    Connecting the FortiAP Unit

    Using the provided mounting brackets, attach the FortiAP unit to a wall or pole,

    as described in the FortiAP-222B Hardware Installation Guide. The PoE adapter

    unit is not weatherproo and must be mounted indoors. Adequate grounding must

    be provided to the FortiAP unit and the PoE adaper, compliance with your localelectrical code or regulations. Grounding lugs are provided or this purpose.

    Connect the FortiAP unit as ollows:

    1. Connect your region-specic AC plug adapter to the AC Adapter by inserting the

    round disk into the Adapter and rotating clockwise until you hear the disk lock

    in place.

    2. Insert the DC plug o the power adapter into the DC IN port on the PoE adapter.

    Plug the AC Adapter into a wall outlet or power strip. The PWR LED will light up.

    3. Connect one end o a cross-over Ethernet cable into the Network port on the

    PoE adapter. Connect the other end to the FortiGate controller or router.

    4. Using the supplied weatherproo connector, connect one end o a weather-proo

    straight-through Ethernet cable to the PoE port on the bottom o the FortiAP unit,

    ollowing the procedure in the FortiAP-222B Install Guide. Insert the other end o

    the Ethernet cable into the AP/Bridge port on the PoE adapter.

    Note: The FortiAP 222B is certied or use with only the included antennas or with

    the FortiAP Antenna-336R.

    Conguring the FortiAP Unit

    The FortiAP unit is designed to require no conguration in most networks. Zero

    Conguration mode works i the unit is directly connected to the FortiGate or

    FortiWi perorming the Wireless LAN Controller (WLC) unctions, or on the same

    layer-2 network and subnet as the FortiGate or FortiWi unit.

    I the FortiAP wireless controllers IP address cannot be determined using Zero

    Conguration mode, or i the network uses static IP addresses, it can be congured

    to use a static IP address.

    To enable the FortiAP using Zero Confguration:

    1. Ater connecting the FortiAP unit as described in the previous chapter, the unit

    goes through its boot procedure and requests an IP address rom the DHCP

    server.

    2. I the IP address is retrieved successully, the FortiAP enters discovery mode to

    locate a FortiGate or FortiWi wireless controller. The discovery modes are:

    Broadcast

    Multicast DHCP option 138

    3. Veriy that the FortiAP has successully connected to the controller.

    In the FortiGate Web-based Manager, go to WiFi Controller > Managed Access

    Points > Managed FortiAP. A successully discovered unit displays an orange

    circle with a question mark.

    4. Select the access point and clickEdit.

    5. In the State eld, selectAuthorize.

    6. In theAP Profle eld, select Change, then select a prole rom the list and clickOK.

    To enable the FortiAP with a static IP address:

    1. Connect the FortiAP device to a separate private switch or hub, or directly

    connect it to your management computer via a cross-over cable.

    2. Congure the management computer to be on the same subnet as the internal

    interace o the FortiAP unit:

    a. Browse to the Network and Sharing Center > Change Adapter Settings >

    Local Area Connection Properties > Internet Protocol Version 4 (TCP/IPv4)

    Properties.

    b. Change the IP address o the management computer to 192.168.1.3 and the

    netmask to 255.255.255.0.

    3. Use a Telnet apllication to connect to IP address 192.168.1.2.

    4. Type admin in the Name eld, leave the Passwordeld blank, and press Enter.

    5. Congure a static IP address or the FortiAP unit and netmask & gateway

    inormation or your network, using the ollowing commands:cfg -a ADDR_MODE=STATICcfg a AP_IPADDR=xxx.xxx.xxx.xxcfg a AP_NETMASK=255.255.255.0cfg a IPGW=yyy.yyy.yyy.yyycfg a AC_IPADDR_1=zzz.zzz.zzz.zzz

    where xxx is the IP address o the FortiAP unit, yyy is the Gateway IP address

    and zzz is the IP address o the FortiGate Wireless Controller.

    6. Save the conguration by typing the ollowing command:cfg c

    7. Unplug the FortiAP unit and plug it back in order or the conguration to take

    eect.

    8. Move the FortiAP to the intended deployment location and connect the Ethernet

    cable as described in the Connecting Your FortiAP Unit section.

    9. Log in to the FortiGate controller Web-based Manager, and go to WiFi Controller> Managed Access Points > Managed FortiAP. A successully discovered unit

    displays an orange circle with a question mark in the Status column.

    10. Select the access point and clickEdit.

    11. In the State eld, selectAuthorize.

    12. In the Edit FortiAPdialog box, select Enable Wireless Radio. Leave the remaining

    settings at their deault values. The conguration is downloaded rom the

    FortiGate unit to the FortiAP device.

    Resetting the FortiAP unit:

    Following an upgrade, some old conguration items rom a previous rmware

    version or wrong conguration might remain in the conguration le. This may cause

    the unit to display unexpected behavior. Resetting the unit to actory deault settings

    can correct this issue and will not change the rmware version.

    The FortiAP unit can be reset to actory deault settings in two ways: using the CLI,

    or using the hardware reset button.

    To reset the unit using the CLI:1. Connect to the unit using steps 1 through 4 o the enabling the FortiAP unit using

    the CLI.

    2. Enter the ollowing command:

    cfg -x

    To reset the unit using the hardware reset button:

    1. Locate the hardware reset button on the side o the PoE adapter.

    2. Using an appropriate implement, press and hold the reset button or 5 seconds.The unit will reboot to actory deault settings.

    GroundingEnsure your Fortinet product is connected and properly grounded to a lightning and surge

    protector. WAN or LAN connections that enter the premises rom outside the building should

    be connected to an Ethernet CAT5 (10/100 Mb/s) surge protector.

    Shielded Twisted Pair (STP) Ethernet cables should be used whenever possible rather than

    Unshielded Twisted Pair (UTP).

    Do not connect or disconnect cables during lightning activity to avoid damage to your

    Fortinet product or personal injury.

    Electrostatic discharge (ESD) can damage Fortinet equipment. Only perorm the procedures

    described in this document rom an ESD workstation. I no such station is available, you can

    provide some ESD protection by wearing an anti-static wrist strap and attaching it to an

    available ESD connector or other bare metal object.

    Adequate grounding must be provided to the FortiAP unit and the PoE adapter. Grounding

    lugs are provided on both units or this purpose. Consult a certied electrician to ensure that all

    grounding and cabling is installed in compliance with the local electrical code.

    Caution: For devices that contain a battery there is a risk o explosion i battery is replaced by

    an incorrect type. Recycle used batteries according to your local regulations.

    Product License Agreement

    The parties to this agreement are you, the end customer, and either (i) where you have purchased your Product within the Americas, Fortinet, Inc., or (ii) where youhave purchased your Product outside o the Americas, Fortinet Singapore Private Limited (each reerred to herein as Fortinet) .CAREFULLY READ THE FOLLOW-

    ING LEGAL AGREEMENT (THE OR THIS AGREEMENT OR EULA). USE OF FORTINET PRODUCT(S) AND ANY UPDATES THERETO, INCLUDING HARDWARE APPLIANCE

    PRODUCTS, SOFTWARE AND FIRMWARE INCLUDED THEREIN BY FORTINET, AND STAND-ALONE SOFTWARE PRODUCTS SOLD BY FORTINET (TOGETHER, THE PROD-

    UCTS) CONSTITUTES ACCEPTANCE BY YOU OF THE PROVISIONS IN THIS AGREEMENT. FORTINET SHALL NOT BE BOUND BY ANY ADDITIONAL AND/OR CONFLICTING

    PROVISIONS IN ANY ORDER, RELEASE, ACCEPTANCE OR OTHER WRITTEN CORRESPONDENCE OR OTHER WRITTEN OR VERBAL COMMUNICATION UNLESS EXPRESSLY

    AGREED TO IN A WRITING SIGNED BY THE GENERAL COUNSEL OF FORTINET. YOUR INSTALLATION OR USE OF ANY PRODUCT REPRESENTS AGREEMENT TO THE TERMS

    HEREIN, AS AMENDED OR UPDATED FROM TIME TO TIME IN FORTINETS DISCRETION BY FORTINET PUBLISHING AN AMENDED OR UPDATED VERSION. IF YOU DO NOT

    AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, DO NOT START THE INSTALLATION PROCESS OR USE THE PRODUCTS. IF YOU DO NOT AGREE TO THE PROVISIONS

    OF THIS AGREEMENT, YOU SHOULD IMMEDIATELY, AND IN NO EVENT LATER THAN FIVE (5) CALENDAR DAYS AFTER YOUR RECEIPT OF THE PRODUCT RETURN THE

    PRODUCTS TO THE LOCATION WHERE YOU OBTAINED THEM FOR A FULL REFUND FROM THE PARTNER SELLING TO YOU.

    1. License Grant.

    This is a license, not a sales agreement, between you and Fortinet. The term Sotware, as used throughout this Agreement, includes all Fortinet and third party

    rmware and sotware provided to you with, or incorporated into, Fortinet appliances and any stand-alone sotware provided to you by Fortinet, with the exception

    o any open source sotware contained in Fortinets Products which is discussed in detail in section 15 below, and the term Sotware includes any accompanyingdocumentation, any updates and enhancements o the sotware or rmware provided to you by Fortinet, at its option. Fortinet grants to you a non-transerable (except

    as provided in section 5 (Transer) and section 15 (Open Source Sotware) below), non-exclusive, revocable (in the event o your ailure to comply with these terms

    or in the event Fortinet is not properly paid or the applicable Product) license to use the Sotware solely or your internal business purposes (provided, i a substantial

    portion o your business is to provide managed service provider services to your end-customers, you may use the Sotware embedded in FortiGate and supporting

    hardware appliances to provide those services, subject to the other restrictions in this Agreement), in accordance with the terms set orth in this Agreement and subject

    to any urther restrictions in Fortinet documentation, and solely on the Fortinet appliance, or, in the case o blades, CPUs or databases, on the single blade, CPU or

    database on which Fortinet installed the Sotware or, or stand-alone Sotware, solely on a single computer running a validly licensed copy o the operating system or

    which the Sotware was designed, or, in the case o blades, CPUs or databases, on a single blade, CPU or database. For clarity, notwithstanding anything to the contrary,

    all licenses o Sotware to be installed on blades, CPUs or databases are licensed on a per single blade, solely or one blade and not or multiple blades that may be

    installed in a chassis, per single CPU or per single database basis, as applicable. The Sotware is in use on any Fortinet appliances when it is loaded into temporary

    memory (i.e. RAM). You agree that, except or the limited, specic license rights granted in this section 1, you receive no license rights to the Sotware.

    2. Limitation on Use.

    You may not attempt to, and, i you are a corporation, you are responsible to prevent your employees and contractors rom attempting to, (a) modiy, translate, reverse

    engineer, decompile, disassemble, create derivative works based on, sublicense, or distribute the Sotware; (b) rent or lease any rights in the Sotware in any orm toany third party or make the Sotware available or accessible to third parties in any other manner; (c) except as provided in section 5, transer assign or sublicense right

    to any other person or entity, or (d) remove any proprietary notice, labels, or marks on the Sotware, Products, and containers.

    3. Proprietary Rights.

    All rights, title, interest, and all copyrights to the Sotware and any copy made thereo by you and to any Product remain with Fortinet. You acknowledge that no title

    to the intellectual property in the Sotware or other Products is transerred to you and you will not acquire any rights to the Sotware or other Products except or the

    specic license as expressly set orth in section 1 (License Grant) above.

    4. Term and Termination.

    Except or evaluation and beta licenses or other licenses where the term o the license is limited per the evaluation/beta or other agreement or in the ordering docu-

    ments, the term o the license is or the duration o Fortinets copyright in the Sotware. Fortinet may terminate this Agreement, and the licenses and other rights herein,

    immediately without notice i you breach or ail to comply with any o the terms and conditions o this Agreement. You agree that, upon such termination, you will cease

    using the Sotware and any Product and either destroy all copies o the Fortinet documentation or return all materials to Fortinet. The provisions o this Agreement,

    other than the license granted in section 1 (License Grant), shall survive termination.

    5. Transer.

    I you are a Fortinet contracted and authorized reseller or distributor o Products, you may transer (not rent or lease unless specically agreed to in writing by Fortinet)

    the Sotware to one end user on a permanent basis, provided that: (i) you ensure that your customer and the end user receives a copy o this Agreement, is bound by

    its terms and conditions, and, by selling the Product or Sotware, you hereby agree to enorce the terms in this Agreement against such end user, (ii) you at all times

    comply with all applicable United States export control laws and regulations, and (iii) you agree to reund any ees paid to you by an end user who purchased Product(s)

    rom you but does not agree to the terms contained in this Agreement and thereore wishes to return the Product(s) as provided or in this Agreement. Further, i you

    are a non-authorized reseller o Products, you are not authorized to sell Product(s) or Sotware, but, regardless, by selling Product(s) or Sotware, you hereby agree

    you are bound by the restrictions and obligations herein and are bound to: (i) ensure that your customer and the end user receive a copy o this Agreement and are

    bound in ull by all restrictions and obligations herein (ii) enorce the restrictions and obligations in this Agreement against such customer and/or end user, (iii) comply

    with all applicable United States export control laws and regulations and all other applicable laws, and (iv) reund any ees paid to you by a customer and/or end user

    who purchased Product(s) rom you but does not agree to the restrictions and obligations contained in this Agreement and thereore wishes to return the Product(s) as

    provided or in this Agreement. Notwithstanding anything to the contrary, distributors, resellers and other Fortinet partners (a) are not agents o Fortinet and (b) are not

    authorized to bind Fortinet in any way.

    6. Limited Warranty.

    Fortinet provides this limited warranty or its product only to the single end-user person or entity that originally purchased the Product rom Fortinet or its authorizedreseller or distributor and paid or such Product. The warranty is only valid or Products which are registered on Fortinets Support Website: https://support.ortinet.com;

    or on the TalkSwitch support website: http://global.talkswitch.com; or such other website as provided by Fortinet. For the below sotware warranty to start, registration

    must take place within three hundred sixty-ve (365) days rom the date the Product was originally shipped rom Fortinets acilities or the warranty is null and void

    and will not be honored. For the hardware warranty, such warranty starts on the earlier o the date o Product registration on Fortinets Support Website or ninety (90)

    days rom the date that the Product was originally shipped rom Fortinets acilities. It is the Fortinet distributors and resellers responsibility to make clear to the end

    user the date the product was originally shipped rom Fortinet, and it is the end users responsibility to understand the original ship date rom the party rom which the

    end user purchased the product. All warranty claims must be submitted in writing to Fortinet beore the expiration o the warranty term or such claims are waived in

    ull, i.e. ninety (90) days rom the earlier o registration or the automatically started term or hardware and spare parts claims and three hundred sixty-ve (365) days

    rom registration within three hundred sixty-ve (365) days rom shipment or sotware claims. Fortinet provides no warranty or any beta, donation or evaluation

    Products, or any spare parts not purchased directly rom Fortinet by the end-user, or any accessories, or or any stand-alone sotware.

    Fortinet warrants that the hardware portion o the Products, including spare parts unless noted otherwise (Hardware) will be ree rom material deects in workman-

    ship as compared to the unctional specications or the period set orth as ollows and applicable to the Product type (Hardware Warranty Period): a three hundred

    sixty-ve (365) day limited warranty or the Hardware excluding spare parts, and, or spare parts, solely a ninety (90) days limited warranty. Fortinets sole obligation

    shall be to repair or replace the deective Hardware at no charge to the original owner. This obligation is exclusive o transport ees, labor or installation costs, and anyPage 11

    other cost which are not directly associated to the Product. Such repair or replacement will be rendered by Fortinet at an authorized Fortinet service acility as deter-

    mined by Fortinet. The replacement Hardware need not be new or o an identical make, model, or part; Fortinet may, in its discretion, replace the deective Hardware

    (or any part thereo) with any reconditioned Product that Fortinet reasonably determines is substantially equivalent (or superior) in all material respects to the deective

    Hardware. The Hardware Warranty Period or the repaired or replacement Hardware shall be or the greater o the remaining Hardware Warranty Period or ninety days

    rom the delivery o the repaired or replacement Hardware. I Fortinet determines in its reasonable discretion that a material deect is incapable o correction or that it

    is not practical to repair or replace deective Hardware, the price paid by the original purchaser or the deective Hardware will be reunded by Fortinet upon return to

    Fortinet o the deective Hardware. All Hardware (or part thereo) that is replaced by Fortinet, or or which the purchase price is reunded, shall become the property o

    Fortinet upon replacement or reund.

    Fortinet warrants that the sotware portion o Hardware Products will substantially conorm to Fortinets then current unctional specications or the Sotware, as set

    orth in the applicable documentation or a period o ninety (90) days (Sotware Warranty Period), i the Sotware is properly installed on approved Hardware and

    operated as contemplated in its documentation. Fortinets sole obligation shall be to repair or replace the non-conorming Sotware with sotware that substantially

    conorms to Fortinets unctional specications. Except as otherwise agreed by Fortinet in writing, the replacement Sotware is provided only to the original licensee,and is subject to the terms and conditions o the license granted by Fortinet or the Sotware. The Sotware Warranty Period shall extend or an additional ninety (90)

    days ater any replacement sotware is delivered. I Fortinet determines in its reasonable discretion that a material non-conormance is incapable o correction or that

    it is not practical to repair or replace the non-conorming Sotware, the price paid by the original licensee or the non-conorming Sotware will be reunded by Fortinet;

    provided that the non-conorming Sotware (and all copies thereo) is rst returned to Fortinet. The license granted respecting any Sotware or which a reund is given

    automatically terminates immediately upon reund. For purpose o the above hardware and sotware warranties, the term unctional specications means solely

    those specications authorized and published by Fortinet that expressly state in such specications that they are the unctional specications reerred to in this section

    6 o this Agreement, and, in the event no such specications are provided to you with the Sotware or Hardware, there shall be no warranty on such Sotware.

    7. Disclaimer o Other Warranties and Restrictions.

    EXCEPT FOR THE LIMITED WARRANTY SPECIFIED IN SECTION 6 ABOVE, THE PRODUCT AND SOFTWARE ARE PROVIDED AS-IS WITHOUT ANY WARRANTY OF ANY KIND

    INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY, IMPLIED OR EXPRESS WARRANTY OF MERCHANTABILITY, OR WARRANTY FOR FITNESS FOR A PARTICULAR

    PURPOSE AND NON-INFRINGEMENT. IF ANY IMPLIED WARRANTY CANNOT BE DISCLAIMED IN ANY TERRITORY WHERE A PRODUCT IS SOLD, THE DURATION OF SUCH

    IMPLIED WARRANTY SHALL BE LIMITED TO NINETY (90) DAYS FROM THE DATE OF ORIGINAL SHIPMENT FROM FORTINET. EXCEPT AS EXPRESSLY COVERED UNDER

    THE LIMITED WARRANTY PROVIDED HEREIN, THE ENTIRE RISK AS TO THE QUALITY, SELECTION AND PERFORMANCE OF THE PRODUCT IS WITH THE PURCHASER OF

    THE PRODUCT. NOTWITHSTANDING ANYTHING TO THE CONTRARY, THE HARDWARE WARRANTY PERIOD DISCUSSED ABOVE DOES NOT APPLY TO CERTAIN FORTINETPRODUCTS, INCLUDING FORTIFONE WHICH HAS A NINETY (90) DAY LIMITED WARRANTY AND FORTITOKEN WHICH HAS A 365 DAY WARRANTY FROM THE DATE OF

    SHIPMENT FROM FORTINETS FACILITIES, AND THE SOFTWARE WARRANTY DOES NOT APPLY TO CERTAIN FORTINET PRODUCTS, INCLUDING FORTIGATE-ONE AND

    VDOM SOFTWARE.

    The warranty in Section 6 above does not apply i the Sotware, Product or any other equipment upon which the Sotware is authorized to be used (a) has been altered,

    except by Fortinet or its authorized representative, (b) has not been installed, operated, repaired, or maintained in accordance with instructions supplied by Fortinet, (c)

    has been subjected to abnormal physical or electrical stress, misuse, negligence, or accident; or (d) is licensed or beta, evaluation, donation, testing or demonstration

    purposes or or which Fortinet does not charge a purchase price or license ee. In the case o beta, testing, evaluation, donation or ree Sotware or Product, the end

    user acknowledges and agrees that such Sotware or Product may contain bugs or errors and could cause system ailures, data loss and other issues, and the end user

    agrees that such Sotware or Product is provided as-is without any warranty whatsoever, and Fortinet disclaims any warranty or liability whatsoever. An end users

    use o evaluation or beta Sotware or Product is limited to thirty (30) days rom original shipment unless otherwise agreed in writing by Fortinet.

    8. Governing Law.

    This Agreement and the warranty herein shall be governed by the laws o the state o Caliornia, without regards to the conficts o laws principles thereo.

    9. Limitation o Liability.

    TO THE MAXIMUM EXTENT PERMITTED BY LAW AND NOTWITHSTANDING ANYTHING TO THE CONTRARY, FORTINET IS NOT LIABLE UNDER ANY CONTRACT, NEGLI-GENCE, TORT, STRICT LIABILITY, INFRINGEMENT OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY LOSS OF USE OF THE PRODUCT OR SERVICE OR ANY DAMAGES

    OF ANY KIND WHATSOEVER, WHETHER DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL,

    LOSS OF PROFIT, LOSS OF OPPORTUNITY, LOSS OR DAMAGE RELATED TO USE OF THE PRODUCT OR SERVICE IN CONNECTION WITH HIGH RISK ACTIVITIES, DAMAGE

    TO PERSONAL OR REAL PROPERTY, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, COMPUTER SECURITY BREACH, COMPUTER VIRUS INFECTION, LOSS

    OF INFORMATION OR DATA CONTAINED IN, STORED ON, OR INTEGRATED WITH ANY PRODUCT INCLUDING ANY PRODUCT RETURNED TO FORTINET FOR WARRANTY

    SERVICE) RESULTING FROM THE USE OF THE PRODUCT, RELATING TO WARRANTY SERVICE, OR ARISING OUT OF ANY BREACH OF THE LIMITED WARRANTY IN SECTION

    6 ABOVE, EVEN IF FORTINET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SOLE REMEDY FOR A BREACH OF THE LIMITED WARRANTY IS REPAIR,

    REPLACEMENT OR REFUND OF THE DEFECTIVE OR NON-CONFORMING PRODUCT AS SPECIFICALLY STATED IN SECTION 6 ABOVE.

    10. Import / Export Requirements; FCPA Compliance.

    You are advised that the Products may be subject to the United States Export Administration Regulations and other import and export laws; diversion contrary to

    United States law and regulation is prohibited. You agree to comply with all applicable international and national laws that apply to the Products as well as end user,

    end-use, and destination restrictions issued by U.S. and other governments. For additional inormation on U.S. export controls see www.bis.doc.gov. Fortinet assumes

    no responsibility or liability or your ailure to obtain any necessary import and export approvals. You represent that neither the United States Bureau o Industry and

    Security nor any other governmental agency has issued sanctions against you or otherwise suspended, revoked or denied your export privileges. You agree not to useor transer the Products or any use relating to nuclear, chemical or biological weapons, or missile technology, unless authorized by the United States Government by

    regulation or specic written license. Additionally, you agree not to directly or indirectly export, import or transmit the Products contrary to the laws or regulations o

    any other governmental entity that has jurisdiction over such export, import, transmission or use. Furthermore, you represent that you understand, and you hereby

    agree to comply with, all requirements o the U.S. Foreign Corrupt Practices Act and all other applicable laws. For beta, testing, evaluation, donation or ree Products

    and/or related services, you hereby agree, represent and warrant to Fortinet that (a) receipt o the Products and/or services comply with all policies and you have

    obtained all necessary approvals or such Products and/or services, (b) the Products and/or services are not provided in exchange or Fortinet maintaining current busi-

    ness or or new business opportunities, and (c) the Products and/or services are not being received or the benet o, and are not being transerred to, any government

    entity, representative or aliate.

    11. U.S. Government End Users.

    The Sotware and accompanying documentation are deemed to be commercial computer sotware and commercial computer sotware documentation, respec-

    tively, pursuant to DFAR Section 227.7202 and FAR Section 12.212, as applicable. Any use, modicat ion, reproduction, release, perormance, display or disclosure

    o the Sotware and accompanying documentation by the United States Government shall be governed solely by the terms o this Agreement and shall be prohibited

    except to the extent expressly permitted by the terms o this Agreement and its successors.

    12. Tax Liability.

    You agree to be responsible or payment o any sales or use taxes imposed at any time on this transaction.

    13. General Provisions.

    Except as specically permitted and required in section 5 (Transer) above, you agree not to assign this Agreement or transer any o the rights or obligations under

    this Agreement without the prior written consent o Fortinet. This Agreement shall be binding upon, and inure to the benet o, the successors and permitted assigns o

    the parties. The United Nations Convention on Contracts or the International Sales o Goods is expressly excluded. In the event o any claim arising out o this Agree-

    ment, the parties hereby submit to the jurisdiction o the ederal and state courts located in Santa Clara County, Caliornia, as applicable. This Agreement and other

    Fortinet agreements may be amended or supplemented only by a writing that reers explicitly to the agreement signed on behal o both parties, or, or this Agreement,

    as otherwise expressly provided in the lead-in above Section 1 above, provided, notwithstanding anything to the contrary and except or this Agreement which may be

    amended or updated as expressly provided in the lead-in above Section 1 above, or any amendment or other agreement to be binding on Fortinet, such amendment

    or other agreement must be signed by Fortinets General Counsel. No waiver will be implied rom conduct or ailure to enorce rights nor eective unless in a writing

    signed on behal o the party against whom the waiver is asserted. I any part o this Agreement is ound unenorceable, that part will be enorced to the maximum

    extent permitted and the remainder shall continue in ull orce and eect. You acknowledge that you have read this Agreement, understand it, and agree to be bound by

    14. Privacy.

    By entering into this Agreement, you agree and consent that Fortinet may collect, retain and use personal inormation supplied, including name, address, and e-mail

    address o individuals and payment details and other inormation. Personal inormation will be used primarily to provide services and product unctionality to end us-

    ers. Fortinet may also use personal inormation or additional communication, subject to an opt-out notice provided by you in writing per below. Fortinet may engage

    other companies and individuals to perorm unctions on its behal, such as payment processing, order ulllment, marketing programs and customer service. Fortinet

    may share personal inormation with such subcontractors in order to perorm these and other unctions, but such subcontractors may not use your personal inorma-

    tion or other purposes, unless you agree. By entering into this Agreement, you agree and consent to the transer the supplied personal inormation to Fortinets oces

    in the United States and elsewhere, or the purposes stated above. For more detailed inormation on the collection, use and transer o your personal inormation, and

    or inormation on how to opt out o or unsubscribe rom the communications described above, please read the Fortinet privacy policy on the Fortinet web site (www.

    Fortinet.com).

    15. Open Source Sotware.

    Fortinets products may include sotware modules that are licensed (or sublicensed) to the user under the GNU General Public License, Version 2, o June 1991 (GPL)or GNU Lesser General Public License, Version 2.1, o February 1999 (LGPL) or other open source sotware licenses which, among other rights, permit the user touse,

    copy, modiy and redistribute modules, or portions thereo, and may also require attribution disclosures and access to the source code (Open Source Sotware). The

    GPL requires that or any Open Source Sotware covered under the GPL, which is distributed to someone in an executable binary ormat, that the source code also be

    made available to those users. For any Open Source Sotware covered under the GPL, the source code is made available on this CD or download package. I any Open

    Source Sotware licenses require that Fortinet provide rights to use, copy or modiy a Open Source Sotware program that are broader than the rights granted in this

    agreement, then such rights shall take precedence over the rights and restrictions herein. Fortinet will provide, or a charge refecting our standard distribution costs,

    the complete machine-readable copy o the modied sotware modules. To obtain a complete machine-readable copy, please send your written request, along with
