Case StudyIn a previous civil case that Ratkovich worked, an employer was being sued by a former employee for approximately $800,000 USC. The allegations against the company were that the employee’s supervisor had supposedly sent discriminatory text messages to the employee on the employee’s personal cell phone and then terminated the employee based on the discrimination. The employee’s attorney was working on a contingency fee and had hired a firm in Chicago that purported to be experts in digital forensics. They supposedly evaluated the employee’s phone and then prepared a four-page report of their findings that supposedly validated their client’s allegations. Ratkovich and his firm were retained by the law firm representing the employer to forensically image the employee’s phone to which the alleged text messages were sent and to form an expert opinion as to whether the messages were indeed sent from the employer’s device to the employee’s personal device and consequently if the allegations were substantiated in any way.

Using Oxygen Forensic Detective, Ratkovich recovered all of the available

data and determined through examination that the employee had actual drafted the text messages and sent them to himself by changing a contact ID in his phonebook and then changing it back to avoid detection. Ratkovich recovered the deleted message from the drafts folder on the device.

The reporting available in Oxygen Forensics Detective produced a forensically sound case report in excess of 5,000 pages that was used during negotiations and arbitration to invalidate the employee’s claims. Ratkovich developed a series of questions for the attorney to use during deposition based on his review of the other company’s forensic evaluation and the data recovered by Ratkovich which impeached the testimony of the employee. The case was settled for a mere $8,000 USC as a disposal cost.
