5165.—Ministry of War Transport Eoad Haulage Organization(N.S.M.T. 1089/43.— 28 Oct. 1943.)

The Ministry o f W ar Transport have extended the schem e w hich has been operating for som e tim e, whereby Government road traffic over trunk routes has been carried in chartered vehicles operating under the control o f th e Ministry.

2. Under the new arrangements, the M inistry w ill control m ovem ents by commercial road vehicles o f general goods for distances o f 60 or more m iles on com mercial account and on Government account for all distances.

3. Arrangements have been made for the vehicle com plem ent o f all haulage contractors operating vehicles over long distances to be form ed into road haulage units, each unit being controlled by a U n it Controller appointed by the M inistry of War Transport. These U n it Controllers w ill be responsible for road transport over distances o f 60 m iles or more from the point o f collection to the point o f delivery and A dm iralty traffic w hich m ust essentially travel b y road for such distances should be offered to the appropriate U n it Controller (see Appendix 1 attached).

4. R equests for provision o f transport should be m ade by telephone to the U n it Controller, and confirmed on Form R H /T /2A in duplicate ; the necessary forms being obtained from the Superintending N aval Store Officer, Park R oyal. A copy o f the instructions issued by the M inistry o f W ar Transport to U nit Controllers regarding the acceptance o f traffic is shown in A ppendix 4.

5. I f no U n it Controller has been appointed to cover the particular place where the traffic originates, th e request for transport assistance should be to the appropriate Area R oad Haulage Officer (see Appendix 2).

6. A dm iralty traffic for journeys up to 60 m iles w hich cannot be dealt w ith as econom ically b y R .N . vehicles, should be offered, and, if accepted, confirmed on Forms R H /T 2 A , to the Area Road H aulage Officers, as should dock traffic, nam ely, traffic from ship or transit shed, or warehouse, w ithin the dock w all at Liverpool (and Birkenhead), Manchester, Glasgow, Bristol, Cardiff, Swansea and Newport (Mon.).

7. W hen the U n it Controller or Area Officer has agreed to provide transport, a reference number, prefaced by the letters “ T R ” w ill be allocated. This reference m ust be used in all com m unications and documents relating to the consignment.

8. D elivery, consignment and receipt notes, w ill be raised b y the M inistry of War Transport for each consignment, and w ill bear the relevant reference (see paragraph 7).

9. The delivery note w ill be handed to th e consignor b y the driver o f the vehicle as his authority to collect the goods and as a receipt for them . I t w ill be the responsibility o f the consignor to see th at the description o f the stores, etc., is correct and th at the appropriate reference (see paragraph 7) is quoted. The consignment note w ill be handed by the driver to the consignee who w ill sign the receipt note and return it to the driver w ith any notification as to loss or damage. The consignee m ust g ive prom pt separate notice to the consignor o f any damage or deficiency, in accordance w ith Appendix 3.

10. Facilities are to be afforded for th e loading and the unloading o f vehicles w ith the least possible delay.

11. E xplosive traffic w ill be accepted.12. Transport o f bulk liquids requiring tank vehicles and heavy indivisible

loads, i.e., large craft, oversize m achinery, gear, etc., requiring the use o f a vehicle outside the normal construction and use regulations can be offered to Area Road H aulage Officers, and th ey w ill wherever possible undertake the m ovem ent but otherwise the traffic should be offered direct to approved A dm iralty heavy haulage contractors. Form D .80A should be used in the latter case.

13. The M inistry o f W ar Transport w ill, a t a later date, assume responsibility for hiring vehicles on behalf o f Government D epartm ents requiring vehicles on a “ tim e and m ileage basis ” . Meanwhile, efforts should be m ade to elim inate the hire o f any such vehicles in A dm iralty service (except vehicles used w ithin A dm iralty establishm ents, engaged in site or building work, or in full use on short distances between establishm ents) by offering the traffic to Area R oad Haulage Officers on the basis o f individual loads, i f practicable.

ean provide the required transport, existing contracts for road haulage other than for the exceptions m entioned in paragraph 13 above, and for such operations as the carriage o f m ails and postal parcels and the conveyance o f coal or similar goods over short distances, should be term inated. Should any contractor be unwilling to term inate a contract b y m utual agreement, the appropriate Area R oad Haulage Officer o f the M inistry o f W ar Transport should be informed. The Director o f N avy Contracts should be advised o f details o f all contracts term inated in th is w ay ; he should also be informed o f all cases referred to Area Road Haulage Officers.

15. The M inistry o f War Transport control does n ot apply to Service vehicles and does n ot preclude the despatch o f A dm iralty traffic by R .N . vehicles for journeys o f 60 m iles or more where, for operational needs or for reasons o f security, despatch by road is essential, but it is desired to make the fullest use o f the M inistry o f War Transport’s scheme whenever possible.

16. W here, for special reasons, R .N . vehicles are used for long-distance journeys and a return A dm iralty load unsuitable for rail cannot be arranged, the U n it Controller nearest to the destination o f the R .N . vehicle should be inform ed and given the opportunity o f finding a load for the R .N . vehicle on the return journey. An undertaking has been given not to delay the return o f the vehicle or deviate it beyond 20 m iles'o f the direct journey back to the base. The M inistry o f W ar Transport w ill deal w ith any claims in respect o f loss or damage to consignm ents transported in the R .N . vehicles on their behalf.

17. Paym ent o f transport charges for traffic accepted b y the M inistry o f W ar Transport w ill be m ade by th at Departm ent, but it is essential that Form R H /T /2A should be furnished im m ediately in duplicate. The form provides for the use o f a “ Consignor Code ”, v iz., “ G/4 ” when transport costs are an Adm iralty liability , and “ G/C ” when the liability o f an Adm iralty contractor, and these should.be inserted w ithout fail on Form R H /T /2A . I f on any occasion M inistry o f W ar Transport is engaged on behalf o f U .S .N . A uthorities the code “ G/12 ” should be used. A dm iralty consignm ent notes, D .80A, should in future be used only for traffic not accepted b y the M inistry, and for such traffic paym ent w ill continue to be made from N avy Votes.

18. The M inistry o f War Transport w ill recover charges from contractors for traffic for “ Third P arty Account ” .

19. Conditions o f carriage o f goods under th is schem e is contained in M. o f W .T. Form R H /D /36 . Copies can be obtained from local Road Haulage U n it Controllers.

20. The instructions contained in th is Order do not in any w ay lessen the need for the strictest econom y in the use o f m otor transport as defined inA.F.O . 724/42.

ROAD HAULAGE ORGANIZATIONLoss of or Damage to Goods in Transit

1. The Minister of W ar Transport in accepting goods from Government Departm ents or others for carriage by the Road Haulage Organization becomes liable for loss o f or damage to such goods subject to his Conditions o f Carriage. So far as th e goods o f Government D epartm ents are concerned, it is not proposed th at any cash paym ent should be made in respect o f such liability except where goods are carried :—

(а) in vehicles included in the Meat Section o f the Road Haulage Organization;or

(б) in vehicles employed b y the R oad Haulage Organization on a casual hirebasis for the job.

2. Should a D epartm ent m ake a contract direct w ith any carrier (including a firm w hich is a controlled undertaking) and not place th e traffic through an Area R oad Haulage Officer or U nit Controller o f the Road Haulage Organization (and in consequence m ake a paym ent in respect o f transport charges) liability rests on the carrier and claims should be pursued against him in the ordinary way.

3. I t follows from the above that, in m ost cases, loss or damage claims affecting Government goods w ill not be settled by a cash paym ent to the D epartm ent concerned. Arrangements have, however, been m ade for the investigation and recording by Insurers o f all claims which are not so settled , and the M inistry o f War Transport w ill inform D epartm ents o f the results o f th e investigations and w ill furnish the equivalent o f Clearance Certificates against th e necessity for further pursuit o f claims. In respect o f every adm itted claim, therefore, the D epartm ent concerned w ill receive either a cash paym ent or a Clearance Certificate.

4. The M inistry o f W ar Transport w ill not be responsible for advising D epartm ents when a receipt note is claused and D epartm ents should ensure th at, in the event o f any loss of, or damage to , the D epartm ent’s goods, consignees inform the appropriate officer o f th e D epartm ent w hich ordered th e m ovem ent.

5. In all cases where a claim has arisen the D epartm ent concerned w ill complete Part 1 o f Form R H /A /21*, and send the form at once to the carrier whose name appears on the relevant D elivery or Consignment N ote. In the case o f a claim in respect o f goods carried in a vehicle belonging to another Government Departm ent (including Service vehicles), the claim form should be sent direct to the M inistry of War Transport R oad Haulage Organization, Berkeley Square H ouse, W .l, whence it w ill be passed to the Insurers for such investigation as m ay be practicable.

6. In order to facilitate dealing w ith claims the following procedure should be carried o u t :—

(a) I f the claim is made on behalf o f the D epartm ent, the nam e o f theD epartm ent should appear in Section 1 o f Part 1 of Form R H /A /21. The nam e of th e D epartm ent m ust not appear in the case o f a claim made in respect o f traffic coded “ G.C.” (e.g., in th e case o f a com m odity control from which transport charges are raised the nam e to be inserted is th at o f the control).

(b) Claims should be serially numbered in the box provided above the nameof the claimant.

7. I f a D epartm ent having made a claim does not w ithin one m onth receive either paym ent or a Clearance Certificate and is unaware o f any reason for delay an enquiry should be addressed to the M inistry o f War Transport R oad H aulage Organization giving th e information in Sections 4 to 8 o f the claim Form R H /A /21 and th e serial number o f the claim.

8. I f there is any difficulty in identifying the Carrier concerned, enquiry should be m ade o f the U n it Controller or the Area Road Haulage Officer who accepted the traffic who m ay be identified from the first part o f the Traffic Reference Number, which consists o f the identification number and letter o f th e U n it or Area concerned. B y consulting the lists o f Areas or U nits, the appropriate nam e and address can be ascertained.

*Note.— These forms can be obtained either from th e M inistry o f W ar Transport R oad Haulage Organization, Berkeley Square House, W .l, or from any area office o f the Road Haulage Organization.

9. The Clearance Certificate w ill indicate t h a t :—•(1) The claim is adm itted, or(2) The claim is adm itted but not as regards amount, or(3) The claim is not adm itted and w hy (e.g., not adm issible under Conditions

o f Carriage), or(4) The claim is not adm itted but there are grounds for proceeding against

a third party.

OF W AR TRANSPO RT ROAD H AULAGE ORGANIZATION

Acceptance of TrafficA . General

1. The control o f acceptance o f traffic for conveyance by road rests w ith the Regional Transport Commissioners and their officers, including Sub-D istrict Managers, who are finally responsible th at such acceptance is in accordance w ith th e Minister’s policy. The Regional Transport Commissioners’ Organization (E.R .T.O .) w ill check D aily Traffic Reports in order to ensure that acceptances are in accordance w ith these instructions and the M inister’s general policy.

Subject to this, in itial responsibility for acceptances o f controlled traffic w ill rest w ith U nit Controllers.

This control has in practice been exercised in close co-operation w ith Governm ent user D epartm ents and th is co-operation should continue.

B . General Principles1. The primary object o f the R oad Haulage Organization is to save fuel and

rubber, while providing by the m ost economical m eans for such traffic as m ust pass b y road. I t is essential therefore that traffic should not be accepted for m ovem ent by road i f it can reasonably be carried by any other form o f transport. In. effecting diversions o f traffic from road, however, every care m ust be taken to ensure that production or m ovem ent o f essential goods is not interrupted or distribution of food, particularly perishables, jeopardized.

2. M ovement Officers and other representatives of governm ent departm ents w ill readily co-operate in effecting economies in road transport, and consultation w ith the consignor should take place before it is rejected. Where a departm ent asks th at traffic should be m oved by road on the ground o f urgency or the damageable or perishable nature o f the traffic it should be accepted and investigation as to the necessity for using road transport should be carried out subsequently. A similar procedure should be adopted in the case o f a continuing order w hich appears to the U nit Controller to be appropriate to som e m eans o f transport other than road ; the first part o f the consignm ent, i f it has to be m oved at once, should be accepted for road transport while inquiries are m ade as to the remainder. Urgent commercial traffic should be dealt w ith on the sam e lines.

3. Before refusing acceptance o f traffic for conveyance by road on the ground th a t other means o f transport should be used the U n it Controller or the Area Road H aulage Officer w ill, unless otherwise instructed by the Em ergency R oad Transport Organization, consult w ith h is railway liaison as to the practicability o f conveyance b y rail w ithin the tim e required or in appropriate cases w ith canal or coastwise shipping liaisons. Subject to satisfying him self by such consultation he should take in to consideration any representations m ade by consignors or others that no means o f transport other than road is reasonably practicable.

4. In cases o f doubt the Em ergency R oad Transport Organization should invariably be consulted and their decision accepted. If, however, the U n it Controller is not satisfied w ith the decision the m atter should be referred (w ithout holding up the traffic) to the Area R oad Haulage Officer.

5. Generally it is the duty o f A .R .H .O s. and U n it Controllers to see that such diversions from road to other m eans o f transport as are practicable are effected, but it is also their duty to see th at the transfer, particularly where it involves an alteration in established channels o f transport, is n ot carried out in such a w ay as to risk

dislocation o f production or distribution o f essential goods or the holding up o f urgent consignments. U n it Controllers should g ive careful study to all streams o f traffic regularly carried by road in order to see whether there is a prim a facie case for diversion. Machinery is being set up whereby diversion o f regular streams or substantial blocks o f traffic can be considered a t a regional level by the transport agencies concerned and U nit Controllers should bring cases where in their opinion regular streams or substantial blocks o f traffic should be diverted from road to the notice o f the Area Road Haulage Officers for transm ission to the D ivisional R oad Haulage Officer.

6. In each U n it’s area or sphere o f activ ity it w ill become gradually established th at certain classes o f traffic to certain destinations are norm ally road traffic w hilst som e traffic w ill be road traffic only under certain conditions o f difficulty, e.g., when there are restrictions on rail traffic.

7. Port traffic when allocated for road m ovem ent b y the appropriate subcom m ittee o f the Port Em ergency Committee w ill be accepted subject to any instructions that m ay be given b y the Regional Transport Commissioner.

N ote .— The principles governing the acceptance o f traffic are the sam e whether the load is carried as a “ forward ” or a “ back ” load.C. Contact with Regional Organization

1. Close contact m ust be m aintained w ith the Sub-District Managers o f Sub- D istricts from w hich traffic em anates in order th at a uniform policy o f acceptance o f traffic m ay be pursued. W hen it is difficult to decide on general principles, or from general knowledge or previous experience, whether traffic should properly be accepted, direct consultation should occur before acceptance.

2. The D istrict Transport Officer, Sub-District Manager or other representative o f the Regional Transport Commissioner should be given full access to the D aily Traffic Reports m aintained in the unit. This representative will discuss w ith the U n it Controller or the Area Road Haulage Officer any m ovem ents w hich he considers could have been carried by other means o f transport.D . Excluded Traffic

U n it Controllers are also responsible for supervision o f acceptance o f the excluded traffic dealt w ith by the controlled undertaking w hich provides his U n it Centre. Accordingly, excluded traffic cannot be accepted by a controlled undertaking at a U n it Centre w ithout reference to the U n it Controller unless offered to them by an Area Road Haulage Officer upon whom w ill then rest the responsibility for acceptance o f that traffic on the grounds o f need to pass by road.

The U n it Controller w ill satisfy h im self by exam ination o f the controlled undertaking’s D aily Traffic Reports th at no traffic is accepted otherwise than in accordance w ith th is instruction.E . Refusal of Traffic

I t is im portant that the U n it Order Book should contain a note o f all controlled traffic offered to the U n it Controller and, i f it is refused, th e reason for refusal. B oth governm ent and commercial consignors are liable to raise such m atters on a higher level and it w ill be necessary to call on U n it Controllers to supply the facts about such cases.

As a general practice a U n it Controller should keep the Sub-District Manager concerned informed o f refusals o f controlled or excluded traffic in order that the use o f fuel for the conveyance o f such traffic by other carriers m ay n ot be authorised by th e Em ergency R oad Transport Organization.
