SUBJECT TO RATIFICATION BY CENTRAL COUNCIL OF THE PCI.

* Consideration of the approval of Diploma / Degree / Pharm.D / Pharm.D (Post Baccalaureate) course

and examination in pharmacy at the undermentioned institutions

It was decided to recommend to the Council to grant approval for conduct / extension of approval / u/s 12

of the Pharmacy Act, 1948 of Diploma / Degree / Pharm.D / Pharm.D (Post Baccalaureate) course and

examination in pharmacy subject to the following conditions -

a) the institution shall submit SIF every year as per the Time-Schedule prescribed by the Council.

b) the institution shall submit annual affiliation fee on or before due date.

c) the institution shall appoint the teaching faculty with the qualification and experience as prescribed

under the “Minimum Qualification for Teachers in Pharmacy Institutions Regulations, 2014”.

Besides above conditions, institutions seeking approval of Pharm.D / Pharm.D (Post Baccalaureate)

course shall comply with the following conditions -

1. The institution shall comply with the requirements of Pharm.D. Regulations, 2008 particularly

regarding appointment of teaching staff, equipments and Hospital facility.

2. Further the PCI recommends that Pharmacy Practice Faculty including HOD shall undergo at least 1

Continuing Education Programme / Training Programme of minimum 3 days duration every year and

participation in atleast one seminar/conference every year.

3. In view of above, please intimate per return of mail the number of such Continuing Education

Programmes / Training Programmes / Seminar / Conference etc. attended by HOD and pharmacy

practice faculty during the last one year with documentary evidence i.e. participation certificate etc.

4. The institution to submit full compliance of the Pharm.D Regulations, 2008 as per following details:-

Training of HOD of Pharmacy Practice Department and Pharmacy Practice Faculty

The HOD & the faculty of Pharmacy Practice Department who are not qualified with M.Pharm

Pharmacy Practice Qualification or Pharm.D Qualification and have other specialized training of

qualification in the Pharmacy Practice Department, shall undergo the training as per Regulations 3 vi)

of Appendix–B of Pharm.D Regulations, 2008. The following details be submitted –

94.3 In view of above, it was noted that the Principal has submitted false information to PCI

and as per Regulation (xi) of the “Minimum Qualification for Teachers in Pharmacy

Institutions Regulations, 2014”, the employer Pharmacy Institution shall be responsible to

ensure that the faculty employed by it as teacher is not working simultaneously in any

other institution. In case the employer Pharmacy institution submits false Staff

Declaration Form (SDF) in this regard then action shall be taken against it under Section

13 of the Pharmacy Act, 1948.

94.4 In view of above, it was decided to call the Principal for PHC and seek explanation as to

197. Consideration of approval of Pharm.D conducted at Faculty of Pharmacy, Integral

University, Dasauli, Kursi Road, Lucknow-226026 (Uttar Pradesh).

197.2 It was noted that the institution started the Pharm.D. course from 2015-2016 academic

session in total contravention of Regulation 9 of the Pharm.D. Regulations, 2008 which

clearly states that no person, institution, society or university shall start and conduct

Pharm.D or Pharm.D. (Post Baccalaureate) programme without the prior approval of the

Pharmacy Council of India.

197.3 In view of above, it was decided to –

a) invite attention of the institution to Regulation 9 of the Pharm.D. Regulations, 2008

as notified in the Gazette of India.

b) reject the application.

c) instruct the institution to immediately discharge the students already admitted.

d) invite the attention of the institution to Council’s (96th

CC) following decision -

Action to be taken against the pharmacy institutions found indulged in flouting

the PCI norms:

Existing Provisions

a) No new pharmacy course shall be permitted for a period of 5 years.

b) No increase of intake capacity shall be granted for a period of 5 years.

c) Before considering request of institution for neutralization of excess admissions in

B.Pharm course, monetary penalty as may be decided by the PCI be imposed

besides refunding of tuition fee by institution to excess students.

d) The institution shall render itself liable for action for withdrawal of approval u/s

13 of the Pharmacy Act, 1948.

Additional Provisions

a) Application for starting of any pharmacy course / raise in admission / extension of

approval received after the cut of date shall be summarily rejected. The

institutions shall be held solely responsible for consequences and the council shall

not consider any retrospective approval.

b) In case of excess admission, besides refunding the tuition fee – a surcharge

amounting to five times of the total fees collected per student shall be levied

against each excess admission.

c) Seats equal to double the number of excess admissions shall be reduced from the

intake in the subsequent academic year.

d) In order to compensate the damages done to the students by the pharmacy

institutions by admitting non-eligible students or admitting students against the

seats beyond the intake approved by the PCI, the defaulting institutions shall also

have to pay compensation fee amounting to Rs. 10 lakhs to 50 lakhs in addition to

above cited penalties as may be decided by the PCI on case to case basis and the

funds so collected shall be utilized for the welfare of the pharmacy students.

Dasauli, Kursi Road, Lucknow, Uttar Pradesh, has started the Pharm.D. course during

2015-2016 academic session in total contravention of Regulation 9 of the Pharm.D.

Regulations, 2008 as notified in the Gazette of India.

The said University is not approved by the PCI for the conduct of Pharm.D. course

and has been advised to immediately discharge the students already admitted. The

application of the said University has also been rejected by the PCI for consideration

of approval of Pharm.D course.
