Commissioner News ServiceCHANDIGARH : TheDistrict Consumer DisputesRedressal Commission saidthe consumer could not bemade to wait for an indefiniteperiod and the builder, who isnot in a position to deliver thepossession of the unit aspromised, has no right to retainthe hard-earned money of thecomplainant.Not delivering a plot in ahousing project for over eightyears has cost a builder dear.Holding the delay asdeficiency in service, theCommission, Chandigarh, hasdirected the builder not only torefund the booking amount ofRs2.60 lakh to a consumer butalso pay Rs25,000 ascompensation on account ofmental agony and litigationcost.Jyoti Bhatia, a resident ofSector 38, approached thecommission through counselGurjot Singh Sadhrao after thebuilder, BCL Homes Limited,failed to deliver the plot for

over eight years.Bhatia said she booked a 200square yard plot on August 8,2011, in the project Chinar cityon the Patiala road, Zirakpur,@ Rs13,000 per sq yd afterpaying a sum of Rs2.60 lakh asbooking amount.She repeatedly approached thebuilder regarding theconstruction of the project andallotment thereafter, but to noavail. Later, it came to herknowledge that no formalapproval has been obtained bythe builder to carry out theconstruction at the relevantplace. In June 2019, sherequested the builder to refundthe money. However, thebuilder refused to refund themoney and offered her aninvestment in other projects.

Alleging that the aforesaid acton part of the opposite party(builder) amounts todeficiency in service andunfair trade practice, she fileda complaint with thecommission. No one from theopposite party (builder)appeared before thecommission despite notices.After hearing the arguments,the Commission found thebuilder guilty and noted thatnon-appearance of the builderalso shows that they hadnothing to say in their defenceagainst the allegations madeby the complainant. TheCommission directed thebuilder to refund Rs2.60 lakhto the complainant, along withinterest @ 9 per cent perannum from the date of deposittill its realisation. TheCommission also directed thebuilder to pay Rs15,000 ascompensation on account ofmental tension and physicalharassment and Rs10,000 aslitigation expenses.

However, the stategovernment in the Budgetthis year increased theamount to Rs 1,500 permonth from July onwards.

In July last year, thedepartment had written to alldeputy commissioners about70,137 illegal beneficiariesin the state and asked themto constitute district-levelcommittees, led by districtsocial security officers, toreview the recovery processevery 15 days.The recovery is, however,negligible so far.District Social Security

more than Rs2,000 inclusiveof taxes for CT scan/HRCTchest.According to information,the administration had beenreceiving complaints frompeople about overchargingby diagnostic centres for CTscan.Dayalan said all diagnosticcentres in the district shouldadhere to the orders. All pri-vate diagnostic centres con-ducting chest CT scan mustshare their data with the dis-trict Civil Surgeon. The cen-

tres should not declare anyCovid positive or negativereport on the basis of thechest CT scan without con-firmation from the Covid-19testing lab.The Deputy Commissionersaid every diagnostic centremust submit weekly reportof CT scan/HRCT chest tothe Civil Surgeon. As per theinstructions of the state gov-ernment, diagnostic centresmust display scanning ratesin a visible manner.

They have the option ofundergoing RT-PCR test aftersix or seven days.Those people from hotspots,who are carrying a negativeRT-PCR report not older than72 hours, will be allowedentry without restrictions.Also those who have complet-ed their Covid vaccination anda minimum of 14 days haselapsed and are carrying theircertificates would be allowed

from hotspots.People, who travel toHimachal from the hotspot forshort duration for medical,business or officials work fortime not exceeding 72 hoursand will not attend any gather-ing, shall be exempted fromquarantine requirements.Children below the age of 10years age will not requireCovid test report if accompa-nying adults have a Covidnegative report.The local panchayat membersor urban body representativeswill share details of arrivalsfrom outside with health offi-cials. The movement of familymembers of people who havebeen quarantined will also berestricted and the local author-ity will supply essential itemsat their doorsteps.

As per the order, movement ofindividuals shall remain strict-ly prohibited between 10 pmand 5 am, except for essentialcommodities. District magis-trate will issue separate ordersin their areas, such as under144 Cr PC and ensure strictcompliance.Task forces will be constitutedfor the enforcement of theSOPs for the organising ofpermitted gatherings at thelocal level and initiate actionagainst the violators.The order by Secretary(Health) stressed that keepingin view the circumstances, it isimperative to take necessarymeasures for the containmentof the disease and limit itsspread by undertaking efforts.
