Action Requested
Execution of Contract for Permanent Easements from Florida Power & Light Company in the amount of $16,204.00 as consideration for the Easements ("Payment"). The Payment shall be allocated as follows: $9,162.00 for the Mendoza Easement; and $7,042.00 for the Ellenton-Gillette Easement.

Florida Statutes Chapter 5.3 addresses coordination of traffic systems to future uses.
Background Discussion
A Contract for Permanent Easements was established through the efforts of the Manatee County Attorney's Office and consequently executed by Florida Power & Light Company for Easement Agreements required for roadway improvement projects at Ellenton-Gillette Road and Mendoza Road.
The roadways intersecting the railroad crossings have deteriorated, require rehabilitation, and upgrades to facilitate safe crossing.
An amount of $.52 per square foot was agreed upon for a 13,543 square foot easement parcel at the Ellenton-Gillette railroad crossing and a 17,619 square foot easement parcel at the Mendoza Road railroad crossing. The agreed pricing is based on a comparative contract previously accepted by the Manatee County Board of County Commissioners on May 11, 2010 for a similar project with same ownership.
