and places of worship always want to help the poor and needy. All human beings are inclined to help each other. In India, helping a needy man or a poor person is considered an action ordained by God.

The CSR has emerged as a necessity to create a legal framework and regularize the social activities undertaken by the companies, which is for their own survival and growth. They have to take actions which are beneficial towards the society. The companies cannot prosper without caring and helping people in their neighborhood.

Mr Dharam Vir also discussed the Government’s role of giving Income Tax benefits for philanthropic activities under sections 10A, 12 and 12A of Income Tax Act, 1961 for Trusts, Societies, Companies, Association of

Persons etc. They can receive donations under section 80G of Income Tax Act, and the donor gets income tax benefits.

In Companies Act, 2013 the Government institutionalized CSR under section 135. Under this section 135, every company, private limited or public limited which either has a net worth of Rs 500 crore or a turnover of Rs 1000 crore or net profit of Rs 5 crore needs to spend at least 2 percent of its average net profit for the immediately preceding three financial years on corporate social responsibility activities. Only activities in India would be considered for computing CSR expenditure. This section 135 will also keep the companies under check.

Contributions to any political party is not considered to be a CSR activity.
