This guide is meant to provide you with information and practical advice that you may find useful in the early years following the loss of your loved one.

This guide was produced by Threads of Life — the Association for Workplace Tragedy Family Support (Threads of Life) in partnership with:

Threads of Life is a national, charitable, not-for-profit organization dedicated to supporting families whohavebeenaffectedbyaworkplacetragedy,whichwegenerallydefineasafatality,alife-alteringinjury, or a life-altering occupational disease.

InAugust2007,anAlbertacompanywasfinedforfailingtoprotectaworkerwhoreceivedalife-altering injury in a manufacturing incident. Under the “creative sentencing” provisions in the Alberta Occupational Health and Safety Act, a portion of the fine was directed to Threads of Life to produce two resource guides. The guides are entitled:

• ForFamilies–AResourceGuideforSeriouslyInjuredWorkersandtheirFamilies

OntheinsidebackcoverofeachguidewehaveincludedaDVDwhichcontainsawiderangeofadditionalinformation.TheDVDincludes:

• A video entitled “Beginning of Forever,” which includes first-hand comments from families like yours that have experienced a workplace tragedy, whether a serious injury or fatality.

• A series of informational video segments that will help you understand different processes, such as injury or fatality investigations and court proceedings, as well as the services and benefits you may receive from the workers’ compensation system.

WhoWillContacttheFamily?Intheearlydaysfollowingaworkplacefatality, you may be contacted by different people, or you may have to initiate the contact.

Thismayincludeyourlovedone’semployer,theWCB,aWorkplaceHealthandSafetyinvestigator,thelocalpoliceorRCMP,apoliceVictimServicesrepresentative,theOfficeoftheChiefMedicalExaminer,afuneral home, friends, relatives, the media and many others.

The following pages provide basic information about some of the main contacts you will have with government or regulatory agencies.

ImportantFactsAboutWorkplaceFatalitiesinAlbertaAdeceasedworkermusthavebeenemployed by an employer covered under the Workers’ Compensation Act in order for the surviving family to be eligible for WCBbenefitsorservices.Therearesomeinstances where others may be eligible, such as contractors that are deemed tobeworkers,orvolunteersthatmayholdworkerstatusundertheWorkers’ Compensation Act.

WHS onlyinvestigatesworkplacefatalitiesthat fall within their jurisdiction under Alberta’sOccupational Health and Safety ActorotherAlbertalegislation.

HumanResourcesandSocialDevelopmentCanada(HRSDC)isresponsibleforinvestigatingworkplacefatalitiesinfederally-regulated organizations that operateinAlberta,suchasrailways,thetelecommunications industry, interprovincial transport companies and federal government departments.Insomecases,theremaybe a joint federal-provincial investigation. ImportantLegislationLegislation that may be of interest to readers of this guide includes:

InAlberta,apersonisanadultinterdependent partner if:

— the person has lived with the other person in a relationship of interdependence for a continuous period of not less than 3 years, or of some permanence, if there is a child of the relationship by birth or adoption, or

— the person has entered into an adult interdependent partner agreement with the other person.

Inthisguide,forsimplicity,wehaveshortened all usages of the term adult interdependent partner to partner.Wealsouse the terms spouse, partner and common-law partnerequally,assomefederallegislation refers to the common-law term. The use of these terms in this guide generally relates to the eligibility of a deceased person’sspouse,partnerorcommon-lawpartnertoreceivesurvivor’sbenefits.

Workers’CompensationBoard–Alberta(WCB)Within24businesshoursofbeingnotifiedofaworkplacefatality,aWCBSpecialNeedscasemanagerwillpersonallycontactthedeceasedworker’sfamily.Duringtheinitialcontact,theSpecialNeedscasemanagertellsthefamilythattheWCBisaware of the fatality and sensitively informs thefamilywhattheycannowexpect,intermsofWCBbenefits,supportandservices.

TheWCB’sgoalistoestablishaclaimforWCBbenefitsasquicklyaspossible,inordertoassisttheworker’sfamily immediately.

YourWCBSpecialNeedscasemanagermayprovide general supports such as:

• contactingfamilymembersforyou

• assistingwithfuneralarrangements

• helpingyoucompleteforms

• contactingschoolcounsellors

• settingupgriefcounselling

The Special Needs case manager is an important contact because they are assigned to provide support to you and generally assist you in applying for any WCB benefits to which you and your family may be entitled.

Grief CounsellingGriefcounsellingisoneofmanyservicesofferedbytheWCBtosurvivingspousesorpartners.Duringtheinitialdiscussionwiththefamily,theWCBSpecialNeedscasemanager will offer the services of a licensed psychologist, from a list of approved service providers.

You may wish to consider grief counselling intheearlydaysorweeksafteryourloss,and at other times in the first year or beyond. Manyfamiliesthathaveexperiencedaworkplacefatalityhavestatedthatgriefcounselling has been very helpful to them in coping with their loss and with moving on in life.

Financial Assistance for Funeral ExpensesForfamiliesofdeceasedworkersthathadWCBcoverage,theWCBpaysupto,butnotexceeding,$8,150towardstheburial,cremation or memorial service for the deceasedworker.

TheWCBwillpayupto$550towardsanycosts incurred in the transportation of the bodywithinAlberta,orupto$1,000ifthebodymustbetransportedoutsideofAlberta.

Theworker’sfamilymayalsoreceiveaseparatepaymentof$1,300toassistwithanyextracostsassociatedwitharrangingthefuneral.YourSpecialNeedscasemanagerwillansweranyofyourquestionsaboutfuneralexpensesandrelatedmatters.

You may be able to use funeral funds from theCanadaPensionPlan(CPP)topayforsomeorallofthecostsabovetheWCBmaximum.WorkerswhohavecontributedintotheCPPduringtheirworkinglivesaregenerallyeligibleforCPPbenefits,includingfuneralexpenseswithinsetamounts.Refertopage___formoreinformationonCPPbenefits.

Your Application for WCB Benefits (WCB Claim)TheSpecialNeedscasemanagerwillhelpyoumakeanapplicationforanyWCBbenefits or services that you may be entitled to as the surviving spouse or partner, including benefits for any surviving children.

The benefits and services you are entitled to are based on a number of criteria, such as:

• thewagesofthedeceasedworkeratthetime of injury

• iftherearedependentchildren

• ageofchildren

• abilityofspouseorpartnertowork

• willingnessofspouseorpartnerto participate in services/benefits providedbytheWCB,suchaslabourmarketre-entry

Labour Market Re-entry ServicesIfyouarethedependantspouseorpartnerofthedeceasedworker,youareentitledtothesamelabourmarketre-entryservicestowhichanyworkerwithWCBcoverageis entitled. This is in accordance with WCB Policy04-08.AllpoliciesintheWCBPolicyandInformationManual can be viewed on theWCB’swebsite.

The intent of these services is to help you find meaningful employment at the highest wagepossible,basedonyourexperienceand training.

Iftherearenochildrenunder18atthetimeofaworker’sdeath,theseservicesstart immediately. For surviving spouses with children, they can use the labour marketre-entryservicesbeforetheyoungestchild turns 18 or when the youngest child turns 18.

Ifthechildrenareunder18,thesurvivingspousecanreturntotheworkforcewithoutaffectingtheamountofWCBbenefitsbeing received.

Examplesoflabourmarketre-entryservices include:

• careercounselling

• sponsorshipofwagesduringthefirstthree months of on-the-job training with an employer

• assistancewithjobplacement,suchasresumes,interviewingtechniquesandemployer contacts

• paymentofsomecostsassociatedwitheducationandtraining,e.g.,books,tuition, supplies, childcare, etc.

If Your Claim is Not AcceptedAllWCBdecisionscomewithawrittenexplanationaboutthedecision,aninvitationto contact the case manager to discuss your concerns and the time limits for appealing the decision. Your case manager is prepared to discuss the reasons for a decision with you.

Ifyouwishtoappealthedecision,thereisaprocess to follow.

• ThefirststepistocontactyourSpecialNeedscasemanagerandinformthecasemanager of your wish to appeal.

• Typically,areviewofthedecisionwill first be done by the case manager’ssupervisor.

• Ifyoustillwishtocontinueyourappealafterthesupervisor’sreview,thenextstepistorequestareviewbytheWCB’sDisputeResolutionandDecisionReviewBody.

• Ifyoudonotacceptthereviewbody’sdecision, the last stage of appeal is to requestareviewofthedecisionbytheAppealsCommission.

Inallofthesesteps,youareentitledtoreceive information and guidance from the WCB’sOfficeoftheAppealsAdvisor.

Ifthedeceasedwasamemberofaunion,the union may also be able to provide information or assistance to the family. Youmayalsowishtoseeklegaladviceorcounselfromworkers’compensationconsultantsintheprivatesector.Besuretocheckforcredentialsorreferenceswhenengaging legal or other assistance.

Can the Family Sue?No.Theworkers’compensationsystemisano-faultinsurancesystem.UnderSection23of the Workers’ Compensation Act, when an accidentinvolvesaworkercoveredunderthe Act,andthataccidentoccursinAlberta,theworker(andthus,thefamily)doesnothavetherighttosueanyotherworkeroranyemployer.

However,underSection22oftheWorkers’ Compensation Act,theWCBitselfmay,in some cases, bring an action against a thirdparty,i.e.,ifthereisaperson(s)whois responsible, or partially responsible for theaccidentandwhoisnotaworkeroremployer under the Act.IftheWCBactionis successful, the proceeds of that action are distributed in accordance with sub-section 22(11)oftheWorkers’ Compensation Act.

CanadaPensionPlanInorderforadeceasedworker’sspouseor family to be eligible for any benefits undertheCanadaPensionPlan(CPP),thedeceasedworkermusthavecontributedtotheCPPintheirworkinglife.Therearethreetypes of benefits:

• Thedeath benefit is a one-time payment to, or on behalf of, the estate of a deceasedcontributor.Themaximumdeathbenefitis$2,500andmaybeusedtowardsfuneralexpenses.

• Thesurvivor’s pension is a monthly pension paid to the surviving spouse or common-law partner.

• Thechildren’s benefit is a monthly benefit for dependent children.

ItisimportanttoapplyforCPPbenefits.Ifyoudonotapply,youmaymissoutonbenefits that could be helpful.

Making an Application for CPP benefitsYou must complete an application for each type of benefit. Usually, you can get application forms from funeral homes. Funeral directors often offer to help completetheseformstheweekfollowingthefuneral.YourWCBcasemanagermayalsogive you helpful guidance.

YoucanalsocontactHumanResourcesandSocialDevelopmentCanada(HRSDC).There are online forms available on the HRSDCwebsiteforallthreetypesofbenefits.InadditiontotheHRSDCwebsite,you can access these forms via the federal government’sServiceCanadawebsite.Pleaserefertopage___forHRSDCandServiceCanadacontactinformation.

How soon can I receive CPP benefits?ItwilltakeseveralweekstoprocessyourapplicationsforCPPbenefits.Benefitsarepayablethemonthafterthecontributor’sdeath. The death benefit, which may be used towardsfuneralexpenses,ispayableassoonas the application is processed.

Can I receive CPP and WCB benefits at the same time?Yes.TheWCBdoesnotreduceyourWCBbenefitsevenifyoualsoreceiveCPPbenefits.

InvestigationoftheFatalityWHSassignsaLeadInvestigatortoeachworkplacefatalityincident.TheLeadInvestigatorwillkeepintouchwithyouinthe months ahead.

Typically, the initial fatality investigation will takethreetofivedays,afterwhichtheLeadInvestigatorwillsendoutalettertothenextofkin,usuallywithinaweekortendaysofthe incident.

IfyouwishtohavedirectcontactwiththeLeadInvestigator,youmayusethecontactinformationprovidedinthelettertokeepintouch over time. Other families who have gonethroughaworkplacetragedyoftenrecommendthatyoukeepinregularcontactwiththeWHSLeadInvestigator.

ItcantakeuptosixmonthsormoretocompleteaFatalityReport.FatalityReportsarecompletedinsequence,basedonthedateofthefatality.Ifprosecutionisrecommended, the report will not be released until after any legal proceedings are completed.

Inmanycases,theLeadInvestigatorwillbe willing to meet with you in person. Basedonexperience,thiskindofmeetingor contact allows the involved parties to review how the report is coming along, and to sometimes clarify facts, rumours or issues about the case.

Steps in the Fatality Investigation

TheLeadInvestigatorcollectsevidenceandcompilesadraftFatalityReport,liaisingwithotherpartiesasneeded,suchaspolice,theChiefMedicalExaminer,theemployer,witnessesandoutsideexpertsorconsultants.Expertsorconsultantsarecommonlyengagedinregardstotechnicalissuesand/orincidentinvestigationdetails,and to help determine contributing factors and root causes of an incident.

The general aim of the Fatality Report is to determine all of the contributing factors and the root cause of the incident. By learning from past incidents, future or similar incidents may be avoided.

When the draft Fatality Report is completed it then undergoes a vigorous technical review within WHS, as well as a review by senior management.

Insomecases,ifrecommendedbyseniormanagement,thefinalizedFatalityReportissenttoAlbertaJustice(RegulatoryProsecutions)forreviewbyaspecializedOHSprosecutor.

The OHS prosecutor will review the entire Fatality Report, including witness statements and other key elements. TheprosecutorwillalsospeaktotheLeadInvestigatorfromWHSandotherpersonswithakeyrole,suchastechnical experts, the police or others.

Afterthisthoroughreview,theOHSprosecutorwillconsultwiththeChiefofRegulatoryProsecutions.Ifthereisenough evidence to prove wrongdoing on the part of any one party or person, then charges may be laid.

Inordertolaycharges,theOHSprosecutormustconsiderthatthereisareasonablelikelihoodofconvictionorelse the charges will not be laid.

AlbertaJustice(OHSprosecutor)mustlaychargeswithintwoyearsofthedateofthefatalityincident,inaccordance with a two-year statute of limitations in the OccupationalHealth&SafetyAct.

Charges may be laid against employers, supervisors or workers. They may be charged jointly or individually.

Prosecutionsaredoneinthepublicinterest,withageneralaimtohaveadeterrenceeffectonemployersandemployeesbyhandingdownfinesand/orpenaltiesavailableundertheOccupationalHealth&SafetyAct.

Fatality reports are not made public or posted on the WHS website until it is clear that no legal proceedings will be undertaken, or until the completion of any legal proceedings.

Ifnochargesaretobelaid,thereportisofferedfirsttothefamilyfortheirreview.Ifthefamilyacceptstheoffer,thereportisprovided.Inthisway,thefamilycanseethereportbeforeitisreleasedtothepublic.Similarly,theemployerisprovidedachancetoreviewthereportatthisstage.Inbothcases,thisisdoneasacourtesyto the involved parties and to ensure that the report contains no unintentional errors, such as clerical errors or misspellings of names.

TheRoleoftheChiefMedicalExaminerUnder the FatalityInquiriesAct, the office ofAlberta’sChiefMedicalExaminer(CME)mustbenotifiedofallworkplace-related deaths.

InaccordancewiththeFatalityInquiriesAct, any occupational death must be recorded onaCertificateofMedicalExaminer.This document notes the manner and cause of death, so it is different from the basicCertificateofDeathandprovidesmore detail.

TheCertificateofMedicalExaminerprovidesthemedicalcause(e.g.,workrelated)ofdeath,themanner(e.g.,accidental)ofdeath,andabriefdescriptionof the circumstances. The Office of the ChiefMedicalExaminerwillnotprovidethis document to any institution or person without written authorization from the adult nextofkin.

TheCertificateofMedicalExaminerisanimportantdocument.Insurancecompanies,banksorlawyersoftenrequireacopyofthisdocument. The manner and cause of death are important in determining the claim. Similarly,itmayalsoaffectyourWCBandCPPclaims.

TheCertificateofMedicalExaminerwillonlybesignedaftertheCMEcompletesa full report on the manner and cause of death.Thiscantakeuptothreeorfourmonths,partlybecausetheCMEmustcarryoutdrugandalcoholtoxicologytestingforallworkplace-relateddeaths.

Will there be an autopsy?Afteraworkplacefatality,theCMEwilldecide whether an autopsy is necessary to help determine the cause of death. This will only happen when a reasonable doubt about themedicalcauseofdeathexists.

Forexample,inthecaseofafatalityinvolvingindustrialequipmentormachinery, the cause of death may be fairlyclear,suchasequipmentfallingonorimpactingtheworker.Inothercases,thecause may be less clear, such as incidents involvingthe“suddencollapse”ofaworkeratwork.Thiskindofincidentmayinvolvetoxicsubstances(e.g.,exposuretohydrogensulphide),perhapsaheartattackorseizure,orotherunknowncauses.Insuchcases,theCMEwillnormallydecidetoconductanautopsy to help determine the actual cause of death.

TheCMEdoesnotneedthepermissionofthenextofkintoperformanautopsy.Anautopsymayincludecomplexlaboratorytests,soitmaybesomeweeksormonthsbeforeresultsareknown.

CME and WHSTheCME’sinvestigationisdifferentfromtheWHSinvestigation.TheWHSinvestigationis largely directed at finding the contributing factors and root cause of the fatality incident.TheCME’sjobistoinvestigatefrom a medical viewpoint, identifying the mannerandcauseofdeath.BoththeCMEandtheWHSLeadInvestigatorwillshareinformationbackandforthregardingtheirrespective investigations, in order to ensure both parties have a full understanding of relevant facts or factors that may have contributed to the death.

Dealings with the CMEInourexperience,theCME’sofficeisalwayswillingtospeakwiththefamily.Prepareyourquestionspriortocontactingtheoffice.TheCMEorhis/herrepresentativeswillverbally give you as much information as they are allowed to at that time.

About Fatality InquiriesFatalityinquiriesdirectlyrelatedtoworkplacedeathsareinfrequent.Thisis generally because most incidents are investigatedquitethoroughlybyWHS,aswell as police services.

Courtactionsarisingfromaworkplacefatalityhavetoberesolvedbeforeaninquirycanbeheld.TheCMEdoesnotreceivetheFatalityReportfromWHSuntilanyactionagainst the employer is concluded.

Whatifthemediacalls?Whensomeonediesinaworkplacefatalityincident, the media usually reports on the matter. Members of the media may contact you, your family or friends for a comment about what has happened.

The following may be helpful to you.

• Youdonothavetospeaktothemediaifyoudonotwantto.Simplytellthemthatyou have no comment.

• Ifyouchoosetospeaktothemedia,youmaywanttoappointaspokesperson.This may be a family member or a friend of the family.

• Alwaysaskthenameofthejournalistand what media outlet they represent. Taketheircontactnumbers.

• Don’tbowtopressure.Feelfreetotellthereporterthatyouwillcallthembackifyou’refeelingrushedoryouarenotreadytotalk,orifyou’vechangedyourmindandnolongerwanttospeaktothem.

• Befirmaboutwhatyoudoanddonotwanttodiscusswiththemedia.Talkwithyour family members and be very clear asafamilyaboutwhatisokaytosaypublicly.

• Avoidspeculationorguessing.

• Ifyouarenotcomfortablewiththequestion,don’tanswerit.

• Youcansetboundarieswiththepress–sticktowhatyou’recomfortablewith.

l Reviewthewilltoseeifthereareany instructions regarding funeral arrangements. You may wish to have yourlawyerpresent.Reviewanyotherimportantpapersfiledathome.Somepersonal possessions may not be mentionedintheWill.Takeyourtimeindecidingwhattokeepandwhattogiveto family or close friends.

l Ifthereisnowill,thisiscalledintestate.The estate will be distributed according to the law. You may wish to have your lawyer guide you through this process.

l AccordingtotheIntestateSuccessionAct, if there is no will the estate goes to thedeceased’slegallymarriedspouse,adult interdependent partner and other relatives in order of their blood relation. Ifthereisnowillandtherearenoknownrelatives,thePublicTrusteemayadminister the estate.

Death Certificate

l CertifiedcopiesoftheCertificateofDeathcanbeobtainedfromyourlocalRegistryOffice.Youmayneedseveralcopies in order to finalize a variety of matters, such as pensions, investments, real estate or life insurance.

Financial Affairs and Documentation

l Organize and update your financial affairs and official documents.

l Determineallofyourassetsandliabilities.

l Contacttheemployerofthedeceased,inregards to outstanding salary, employer or union insurance plans/benefits or othermatters.Allpastandpresentincomesourcesshouldbecheckedtoseeifthereareanysurvivor’sbenefits.

l Contactinsurers:home,car,life,other.l Contactfinancialinstitutions.l Checkformortgageinsuranceand

arrange to change mortgage documents.

l Obtain title documents for property, mortgages, bonds, debentures and any other investment certificates.

l Obtainprioryear’staxreturnsandfileany T1 returns for previous years. This shouldbedonewithinsixmonthsofthedate of death.
