M y understanding is that the House is debating it today and will vote today. You might be in a better position to know whether it will pass. The Senate passed the same bill last week. If it passes and is signed by the President, it would establish June 12 as the new deadline. However, our message to people is that they should continue to prepare for the transition regardless of the date.
If your constituents are Over-the-Air only households (i.e. no cable or satellite), they will need a converter box or a new digital set to receive digital signals once the transition occurs. If constituents are on the NTIA's waiting list for DTV converter box coupons, a delay may provide more time for those coupons to arrive (There is a separate provision in the Economic Stimulus package to provide additional funding for converter box coupons, but that has not passed both the House and Senate yet). We encourage people to get hooked up and test boxes and antennas as soon as they can in order to make sure there aren't any issues prior to the deadline. If constituents have cable or satellite, they should be okay for the transition.

In a statement, Waxman blamed the delay on Senate Republicans, who last week blocked an attempt by Senate Commerce, Science and Transportation Chairman Jay Rockefeller (D-W.Va.) to fast-track similar Senate legislation to the floor.
"Late last week, Senate Republicans blocked a bill to delay the transition date," Waxman said. "I have postponed committee consideration of the DTV markup to give the committee more time to assess the implications of the Senate action."
Key Democrats, as well as President Barack Obama, began calling for a delay of the Feb. 17 switch earlier this month after the National Telecommunications and Information Administration announced it had used all its funding for a coupon program that helps subsidize the costs of analog-to-digital converter boxes.
Acting NTIA Administrator Meredith Baker said on Jan. 4 that the agency's $1.34 billion in
appropriations for the coupon program were exhausted after 7.2 million coupons a number
much higher than expected were requested in December. Such large requests for coupons have contributed to a backlog in fulfilling coupon requests that has forced the NTIA to put at least 2 million applicants on a waiting list.
Because of this, Waxman reiterated in his statement today, a delay of the switchover is the only responsible action.
"Delay of the deadline is our only hope of lessening the impact on millions of consumers,"
Waxman said. "Without a short, one-time extension, millions of households will lose all
television reception."
Republican opposition to the bill has also been prevalent in the House.

House Energy and Commerce ranking member Joe Barton (R-Texas) / along with 14 other Republican committee members1 authored a letter to Obama last Wednesday speaking out against the delay.
The group cited numerous reasons1 including the fear that industry groups will withdraw from "what had been vigorous consumer education efforts."
"We believe that the panicky talk of a delay is breeding stultifying uncertainty1 and that an actual delay would be a monumental error in judgment that would damage the program and

Gentlemen, late last night we announced a markup of a DTV delay bill. Wednesday of next week at 130.
We also attached a discussion draft (which I include here). We are trying to balance consumer needs with burdens on industry. We recognize this will put increased pressure on FCC, but we are confident it is up to the task.
After careful thought, Chairman Waxman decided that this is only way to mitigate damage of poorly managed transition.
Will you let Commissioner Copps know about this development? We are expecting vociferous objections from Mr. Barton and others. But we still think we should try. We are working with public safety to try and include a section that will grant them the same flexibility we try to grant to commercial licensees.

7 Public Safety Act of 2005 is amended by inserting after

23 to prevent a licensee of a television broadcast station
24 from terminating the broadcasting of such station's analog
television signal (and continuing to broadcast exclusively

5 the analog television service (as amended by section 2 of
6 this Act) so long as such prior termination is conducted
7 in accordance with the Federal Communications Commis
8 sion' s requirements in effect on the date of enactment of
9 this Act, including the flexible procedures established in
10 the Matter of Third Periodic Review of the Commission's
1 1 Rules and Policies Affecting the Conversion to Digital Tel
1 2 evision (FCC 07-228, MB Docket No. 07-91, released De
1 3 cember 31, 2007).
1 4 (b) EXPEDITED Rur EMAKING.-Notwithstanding

quired by subsection (a), the Commission shall-

1 (1) take into account market-by-market needs,
2 based upon factors such as channel and transmitter
3 availability;
4 (2) ensure that use for experimentation and
testing purposes specified in subsection (a) will not
6 cause harmful interference with signals in the digital
7 television service;
8 (3) take into consideration broadcasters' transi
9 tion and coordination plans that already have been
adopted; and
11 ( 4) prohibit any such use for experimentation
12 or testing purposes on any spectrum that is ap
13 proved or pending approval by the Commission to be
14 used for public safety radio services.
(c) DEFINITIONS.-For purposes of this section:
16 (1) The term "successful bidders" shall mean
17 those entities listed in the Federal Communications

Dear Ranking Members Barton and Stearns:
Thank you for your letter dated February 2, 2009 that raises questions about the transition to digital television. Specifically, you ask for information regarding how many - and which -stations could turn off analog transmissions and turn on their post-transition, fully authorized digital facilities before the transition date without causing harmful interference. I am pleased to provide the best information available to us at this time. In accordance with your request, the expert staff of our Media Bureau has provided the substance of this response.
As you know, the Federal Communications Commission established a process in its Third Periodic Review of the Commission's Rules and Policies Affecting the Conversion to D igital Television (MB Docket 07-9 1 , released December 3 1 , 2007) to allow stations to make early transitions to digital broadcasting. The intent behind tl{is procedure was to provide flexibility to further a station's transition while ensuring that viewers are adequately informed about any permanent loss of analog service . .1
As of February 2, 2009, the Commission has either granted requests or received notifications from 143 stations that have already terminated analog service, with an additional 60 stations plaiming to terminate analog service before February 1 7 , 2009. In addition, even though that there was no requirement that stations notify the Commission that they intend to terminate analog service on February 1 7, 2009, 276 stations have notified the Commission that they plan to terminate analog operations on the cunent transition date of February 1 7 , 2009. However, it is possible some of these stations may choose to remain on the air with an analog signal if the transition elate is extended, and other stations may choose to terminate analog service early.
1 The Commission established an approval process for stations requesting analog reduction or termination, requiring
stations to file requests at least 90 days in advance, with viewer notifications conrn1encing no fewer than 60 days
prior to reduction or termination. The Commission provided a more streamlined notification procedure within 90 days of the transition date, under which stations are required to notify the Commission 3 0 days in advance of the
reduction or termination and to provide viewer notifications.

This is because the Commission has already conducted an interference analysis for digital operations on that channeL both before and after the transition date. Approximately 6 1 % of full power stations
signals). A list of stations that are operating on their post-trm1sition chmmel is attached. This list includes stations that have the same pre-transition and post-transition channel, and other stations that have received approval to operate on post-transition chaimels .
Most of the over 700 remaining full-power stations-those whose pre-trai1sition digital channel is not the same as their post-transition digital channel-may also be able to terminate airnlog operations prior to the transition date without causing harmful interference to other stations. First, a station in this category could simply turn off its analog signal and continue to operate on its pre-transition digital channel until the end of the transition, at which point it would initiate service on its post-transition digital chaimel . Second, a station in this category could move from its pre-trai1sition digital cham1el to its post-transition digital channel, so long as the Commission ' s Media Bureau conducted an engineering analysis and determined that the move would not pose a risk of harmful interference to other existing analog or digital channels. These determinations would be made on a case-by-case, fact-specifie basis. Early termination of analog service also assumes appropriate viewer notification.
I hope this information is helpful to you. As I have said, I believe that a short delay in the transition date will give us ai1 opportunity-with adequate additional resources-to significantly improve the outcome for consumers. Please let me know if I can be of further assistance
