Thursday 26 February

0800 – 0900 Registration and welcome coffee

0900 – 0915 Opening address David W Rivkin Debevoise & Plimpton, New York; President, International Bar Association

0915 – 0945 Keynote address Jim O’Neill former chairman of Goldman Sachs Asset Management, British economist well known for coining the terms ‘BRIC’ and ‘MINT’, London

Since 2001 the emerging economies of BRIC (Brazil, Russia, India, China) – later defined as BRICS by adding South Africa to the list – have been recognised as the symbols of rapid growth and opportunity in the global economy. Today, Mexico, Indonesia, Nigeria and Turkey (MINT) are new emerging global economic giants. MINT GDP growth forecasts are tremendous, indicating that MINT most likely will be changing the global economic landscape in the next few years.

The conference will focus on identifying business opportunities and challenges international business can face when working in and with BRICS, MINT and other growth markets.

The IBA are proud to support the Global Law Summit, being held in London on 23–25 February 2015 to mark 800 years since the sealing of Magna Carta. The Global Law Summit will firmly ground the legacy and values of Magna Carta in a 21st Century context by exploring how, to this day, its values offer solutions to achieving commercial, political and social goals.

The programme features leading experts, Trevor Manuel, Boris Johnson, Aung San Suu Kyi and Professor John G Ruggie; and we invite you to maximise your visit to London and register for this world-class event. We are also exploring ways to bring together our shared delegates for a special event to be held on Wednesday 25 February; further details will be available soon.

Wednesday 25 February

0945 – 1045

Macroeconomic situation in BRICS and MINT countriesThe economic development of BRICS and MINT countries is causing a fundamental realignment in the global balance of economic and political power. What are the prospects for continued growth in these rapidly developing economies and what are the main challenges to their sustained prosperity? The panel will examine the macroeconomic outlook for BRICS and MINT countries, the main factors and differentiators contributing to their continued economic development, and the challenges that lie ahead.

Opportunities and challenges for the legal profession in BRICS and MINT countriesThe legal professions in most growth markets have been expanding and evolving rapidly. In many such countries members of the ‘domestic legal profession’ are now doing work that was previously the exclusive preserve of ‘international lawyers’. The session will consider the implications of this change for the handling of cross-border deals and disputes.

M&A involving BRICS and MINT countriesIn recent years BRICS and MINT countries have had an active role in the M&A transactions, accounting for the most important portion of M&A market in emerging economies. This session will analyse trends in those markets (inbound and outbound M&A), the different laws and regulations affecting M&A transactions. These include restrictions to foreigners, foreign exchange controls, antitrust regimes, and other relevant regulations. In addition to a discussion of relevant legal and regulatory matters, this panel will address cultural and practical issues frequently encountered by practitioners in this area.

Capital markets and corporate finance in and involving BRICS and MINTBRICS and MINT countries are at different stages of development. This is perhaps even more acute when one looks at their respective domestic and cross-border markets for debt and equity securities, derivative transactions, securitisation and structured finance. This panel will try to identify and discuss business, economic, financial, legal and regulatory trends currently affecting these emerging capital markets, the different stages of corporate governance and regulation (be it from governmental authorities and self-regulation) at which some of these countries currently are and how to navigate these jurisdictions given their higher risk profile vis-a-vis more developed regions and distinct cultural traits.

Private wealth management in BRICS and MINTThe introduction in recent years of free market economics by many of the BRICS and MINT countries continues to have a dramatic impact on the growth and composition of private wealth in these countries.

A new phase has begun in the expansion of the private wealth sector in these countries with a greater diversity in their age profile and in the sources of their wealth. This growth has been matched by greater investment opportunities both within and outside of their domestic jurisdictions.

The panel of speakers comprises a range of private wealth advisors working both within specific jurisdictions and internationally. Together they will look at some of the changing perspectives in private wealth in the BRICS and MINT countries and the implications for advisors both domestically and abroad.

FCPA, bribery and other regulatory issues Global corruption is one of the greatest challenges of our current age: it distorts markets, weakens our governments, it promotes unethical, fraudulent and possibly criminal behaviour, it raises the costs of doing business around the world and it erodes level-playing fields and promotes inequalities. It sends the wrong message as to how business should be conducted. Bribery and corruption is the subject of many international agreements, treaties and conventions as well as the UK Bribery Act 2010 and Foreign Corrupt Practices Act. So what is the world doing about it? How are companies, regulators, governments, agencies such as OECD and Transparency International and fraud prevention organisations acting today not only to combat the threat but also to deal with the perpetrators. Are we winning the battle? When will the battle be won? What more can be done? This session will include participation from general counsel, regulators and practitioners who are dealing and advising with the problem first hand and will aim to be as interactive as possible to include a wide ranging discussion with participants on their shared experiences.

Infrastructure challengesOne of the most important challenges for the rapid emerging economies is to adopt ambitious infrastructure programmes and to put in place legal frameworks to funnel the massive amounts of investment needed to improve the region’s infrastructure, through PPP schemes, concessions, and other structures to finance and operate them. This presents an extraordinary opportunity for both the public and private sector to design, contract, finance and execute a large number of PPPs, concessions and public infrastructures in a relatively short space of time. This session will include participation from infrastructure legal experts who will focus on current trends and opportunities, leading sectors and challenges.

International Bar Associationthe global voice of the legal profession

The International Bar Association (IBA), established in 1947, is the world’s leading organisation of international legal practitioners, bar associations and law societies. The IBA influences the development of international law reform and shapes the future of the legal profession throughout the world. It has a membership of more than 55,000 individual legal professionals and 206 bar associations and law societies spanning all continents and has considerable expertise in providing assistance to the global legal community.

Grouped into two divisions – the Legal Practice Division and the Public and Professional Interest Division – the IBA covers all practice areas and professional interests, providing members with access to leading experts and up-to-date information. Through the various committees of the divisions, the IBA enables an interchange of information and views among its members as to laws, practices and professional responsibilities relating to the practice of law around the globe. Additionally, the IBA’s world-class conferences provide unrivalled professional development and network-building opportunities for international legal practitioners, senior business professionals, regulators and government officials.

Asia Pacific Regional Forum overview The Asia Pacific Forum offers fantastic opportunities to establish contact with legal experts in and outside of the region, practising in many different areas of law, and to keep abreast of legal business developments in the region.

In addition to offering an unrivalled opportunity to establish contact among lawyers within and outside the region, and with acknowledged experts on different areas of law, specialist Forum activities provide an unparalleled opportunity to keep abreast of legal business developments in the region. Members also benefit from excellent working relations with national Bars, the Inter-Pacific Bar Association and LAWASIA.

European Regional Forum overviewThe European Regional Forum has been developing and strengthening the existence of the IBA within the whole of Europe by promoting the goals of the IBA to members, non-members and others, disseminating professional know-how, and assisting the committees and other constituencies of the IBA to increase their presence in the different sub-regions of Europe, including parts of North Africa and the Middle East.

The goals of the forum include addressing current and long-term needs of professional organisations and individual members within the geographical reach of the Forum, as well as increasing membership and participation in the IBA and integrating them within the organisation. The Forum will also facilitate cross-border activity between lawyers and bars in different European countries. The Forum has a particular focus on cross-disciplinary activities

Latin American Regional Forum overviewThe Latin American Forum covers all countries in Latin America as well as Mexico, Puerto Rico and Spanish-speaking areas of the Caribbean. The LAF provides a focus for all activities in the region. The group organises sessions at IBA Conferences and in particular has been instrumental in ensuring that a Latin American perspective is addressed during relevant special sessions. The LAF is closely affiliated with the North American Forum as the regions are geographically proximate and share many issues.

African Regional Forum overview The problems facing African lawyers are different from those affecting lawyers in other regions. To this end, the African Regional Forum was created to identify and address these problems. The Forum aims to initiate programmes that will promote specialisation and partnership in the legal profession in Africa, liaise with other regional fora, enabling members of the forum to learn from their counterparts and to educate African society about their rights and duties in their relationship with one another and their governments.

The African Regional Forum produces a regular newsletter and communications as well as hosting various regional conferences to serve as channels for information to be exchanged and shared between members.

North American Regional Forum overviewThe North American Regional Forum covers Canada, Mexico, Puerto Rico, the United States, and English-speaking areas of the Caribbean. Launched at the Chicago Annual Conference in 2006, the Forum is the focus for all activities in the region, and organises sessions and a luncheon event at each IBA Annual Conference for education and networking. Future plans include organising conferences in partnership with other IBA committees and fora, as well as other bar associations and legal organisations in the region.

The aim of the North American Forum is two-fold:• To spread knowledge about legal practice within North America; and• To expand the international perspective of lawyers practicing in

North America.
