PREFACE The 1949 Florida Legislature, by Chapter 25035, adopted this new revision

designated as "Florida Statutes of 1949" and, by Chapter 25034, directed the Attorney General, through the Statutory Revision Department, to compile this revision, which includes the Florida Statutes of 1941, the Supplement of 1947 and General Session Laws of the 1949 Legislature enacted at both the regular and special sessions.

The objective of said chapters is to carry on the arrangement and identi­fication of the general laws as adopted in Volume I, Florida Statutes, 1941, and to keep them current by deleting all general statutes no longer in force, and by adding, with all convenient speed in the future and in proper place, ail new general laws with necessary revisions and corrections. This contem­plates a system for progressively revising the statutes by publishing the "Florida Statutes" biennially, following each regular session of the Legislature. No laws of purely local application, road designations or similar material not used generally are included.

The present realization of this original system of revision as visualized in 1941 is due largely to the creative efforts of the Florida State Bar Associa­tion, certain of its committees, and the Attorney General during the past several months.

The Junior Bar Section of the Florida State Bar Association, under the direction of E. Dixie Beggs, Jr., of Pensacola, as president, and J. Lance Lazonby, of Gainesville, as chairman of a committee on Costs of Law Books, began working toward this goal as early as 1937. Its work culminated in the enactment of Chapter 19140, Acts of 1939, authorizing the Attorney

· General to compile a new revision of the statutes. A few months after adjournment of the 1939 Legislature, a statutory re­

vision committee, composed of E. Dixie Beggs, Curtis Byrd, J. Lance Lazonby . and Julius F. Parker, representing the Florida State Bar Association, met with the late Attorney General Gibbs, Honorable Glenn Terrell, then chief justice of the supreme court, the late Honorable J. B. Whitfield, justice of the supreme court, D. H. Redfearn and Ed. R. Bentley, president and immediate past presi­dent of the Florida State Bar Association, W. P. Simmons, Jr., president of the Junior Bar Section, T. T. Turnbull, attorney for the State Railroad Commis­sion and H. E. Carter, Lawrence Truett and T. J. Ellis, Assistant Attorneys General, and discussed plans for the new revision of the statutes. Following this meeting, Attorney General Gibbs, in September 1939, appointed as Assist­ant Attorneys General Lewis H. Tribble, (head revisor), Fred M. Burns, Guy A. Race, James W. Moore, J. C. Adkins and Woodrow Melvin to make a complete revision of the Florida Statutes. Their effective work resulted in the revision later adopted by Chapter 20719, Laws of Florida, 1941, as Florida Statutes, 1941. This chapter approved for the state the "Wisconsin Plan" of biennially revising the statutes after each regular session of the Legislature.

The 1943 Legislature changed the revision system from a biennial edition to a supplement plan. The supplements of 1943, 1945 and 1947 were brought out by the Attorney General's office but the original revision of 1941 was not authorized to be further revised until now.

Officers of the Florida State Bar Association and members on the statu­tory revision committee in 1948 recommended to me, as Attorney General Elect, the reactivation of the "Wisconsin Plan," contemplating biennial re­vision and publication of the general statutes of Florida, 1949. I accepted this recommendation and gave my full cooperation to the Florida State Bar Associa­tion which adopted its statutory revision committee's report for this re-estab­lishment of the biennial system of revision as first provided in the 1941 law and which was enacted by the 1949 Florida Legislature in Chapters 25034 and 25035.

INTRODUCTION TO

THE FLORIDA STATUTES OF 1949

(Note: Read these pages before using this volume and become acquainted with Its purpose, coatents and plan of organization.)

The Florida Statutes contained in this edition constitute all the statutory law of Florida of a general nature enacted at subsequent sessions of the legisla­ture up to and including the regular and special sessions of 1949. It is the only complete, down to date, official edition of the statutes (See Section 16.24, F. S. '49). Amendments and new legislation have been compiled in their proper places and sections repealed or expired since 1941 have been deleted*. (See Section 16.28, F. S. '49.) The statutes speak for themselves and reference to the acts of the legislature from which they were derived is necessary only in cases of conflict within the revised statutes.

A copy of this statute book should be on the desk of every judge and lawyer in Florida.

GENERAL INDEX

An index has never been prepared which has been entirely satisfactory to all members of the bench and bar. It is doubtful whether that Utopia will ever be reached.

No index can contain every possible entry. An index of such size would be incapable of practical use. On the other hand, to index the law only in those places where the user of statutes should logically look would not be >ufficient because many persons are not logical in searching an index. The happy medium which we have attempted to reach is one between the logical and ~he practical approach by selecting generally used catch-words and titles. Cross references have been reduced to a minimum and direct reference mbstituted.

An effort has been made in this edition to revise the index so that it will be workable for the greatest number of persons. The checking plan which we have followed insures that no section has been omitted and that every section has been properly indexed under several heads.

Many key words have been changed, as a result of the examination of indexes of commonly used legal publications and additional references have been added.

We have attempted to use a noun as a catch-word wherever possible in-3tead of an adjective, preposition, a conjunction or an adverb.

The subject matter with which one is concerned will generally give a key to the spot in the index from which to begin the search.

The index is based on a logical arrangement of the statutes. The user will meet with greater success by looking in a place where it should logically be rather than relying upon alphabetical uncertainties of the index.

All indexes at best are inconvenient and time consuming. Continued im­provement can and will be made through cooperation of the bench and bar with y-our Statutory Revision Department.

HISTORY NOTES

History Notes have been added to all sections. They have been carefully !ompiled, checked for accuracy with original session laws, and brought com­pletely up to date. The lawyer will find them dependable and convenient in the practice of law. We believe the compilation and addition of the history notes to the statutes will enhance the value and expedite the use of the official edition Jf the Florida Statutes of 1949.

NUMBERING SYSTEM

The decimal system of numbering sections, as adopted in 1941, has been retained. This decimal system is used in our official Florida Statutes and also in the Florida Statutes Annotated, published by West Publishing Company.

CHAPTER AND SECTION NUMBERS Each chapter subject is given a number. (See chapter 25.) Each section

added is assigned a decimal number. (The first section would be 25.01, the fifteenth section would be 25.15.)

We have followed the original decimal system of numbering sections with the following exception. · Where a new section has been inserted between two already existing sections the hyphen has been eliminated between the section number and an added third decimal. For example in Chapter 25, "Supreme Court of Florida" between sections 25.12 and 25.13 there were added 3ix new sections in 1945. These sections were numbered in the 1947 Supplement as 25.12-1, 25.12-2, 25.12-3, etc. In this volume we deleted the hyphen and these sections now are numbered 25.121, 25.122, 25,123, etc. This change has been consistently used throughout the statutes. Since all sections herein are active and down to date, it will not be necessary to refer to the 1941 Statutes nor the 1947 Supplement except to compare a former section with an amended section or to refer to a repealed section for information.

LOGICAL ARRANGEMENT OF TITLES AND CHAPTERS The object of any arrangement of statutes is to facilitate the finding of the

law. Two methods of arrangement are in general use in the United States namely: The "logical," · grouping of related subjects together, and the "alphabetical," as used in Corpus Juris and American Jurisprudence. A few states use a combination of both methods, however, a majority use the "logical" arrangement which we have adopted in Florida.

INDEX TO TITLES AND CHAPTERS The "Analysis of Florida Statutes by titles and chapters" printed in the

front part of this volume will afford the attorney a quick reference to the ~hapters grouped under the logical title system. Familarity with this index will save the lawyer much time.

It lists groups of related subjects in a general subject field, and lists in numerical order all chapters assigned. Should a chapter be repealed or expire by law, the number is followed by the word (repealed) or (expired). When vacancies occur in the numerical order the unused numbers have been reserved for future use. A reference to this index will quickly inform one whether a ::hapter is active or has been repealed or has expired. The history notes will give detailed information.

CHAPTERS Chapters have retained their original numbers with the following excep­

tions. Chapter 481 on "Labor Organizations" has been renumbered Chapter 447 under title of "Labor." Chapter 39, "Attorneys at Law" was transferred and renumbered Chapter 454 under title of "Regulation of Professions and Voca­tions." "Administrative Boards, Generally" which was Chapter 485 was trans­ferred and renumbered 455 under the same title, "Regulation of Professions and Vocations."

INDEX TO SECTION SUBJECTS AT BEGINNING OF EACH CHAPTER At the top of each chapter you will find a numerical index to section sub­

jects within the chapter. Should skips appear in section numbers, the section has been repealed or deleted by law.

When sections have expired or have been repealed the section number is carried numerically in the body of the chapter together with history notes giving the chapter number of the general session law authorizing the Jeletion. If a section number does not appear in the chapter it has not been assigned. With few exceptions our policy is to assign new section numbers to new matter rather than reassign used section numbers. History notes will give full information on any deviation from this policy.

INDEX TO CONSTITUTION OF FLORIDA The Constitution of Florida has been brought up to date through 1948. The index to the Constitution of Florida is carried immediately preceding

the constitution itself in the beginning of book one. The same index has been meshed in with the general index in order that a person searching for a subject may have references to both the constitution and the statutes in one index. rhis addition to the general index should prove a time saving and valuable reference service,

ADOPTION OF THE STATUTES AND GENERAL LAWS OF 1949

All statutes in this volume through 1947 have been officially adopted as ~tatutory law in their present form by Chapter 25035, General Session Laws of 1949. (See Section 16.19, F. S. '49.) The affect of an adoption is to cure any technical defect with reference to title, form, etc. See: McConville v. Ft. Pierce Bank and Trust Co., 101 Fla. 727, 135 So. 392; Christopher v. Mugen, 61 Fla. 513, 55 So. 273, also 63 Fla. 1, 58 So. 486, 89 Fla. 119, 103 So. 414, error dismissed 46 S. Ct. 23, 269, U. S. 594, 70 L. Ed. 430.

Chapter 25035 also authorized the inclusion of the -1949 Laws in this volume (See Sections 19.28, 19.29, F. S. '49.) The 1949 Statutory Laws have been edited but not changed. They read substantially verbatim as enacted by the legislature and recorded in the official general session laws of 1949, whether as amendments to existing sections or new sections. We assigned a decimal section number when we converted the law into statutory form in place of the original section number as designated in the general session law. (See: Section 11.07 as amended which was Section 1, Chapter 25005, Laws of 1949.) If the law of 1949 amended a section, the history note reads "Am.§1, ch. 25005, 1949." If a new section has been added, we convert the law into statu­tory form and the history note will read "Comp. §1, ch. 25016, 1949." See: History note under Section 365.01.)

An adoption bill will be prepared for the adoption of the 1949 laws in statu­tory form, by the 1951 legislature. In the intervening two years, while the 1949 statutory law is evidence of existing law the statute is unofficial until adopted in 1951 (See Section 19.29, F. S. '49.) The general session laws of 1949, until 1951, are the official laws. Reference to the history notes will constantly keep the attorney informed on the status of each section with reference to source, amendments, repeals, or new sections added in 1949.

TABLES

A table tracing all existing general acts of the legislature from 1919 through 1949 into the Florida Statutes, may be found in the back of book two. fhis table indicates the particular section of the Florida Statutes that has been assigned to any general legislative act. If the act is local, the word "omitted" will be shown in place of a statute section number.

At the beginning of this table there appears an explanation, which, if read, will expedite and facilitate its use.

The mortality tables will be found in back of book two.

COURTS

A tabulation of state and county courts arranged according to jurisdiction beginning with the supreme court down to the small claim courts will be found in book two. It will give information concerning, the date of term of court, type of courts in each county, and chapter number and date of the law estab­lishing the court under a legislative act.

This tabulation is also arranged alphabetically by counties. A reference thereto will save time in determining the courts existing throughout Florida in :!ach of the sixty s·even counties.

COMMON LAW, EQUITY AND SUPREME COURT RULES

The Common Law and Equity Rules recently adopted by our supreme court will be found in book two following the tables. These have been included in this edition by request of and for the convenience of members of the bar.

SUPREME COURT rules precede the Common Law and Equity rules in book two.

FORMER REVISIONS AND COMPILATION

The laws of general application of the territory of Florida and of the .State of Florida have either been compiled unofficially or revised under authority of law and adopted as official statutes, in the following publications to wit: Duval's Compilation of Territorial Laws, 1840 (compilation); Thomp­son's Digest, 1847 (compilation); Bush's Digest, 1872 (compilation); McClel­lan's Digest, 1881 (compilation) ; Revised Statutes (R. S.) 1892, (enacted as a law); General Statutes, (G. S.) 1906, (enacted as a law); Revised General Statutes, (R. G. S.) 1920, (enacted as a law); Compiled General laws, (C. G. L.) 1927, (compilation unofficial); Florida Statutes, (F. S.) 1941, (enacted as a law) ; and the Florida Statutes of 1949, (F. S. '49), (enacted as a law).

BIENNIAL PUBLICATION

Florida Statutes hereafter will be printed each two years and a biennial publication should meet with ever increasing favor (See Section 16.44, F. S. '49.) (t is economical and valuable to the attorney who must purchase and consult the statutes often. No Florida lawyer who wishes to keep down to date with the law should be without this latest edition.

The biennial plan of printing statutes is a plan which has been in successful use in other states for over fifty years. It is a preventive and a cure for the overgrowth of statutes. Since many of our statutes are short lived, the dead are removed each year and buried each two years. This operation makes room for new statutes. The amendments and new laws of each succeeding legislature are meshed in with the standing statutes. Subject matter is gradually con-3olidated and often revised into single chapters as illustrated by Chapter 601, the recent "Citrus Code of 1949" which repealed five chapters and fifty pages !onsolidating scattered subject matter into one chapter with fourteen pages.

A biennial edition of the statutes also affords members of the legislature :1 convenient opportunity to amend and revise existing law which is available in a form convenient for study and improvement. Legislators can know what the bills contain and can intelligently amend or reject them with understanding. When a section or chapter method of revision is used, it is met with intelligent legislative judgment which results in a gradual improvement of existing law.

STATUTORY REVISION

Statutory Revision technique works primarily with form rather than sub­stance (See Section 16.43, F. S. '49.) Revision of the law is often suggested .vhere improvements can be made, however, no change in a statute is ever made without legislative approval. The actual revision of substantive law should be carried out by attorneys, judges and legislators through specialized commit­tees whose members are in close touch with the practice of law. The revisors ;viii assist when called upon, but are more interested in eliminating unnecessary statutes, repetition of words and technical defects.

Revision work also has to do with conflicts, duplications, redundancy, verbosity, circumclusion, with obsolete provisions, ambiquities, obscurities, Jmissions, incompleteness and other technical faults found in all session laws. Revision plans and works toward the reclassification and consolidation of subject matter. It aims toward changing the wording of a law so that essential ~learness and harmony will exist in order that logical arrangement and com­pactness of the statutes may be obtained. Revision aims toward simplicity in statement and understanding of meaning by the use of, and arrangement of, words and phrases. It helps avoid rhetorical flourishes and ornamentations as existed under the common law, and aims toward setting forth in clear cut and understandable language the present down to date law.

The revisor's office is a clearing house where lawyers, judges, and legisla­tors may help make better statutory law. By calling the Attorney General's attention to errors, omissions, conflicts and other defects found in the statutes, all lawyers can materially help this department to improve our Florida Statutes. Many suggestions of this nature have been included in this edition. . In using the Florida Statutes of 1949 the attorney can save time. in re­:}Uired research. A quick reading of the down to date statute, a conveniept examination of the history notes, a copy of the latest general session laws, and reference to a good annotation for interpretation by court decisions, all of these .viii materially assist the lawyer in making a more thorough, complete and speedy search into Florida statutory law .
