In a nutshell, we are looking to use St Michael's Gate as temporary accommodation for homelessfamilies. There is currently a large number of families in temporary accommodation in bed andbreakfast or travel lodges out of Peterborough due to a lack of accommodation that can be usedwhen someone makes a homeless declaration. The properties at St.mIchael's gate have beenoffered to be use by the owner who will offer it to another local authority if we do not make use of it. This decision has been through various meetings and a CMDN is to be signed imminently by CllrDavid Seaton.
The owner's of St. Michael's Gate have sent us a Service Level Agreement.
Please could you review and confirm if this is ok or give your feedback?

Fiona I wasn't able to attend the meeting yesterday so my comments should be considered in thiscontext and others may have picked up already. 2 points and I have spoken about these toRaymond Murphy this morning in a different context (valuation - see below). 1. I would suggest making the link between 74 units and 98 more explicit. I understand they areadapting certain units to add numbers 2. I think we should also say to what standard the units will be delivered (I understand some needrefurbishment) My point above about valuation was in response to a request from Legal to make sure we cover offwhat the market rents for these would be if they were standard market lets. If there are differencesbetween that and the rents being paid then Jenny in Legal suggested we need to explain this (theservice element). I have a local agent ready to advise but need the updated schedule of areas. Jenny - I amassuming we still need this or have matters progressed. Raymond is sending me the schedule inpreperation for. I suggest a simple statement in the paper covers this to say that the figures arehigher than market rents (which on first look appear to be) because of all the other services whichare provided. Ray, If the SLA you have sent me were to be entered into as a standalone agreement, this would be a contract subject to theprocurement rules. If Stef and Philips are willing to enter into a lease the SLA can form part of the lease agreement setting the landlord’sservices provided under the lease. I am advised that the cost of the SLA is broadly similar to the commercial rent of theproperty so, as there is no real value to these services, there isn’t really a procurement issue if we go down that route. Internally this is the way we have been looking at the deal but I do not know if Stef and Philips have been approachedabout this. The CMDN as drafted doesn’t work. It bases the decision on entering into the SLA as a standalone agreement. If this isthe way the deal with Stef and Philips has to be done then we have to address the procurement aspects. I am not sure why approval is being sought to enter into a contract given my previous advice thatthis should be structured as a lease type arrangement to benefit from the exemptions available forsuch type of arrangements under the Public Contracts Regulations. Urgency and Special Urgency provisions are as follows:
Urgency - If Key Decision has not been included on the Forward Planprior to a decision being required.Special Urgency - If a Key Decision is required and it is so urgent that itcannot wait 5 clear days for advertising.
To invoke Urgency, Officers need simply to inform yourself, as Chair of theSustainable Growth and Environment Capital Scrutiny Committee, and Kim Sawyer,as the Monitoring Officer.
In order to invoke Special Urgency, officers must gain your approval. To approve theuse of this provision, you will need to satisfy yourself that the decision is "urgent", asper the following criteria:
Urgency - The decision must be taken by such a date that it isimpracticable to defer the decision until it has been included in the nextForward Plan and until the start of the first month to which the nextforward plan relates.Special Urgency - That the taking of the decision cannot be reasonablydeferred.
To inform your decision, please find attached the draft Cabinet Member DecisionNotice intended to be made.
For your information the Monitoring Officer has been consulted on the use of theprovisions, and is happy to proceed.

Jenny I am of the same opinion as you. I don't believe that this constitutes a change of use. Theaccommodation will continue to be utilised as single self contained dwellings, which occupants will havesole exclusive use of.
The accommodation will be provided unfurnished and residents will have liability for council tax andutilities etc.
All residents will be issued with licences, but this is only because the accommodation is being utilised inorder to fulfil our duties under S.188 of the Housing Act 1996. Therefore tenants will not be protectedunder the Protection from Eviction Act 1977.
I have attached a copy of the licence that South Holland district council use when they useaccommodation of this type. We intend to utilise very similar.

Further to my email of yesterday I am writing to let you know that the possible dates for the call-into be heard by the Strong and Supportive Communities Committee with be either be Tuesday 18October or Wednesday 19 October. I am just waiting to hear back from some members of theCommittee on their availability. This means the agenda will be published either on Monday 10th orTuesday 11 October. A written response will be required to the call-in which if ready can bepublished with the agenda. If it is not ready then will need to be with me a few days prior to themeeting to allow Members to consider the response.

Further to my email of yesterday I am writing to let you know that the possible dates for the call-into be heard by the Strong and Supportive Communities Committee with be either be Tuesday 18October or Wednesday 19 October. I am just waiting to hear back from some members of theCommittee on their availability. This means the agenda will be published either on Monday 10th orTuesday 11 October. A written response will be required to the call-in which if ready can bepublished with the agenda. If it is not ready then will need to be with me a few days prior to themeeting to allow Members to consider the response.
Cabinet Member and relevant Director/Officers will be required to attend the meeting to respond tothe call-in and take questions from the committee.
