II. Facility Description

A. Permitting History

On September 17, 1990, FRS submitted both a notification of hazardous wastes activity and a hazardous waste permit application (Part A) for container storage. The Part A lists hazardous codes DO01 and D008, and the new Toxicity Characteristics Rule Hazardous waste codes D018, D030, D001, D032 and D033 which became effective September 25, 1990. The activities described involve acceptance of used oil and fuel filters, storing and disassembling, then shipping out to a metal recycler. December 11, 1990 the DTSC acknowledged receipt of Part A permit application. On February 15, 1991, FRS revised its Part A submitted. On August 12, 1993 US EPA sent FRS acknowledgment of a notification of hazardous waste activity from the facility.

Waste activities identified are large quantity generator, Transporter and Treatment, Storage or Disposal. The hazardous waste codes submitted on the notification were D001, D008, and D018. On September 24, 1990, FRS revised its submitted Standardized Permit Notification for existing hazardous waste activities. FRS revised its September 24, 1993, notification on December 31, 1993 and May 5, 1995, On December 31, 1993, an Interim Status Document was issued by the Department of Toxic Substances Control (DTSC).

On March 31, 1994, DTSC sent a letter FRS stating that the facility must submit a complete application by April 1, 1994 to retain its Standardized Permit Interim Status. On May 27, 1994, DTSC sent a letter to FRS to clarify that hazardous wastes activities identified in the Standardized Permit Notification submitted on or before October 1, 1993 are authorized. On June 24, 1994 DTSC acknowledged the timely submittal of a facilities standardized permit application packaged which allowed FRS to retain its standardized permit Interim Status and exemption from facility fees prior to 1993. On June 5, 1995, DTSC sent a letter to FRS to serve as an addendum to the facilities current grant of Interim Status which will remain in effect until October 5, 1995, DTSC extended the Standardized Permit Interim Status until the issuance of the final permit. On December 30, 1997 DTSC issued a Consent Order for FRS. The order authorizes FRS to continue operation as a Hazardous wastes treatment and storage facility until a final decision is made on FRS standardized permit application.

DTSC has determined that FRS Standardized Permit Application is technically complete. DTSC has prepared a draft permit which has been public-noticed for review and comments. FRS and the public had until February 17, 1998 in which to comment on the Draft Series A Standardized Hazardous Waste Facility Permit.

The Department of Toxic Substances Control has completed a detailed technical review of the hazardous waste facility Series A Standardized Permit Application for Filter Recycling Services, Inc. The final application consists of a part A permit application (Standard Permit Notification), dated September 24, 1993, Standardized Permit Application, dated March 30, 1994 and July 9, 1997.

C. Current Operations

Filter Recycling Services, Inc. (FRS) is located at 180 W. Monte Avenue in the City of Rialto. California. FRS is currently operating under a Standardized Permit from the Department of Toxic Substances Control (DTSC) to treat and store California regulated and non-regulated wastes as well as EPA household and conditionally exempt small quantity generator (CESQG) wastes. The waste streams are oil and paint related waste materials from industrial, commercial, household and CESQG generators.

All of the FRS treatment and storage activities are conducted on the subject property which is comprised of one main 12,000 sq. ft. concrete structured building and a receiving/shipping and solids waste bin storage area of approximately 7,000 sq. ft. The egress and ingress to the property is from Monte Avenue. The entire property is secured with a wire mesh fence, gated, slotted barbwire, and monitored by surveillance cameras.

The outside receiving and storage area is completely covered with a metal canopy which makes the property 100% covered. All of the indoor floors in the building are 5'' thick concrete with an industrial surface sealant coating. The outside area is capped with 2-10'' thick asphalt over a 4" crushed gravel base. The entire property is bermed. An additional bermed area exists inside the building designated as storage area #10.

D. Treatment Activities Include:

1. Mechanical separation utilizing a variety of machinery to separate basecomponents for reuse as feed stock in industrial manufacturing.

2. Consolidation/Bulking of similar material for further treatment.

3. Aerosol can depressurizer consisting of two separate units to disassemble andrecycle aerosol cans.

4. Drum crusher consisting of a hydraulic driven rod, crushing metal containers.The unit is limited to crushing drums of length less than 6 feet.

5. High pressure decon unit is a portable high water pressure washer which isoperated inside the bermed storage area.

6. Storage/transfer activities, accumulation of contaminated waste for shipmentto alternate disposal facilities.

E. Treatment Units

Solids Debris Management System Machine(s) (Unit ID No. 1-Oil Waste and No. 2 -Paint Waste). The steel structured mechanical machine is comprised of a conveyor belt, shredder, granulator, magnetic separator, press, several liquid collection pans. Solid debris is placed on the input belt conveyor by an operator and the machine separates the incoming waste into three distinct internal generated waste streams: (1) Collection pans, (2) Metal scrap hopper, and (3) Solid debris hopper.

Aerosol Puncturing Equipment (Unit ID No. 4 and No. 5 --The puncturing devices are portable and used to puncture the aerosol cans received at FRS. These units cause a release from the can and catch the residue material in a DOT drum prior to placing the empty cans on the shredder machine for metal scrap recovery. The units are operated manually by a trained operator in secured ignitable storage area. There are two (2) puncturing device systems, one is used for cans with organic (paint) waste and one for organic (oil) related waste. The designated area for processing is located inside the main building for safety and security reasons. Aerosol vapors are filtered by a coalescing cartridge and activated carbon to minimize emissions. This combined filter unit effectively removes VOCs from the vented gases, resulting in acceptable total hydrocarbon emissions.

Empty Drum Crusher/Bailer Unit (Unit ID No. 3) The crusher unit is a hydraulic driven machine which can accept containers up to 6' in length. FRS uses the unit to crush empty unusable metal containers for disposal through unit No. 1 or bail organic solid wastes such as: wood, plastic containers, rags, and cardboard. The metal containers and other solid debris are placed in the crusher manually by an experience trained operator.

F. Storage Activities

Storage activities used by FRS are conducted in three (3) main portions of the property. Inside the main building a portion is used for storing FRS accepted waste for treatment and/or storage in drums and other containers. Another designated bermed area inside the building is used for storage and decontamination of contaminated equipment and containers. The third area is the unloading and loading area. A brief description of these storage activities are presented below.

General Waste Storage interior Area (Unit ID No. 1) General waste storage area is located inside the main building and is comprised of approximately 8,264 sq. ft. of storage area (8B) and the ignitable waste storage area (#12). The main waste storage area is marked for storing separate waste stream (subsections) and is used to stage waste into the treatment processes and/or into consolidation containers. The hazardous waste ignitable waste storage area will be marked with a 6” painted border.

Maximum Liquid Storage Tank - The facilities maximum liquid storage capacity is 53,428 gallons.

Empty Drum Cleaning and Equipment Decon Storage Area (Unit ID No. 3) - This area #10 inside the main building is used to triple rinse empty drums and decon equipment using a pressure washer on as required basis. If not in use for cleaning activities, this area is also used for a temporary overflow storage area of specific wastes usually stored in the General Waste Storage Area described above.

Receiving/Shipping Waste Storage Exterior Area (Unit ID No. 2) - The waste receiving and shipping general area is located outside the main building on the south portion of the property. Within this area two functions are performed: one designated area of approximately 1500 sq. ft. for receiving and acceptance evaluation for incoming drums and solids material wastes and other adjacent designated area for solid debris bin storage. In the receiving area, FRS inspects and verifies incoming wastes and is used as a standby waste staging area before transferring into the treatment area inside the main building. There are five solid debris roll-off bins located in this area and each bin is used to consolidate specific type of waste; such as, metal scrap, contaminated soil, solid debris, and miscellaneous items. The exterior area is entirely roofed and bermed for secondary containment.

G. Site Security

Entry into the active portions of the facility and offices are controlled by the use of a motion sensitive alarm system. This system is monitored 24 hours a day by ADT Security Systems. In the event that the alarm is triggered three separate entities arc notified by telephone. These include: ADT Security Systems, the Rialto Police Department, and applicable FRS employees.

There is an automatic fire sprinkler system throughout the active facility and offices, which when triggered will alert ADT Security Systems, the Rialto Fire Department, and applicable FRS employees. Controlled entry is utilized at all times by monitoring all entrances to all active portions of the facility and offices. In addition FRS is equipped with a 24 video surveillance system which operates both inside and outside the facility. In the event of an emergency or unauthorized entry all Filter Recycling Services, Inc. management carry cell phones with pagers and 2 way radios 24 hours a day. These can he used to alert other employees and the police departments. Chain link fencing topped with barbed wire is used to secure the premises. The facility gives more than adequate lighting for interior and exterior operations. Lighting can be used for handling hazardous waste during night time operations, emergency response after daylight hours and security measures.

III. Waste Acceptance

A. Procedures

Prior to accepting any waste from an offsite generator FRS requires that a generator complete a Generator Information Profile form. The form describes the common name of the waste, description of the generating process, and the following characteristics: Concentration of volatile halogenated organics, ignitability, corrosivity, reactivity and toxicity. Based on a review of the Generator Information Profile Form and if necessary additional analysis FRS confirms the proper waste classification and determines if the wastes can be managed at the facility.

If the determination is made that the waste is acceptable, a schedule is agreed upon by the generator and FRS. The packaging of the wastes is also agreed upon to facilitate unloading and handling at FRS.

When a waste arrives at the FRS facility, the shipping documents (i.e., bill of lading, uniform hazardous wastes manifest) will be reviewed and visually inspected to compare to the Generator Information Profile form. If no discrepancies are found, the waste is sent to the receiving area of FRS and further reviewed. The information on the shipping documents, labels on the shipping containers and the conditions of the shipping containers are verified. If no discrepancies are found, the containers are unloaded in the receiving area.

Within 24 hours of acceptance, the containers are sampled. If the wastes conform to the acceptable profile, the wastes are moved from the analysis area into the treatment building and assigned to a treatment group. If a discrepancy is found however, the generator is contacted and attempts are made to resolve the discrepancy. Wastes that are not amendable to treatment or storage are sent back to the generator or transferred to another authorized hazardous waste management facility mutually agreed upon by the generator and FRS.

The waste accepted by the facility are limited to wastes that are not fully regulated as hazardous under the Resource Conservation and Recovery act (RCRA) in accordance with federal regulations contained in part 261, Title 40, Code of Federal Regulations. Acceptable wastes include California RCRA exempt, small quantity, household hazardous and non-RCRA. FRS also accepts non-hazardous wastes. The management of the non-hazardous wastes is not regulated under the standardized permit.

VI. Environmental Setting

A. Land Use

Land use immediately adjacent to the Facility consists of light to heavy industrial undeveloped land; oil production activities and materials transportation are the predominant land use surrounding the FRS facility.

The nearest residential zoning is approximately 4500 +/- linear feet southwest of the facility. The Community of Rialto is located 0.85 miles North of the facility.

B. Surface Water Bodies

The nearest surface water body is the Santa Ana River. At its nearest point, the Santa Ana River is located approximately 2.5 miles south of the FRS facility.

C. 100 Year Flood Plain

Based on the flood insurance study conducted by the U.S. Department of Housing and Urban Development and Federal Insurance Administration in March 1996, the above mentioned property is located in Flood Zone "X", (Community Pallel No. 160280 dated 3-18-96) which is defined as an area not subject to flooding by the 100 year flood.

D. Nearest Water Wells

The water purveyor is the West San Bernardino County Water District and they have two (2) wells in the vicinity described as follows:

1) Well #29 - Location 600’ West of Riverside and 100’ North of Slovcr Avenues.Perforations 162 - 236 feet.The well is approximately 800+ feet northeasterly of the facility and is also up grade.

E. Storm Water Drainage

The facility has onsite retention in shipping/receiving and truck dock area with roof drainage directed to the public street.

The storm water flow from the facility nearest to body of water is as follows: Easterly on Monte Avenue approximately 500 feet to Riverside Avenue, then south on Riverside Avenue approximately 1500 ft, to catch basins that convey the drainage easterly under Riverside Avenue and into a concrete trapezoidal channel that discharges onto Santa Ana Avenue as surface drainage, then easterly 4000 feet into a concrete lined channel known as the Rialto Channel, then southerly in the channel approximately 3000=/- feet to the Santa Ana River and then to the ocean.

Filter Recycling has designed an innovative, reliable soil recycling application to reduce remediation costs and accelerate clean-up time. On-site soil treatment is available with the portable soil recycling system. Soil recycling is used at retail gasoline stations, bulk terminals, refineries, chemical plants, military bases and brownfield sites nationwide. Soils contaminated with hydrocarbons and metals can be solidified or stabilized and recycled as high-strength backfill or asphalt paving. Soil recycling provides increased compressive strength; decreased permeability; encapsulation of hazardous constituents; and conversion of hazardous constituents to less soluble, less mobile and non-toxic form. Massive heavy-duty synchronized spiral pattern paddles mixbinding reagents in the 600 ton per hour enclosed pugmill unit, which controls dust and ensures operator safety. Additives include cement, fly ash, asphalt, lime, limestone, gypsum, slag, sodium phosphate, magnesium oxides and proprietary reagents. Support equipment includes excavator, loader, screen plant, bulk material silo, dry/wet additive units, belt scale, conveyors, pumps and tanks. Filter Recycling provides bench and pilot scale testing to evaluate site specific conditions and optimize the process mix requirements. Production quality control is provided using our gas chromatograph (GC) and other standard testing instrumentation.
