Anthem earns win in water rate case

STAFF REPORTResidents on the east side of

I-17 in Anthem will reap the benefits of a nearly two-year long fight that culminated with the Arizona Corporation Commission voting to approve deconsolidation of the Anthem/Agua Fria Wastewater District on May 22.

The decision reversed a Recommended Opinion and Order issue to the Commission on April 10 by an administrative law judge that recommended against deconsolidation.

The deconsolidation will be phased in over three years effective January 1, 2013 and will bring relief to Anthem ratepayers of approximately $2.4 million a year after a three-year phase in.

Commissioners Brenda Burns, Sandra Kennedy, Paul Newman, Gary Pierce and Bob Stump met in an open meeting on May 22 at the Commission’s offices in downtown Phoenix. The Anthem Community Council’s legal team represented Anthem with the Board’s support and direction, and several Anthem residents were present wearing red shirts to show their support for deconsolidation. As a result, the following orders were approved:

An estimated crowd of 2,000 people turned out for Memorial Day ceremonies at the National Memorial Cemetery of Arizona on Monday.

Among a large contingent of veterans was Henry Burks, a one-time Anthem resident, who served in Vietnam.

Burks, a Marine veteran, who has been to the ceremony in previous years said he feels it’s an important gesture.

“It’s a nice chance to support the people that are fighting today and to show your appreciation for those that fought in past wars

and to honor those that gave their lives,” he said.

A ceremony that started with a flyover by World War II trainers and ended with the release of white doves included the reading of the Arizona serviceman that lost their lives in the last year while serving in Iraq and Afghanistan.

A handful of dog owners showed up to the May 23 Anthem Community Council meeting urging the board to add a dog park, what they feel is a pressing need to the community.

The reaction comes following a change in approach to what Anthem staff described as a problem with too many dog owners not having their pets on leashes in Anthem Community Park.

Community Executive Officer Jenna Kollings explained that simply having officers in the park offer reminders to offending pet owners weren’t making an impact. In efforts to gain compliance of rules that are posted throughout the park, and what is a Maricopa County law, officers were asked to step up enforcement.

“We felt as though we offered plenty of warnings,” Kollings said. “It’s one of the first rules on our list of rules posted throughout the park. We don’t have a goal of ticketing,

but it’s a liability issue if we don’t protect patrons of the park.”

The Maricopa County ordinance states that when a dog is taken outside its confined area it must be restrained on a leash that is no longer than six feet in length.

Kollings said the problem has been brought up on and off throughout her tenure.

Anthem board president Craig Boates said after spending a year largely just offering warnings without much in the way of results stepping up enforcement seemed the only viable option.

Anthem resident Sue Natalie, who moved to the community last August, spoke to the board after being ticketed.

In addition to having to pay a fine Natalie said she is facing a Class 2 misdemeanor, which she fears could endanger her ability to continue doing volunteer work.

“This has been a nightmare of an experience,” she said. “It doesn’t have to be like this. There are several areas in Anthem that could be converted to dog parks with little cost.”

Fred Natalie, Sue’s husband, pointed out the amenities offered in Anthem.

“We’ve got nine square miles of terrain, a 63 acre community park with 20 neighborhood pocket parks, a skate park, an inline hockey rink, hiking trails and yet not one area to exercise our pets,” he said. “We need something sooner rather than later. It’s a problem that will only get worse. People are getting ticketed daily.”

Kollings said the Community Planning and Development Committee, which meets at 9 a.m., the first Tuesday of each month in the Anthem Community Center, has a variety of projects they are looking at for the community from a second swimming pool, to additional sports fields, a performing arts venue among others and would welcome any input on how to prioritize them.

One of the board members also made mention of the dog park available in New River, just three miles up the road, on the frontage road east of I-17 between exit 229 and exit 232.

Barbara Windgrassen, the executive director of Jackass Acres K-9 Korral, and an Anthem resident said the park was built in New River in 2006 because efforts to get a park in Anthem went nowhere.

“We fought for two years, but felt we were getting stone-walled by Pulte,” she said. “For a year we had a temporary park on one of the baseball fields in the park, but that was all they ever were willing to do.”

Windgrassen said perhaps as many as half of the park’s 356 dog members reside in Anthem.

“We have a lot of New River folks, some from Cave Creek, Carefree down to Happy Valley and some that even come from Peoria,” she said. “We acquire shot records from people before they can becomes members so we know the dogs that are coming here are all healthy.”

Membership to the dog park will be $40 a year beginning in 2013. Members receive a gate code they punch in to unlock the gate to the park.

Windgrassen said the park, which features a side for dogs 30 pounds and under and a side for dogs of 31 pounds and up is open from dawn until dusk daily.

Windgrassen suggests the cost to build and maintain a dog park is more than some might expect, citing an Arizona Republic article from earlier this month (http://www.azcentral.com/community/scottsdale/aticles/2011/05/05/20110505sr-dogpark0504.html) in which it is reported that Scottsdale spends $100,000 annually on maintaining Chaparral dog park.

ProMusica Arizona (PMAZ) will head into its 10th season under new leadership as Adam Stich has been named Artistic Director for the organization

The PMAZ Board of Directors voted unanimously on May 22nd to offer the position to Stich following the resignation of

Co-Artistic Director and O r c h e s t r a Conductor, K e v i n Kozacek.

of Directors extends its appreciation to Kevin Kozacek for his dedication to building the Chorale and Orchestra over the past nine seasons. He is leaving to pursue other interests. Board Chair, Shirley Fiske comments,

“Kevin has been a constant in an organization that has seen many changes since its formation nine years ago. He has provided artistic leadership, and has helped us grow into a respected performing arts organization, one with the flexibility to successfully pull off both the Mozart Requiem and the Gilbert and Sullivan Pirates in one season. Both he and Adam deserve credit for the completion of a very ambitious and successful season.”

Stich joined PMAZ in June 2011 as Co-Artistic Director to lead the Chorale and Women’s Chamber Choir. He is also the Director of Choirs at Scottsdale Community College where he directs the Concert Choir and Jazz Vocal Ensemble and teaches classes in aural perception, conducting and the humanities.

Stich received his Bachelor of Arts degree with a double major in Music and Theatre from Rollins College in Winter Park, Fla. Upon completion of his undergraduate studies, he earned an assistantship at the University of South Carolina where he completed a Master of Music and a Doctorate of Musical Arts Conducting.

Prior to moving to Arizona, Stich spent two years as Instructor of Choral Music at Eastern Illinois University conducting the University Mixed Chorus and the Music Theatre and Opera Ensemble, and he taught Interacting with Music and Beginning Conducting. As a certified music teacher and committed educator, Dr. Stich spent five years in the public school system in South Carolina teaching beginning strings, band and various levels of choral ensembles.

The 2012-2013 PMAZ season will begin on August 25, 2012 with special guest Kate Campbell Stevenson performing her one-woman show, “From Petticoats to Power Suits.” The script was written by Ms. Stevenson and documents the changing role of women in American politics.

• A one-year delay (until June 1, 2013) in implementing a “winter average water usage” as the basis for calculating wastewater bills. EPCOR will be notifying all customers of this change and conducting workshops starting later this year to help customers understand the new wastewater billing approach, and to provide suggestions on conserving water.

• Deconsolidation of the Anthem Wastewater District. The new rate structure for Anthem customers, when fully implemented, will result in a total estimated savings of $2.4 million per year for the community, or roughly 25 percent (based on the test year 2008 data). The new rates will be phased in over 3 years, starting January 1, 2013.

Once implemented, Anthem residents on the east side of I-17 can expect the following changes in their water and wastewater rates over the next three years:

• Water rates will increase approximately 7 percent while wastewater rates will decrease by approximately eight percent starting in January

• Starting June 1, 2013 wastewater bills from June 1 until the following May 31 will be based on average water usage for preceding months of January, February and March.

• Starting Jan. 1, 2014 wastewater rates will decrease by approximately 8 percent.

• Starting Jan. 1, 2015 wastewater rates will decrease approximately 8 percent.Finally, as a result of the

recent decision, EPCOR was instructed to develop a series of proposals that would effectively consolidate all their districts for billing purposes. Anthem’s Utilities Panel (which will replace the Water Rate Case Panel) will be involved in this cooperative effort starting later this summer or early fall. The panel will consider all factors

that emerge from this effort before recommending to the Board a position pro or con regarding consolidation.

Anthem’s support of deconsolidation began in Dec. 2010 when the Commission approved a water rate increase of approximately 73 percent for Anthem that was to be phased-in over three years starting on Jan. 1, 2011. This compared to a requested immediate increase of more than 100 percent. At that time, the Commission also approved an interim 54 percent increase in Anthem wastewater rates (compared to a request of 81 percent), subject to a subsequent filing by the company to deconsolidate the Anthem Wastewater District from the Anthem/Agua Fria Wastewater District.

Drivers on I-17 should plan for an 18-mile detour overnight on Friday and overnight on June 8 as the Arizona Department of Transportation works to install a pedestrian bridge over the freeway near Happy Valley Road on the south side of the Central Arizona Project Canal.

I-17 and the frontage roads are scheduled to be closed one direction at a time over the next two weekends.

Northbound I-17 will be closed from Happy Valley Road and Loop 303 from 11:30 p.m., Friday until 4 a.m., Saturday.

Southbound I-17 will be closed from Loop 303 and Happy Valley Road from 11:30 p.m., June 8 until 4 a.m., June 9.

Northbound drivers should exit at Happy Valley Road westbound to Lake Pleasant Parkway northbound to Loop 303 eastbound to re-connect with I-17. Southbound drivers should exit at Loop 303 westbound to Lake Pleasant

Motorists that will be using the detour are reminded to be well rested and have enough fuel in their vehicle, as services are limited on the detour route.

The bridge project started last August with two separate pieces of the bridge being built on either side of the freeway. When connected it will stretch 891 feet

in length, going across I-17 and

the freeway’s frontage roads on

already in place at the crossing.

In athletics we had teams that won rivalry games, qualified for state competitions and we had 20 of our students earn athletic scholarships. And our band earned superior ratings at competitions throughout the state. May all of you always carry Jaguars pride in your heart.”

Michael Smith acknowledges that nothing he’d done in his career really prepared him for his current job.

Despite 15 years in the theater world as both a performer and director including work in London’s West End Smith said becoming an artistic director for Cirque du Soleil was a unique challenge.

“Absolutely it could be intimidating, but the reason it isn’t is because these people are so talented and have so much passion and commitment for what they are doing,” Smith said.

“Budget is a consideration with Cirque du Soleil, but you’re really only limited by your imagination and what they’re capable of athletically. We try to push the boundaries as far as possible.”

After spending the last year in Japan, KOOZA, which premiered in 2007, is coming to Glendale’s University of Phoenix Stadium for 33 performances beginning June 8 and running through July 15.

The show’s run has included 116 people from 23 different countries around the world.

“There’s a philosophy with this company that is different from the theater world where

you have a script and regardless of who the actors are you just copy and paste new names and they’re asked to play the same role,” he said. “With what we’re doing when we add a new person we look at it as an opportunity to have the show evolve. That’s how you keep a show that has been running for five years fresh.”

Having previously worked in the world of theater Smith said there is a big difference working for Cirque du Soleil.

“There is a different atmosphere than in theater,” he said. “People in theater are competing to get noticed so they’re competitive against each other. These are elite athletes. They really are competing with themselves to perfect their routine. Plus as athletes they have that teamwork mentality.”

Phoenix will be one of four stop on their U.S. tour, with University of Phoenix Stadium providing the lone west coast stop.

Smith said those attending KOOZA will be taken by a number of elements.

“The high level of acrobatics for one and the art of clowning for another,” he said. “But I think the interesting theme that plays out is the duality of people. Everybody has ambiguity because they have a good and a bad side to

their character.”Because they travel the

world the shows are written such that they don’t require an understanding of a language.

Burks said he was proud to recently be part of the American Legion Riders fundraiser, a motorcycle event, which will aid both the American Legion Legacy Foundation as well as the Pat Tillman Foundation.

“I think because of his extraordinary circumstances, leaving a million dollar a year job in professional sports, Tillman really raised awareness about the sacrifice soldiers make that some people

never really paid much attention to,” he said.

Burks said he is appreciative of how returning soldiers in today’s society are treated, a far cry from what he and his fellow Vietnam veterans received upon returning home.

“We were called baby killers,” he said. “For soldiers it was about effectively executing a mission. It wasn’t political. Whatever you think about the politics of a conflict you should at least have respect for what the soldiers are sacrificing.”

Just two hours after the

ceremony at the National Memorial Cemetery got under way in Phoenix, Anthem hosted its first Memorial Day Ceremony in front of the Anthem Veterans Memorial, in Anthem Community Park.

More than a 100 people turned out to hear a proclamation

by State Senator Lori Klein, an Anthem resident, congratulated Anthem on its efforts to make the memorial, which was dedicated in November, a state historical site.

“This is a day to offer heartfelt

sentiments to the men and women around the globe that have fought bravely to protect the greatest nation on Earth,” Klein said. “The ability to live free and be all we can be was built on the shoulder and the sacrifices of our veterans. For all the special occasions in your families lives that you’ve missed so that we could enjoy them with ours we are grateful.”

Ron Tucker, who led a team of Anthem residents in making the memorial a reality, and a veteran himself, also spoke.

“Today is about remembrance

of men and women that have fought in the name of interests greater than themselves. For that they deserve our thanks,” he said.

The Anthem Summer Skills Camp is open to ages 8 – 14 will run from 7 – 3 p.m., Monday – June 8.

The baseball camp will feature instruction on hitting fundamentals, throwing mechanics, bunting, infield and outfield play, base running, pitching drills, among others along with live games.

From 7 a.m. – 11 a.m. campers will be on the Anthem Community Park fields before spending the rest of the day in the community center with time for swimming and time in the gym. Players can get a week’s worth of instruction for $219 or pay $50 per day.

Boulder Creek High School will have four members of the class of 2012 take the field as Jaguars one final time as West Tunnell, David Real, Chase Wagner and Cameron Brendel will participate in post-season all-star games at Surprise Stadium.

West Tunnell, who has earned a scholarship to play baseball at the University of Baylor in the Fall, will play in the Academic All-Star game at 7 p.m., Friday at Surprise Stadium.

His teammates, David Real, Chase Wagner and Cameron Brendel, all of which have received athletic scholarships to play at Glendale Community College, will play in the Arizona Baseball Coaches Association All-Star Game at 7 p.m. on Sunday.

Real’s standout senior season saw the catcher earn first-team All-State honors at catcher while he and his trio

of teammates all earned All-Section honors with Wagner, an outfielder, joining Real on the first team and Brendel and Tunnell earning second team honors at pitcher and utility respectively.

At Cactus Shadows High School the Falcons softball program had a pair of seniors earn first team all-section honors as Megan Scarpulla and Krisin Hillier were recognized for their play.

Hillier, a four-year starter, hit .544 this season, a school record 11 home runs and a team best 29 RBIs. She also slugged 1.221 and had a .635 on base percentage. Scarpulla hit .481 on the season with 17 RBIs, good for second on the team.

The two seniors will continue as teammates next season when they attend Paradise Valley Community College on softball scholarships.

HIKINGCave Creek park hosts variety of activities

Cave Creek Regional Park recently released its event schedule for June that includes classes, hikes, an exercise series as well as equestrian opportunities. A complete list can be found at Maricopa.gov/parks/cave_creek. Plenty of water and proper hiking shoes are recommended for all events.

Friday: At 7:30 p.m. hikers will take an easy 1 mile hike to Clay Mine under the light of the moon. Once to the cave helmets will be passed out and candles will be used to enter the mine. Hike leaders will explain how the cave’s contents were once used to cure the locals common ailments. The hike will leave from the Group Campground. Flashlights are recommended although their use will be minimal if possible.

June 9: At 10 a.m. in the Nature Center a desert survival class will offer a discussion of basic techniques for staying alive in the desert. Topics will include safety, hydration, staying found, orienting and venomous creatures among others.

Spur Cross Ranch Conservation Area has a variety of hiking opportunities throughout the month of June. Hikes are $3 per person for those that don’t have a Spur Cross Ranch Conservation pass. Friday: At 7 a.m. a moderate, 2.5 mile hike will take participants through a portion of the Conservation Area. Participants need not be tri-athletes, just ordinary folks who would like to begin to add diversity to their walking program. The hike should last approximately 90 minutes.

Saturday: A moderate two-hour moonlight hike begins at 8 p.m. offering a different look at the Conservation area. Flashlights are recommended, although the use of them will be minimal.

Sunday: At 8 a.m. a moderate hike will take participants along Cottonwood Wash. Attendees will learn about the geology and streams of the Spur Corss region during a 2-hour walk with earth science author Thomas McGuire. The hike also will include a visit to an abandoned gold mine, Nutcracker Rock and a Hohokam rock art site.

Cactus Shadows hosts Secret Garden

The Secret Garden, an original Missoula Children’s Theatre musical theater production, is a retelling of a story of hope and celebration and all good things in life that will take place at 2:30 and 7 p.m., July 13 on the Main Stage of Cactus Shadows Fine Arts Center.

Mistress Mary Quite Contrary embarks on a journey from India to her uncle’s home in England. Along the way she makes friends with the Canadian Geese and the colorful Giant Bugs.

In time she learns to appreciate everything around her. The production is open to students in kindergarten through seniors in high school. Everyone will have a role. No advance preparation is necessary. The Missoula Children’s Theatre touring production is complete with costumes, scenery, props and makeup. LAKe PLeASANTThis is the hot spot for striped

bass. Mike McFarland, who guides for Hook Up Outfitters, said right now is the best striper bite of the year. Stripers are oriented around underwater reefs and humps in the main lake basin. Some of the best fishing is in 30 to 35 feet of water using frozen anchovies as bait. He said hundred-plus-fish mornings are common right now if you can find actively feeding stripers. “We caught and mostly kept around 400 stripers from a single spot on consecutive days and that spot is still producing,” he said.

Keep in mind there is no limit on stripers at Lake Pleasant and you are encouraged to catch and keep all you can to help the aquatic environment.

Fishing is also very good for bluegill and good for channel catfish.

Haven’t had many reports recently of the largemouth bass fishing, but it should be good as well. You might even encounter bass chasing shad at the surface, especially in the northern coves at first light. Typically, once the sun comes up, try the main points, islands and reefs in the large basin of the main lake for topwater action. You might even find some striped bass and white bass while working topwater.

This is a good time to fish for bluegills in the backs of

more rocky coves. Try meal worms or night crawlers two or three below bobbers. It’s a lot of fun for kids.

Don’t ignore the plentiful channel catfish. You should be able to load up on channel fishing any of the major lake points or flats using stink bait. Hot dogs, chicken liver and corn can all work well. If fishing from shore, consider using dough bait for the plentiful carp.

percent full. The Jojoba Boat Ramp is open.

This remains a fishing hot spot for 1- to 2-pound largemouth bass and is also doing well for crappie at times. Square-billed crankbaits are working well, or anything that resembles a crayfish from soft plastics to small crankbaits.

Expect to find active post-spawn bass in the shallows, especially the major lake points, islands and reefs. Drop shots, crankbaits and jigs are all working at times. Curly-tailed grubs on jig heads are a good bet here. There can also be sporadic topwater action for bass.

The night fishing for crappie last weekend as decent. Although most crappie are small, there are just enough slabbers to keep it interesting. Try live minnows fished under submersible lights. It’s also

possible to catch crappie during the day, especially at first light.

This is the leading edge of the really good flathead catfish bite. Try live bluegill or small carp as bait. Look for the deeper holes, especially uplake where there is a little current.

Bluegills are spawning. Try the backs of rocky coves using night crawlers or meal worms on light tackle.

As you can see from the picture above, the lower lake level means lots more opportunities for shore camping, especially around Bartlett Flats.

SAGUArOLake elevation is 1,524 feet

at 92 percent full. This is a fishing hot spot. Largemouth bass fishing is good to excellent for post-spawn fish. There are lots of 3- to 5-pound bass being caught.

Bass are in their aggressive post-spawn mode. Keep an eye out for surface boils -- it’s topwater time.

Recreational boating congestion is also increasing significantly -- get on the water at first light, or fishing at night.

As you will see in the angler report below, this is a good time to load up on spawning bluegill.

Saguaro is also a quality channel catfish lake. Try stink baits, hot dogs, chicken livers and the like. Also try chumming with corn.

Americans?As a former high school

teacher, I know one of the great challenges in education is to get teenagers interested in their country. Many of them take their freedom for granted and have no interest in even learning about what it takes to be a good citizen. They are too busy keeping up with the Kardashians to absorb John Adams.

So I have undertaken a new project: teaching a 13-year-old girl to care about being an American.

Lesson 1: Obey the rules. We start with open doors. The rule is that no door in the house is

c l o s e d u n l e s s there is a d r e s s i n g situat ion. The reason for the rule is to discourage

Internet chicanery and encourage lively conversation.

“I can’t have my door open, I just can’t,” the teen wails.

“What’s the problem?”“People are annoying. I don’t

want to see any people.”“Then look away when a

human being passes.”“YOU are SO annoying!”I know.Lesson 2: Discuss intelligent

things — and not just reality shows and music maniacs.

“Nobody wants to talk about politics. That’s boring!”

“The presidential election is boring?” I am sincerely curious about this one.

“No one cares about Obama and Romney.”

“Well, at least you know their names.”

“But I don’t want to talk about them.”

“I do just fine talking about them. Millions of people listen.”

“But you have no social skills. That’s why you’re on TV. I can’t be like you.”

She may have a point.Rule 3: Learn about your

country’s past.“My school says we have to

read your book ‘Killing Lincoln’ over the summer.” This soon-to-be eighth grader is nearly distraught. “I can’t believe it costs $20. What a ripoff!”

“It’s worth it. You’ll learn a lot about the greatest president

America has ever had.”“No one cares.”“So what do you guys

care about?”“’Harry Potter’ and ‘Glee.’”Sounds like the situation

is hopeless, right? Well, it’s difficult, no question. When I was a kid, there was boredom to contend with. Some days nothing was happening, so you might actually read a book about your country. Not anymore. The machines have made boredom obsolete. There are thousands of video games, chat opportunities and gossip sites — plus Facebook — and they’re all available if your fingers work. There is always action in cyberspace, much of it pernicious.

Therefore, you have to either force the urchins to pay attention to important things

like their country or bribe them to do it. There’s no other way unless you have a savant like Bill Clinton running around your house.

But educating America’s youth about the value of their country is second only to educating them about the value of their souls. So against all odds, I’m attempting to do it. Abe Lincoln would approve.

Who judges Judges?

D i d you know A r i z o n a has a full time office w h e r e p e o p l e can file complaints

against judges? The Arizona Commission on Judicial Conduct, in terms of personnel, is perhaps the smallest state agency. However, its importance cannot be overstated.

Article 6.1 of the Arizona Constitution establishes the legal authority for the conduct commission. It provides for the composition of the commission and establishes a framework for the suspension or removal of a judge. It also has a provision for retirements due to a disability.

The permanent staff for the commission includes an executive director, a staff attorney and an investigator. However, most of the decisions concerning judicial misconduct allegations are made by an

eleven member panel. The Chief Justice of the Arizona Supreme Court appoints six judges to serve: two from the court of appeals, two from superior court, one from a justice court and one from a city court. The State Bar of Arizona appoints two attorney members and the remaining three positions are members of the public. They are appointed by the Governor and are confirmed by the state senate. None of the panel members receive a salary for their service.

The commission neither screens nor appoints judges. Attorneys interested in becoming a superior court judge in either Maricopa or Pima County apply to a commission on trial court appointments. Those committees recommend three names to the governor for each opening and she must pick from that list of three. Superior court judges in other counties are elected and all justices of the peace are elected.

The commission accepts and investigates complaints of judicial misconduct and violations of judicial ethical standards. It is not an

appellate court, and if you simply disagree with a judge’s decision, then you should consider appealing your case. Nothing the commission does can change a judge’s decision.

If the commission determines that a judge violated the Arizona Code of Judicial Conduct, then it can issue an informal reprimand. For

more serious cases, and after a suspected judge has had an opportunity for a formal hearing, the commission can recommend that the Arizona Supreme Court remove the judge from office.

In addition to providing a forum for complaints against judges, the judicial conduct commissions help maintain

the balance between our Constitutional requirement for an independent judicial branch of government and a genuine need to hold individual judges accountable to the public.
