College, Sipri Bazar, Jhansi- 284003, Uttar Pradesh dated 25/08/2009 is against the Order No. F. NRC/NCTE/F-7/UP-2088/141st Meeting/2009 dated 09/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “The list of appointed faculty as per NCTE Norms has not been submitted till date”. AND WHEREAS the Correspondent, Arya kanya P.G. College (hereinafter referred to as the appellant), preferred an appeal dated 25/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Keshbhan Singh, Member, Arya kanya P.G. College, Jhansi, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had submitted the faculty details to the University for its approval and the University gave its approval only for 3 lecturers and raised some objections with regard to the appointment of the remaining faculty. The appellant informed to NRC on 11.01.08 saying that the faculty appointment was under process. AND WHEREAS the Council noted the appellant has not yet appointed the faculty i.e. a Principal and 7 lecturers, in compliance to the letter of intent prior to grant of recognition dt. 24.01.07. In view of the above, the Council, came to the conclusion that there was no justification in accepting the appeal and that it should be rejected. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. WHEREAS the appeal of Arya kanya P.G. College, Sipri Bazar, Jhansi- 284003, Uttar Pradesh dated 25/08/2009 is against the Order No. F. NRC/NCTE/F-7/UP-2088/141st Meeting/2009 dated 09/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “The list of appointed faculty as per NCTE Norms has not been submitted till date”.

AND WHEREAS the Correspondent, Arya kanya P.G. College (hereinafter referred to as the appellant), preferred an appeal dated 25/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Keshbhan Singh, Member, Arya kanya P.G. College, Jhansi, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had submitted the faculty details to the University for its approval and the University gave its approval only for 3 lecturers and raised some objections with regard to the appointment of the remaining faculty. The appellant informed to NRC on 11.01.08 saying that the faculty appointment was under process.

AND WHEREAS the Council noted the appellant has not yet appointed the faculty i.e. a Principal and 7 lecturers, in compliance to the letter of intent prior to grant of recognition dt. 24.01.07. In view of the above, the Council, came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 09.07.09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of B.Ed Teacher Training College, Kashi College, Plot No. 269, Street No. Near Indore, Gas Godown, Dist- Khagaria, Bihar- 851205, dated 16/09/2009 is against the Order No. ERC/7-99.6(11).3/2009/1051 dated 05/08/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “Building completion certificate not submitted as per the NCTE norms”.

AND WHEREAS the Correspondent, B.Ed Teacher Training College (hereinafter referred to as the appellant), preferred an appeal dated 18/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Awadhesh Kumar, Manager, B.Ed Teacher Training College, Khagaria, Bihar presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the proposed institute fulfills all the criteria terms and conditions as laid down by the NCTE. The institute had also submitted the building completion certificate issued by the competent authority which was accepted by the ERC and being satisfied, the ERC had constitute a visiting team and the team had inspected the institute and submitted its report to ERC on 16.06.2009.

AND WHEREAS the Council noted that the VTR dt 16.06.09 was positive and it inter-alia indicated the availability of infrastructural & instructional facilities as per norms. It further noted that building completion certificate dt. 10.04.09 was issued by the competent civic authority i.e. PWD office and it stated the availability of 1629 sq. mt. of builtup area with the institution. In view of the above the Council came to the conclusion that there was enough justification in accepting the appeal, that it should be accepted.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside ERC’s order dated 05.08.09 and remand back the case to ERC to issue letter of intent prior to recognition under clause 7(9) of the NCTE Regulation, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby remands back the case of B.Ed Teacher Training College, Khagaria, Bihar to the ERC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Bijendra Teotia Memorial Mahavidyalaya, Khasra No. 745, Kalchina

Road, Manki. Modinagar, Ghaziabad, Uttar Pradesh dated 28/08/2009 is against the Order No.

F.NRC/NRC/F-7/UP-3061/2009/8981-8987 dated 28/08/09 of Northern Regional Committee refusing

recognition for conducting B.Ed course on the grounds “1) The size of the Multipurpose Hall is small.

2) The titles in the library are not as per NCTE norms. 3) The building in the present state cannot be

used running B.Ed Course. 4) Five computers are not sufficient for 100 students”.

AND WHEREAS the Correspondent, Bijendra Teotia Memorial Mahavidyalaya (hereinafter

referred to as the appellant), preferred an appeal dated 28/08/2009 to the National Council for

Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the

NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Satish Teotia, President, Bijendra Teotia Memorial Mahavidyalaya,

Modinagar, Ghaziabad, Uttar Pradesh presented the case of the appellant institution on 14.10.09.

In the appeal and during personal presentation it was submitted that the multipurpose hall size is

25 x 60.5 (1512.5 sq. ft.); Further they procured 15 more computers on 10.11.08 and now they have

20 computers in the ET lab. and library has more than 1000 titles and more than 3000 books; The

building has requisite infrastructure for conducting B.Ed programme.

AND WHEREAS the Council noted from the VTR dt 10.06.09 that the size of the multipurpose

hall is 1500 sq. ft. However, the Council observed by viewing the CD that the size of the

multipurpose hall is small. So there is no conformity with regard to the size of multipurpose hall. It

further noted that building completion certificate did not mention any area details and it was not

issued by competent civic authority. In view of the above the Council came to the conclusion that

there was enough justification in accepting the appeal, to be remanded to NRC for causing re-

inspection of the institution to ascertain the availability of the requisite infrastructure after obtaining

a payment of Rs. 40,000/- from the institution.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and

after considering oral arguments advanced during the hearing, the Council reached the

conclusion that there was adequate ground to accept the appeal and set aside NRC’s order

dated 28.08.09 and remand the case to NRC for causing re-inspection of the institution to

ascertain the availability of the requisite infrastructure after obtaining a payment of Rs. 40,000/-

from the institution and thereafter pass appropriate orders.

NOW THEREFORE, the Council hereby remands back the case of Bijendra Teotia Memorial Mahavidyalaya, Ghaziabad, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of D.V.M College of Education, Daula Road Sohna, Gurgaon, Haryana dated 28/08/2009 is against the Order No. F.NRC/NCTE/F-7/HR-1800/142 MEETING/2009/5709 dated 08/07/2009 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “1) CLU is not submitted. 2) FDRs of Rs.5 lakhs and Rs.3 lakhs are not for five years. 3) Building plan approved from competent authority is not submitted”.

AND WHEREAS the Correspondent, D.V.M College of Education (hereinafter referred to as the appellant), preferred an appeal dated 28/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Mohan Parkash, Secretary, D.V.M College of Education, Gurgaon, Haryana presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that CLU and building plan approved by the competent authority were submitted to NRC on 25.05.09 in compliance to the deficiency letter of NRC. it also created FDR’s Rs 5 Lakhs and Rs. 3 Lakhs for five years.

AND WHEREAS the Council noted that the appellant created FDR’s towards endowment fund and reserve fund for a period of five years in Corporation Bank, only on 26.08.09 that is after the date of refusal order. In view of the above, the Council therefore, came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 08.07.09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of Dayanand Danku Paraga Gyan Udal Mahavidyalaya, Village- Murlipur, Ghatampur, Kanpur Nagar, Uttar Pradesh dated 25/08/2009 is against the Order No. F. NRC/NCTE/F-73/UP-1762/147th Meeting 2009/ 8528-8534 dated 20/08/2009 of the Northern Regional Committee, refusing recognition for conducting B.P.Ed course on the grounds “1) The college admitted students to B.P.Ed course during academic sessions 2006-2007 and 2007-2008 without the recognition of NCTE and affiliating university also conducted the examination of students admitted during these academic session. 2) The affiliating university is directed to derecognize the degrees of the students of this college admitted during academic sessions 2006-2007 and 2007-2008 and intimation of having derecognize the degree should also be sent to NRC for information”.

AND WHEREAS the Correspondent, Dayanand Danku Paraga Gyan Udal Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 25/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Gopal Singh, President, Dayanand Danku Paraga Gyan Udal Mahavidyalaya, Kanpur Nagar, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant already fulfilled the requirements prescribed by the NCTE to start B.P.Ed course by the institute; On the basis of affiliation the institute admitted the students that were allotted by the university. In view of the future of the students who passed the course during session 2006-07 to 2008-09 (150 students) from the institute, the appellant requested to issue the recognition from the session 2006-07.

AND WHEREAS the Council noted that the appellant was issued conditional recognition on 26.07.06 directing the institution to appoint the staff, as per Regulations 2005. In compliance with this letter, the appellant appointed a Principal and 3 lecturers, in the year 2006, following the due procedure laid down in the norms. Further it appointed one more lecturer on 25.07.09, when NRC pointed out the deficit of a lecturer, vide its letter dt 05.07.09. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, with a direction to NRC to issue a formal recognition order in continuation to the conditional recognition order dt 26.07.06, so as to continue the recognition of the institution from the session 2006-07 onwards.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and NRC’s order dated 20.08.2009 was reversed, with direction to issue formal order in continuation of earlier order .

NOW THEREFORE, the Council hereby reverses the Order appealed against.

WHEREAS the appeal of Deomornoi B.Ed College, Po- Deomoroi, Dist- Darrang, Vill- Mangaladi, Assam- 784147 dated 14/09/2009 is against the Order No. ERC/7-98.5(1).1/2009/853 dated 26/07/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) As per the CD the building is having asbestos roof (temporary roof) which is not as per NCTE norms. 2) The institution has not appointed requisite number of teaching staff qualified as per NCTE norms”.

AND WHEREAS the Correspondent, Deomornoi B.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 18/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Jadab Chandra Sharma, Member, Deomornoi B.Ed College, Darrang Dist., Assam presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had already removed the asbestos roof and a report of the construction supervision committee dated 14.09.09 had been obtained to this effect. It was further submitted that it had appointed a Principal and seven lecturers, but one of the lecturers was not qualified as per norms and to fill up this vacancy they re-advertised and appointed a qualified lecturer on 16.08.09.

AND WHEREAS the Council examined the staff profile of the institution and found that a Principal and 7 lecturers appointed by the institution, were qualified as per norms. The appellant had removed the asbestos sheets. It further noted that the VTR dt 30.06.09 was positive and it inter-alia indicated the availability of adequate infrastructure and instructional facilities. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, and that it should be accepted.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and ERC’s order dated 26.07.2009 was reversed, with direction to issue the formal recognition order within 15 days of issue of the order.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

WHEREAS the appeal of Education College, Vill/PO- Basantpur, Dist-Murshidabad, West Bengal dated 21/08/2009 is against the Order No. ERC/7-99.6(II)(IS).2/1055 dated 05/08/2009 of the Eastern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “1) List of teaching staff not submitted by the institution in prescribed format. The institution has not submitted details of appointment of requisite no. of teaching staff as per the NCTE norms and not submitted the affidavits as per the prescribed format. 2) The downloaded copies of the website covering, inter alia, the details of the institution, its location, name of the course applied for with intake, availability of physical infrastructure (land, building, office, classrooms, and other facilities /amenities, instructional facilities laboratories, library, etc) and the particulars of their proposed teaching and non-teaching staff etc with photographs not submitted”.

AND WHEREAS the Correspondent, Education College (hereinafter referred to as the appellant), preferred an appeal dated 28/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Nazrul Islam, Chairman, Education College, Murshidabad, West Bengal presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had submitted the details of the appointed staff in the prescribed format, along with the individual staff members affidavits on 18.07.09; The staff had been selected by selection committee and the list was approved by the affiliating University. It was also submitted that visiting team itself down loaded from the website the information hosted on it and it also submitted staff particulars to VT.

AND WHEREAS the Council examined the staff profile and found that the requisite No. of staff, qualified as per norms, has been appointed by the institution and the staff profile details were submitted to the ERC. In view of the above the Council, came to a conclusion that there was enough justification in accepting the appeal, and that it should be accepted.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and ERC’s order dated 05.08.2009 was reversed, with direction to issue the formal recognition order within 15 days of issue of this order.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

AND WHEREAS the Correspondent, Institute of Professional Studies (hereinafter referred to as the appellant), preferred an appeal dated 31/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Satender Singh Secretary, Shri Ashok Garg, Administrator, Institute of Professional Studies, Ghaziabad, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the teaching faculty had been appointed following the due procedure laid down in the norms and staff list approved by the University along with the copies of advertisement was already submitted to NRC vide its letter dt 21.07.07 by Regd. Post.

AND WHEREAS the Council observed that appellant had appointed the teaching faculty as per the procedure of norms and send the details of staff to NRC by Regd. post. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal and remand the case to NRC for examination of the staff profile and thereafter pass appropriate orders.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate grounds to accept the appeal, set aside NRC’s order and remand the case to NRC, for examination of the staff profile so as to ensure that they have been appointed as per NCTE Norms and thereafter pass appropriate orders.

NOW THEREFORE, the Council hereby remands back the case of Institute of Professional Studies, Ghaziabad, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Jamtara College, Vill-Jamtara, Town- Jamtara, Jharkhand- 815351 dated 14/09/2009 is against the Order No. ERC/7-97.8.10/1s/2009/751(1) dated 23/07/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) certified copy of land documents not given. 2) Building completion certificate given by Block Development Officer not countersigned by the Engineer. 3) A copy of M.O.A/Bye-laws is not submitted, which is required to be submitted as provided in the instruction attached to prescribed application format. However the institution mentioned that it is a constituent unit of state university, but no supporting documents has been submitted. 4) The built up area is 577 sq.mtr. as per application form is less than required. Also as per, a certificate from Block Development Officer, Jamtara is only 4500 sq.ft. is less than required as per NCTE norms. 5) Approved building plan with plot no., khata no., khasra no., total area, builtup area from the competent state govt. authority has not been submitted”.

AND WHEREAS the Correspondent, Jamtara College (hereinafter referred to as the appellant), preferred an appeal dated 18/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Nilesh Kumar, Prof-in-charge, Jamtara College, Jamtara, Jharkhand presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the new building for exclusive use of B.Ed course having built up area of 4500 sq.ft. had been constructed on 20 acres of land with a back up of additional 16816 sq.ft. built up area for use of laboratory work, library and for conducting classes also. So, a total of 21316 sq. ft. of builtup area was available; Building Completion certificate issued by B.D.O. is countersigned by the Engineer; It submitted to ERC certified copy of the land documents in Hindi version and a notarized copy of it in English version and also Bye-laws of the society.

AND WHEREAS the Council noted that the appellant had earmarked only 4,500 sq. ft. of building exclusively for B.Ed programme and 16816 sq. ft. of built-up space would be shard with general degree courses, which was not acceptable as per norms. In view of the above, the Council came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and hence should be rejected. Accordingly, the appeal was rejected and ERC’s order dated 23.07.09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of L.T.R. Institute of Technology, Vill- Kurali, Baghpat Road, Meerut, Uttar Pradesh dated 24/08/2009 is against the Order No. F.NRC/NCTE/F-3/UP-2521/140 MEETING/2009/2544 dated 18/05/2009 of the Northern Regional Committee, refusing recognition for conducting B.P.Ed course on the grounds “1) Khasra numbers have not been mentioned in the building plan. 2) The total land area as per VT and CLU does not match. 3) Copy of the letter from the affiliating body nominating a member for the selection committee is not submitted. 4) The selection committee was not constituted as per NCTE norms. 5) Affidavit on Rs.100 stamp paper from the management of the institution about the staff on the prescribed format is not submitted”.

AND WHEREAS Shri Anil Gupta, Manager, L.T.R. Institute of Technology, Meerut, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant after fulfilling the deficiencies, informed NRC, well before the date of 144th Meeting of NRC held on 12-14th July’09.

AND WHEREAS the Council noted that NRC caused inspection of the institution on 09.04.09 and VTR reported that the appellant was in possession of 12540 sq. mt of land for conducting the existing B.Ed and the proposed B.P.Ed programme and this land was inadequate as per NCTE norms. Further a certificate issued by an architect on 12.05.09 also stated the availability of 12540 sq. mt. of land only and this area was also indicated in the building plan. In view of the above, the Council, came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 18.05.09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of M.V.M.M. Degree College, Firozabad, Uttar Pradesh dated 24/08/2009 is against the Order No. F.NRC/NCTE/F-7/UP-3371/141 MEETING/2009/5340 dated 02/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “Khasra number mentioned in the certificate issue by Tehsildar and in the CLU is not mentioned on the building plan / map. Hence, mortgaged deficiency still stands”.

AND WHEREAS Shri Vijay Pratap Singh, Joint Secretary, M.V.M.M. Degree College, Firozabad, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the total land area in the possession of the appellant, on ownership basis, is 2.403 Hect. or 24030 sq.mtr. Out of this total land area 1.043 Hec or 9830 sq. mts. of land was mortgaged in the favour of Regional Higher Education officer, Agra and the remaining land area of 0.36 Hect. or 3600 sq.mtr. was free from all encumbrances and the building for conduct of B.Ed course had been built upon this particular piece of land of 3600 sq.mtr. Thus it fulfilled the norms of NCTE that the land and building should be free from all encumbrances. A certificate issued by Tehsildar, Tehsil Shikihabad, Distt.Firozabad (U.P) certifying that the land area of 0.36 Hect. or 3600sq.mtr. alongwith pther land, recorded in the name of appellant in the revenue records, has not been mortgaged by the appellant to the committee. The building for conduct of B.Ed course had been built on this particular piece of land. The omission in mentioning the Khasra no.165 on the approved plan was a mere mistake and is not an act committed intentionally.

AND WHEREAS the Council noted that the appellant was in possession of 2.043 Hect of land at property bearing Kh. No. 165, as indicated in the certificate issued by Tehsildar and CLU. Further Tehsildar vide letter dt 25.04.09 certified that 0.360 Hect of land has not been mortgaged. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, to be remanded to NRC for causing inspection of the institution, to ascertain the availability of infrastructure and instructional facilities and also to verify whether the proposed B.Ed college building is as per norms and located on the non-mortgaged piece of land.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 02-07-09 and remand the case to NRC for causing inspection of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms within one month of issue of this order and thereafter pass appropriate order.

NOW THEREFORE, the Council hereby remands back the case of M.V.M.M. Degree College, Firozabad, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

AND WHEREAS Shri Bajrangi Singh, President, Magadh Teacher's Training (B.Ed College), Aurangabad, Bihar presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had appointed Mr. Akhil Chandra Biswal, a retired person as principal, on contractual basis for a year and he tendered his resignation. Mr. Tribhuwan Rai, from the waiting list of the selection panel has been appointed as principal now. It submitted to ERC downloaded copies from the website on 18.06.09, 19.05.09 and also on 14.07.09.

AND WHEREAS the Council noted that Mr. Akhil Chandra Biswal who had been appointed as principal was also, eligible as per norms. However the appellant has now appointed a permanent regular principal as per norms. . In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, and that it should be accepted.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough justification to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and ERC’s order dated 04.08.2009 was reversed, with direction to ERC, to issue the recognition order within 15 days of issue of its order.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

WHEREAS the appeal of Mankundu B.Ed College, Hoogly Dist., West Bengal dated 18/09/2009 is against the Order No. ERC/7-99.6(II)(1S).4/2009/989 dated 04/08/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) Requisite No. of teachers are not qualified as per the NCTE norms. No supporting documents with regard to teaching qualifications such as mark sheet etc. not submitted. 2) Downloaded copies from the website not submitted as per the NCTE norms”.

AND WHEREAS Shri Subhabrata Majumdar, Secretary, Mankundu B.Ed College, Hoogly Dist., West Bengal presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the inspection team was very much satisfied with the faculty, the appellant submitted its reply on 24.07.09, in response to the ERCs notice dt. 18.07.09. Suffice to say that no opportunity is given to the appellant to explain the query regarding the alleged refusal ground.

AND WHEREAS the Council noted that the institution was issued a show cause notice on 18.07.09 after examining the inspection report. It had not been issued a letter of intent prior to grant of recognition and it is untenable for refusing the recognition on the above grounds. It also noted that the appellant had already taken the action towards appointment of the staff. The Council therefore, came to the conclusion that there was enough justification in accepting the appeal, to be remanded to ERC for issuing a letter of intent prior to grant of recognition under clause 7(9) of NCTE Regulations within 15 days.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside ERC’s order dated 04.08.09 and remand back the case to ERC to issue letter of intent prior to recognition under clause 7(9) of the NCTE Regulation, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby remands back the case of Mankundu B.Ed College, Hoogly Dist., West Bengal to the ERC, NCTE, for necessary action as indicated above.

In the appeal and during personal presentation it was submitted that ERC remained non-committed on the issue of the principal till the date of refusal order 06.08.09. It had earlier appointed a retired qualified person as principal. When ERC did not accept this, then the institution through another advertisement has already identified; a qualified person for the post of principal on regular basis.

AND WHEREAS the Council noted that ERC had not brought to the notice of the appellant, the grounds of refusal. The institution has already taken measures for replacement of the earlier appointed principal. In view of the above, the Council came to the conclusion that there was enough justification in accepting the appeal and that it should be accepted.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and ERC’s order dated 06.08.2009 was reversed, with direction to issue of the order of recognition, to the institution within 15 days of issue of this order.

WHEREAS the appeal of Nandanpur Teacher's Training Institute, Midanapore, West Bengal dated 25/08/2009 is against the Order No. ERC/7.99.6(1).14/2009/965(1) dated 04/08/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) Requisite no. of teaching staff are not qualified as per the NCTE norms. 2) The institution has not submitted the downloaded copies of affidavit of Rs.100/- selection committee, Rs.10/- reg. Individual teaching staff, list of teaching staff in prescribed format”.

AND WHEREAS Shri Arup Kr. Bhaumik Secretary, Nandanpur Teacher's Training Institute, Midanapore, West Bengal presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that The duly formed selection committee of the appellant had conducted an interview on 11/07/09 and made a panel for recruitment of I Principal and 7 Lecturers. A per NCTE norms, the said Principal and 7 Lecturers have furnished their respective affidavits on non-judicial stamp paper of Rs.10/- each, duly notarized containing the details of their respective academic career. The institution had submitted downloaded copies of all the other details from the website www.nandapurtti.org but failed to submit the downloaded copies as asked in reason no.(ii), since the fact was not known to them. Moreover, the institution also studied the mandatory disclosure as available from the website of NCTE, but did not find any clause to publish and to submit a copy from the website of the materials asked in reason(ii). Now to avoid all the future controversies and complications they have submitted said downloaded copies of affidavit of 100/- selection committee, Rs.10/- reg. individual teaching staff for consideration of the appeal Committee. The appellant also submitted an under-taking stating that they would appoint a qualified principal within 15 days.

AND WHEREAS the Council examined the staff profile submitted by the appellant and found that 7 lecturers are qualified as per norms; whereas the principal DR. Sanga Mitra Maite, though qualified, was not having requisite experience as per norms. Looking into the problem of Teacher Education in the state of West Bengal, the Council came to a conclusion that there was enough justification in accepting the appeal, with the direction to the institution, to appoint a qualified, experienced principal as per norms. within a Month.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and ERC’s order dated 26.07.2009 was reversed, with a direction to the institution to appoint a principal as per norms within a month and submit its compliance report to ERC.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

WHEREAS the appeal of Rabindra Nath Thakur Primary Teachers Training Institute, Purba Medinipur , West Bengal dated 27/08/2009 is against the Order No. ERC/7.99.4(1).11/2009/983(1) dated 04/08/2009 of the Eastern Regional Committee, refusing recognition for conducting ETE (D.Ed) course on the grounds “Teaching staff are not qualified as per the NCTE norms”.

AND WHEREAS Shri Santanubrata Sahoo, Member, Rabindra Nath Thakur Primary Teachers Training Institute, Purba Medinipur, West Bengal presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that it has appointed a principal and 5 lecturers qualified as per norms. The principal is having 10 years teaching experience in B.Ed College, which is more than five years of experience of teaching in elementary teacher education.

AND WHEREAS the Council examined the staff profile and found that a Principal and five lecturers are qualified as per norms. It however noted that the principal is not having experiences as per requirement. Looking into the problem of primary teacher education in West Bengal, the Council was of the view that the appeal deserved to be accepted, with the direction to the institution to appoint a qualified and experienced principal as per norms within six months.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was enough ground to accept the appeal and ERC’s order dated 04.08.09 was reversed, with the direction to ERC to issue formal recognition order within 15 days of issue of this order, with an instruction to the institution to appoint a qualified and experienced principal as per norms within six months and send its compliance report to ERC.

WHEREAS the appeal of Shri Krishna College of Education, Fizorabad, Uttar Pradesh dated 24/08/2009 is against the Order No. F.NRC/NCTE/F-7/UP-3394/141 MEETING/2009/5506 dated 03/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) Building plan is approved by Gram Pradhan without the resolution of Gram Panchayat. 2) Earmarked building plan is not submitted. 3) Application is not filed completely”.

AND WHEREAS Shri Vijay Pratap Singh, Joint Secretary, Shri Krishna College of Education, Fizorabad, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that it had already submitted the building plan approved by Gram Panchayat office. Resolution of the Gram Panchayat dt 20.10.08 was not submitted to NRC, as this was not demanded in the deficiency letter of NRC; Further the college had been exclusively established for conducting the B.Ed course. With regard to point 3. it was submitted that few entries might have been left blank by mistake.

AND WHEREAS the Council noted that the building plan was approved by Shri Govind village Panchayat office head, and the resolution of Gram Panchayat dt 20.10.08 is also available in NRC’s file. It further noted that the institution had not been conducting any other course in the premises proposed for B.Ed programme, so there was no need of earmarking of the builtup area. The Council therefore came to the conclusion that the appeal deserved to be accepted and the case be remanded to NRC for examining the application and point out the unfilled columns of the application to the institution and taking further necessary action.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 03-07-09 and remand back the case to NRC for examining the application and point out the unfilled columns of the application to the institution and taking further necessary action.

NOW THEREFORE, the Council hereby remands back the case of Shri Krishna College of Education, Fizorabad, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Shri Sai College of Education and Technology, Meerut, Uttar Pradesh dated 19/08/2009 is against the Order No. F.NRC/NCTE/F73/UP-2802/143 MEETING/2009/6707 dated 23/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “ 1) The date of birth mentioned in the bio-data of Dr. G.S. Verma is 30/06/1949 while as per class X certificate the date of birth is 30/06/1945. Thus, false information was given. 2) Signature of university nominee, that is, Prof.Sureksha Pal on two minutes of the selection committee of the same date is different”.

AND WHEREAS the Correspondent, Shri Sai College Of Education And Technology (hereinafter referred to as the appellant), preferred an appeal dated 26/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri K.P. Mavi Chairman & Dr. O.D. Sharma Director, Shri Sai College Of Education And Technology, Meerut, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that they did not submit any bio-data of Dr.G.S. Verma where the birth date is mentioned as 30.06.1949. The age of Dr.G.S. Verma is less than 65 years and by considering both the birth date mentioned in refusal letter, then why, they would give false information. Dr.G.S. Verma has submitted his bio-data to the institute and the same was forwarded to the NRC. Thus, there was no mistake on the part of the institute. They did not submit wrong documents for selection of faculty where the signature of the expert is different in the same date. It is also needless to mention here that before taking the decision in this regard, the NRC should confirm from the C.C.S.University, Meerut as well as from the signature expert.

AND WHEREAS the Council noted that DR. G.S. Verma’s DOB is 1945, as authenticated in his class X certificate. It further noted that signature of Prof. Surakrha Pal is same, on both the documents. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, to be remanded to NRC for issuing letter of intent, prior to grant of recognition.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside NRC’s order dated 23.07.09 and remand back the case to NRC to issue letter of intent prior to recognition under clause 7(9) of the NCTE Regulation, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby remands back the case of Shri Sai College Of Education And Technology, Meerut, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Smt. Genda Devi Mahavidyalaya, Allipur, Barwara, Post. Sirawali, Kasganj, Etah,, Uttar Pradesh dated 18/09/2009 is against the Order No. F.NRC/NCTE/F73/UP - 3001/143rd Meeting/2009/6602 dated 22/07/2009 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “The university letter regarding university expert has not been submitted. Thus, the selection committee was not valid”.

AND WHEREAS Shri Vijay Singh Jain, Administrator, Shri Pankaj Singh, Clerk, Smt. Genda Devi Mahavidyalaya, Kanshiram , Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the selection committee was duly constituted as per University norms and the same was communicated to the university. The minutes of 137th meeting of NRC showed that the college was required to submit experience certificates of selected professor, reader and other faculty members which, on the face is the approval of the selection committee and the NRC cannot raise any doubt over the selection committee in subsequent meetings. The NRC was not correct in holding that the selection committee was not valid, only because the university letter regarding the university expert was not submitted. A perusal of the contents of the letter given by the university, gives an impression that as per the university, an expert can only be deputed to the institution after the recognition is granted by the NCTE to such institution and therefore, the appellant has no other remedy except to obtain the said recognition first and then complete the other formalities as per norms.

AND WHEREAS the Council noted that as per the provisions of the Clause 7(9) Regulation of NCTE, an institution has to select and appoint staff following the due selection procedure involving university. In view of the above, the Council came to a conclusion that NRC has refused recognition on a valid ground and hence the appeal deserves to be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 22.07.09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

AND WHEREAS the Correspondent, Solanki B.Ed Teacher's Training College (hereinafter referred to as the appellant), preferred an appeal dated 25/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Ramakant Singh, Secretary & Shri Upendra Mishra, Advisor, Solanki B.Ed Teacher's Training College , Saran, Bihar presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that Mr. Giri had already made a declaration on an affidavit that he never worked in Indira Singh B.Ed College and he had been working with the appellants institution since 16.08.08 as principal.

AND WHEREAS the Council noted that Mr. Giri had not been in the acquaintance register of the Indira Singh B.Ed College. It further noted that the appointment of teaching faculty (a Principal and 7 lecturers) was in order. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, to be remanded to ERC, for issue of letter of intent prior of grant of recognition under clause 7(9) of Regulations 2007, immediately and thereafter to issue formal recognition order within 15 days, after obtaining the staff profile.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside ERC’s order dated 04.08.09 and remand back the case to ERC to issue letter of intent prior to recognition under clause 7(9) of the NCTE Regulations immediately and thereafter to issue formal recognition order within 15 days, after obtaining the staff profile.

NOW THEREFORE, the Council hereby remands back the case of Solanki B.Ed Teacher's Training College , Saran, Bihar to the ERC, NCTE, for necessary action as indicated above.

AND WHEREAS the Correspondent, Sri G.S. Patil D.Ed College (Group Education Committee) (hereinafter referred to as the appellant), preferred an appeal dated 24/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Manjappa R. Chavan Jr. Asst., Sri G.S. Patil D.Ed College (Group Education Committee), Dharawad, Karnataka presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant established exclusive infrastructure and instructional facilities for the proposed D.Ed Course and it had shifted P.U. College to some other premises on 06.07.09. Further the management had submitted original land documents to SRC.

AND WHEREAS the Council noted that the appellant was conducting PU college, in the building of the D.Ed College and it shifted the PU college, form the D.Ed College building only on 06.07.09 after the date of inspection. Even VT in its report dt 16.04.09 stated that PU college was being run in the D.Ed building. In view of the above, the Council, came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. Accordingly, the appeal was rejected and SRC’s order dated 04.08.09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

AND WHEREAS the Correspondent, Sri Gurulingeshwara D.Ed College (Sri Gurulingeshwara Vidyavardhaka Sangha) (hereinafter referred to as the appellant), preferred an appeal dated 18/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri M.P.M. Revanasiddaiah, Principal, Sri Gurulingeshwara D.Ed College (Sri Gurulingeshwara Vidyavardhaka Sangha), Bagalkot, Karnataka presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the management is running High school & PU college in the same campus. The management has constructed separate buildings for High School and PU college. The management has constructed a separate R.C.C building at the cost of nearly 48 lakhs for the proposed Sri Gurulingeshwara D.Ed College and the total built up area is 17,787 sq.ft.(1652.47 sq.mtr) which is clearly mentioned in the inspection report also and this area is adequate as per NCTE norms for D.Ed course. The approved building plan and building completion certificates are also submitted in reply to the SRC notice dt. 05/05/09, on 11.05.09. The management had already submitted letters from the concerned Govt. authorities i.e. Block Educational Officer, Bagalkot regarding separate building for High School and Deputy Director of Pre University Education and Vocational Education Board, Bagalkot for PU College to the NCTE. In both certificates it is clearly mentioned that the proposed D.Ed college is not functioning in High School or in PU college building and the management has constructed a separate RCC building for the proposed D.Ed college, .Govt. of Karnataka has granted 3.13 acres of land on free of cost on long term lease basis for the purpose of starting schools and college to impart education at the rural level. The management provided adequate and suitable furniture and equipments for labs and adequate no. of books, journals and encyclopedia for library and hence the management has provided adequate infrastructural and instructional facilities for the proposed D.Ed course. The management has submitted VCD and photos indicating separate buildings for proposed D.Ed course, PU college and High School to visiting team members at the time of inspection.

AND WHEREAS the Council noted that there are 3 separate building plans for the school, PU College and D.Ed College. Further Block Education Officer had certified that there are separate buildings for school and PU College; The trust was in possession of requisite land on lease basis from Govt. In view of the above the Council came to the conclusion that there was enough justification in accepting the appeal and that it should be accepted.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside SRC’s order dated 28.07.09 and remand back the case to SRC to issue letter of intent prior to grant of

recognition under clause 7(9) of the NCTE Regulation, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby remands back the case of Sri Gurulingeshwara D.Ed College (Sri Gurulingeshwara Vidyavardhaka Sangha), Bagalkot, Karnataka to the SRC, NCTE, for necessary action as indicated above.

AND WHEREAS Shri Nasim Ahmad, Secretary & Shri M.D. Samsuddin, Member, Taiyab Memorial Teacher's Training Institute, Dhanbad, Jharkhand presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the institution had already submitted attested photocopies of the land documents.

AND WHEREAS the Council perused the original land document and noted from the sale deed dt 16.10.08 that 3 acre of land was in possession of the institution, on ownership basis. In view of the above the Council came to the conclusion that there was enough justification in accepting the appeal, to be remanded to ERC for causing inspection of the institution and thereafter pass appropriate orders. Further the institution is directed to submit certified copy of the land document to ERC.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside ERC’s order dated 06-08-09 and remand the case to ERC for causing inspection of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms within one month of issue of this order and thereafter pass appropriate order.

NOW THEREFORE, the Council hereby remands back the case of Taiyab Memorial Teacher's Training Institute, Dhanbad, Jharkhand to the ERC, NCTE, for necessary action as indicated above.

O R D E R WHEREAS the appeal of V.T College of Education, Meerut, Uttar Pradesh dated 28/08/2009 is against the Order No. F.NRC/NCTE/F-3/UP-2946/144 MEETING/2009/6134 dated 22/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “ As per new CD submitted by the institution the deficiencies regarding staff room, laboratories, Multipurpose Hall, etc. still exist”. AND WHEREAS the Correspondent, V.T College of Education (hereinafter referred to as the appellant), preferred an appeal dated 28/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Davendra Kumar, Secretary & Shri Priraj Mohan Shama, Employee, V.TCollege of Education, Meerut, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the NRC in its 144th meeting viewed the C.D.. and observed some deficiencies, accordingly it issued a show cause notice to the appellant on 22.07.09. In reply to that notice, the appellant removed all the deficiencies and submitted a new C.D., NRC examined this and found that the deficiencies still existed . But nothing was resolved on the basis of VT report. It was further submitted that the sizes of multi purpose hall, lecture halls, labs and staff rooms as per norms and this may be verified from the building competition certificate. AND WHEREAS the Council noted that at the time of inspection it was having 1200 sq. ft. size of multipurpose hall and after the show cause notice it reconstructed a bigger multipurpose hall by removing internal wall. In view of the above, the Council came to the conclusion that there was no justification in accepting the appeal and that it should be rejected. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. WHEREAS the appeal of Vidya vikas Educational Trust, Mysore Dist., Karnataka dated 30/07/2009 is against the Order No. F.SRC/NCTE/2009/M.ED/REF/13252 dated 29/05/2009 of the Southern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “1) Exclusive building for the existing B.Ed and Proposed M.Ed course is under construction. 2) The management is running existing B.Ed college at the 4th floor of the Engineering college managed by the same management. As per NCTE Regulations, 2007 the management has to provide exclusive building and infrastructural and instructional facilities for establishment of the teacher education colleges. 3) No exclusive land and built up area is available for proposed M.Ed course. As per regulations, para 8(7), no institution be granted recognition unless it is in possession of required land on the date of application. 4) Further, the Council decided to cause inspection for shifting of existing B.Ed course to its permanent premises after completion of building and submission of building completion certificate. The institution has to pay Rs.40,000/- D.D. for shifting of premises”.

AND WHEREAS the Correspondent, Vidya vikas Educational Trust (hereinafter referred to as the appellant), preferred an appeal dated 30/07/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Kaveesh Gowdav, Secretary, Vidya Vikas Educational Trust, Mysore Dist., Karnataka presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that it had already been conducting B.Ed & D.Ed courses and proposed for M.Ed programme. It was at the initial time of obtaining recognition, the B.Ed college was accommodated in the building constructed for integrated campus. Trust is having 65 acres of land in one place. To comply with the revised regulations and norms and standards of NCTE, 4 acres of land was earmarked exclusively for B.Ed and M.Ed courses whereas the land requirement as per NCTE norms is only 2500 sq.mtr. The management has not only constructed exclusive 3012.22 sq.mtr of building and is also developing exclusive play ground and courts of tennis, basket ball etc for the benefit of the B.Ed and M.Ed students. The management has started the B.Ed college from the academic session 2004-05 in the own building itself. The SRC is making a new point of shifting of the institution to its own premises, for which the institution has to pay Rs 40000/- towards the inspection fee. If SRC intends to verify the infrastructural and instructional facilities of B.Ed course, it has to depute team on its own.

AND WHEREAS the Council noted that on the day of inspection the teacher education programmes were being organised in a building of an engineering college. It later constructed an exclusive building with a built-up area of 3012 sq. mt on a earmarked land of 4 ½ acre. In view of the above the Council came to a conclusion that there was no justification in accepting the appeal and that it should be rejected. Further the institution is directed to apply to SRC for inspection of its new premises, along with a fee of Rs. 40,000/- for shifting the existing teacher education programmes the B.Ed and D.Ed course.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected.

WHEREAS the appeal of Vivekananda Institute of Education (Vivekananda Vidyapeeth), Raipur, Chhatisgarh dated 14/09/2009 is against the Order No. No.WRC/APW07436/725028/723093/122nd/2009/158016 dated 24/07/2009 of the Western Regional Committee, refusing recognition for conducting M.Ed (H/E) (Co. Ed) course on the grounds “Land is on lease basis which is not valid as per the NCTE norms”.

AND WHEREAS the Correspondent, Vivekananda Institute of Education (Vivekananda Vidyapeeth) (hereinafter referred to as the appellant), preferred an appeal dated 18/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri R. Chanti Babu, Representative, Vivekananda Institute of Education (Vivekananda Vidyapeeth), Raipur, Chhatisgarh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the institution has got the land from the Govt. on permanent lease. It is further submitted that the NCTE has already given recognition to run B.Ed course on the provision of the NCTE Regulation but arbitrarily the provision 8(7) of Regulation has been violated and they have been deprived of the recognition for new M.Ed course.

AND WHEREAS the Council noted that the trust was in possession of 14 acre of land, on lease basis from Govt. and this is acceptable as per norms. the Council therefore came to a conclusion that there was enough justification in accepting the appeal to be remanded to WRC for causing inspection of the institution and thereafter pass appropriate order.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside WRC’s order dated 24-07-09 and remand the case to WRC for causing inspection of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms within one month of issue of this order and thereafter pass appropriate order.

NOW THEREFORE, the Council hereby remands back the case of Vivekananda Institute of Education (Vivekananda Vidyapeeth), Raipur, Chhatisgarh to the WRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Amar Shaheed Kanchan Singh Mahavidyalaya, Fatehpur, Uttar

Pradesh dated 01/09/2009 is against the Order No. F.NRC/NCTE/F-7/UP-3133/139 Meeting/2009/7039 dated 27/07/2009 of the Northern Regional Committee, refusing recognition for conducting M.P.Ed course on the grounds “1) CLU submitted is not on prescribed format of State Government. 2) The building plan submitted is signed by Gram Pradhan without the resolution of Gram Panchayat”.

AND WHEREAS the Correspondent, Amar Shaheed Kanchan Singh Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 01/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Dayal Sharan Singh, Manager & Shri Amresh Kumar, Director, Amar Shaheed Kanchan Singh Mahavidyalaya, Fatehpur, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant college had already been granted recognition for B.Ed(200 intake), M.Ed(25 intake) and B.P.Ed(50 intake). and the recognitions for these existing teacher education were granted on the basis of the copy of approved building plan and building completion certificate. As such refusal of the application for M.P.Ed on the basis of the so called, "CLU submitted is not on prescribed format of State Government and the building plan submitted is signed by Gram Pradhan without the resolution of Gram Panchayat" has not been justified.

AND WHEREAS the Council noted it is an existing institution conducting multiple teacher education programmes- B.Ed , M.Ed & B.P.Ed and now proposed for M.P.Ed programme in the same premises. It further noted that refusal grounds stated in the impugned order were not pointed out earlier in the NRC’s deficiency letter dt 15.11.08. in view of the above, the Council therefore came to a conclusion that there was enough justification in accepting the appeal, to be remanded to NRC for causing inspection of the institution and thereafter pass appropriate order.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 27-07-09 and remand the case to NRC for causing inspection of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms within one month of issue of this order and thereafter pass appropriate order.

WHEREAS the appeal of Amtala B.Ed College, Murshidabad, West Bengal dated 07/07/2009 is against the Order No. ERC/7-95.8.83/2009/16737(1) dated 19/05/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) As per letter received by the institution on 06.04.09 it is observed that the building has been taken on rent basis for running B.Ed college which has been registered in the office of Addl.District Sub-Register, Amtala, Murishdabad. 2) As per the affidavit and as per the land document submitted it is observed that the land is on lease from private party. 3) Building completion certificate from the competent authority mentioning the total area and built up area and plot No. has not been submitted. 4) Building plan not approved and total area is not mentioned in the building plan”.

AND WHEREAS the Correspondent, Amtala B.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 10/07/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Tapas Roy, Director & Shri Ashish Kumar Ghosh, Member, Amtala B.Ed College, Murshidabad, West Bengal presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had taken 2676 sq. mts of land on 99 years lease from a private party located at Kh. No. 2267 and the building with a builtup area 1569 sq. mts existing on this land had been taken on rent.

AND WHEREAS the Council noted that the appellant applied for recognition on 31.10.08 and as per applicable Regulations 2007, land on lease from a private party is not permissible. In view of the above, the Council came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and ERC’s order dated 19.05.09 was confirmed.

In the appeal and during personal presentation it was submitted that the appellant had already created requisite infrastructure and other facilities for B.P.Ed programme; It was further stated that it submitted applications for B.Ed on 01.10.08 and for B.P.Ed on 31.10.08; It got recognition for B.Ed programme on 22.08.09.

AND WHEREAS the Council noted that NRC had sought some clarification from the institution as to which programme of the applicant needed to be processed, B.Ed or B.P.Ed. It was further observed from the regulations 2007 that only one application for one course be processed in an academic year for one institution, Since, NRC has already processed (the first submitted application) for the B.Ed course and granted recognition. the Council therefore came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. In the appeal and during personal presentation it was submitted that the building plan is approved by the competent civic authority and as per the plan it was having 3476 sq. mt. of builtup area for conducting the existing B.Ed Course, B.A course, B.P.Ed course and the proposed M.Ed course and it earmarked exclusively for teacher education programmes 2000 sq. mt of builtup area CLU was already submitted to NRC.

AND WHEREAS the Council noted from the building plan that 444 sq. mt of builtup area for M.Ed and 505 sq. mts of builtup area for B.Ed was exclusively earmarked and in total it was having 2000 sq. mt for the B.Ed, M.Ed and B.P.Ed programmes and this area was not adequate as per norms. In view of the above, the Council, came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. In the appeal and during personal presentation it was submitted “ (1). The library already had 3213 books for B.Ed and M.Ed course and very recently more than 1000 books containing more than 200 of titles have been purchased for Master of Education course which are strictly according to the NCTE norms; (2). Before issuing the refusal order no fresh notice was given to the institution about the deficiency of title of the books in the library which violates the principles of natural justice of fair hearing”.

AND WHEREAS the Council noted that the appellant added 1000 books to the existing stock of 3213 books, only on 27.08.09 i.e. after the date of refusal order. In view of the above, the Council, came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS the Correspondent, Jamini Kant B.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 26/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri J.K. Mohata, Secretary, Jamini Kant B.Ed College, East Singhbhum, Jharkhand presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant institution had submitted a certificate on 04/04/2009 from the District Education Officer, Dept. of Education that no other school was being run in the campus earmarked for proposed B.Ed college. The appellant institution had submitted two original affidavits on 29/05/2009. i.e (i) an affidavit regarding faculty as per format given by ERC with the deficiency letter dt.11/05/2009 and (ii) a fresh affidavit relating to land and building; The ERC has communicated vide its deficiency letter dt.27/03/2009 that the institution was required to re-name the college as Jamini Kant B.Ed College instead of Jamini kant Mahao High school B.Ed College. On the instruction of ERC it renamed the college as Jamini Kant B.Ed College. The state Govt. vide its letter no. 917/971 dt. 19/03/09 informed the ERC not to grant recognition for B.Ed Colleges. This letter has been relaxed by the same state Govt. vide letter no. 1321 dt. 24.04.2009.

AND WHEREAS the Council noted that the trust had already been conducting a school in a separate campus and to this effect DEO issued a certificate. Further it noted that the appellant had christened the college in its application as Jamini Kant Mahao High School B.Ed College and hence the documents related to land & building remained in that name. Later, on the instruction of the ERC, it changed the name of the institution as Jamini Kant Mahao B.Ed College. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, to be remanded to ERC for causing inspection of the institution and the inspection team to verify whether the school is being run in the proposed college building or not.

AND WHEREAS After perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside ERC’s order dated 25-07-09 and remand the case to ERC for causing inspection of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms within one month of issue of this order and thereafter pass appropriate order.

WHEREAS the appeal of Mahila Mahavidyalaya, Aurangabad, Bihar dated 26/08/2009 is against the Order No. ERC/7-99.6.(11).5/2009/1045(1) dated 05/08/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “1) Experience Certificate of the Principal is not as per the NCTE norms. 2) Built up area shown in the building plan submitted by the institution appears to be tampered. 3) The institution has not mentioned details of marks obtained by the appointed staff in affidavit of Rs.100/- stamp paper”.

AND WHEREAS the Correspondent, Mahila Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 26/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Rana Pratap Singh, Secretary, Mahila Mahavidyalaya, Aurangabad, Bihar presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that all the deficiencies were fulfilled and clarified through appellant letter no. 44/MBC/09 & 45/MBC/09 dt.16/07/09 & 28/07/09. It showed photocopies of the compliances in respect of Principal eligibility criteria and experience certificate, built up area and percentage of marks of teachers obtained in their academic carrier, to the appeal committee.

AND WHEREAS the Council noted that the Principal was qualified and also possessed experience as required under the norms; It further noted from the VTR dt 16.03.09 that institution was having adequate infrastructure and instructional facilities as per norms; It further noted from the building completion certificate issued by competent civic authority on 29.05.08 that institution was having 2860 sq. mts of builtup area and the appellant in his affidavit dated 24.05.09 also mentioned the availability of 2860 sq. mts of builtup area. Further the building plan also indicated the availability of a total builtup area of (30793 sq. ft) 2860 sq. mts. on two floors. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, to be remanded to ERC for issuing letter of intent prior to grant of recognition under clause 7(9) of NCTE Regulations 2007.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside ERC’s order dated 05.08.09 and remand back the case to ERC to issue letter of intent prior to recognition under clause 7(9) of the NCTE Regulation, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby remands back the case of Mahila Mahavidyalaya, Aurangabad, Bihar to the ERC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Mariyan Institute for Higher Studies and Allied Course, Nanital, Uttaranchal dated 03/09/2009 is against the Order No. F.NRC/NCTE/F-7/UR-200/141 Meeting/2009/5561 dated 06/07/2009 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the grounds “1) Land is gifted to the institution but not registered. 2) Building Plan is not readable and letter of approval of building plan is not submitted. Course - wise earmarked area is not shown in the building plan. 3) Rs. Five lacs. FDR is not submitted”.

AND WHEREAS the Correspondent, Mariyan Institute for Higher Studies and Allied Course (hereinafter referred to as the appellant), preferred an appeal dated 03/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Abdul Salim Secretary & Shri Gireish Kanpal, Cordinator, Mariyan Institute for Higher Studies and Allied Course, Nanital, Uttaranchal presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that according to the Muslim Personal Law (SHARIAT) which is applicable to the appellant, even a oral gift is a valid gift and therefore in this case the “ Hibanama” by the owner of the land in favour of the appellant society be accepted. He therefore submitted that the registration of gift deed was not required. The amount of FDR as stated by NCTE in the 1st deficiency letter was Rs. 3 lacs. and same was submitted. FDR of Rs. 5 lacs. was only demanded by a subsequent letter containing the order of rejection of application, thus a chance to make up deficiency in FDR amount was not provided to the appellant. It was further submitted that the building plan is readable.

AND WHEREAS the Council noted that land along with a building is gifted to the society, but it has not been registered, and this mode of possession of land is not permissible as per NCTE Regulations. In view of the above, the Council came to the conclusion that there was no justification in accepting the appeal and that it should be rejected.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that should be rejected. Accordingly, the appeal was rejected and NRC’s order dated 06.07.09 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

AND WHEREAS the Correspondent, Rajkumari Agrajaraje Bhonsale Mahila Adhyapak Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 26/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Ashfaque Ahmad Khan Coordinator & Shri Yujraj Shirke, Rajkumari Agrajaraje Bhonsale Mahila Adhyapak Mahavidyalaya, Nagpur, Maharashtra presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had been conducting B.Ed programme since 2005 and also proposed for M.Ed programme. After causing an inspection WRC not only refused recognition for M.Ed course, but also withdrew the recognition of the existing B.Ed Course. At the time of inspection it was in possession of 1100 sq. mt of land and 2000 sq. mt of builtup area. It was further submitted that the appellant purchased 4000 sq. mt of land and constructed a new building to meet the requirement of the Regulations 2007.

AND WHEREAS the Council noted that 1100 sq. mt of land was highly inadequate for conducting B.Ed programme. It however noted that the recognition for the B.Ed programme was granted in 2005 as per the Regulations in vogue, which did not stipulate a definite land area requirement and now the appellant has procured land as per requirement and constructed a new building. In view of the above the Council came to the conclusion that there was enough justification in accepting the appeal, to be remanded to WRC for causing inspection of the new premises before the commencement of the next academic session, after obtaining a payment of 40000/- from the institution. Till then institution is to be treated as recognised one.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside WRC’s order dated 29-07-09 and remand the case to WRC for causing inspection of the new premises of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms before the commencement of the next academic session, after obtaining a payment of 40000/- from the institution. Till then institution is to be treated as recognised one.

NOW THEREFORE, the Council hereby remands back the case of Rajkumari Agrajaraje Bhonsale Mahila Adhyapak Mahavidyalaya, Nagpur, Maharashtra to the WRC, NCTE, for necessary action as indicated above.

AND WHEREAS the Correspondent, RBVRR College of Education (hereinafter referred to as the appellant), preferred an appeal dated 07/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri P. Bhaskar Reddy, Correspondent & Shri G. Janardhan Reddy, Director, RBVRR College of Education, Karimnagar, Andhra Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had been conducting B.Ed programme since its inception in its own premises at Seetharampur Karimnagar and hence there was no need to shift the premises; With regard to point 3 & 4- it was submitted that the appellant constructed pucca building with 52 pillars as per the norms of NCTE, but the outward plaster of the building was incomplete and the work was in progress at the time of arrival of visiting team. Further the appellant submitted a representation on 16/092008 seeking postponement of visit in view of the fact that incessant rains during that period could not facilitate the preparation for inspection, which is beyond the control of the appellant which cannot be constructed as defiance.

AND WHEREAS The Council noted that Kakatiya University vide its letter 14.03.08 informed SRC the existing accommodation of the institution was not sufficient and congenial for running a B.Ed. college; Sequel to this report SRC issued a Show Cause notice 28.05.08 and in response to this notice the institution on 21.06.08 informed the SRC that the appellant proposed to add second floor to the existing building for which it sought 3 month’s time; SRC detailed an inspection on 16.09.08. When the team visited the institution the management sought postponement of the inspection by another 3 months as the construction of the building was not completed; So, it was apparent from all these that the B.Ed. programme was being conducted in insufficient accommodation till the date of inspection under Section 17 of NCTE Act. The Council further noted Hon’ble High Court of Andhra Pradesh vide its order dt 11.08.09 directed NCTE not to withdraw the students already allotted to the petitioner college till the disposal of the appeal. In view of above, the Council came to the conclusion that SRC was right in withdrawing the recognition on valid grounds. It, however, opined that the withdrawal should come into effect from the academic session 2010-11.

AND WHEREAS After perusal of documents, memorandum of appeal, affidavit, VT Report and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and SRC’s order dated 06.10.08 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of Sarvodaya Mahaviyalaya, Mathura, Uttar Pradesh dated 18/09/2009 is against the Order No. F. NRC/NCTE/F-7/UP-2350/140 Meeting/2009/6738 dated 24/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “Deficiencies communicated in the deficiency letter issued by the office are not removed within stipulated period”.

AND WHEREAS the Correspondent, Sarvodaya Mahaviyalaya (hereinafter referred to as the appellant), preferred an appeal dated 18/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri A.K. Sharma, Vice- Principal, Sarvodaya Mahaviyalaya, Mathura, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that The college applied for enhancement of intake of 100 seats vide its application dt. 05.02.2007. The required infrastructure & instructional facilities have been created and the same have been furnished within the stipulated time with the documentary evidences. After submission of application to the NRC, jaipur, the NRC took the decision of refusing enhancement of the intake without conducting any inspection as is usually done by NCTE in all cases.

AND WHEREAS the Council noted that the appellant had been conducting B.Ed programmes with an intake of 60 students since 2002 and it applied for enhancement of intake from 60 to 100 to NCTE on 05.02.07. The NRC on 20.03.07 issued a deficiency letter and the institution submitted its compliance report on 09.05.07. the Council on perusal of the documents deduced that the institution fulfilled the deficiencies pointed out by NRC and it also possessed requisite infrastructure and instructional facilities for a basic unit of 100 in B.Ed programme. In view of the above, the Council came to a conclusion that there was enough justification in accepting the appeal with a direction to NRC to issue a recognition order basic unit of 100 students, by enhancing the existing intake of 60 students by 40 more students.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and NRC’s order dated 24.07.2009 was reversed, with a direction to NRC to issue a recognition order basic unit of 100 students, by enhancing the existing intake of 60 students by 40 more students.

NOW THEREFORE, the Council hereby reverses the Order appealed against.

This has not been done within the stipulated time”.

AND WHEREAS the Correspondent, Shri Shiddhi Vinayak Degree College (Educational Trust) (hereinafter referred to as the appellant), preferred an appeal dated 03/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Murari lal Choker, Secretary & Shri Ajay Singh President, Shri Shiddhi Vinayak Degree College (Educational Trust), Agra, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant registered 2500 sqmt of land in the name of the institution, on 10.08.09 and there was delay in transfer of the land, as the concerned authority was out of country.

AND WHEREAS the Council noted from the Khatauni document that 0.492 Hec of land was in the name of the trust on ownership basis and the appellant on the instruction of NRC transferred land in the name of the institution. In view of the above the Council came to the conclusion that there was enough justification in accepting the appeal, with a direction to NRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of NCTE Regulations.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside NRC’s order dated 31.08.09 and remand back the case to NRC to issue letter of intent prior to recognition under clause 7(9) of the NCTE Regulation, within 15 days of issue of this order.

NOW THEREFORE, the Council hereby remands back the case of Shri Shiddhi Vinayak Degree College (Educational Trust), Khasra No.1357-1360, Vill.Raibha, Agra - , Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS The appeal of St. Johns College Of Education, Khammam, Andhra Pradesh dated 07/09/2009 is against the Order No. F.SRO/NCTE/Ref/2008-09/5857 dated 06/10/2008 of the Southern Regional Committee, withdrawal recognition for conducting B.Ed course on the grounds “1) The institution was granted recognition in a rented premises for a period of three years vide order dated 02/03/2005. The stipulated period has been expired on 01/03/2008, the institution failed to complete the construction and to shift to its permanent premises. 2) As per the visiting team report of Kakatiya University, Warangal the institution has the building, which has asbestos sheet roofing, which is not as per NCTE Rules and Regulations. 3) The institution in its written communication dated 20/06/2008 informed that it has made application to a bank loan and the RCC roofing will be completed within a period of two months or otherwise by 31/08/2008. 4) The institution did not have adequate accommodation for running B.Ed course even after lapse of 3 years. 5) The institution did not co-operate with the visiting team in carrying out inspection under section 17 on 18/09/2008. This is considered as an act of defiance and unbecoming of an educational institution. 6) The institution violated the provisions contained under various sections of NCTE Act and regulations there under”.

AND WHEREAS the Correspondent, St. Johns College Of Education (hereinafter referred to as the appellant), preferred an appeal dated 07/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri B. Danam, Representative, St. Johns College Of Education, Khammam, Andhra Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the University team visited the institution and suggested to remove the asbestos roof. To carry out this work it took up all the measures and informed SRC that RCC roofing would be completed by 31.08.08. The appellant failed to accomplish the task within the committed period and further requested SRC to postpone the inspection U/s 17 scheduled on 18.09.08, informing that RCC roofing would be completed by Nov’08. SRC instead of sending the visiting team, has withdrawn the recognition.

AND WHEREAS The Council noted that Kakatiya University vide its letter dated 14.03.08 informed SRC that the institution had been running since its inception in asbestos sheet roof sheds; Pursuance to this, SRC issued a Show Cause notice to the institution on 28.05.08, The appellant in response to this notice on 20.06.08 informed the SRC, it would complete the RCC roofing before 31.08.08; Hence the SRC sent an inspection team to the institution on 18.09.08 and the management sought postponement of the inspection saying that RCC roofing would be completed by the end of November, 2008; From this it was appearant the appellant was conducting the programme in asbestos sheet roof till the date of inspection which was not permissible as per norms. The Council further noted Hon’ble High Court of Andhra Pradesh vide its order dt 11.08.09 directed NCTE not to withdraw the students already allotted to the petitioner college till the disposal of the appeal. In view of above, the Council came to the conclusion that SRC was right in withdrawing the recognition on valid grounds. It, however, opined that the withdrawal should come into effect from the academic session 2010-11.

The stipulated period has been expired on 03.04.2006, the institution failed to complete the construction and to shift its permanent premises; As per the report of inspection carried out by the Kakatiya University, Warangal the institution is still functioning in rented premises with inadequate accommodation; The institution informed in writing vide letter dt.21.06.2008 that construction of permanent building with pillars completed half of the building.The other part of the building shall be completed by july 2008. the institution failed to comply the same; The institution at no point of time communicated the change of land and went for construction on this site; The institution without formal permission of the NCTE has taken a different land in a different locality and Revenue Division and started construction; The institution breached the sworn affidavit submitted by it whereby it has taken oath stating that it will follow norms as prescribed by NCTE; The institution violated the provisions contained under various sections of NCTE Act and Regulations there under.

AND WHEREAS Shri P. Ravinder Rao, President & Shri M. Venkateshwarlu, Asst. Registrar, St.Ann's Education Society(Rousseau College of Education), Karimnagar, Andhra Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant shifted to the permanent premises in the academic year 2004-05 and thereby complied with norms of the NCTE in terms of its regulations. The appellant as of today is running its course in its permanent premises, which is RCC roofed. That the inspection team of Kakatiya university visited the appellant premises and granted affiliation for the academic year 2008-09 vide its letter dt.14/09/2008, after satisfying with the compliance of requirement of built up space etc. It is further submitted that in view of incessant rains the appellant could not complete construction within time and now the building is complete in all respects. The appellant carried on construction in the new premises and also shifted the building premises from sardarpur to venkatrapolli with prior intimation to SRC. It is relevant hereinto submit that the present building is located within the same revenue division. The appellant never violated any provisions of the NCTE Act and Regulations, in fact the appellant complied with all the provisions of the NCTE Act and Regulations.

AND WHEREAS The Council noted that the appellant institution was granted recognition vide its order dated 04.04.03 from the academic 2002-03 in a rented building with a condition to shift to own premises within 3 years from the date of issue of recognition. It further noted from that the report dated 14.03.08 of the Kakatiya University that the institution’s management promised to replace the asbestos roof with the RCC slabs in the year 2006, but even in 2007-08 the RCC roof was not placed. Further the appellant in its reply dated 21.06.08 submitted in response to SRC Show Cause notice that RCC roof would replaced by July, 2008. Accordingly, SRC detailed an inspection team on 17.09.08. When the team visited the institution the management handed over a letter to it saying the construction was under progress and as such the inspection be rescheduled after two months. The Committee further noted Hon’ble High Court of Andhra Pradesh vide its order dt 11.08.09 directed NCTE not to withdraw the students already allotted to the petitioner college till the disposal of the appeal. In view of above, the Council came to the conclusion that SRC was right in withdrawing the recognition

on valid grounds. It, however, opined that the withdrawal should come into effect from the academic session 2010-11.

AND WHEREAS After perusal of documents, memorandum of appeal, affidavit, VT Report and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and SRC’s order dated 06.10.08 was confirmed.

NOW THEREFORE, the Council hereby confirms the Order appealed against.

WHEREAS the appeal of St.R.C. College of Higher Education, Muzaffar Nagar, Uttar Pradesh dated 31/08/2009 is against the Order No. F.NRC/ NCTE/F73/UP-3162/142nd Meeting/2009/5503 dated 03/07/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “Copy of the approved building plan from the competent authority is not submitted”.

AND WHEREAS the Correspondent, St.R.C. College of Higher Education (hereinafter referred to as the appellant), preferred an appeal dated 31/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Arvind Sangal, Chairman & Shri Nand Kishore Mittal, Secretary, St.R.C. College of Higher Education, Muzaffar Nagar, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the approved building plan was submitted alongwith their letter dated 02/02/2009 which has been duly acknowledged by the office of Regional Committee on 02/02/2009.

AND WHEREAS the Council noted that the building plan approved on 11.07.08, by Nagar Panchayat office was submitted to NRC and the plan indicated the land and builtup area details. the Council therefore, came to a conclusion that there was enough justification in accepting the appeal, to be remanded to NRC for further processing of the case on merit.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated ¬03.07.09 and remand back the case to NRC for processing the case on merits and passing appropriate order.

NOW THEREFORE, the Council hereby remands back the case of St.R.C. College of Higher Education, Muzaffar Nagar, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Thorrur College of Education (Vishnu Educational Society), Warangal, Andhra Pradesh dated 07/09/2009 is against the Order No. F.SRO/NCTE/Ref/2008-09/5864 dated 06/10/2008 of the Southern Regional Committee, withdrawing recognition for conducting B.Ed course on the grounds “1) The institution is located in a commercial complex which is not in consonance with the NCTE norms and standards. 2) The grond floor is full of shops, first floor is residential complex and second floor is accommodating temporary B.Ed course. 3) The institution in its application dt.29.12.2005 submitted SRC informed in writing that the construction of own building shall be completed by December 2006. It failed to comply its own statement. 4) The institution did not cooperate to the visiting team in carrying out inspection under section 17 on 16.09.2008. This is considered as an act of defiance and unbecoming of an educational institution. 5) The institution violated the provisions contained under various sections of NCTE Act and Regulations there under”.

AND WHEREAS the Correspondent, Thorrur College of Education (Vishnu Educational Society) (hereinafter referred to as the appellant), preferred an appeal dated 07/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Chinthala Raju, Secretary & Shri G. Venkateshwarlu, Thorrur College of Education (Vishnu Educational Society), Warangal, Andhra Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant was granted recognition in 2007-08 and while granting the recognition, the appellant was permitted to construct own building within a period of 3 years from the date of commencement of that batch and the appellant is having time till 2010. Presently it had been conducting the B.Ed programme in a temporary accommodation located in a commercial complex and it has already informed SRC that it would shift to own premises by 10.09.08; it was further submitted that the appellant requested for post ponement of the inspection; in view of the fact that incessant rains during that period could not enable the appellant to complete the construction of the entire building SRC withdrew the recognition at the instance report of the university, instead of causing an inspection.

AND WHEREAS the Council noted that the appellant vide its letter dated 18.08.08 informed RD, SRC that the construction of the permanent accommodation was completed recently and the college will be shifted to new premises by 10.09.08, from the existing temporary accommodation. Contrary to this the appellant stated in its appeal submission that due to incessant rains they failed to complete the construction of the entire building and sought postponement of the inspection scheduled on 16.09.08. It further noted that the visiting team reached the institution for physical verification of the facilities on 16.09.08 and asked the management to furnish the details with regard to the deficiencies pointed out in the show cause notice of SRC. Instead of showing the sought documents to the visiting team the management submitted a representation, wherein it had requested SRC, Bangalore to grant permission for another two months to comply with the details regarding the show cause notice. It further noted Hon’ble High Court of Andhra Pradesh vide its order dt 11.08.09 directed NCTE not to withdraw the students already allotted to the petitioner college till the disposal of the appeal. In view of above, the Council came to the conclusion that SRC was right on withdrawing the recognition on valid grounds. It however noted that the withdrawal will come into effect from the academic session 2010-11.

WHEREAS the appeal of Veer Kunwar Degree College, Bijnor Dist., Uttar Pradesh dated 01/09/2009 is against the Order No. F.NRC/NCTE/F-7/UP-3098/145th MEETING/2009/7808 dated 12/08/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds “The deficiencies communicated to the institution still exist”.

AND WHEREAS the Correspondent, Veer Kunwar Degree College (hereinafter referred to as the appellant), preferred an appeal dated 03/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Smt Sudhesh Singh & Shri Ashok Kumar Singh, Veer Kunwar Degree College, Bijnor Dist., Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant had already submitted FDRs for 5 lakhs and 3 lakhs from Bijnor Urban Cooperation Bank Ltd. and the NRC did not return there original FDR’s while pointing out the deficiency. Had it returned, it would have changed the FDRs and created in a Nationalised Bank. Now the appellant created FDRs in Punjab and Sindh Bank.

AND WHEREAS the Council noted that the appellant had earlier created FDRs in a non-nationalised bank i.e. Bijnor Co-operation Bank; Further NRC did not return the original FDRs to the appellant for terminating the FDRs in Bijnor Cooperation and depositing them in a nationalized bank, before refusal of recognition. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal to be remanded to NRC for causing inspection of the institution.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC’s order dated 12-08-09 and remand the case to NRC for causing inspection of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms within one month of issue of this order and thereafter pass appropriate order.

NOW THEREFORE, the Council hereby remands back the case of Veer Kunwar Degree College, Bijnor Dist., Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Vidyasagar Primary Teacher's Training Institute, Purba Medinipur Dist, West Bengal dated 07/09/2009 is against the Order No. ERC/7-99.4(1).9./2009/942 dated 31/07/2009 of the Eastern Regional Committee, refusing recognition for conducting D.Ed course on the grounds “1) No compliance made by the institution to the notice dt.18/07/2009 2) List of teaching staff not submitted in prescribed format. 3) The download copies of the website covering inter-alia the details of the institution, its location name of course, facilities and the particulars of their proposed teaching and non-teaching staff etc with photographs not submitted”.

AND WHEREAS the Correspondent, Vidyasagar Primary Teacher's Training Institute (hereinafter referred to as the appellant), preferred an appeal dated 07/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Srisrikanta Manna, Office Assistant & Shri Biswanath Bera, Secretary Vidyasagar Primary Teacher's Training Institute, Purba Medinipur Dist, West Bengal presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that even after the compliance of the mandatory requirements under Regulations 7(9) and 7(10) contemplated, ERC again served a Notice on 18th July, 2009 asking the appellant to fulfill the mandatory requirements of Regulations 7(9) and 7(10) within a very short span of 7 days without high lighting any specific defects in the appellant’s compliance already made on 08.05.09 and 26.06.09 with regard to requirement of Regulation 7(9) and 7(10).

AND WHEREAS the Council examined the staff profile submitted by the institution and found that the faculty was not qualified as per norms. But looking into the problem of primary teacher education in the State of West Bengal, the Council came to a conclusion that there was enough justification in accepting the appeal, to be remanded to ERC for giving another 3 month time, to the institution for appointing the qualified staff as per norms.

AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside ERC’s order dated 31.07.09 and remand back the case to ERC for giving another 3 month time to the institution for appointing the qualified staff as per norms and thereafter process the file as per Rules.

NOW THEREFORE, the Council hereby remands back the case of Vidyasagar Primary Teacher's Training Institute, Purba Medinipur Dist, West Bengal to the ERC, NCTE, for necessary action as indicated above.

WHEREAS the appeal of Vinayak Vidhyapeeth, Meerut, Uttar Pradesh dated 31/08/2009 is against the decision of NRC in its 146th Meeting of NRC held from 5th – 7th August, 2009, refusing recognition for conducting B.Ed course on the grounds “1) As per letter dt. 02/05/09 the institution was directed to register the land in the name of institution within 90 days. This has not been done within the stipulated time. 2) As per approved list of the faculty by the affiliating university there is no teacher to teach Physics, chemistry, Biology, Mathematics, Science, etc”.

AND WHEREAS the Correspondent, Vinayak Vidhyapeeth (hereinafter referred to as the appellant), preferred an appeal dated 31/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order.

AND WHEREAS Shri Somendra Singh Director & Shri Sunil Kumar, Asst. Director, Vinayak Vidhyapeeth, Meerut, Uttar Pradesh presented the case of the appellant institution on 14.10.09. In the appeal and during personal presentation it was submitted that the appellant has replaced the staff to cater to the requirement of teaching of methodology subjects; Further the appellant was not given any opportunity to make its representation on the refusal grounds.

AND WHEREAS the Council noted the appellant was already issued letter of intent prior to grant recognition on 23.07.09 and the appellant possessed requisite land and the staff as per norms. In view of the above the Council came to a conclusion that there was enough justification in accepting the appeal, and that it should be accepted.

AND WHEREAS after perusal of documents, memorandum of appeal, VT Report affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and NRC’s decision dated 5th – 7th August, 2009 was reversed, with a direction to NRC to issue formal recognition order within 15 days of issue of this order.

NOW THEREFORE, the Council hereby reverses the Order appealed against.
