 49, United States Code, is amended by6
inserting after the item relating to section 32919 the fol-7
lowing:8
‘‘32920. Fuel choice enabling manufacturers.’’.
(d) EFFECTIVE D ATE.—The amendments made by9
this section shall apply with respect to model years begin-10
ning with model year 2018.11
