    SECTION1.0 INTRODUCTORYMATERIALS1.1 Overview

    TheFloridaDepartmentofCorrections(Department)isresponsibleforprovidingcareandcustodyforStateofFloridainmates.Pursuanttochapter944,FloridaStatutes,theDepartmenthastheauthoritytoenterintocontractswithvendorstooperatecorrectionalfacilities.StateofFloridacorrectionalfacilitiesoperatedbyvendorsaregenerallyreferredtoasprivateprisons.

    OnMay26,2011,theGovernoroftheStateofFloridasignedintolawSenateBill2000(theBill),whichrequires the Department to issue a request for proposals ormultiple requests for proposal, for themanagement and operation of certain correctional facilities and assigned correctional units. The Billprovides,inpart:

    [ ] From the funds in Specific Appropriations 570 through 759, the Department ofCorrections shall issue a request for proposal, ormultiple requests for proposal, asdefinedinsection287.057(1)(b),FloridaStatutesforthemanagementandoperationofthe correctional facilities and assigned correctional units, including annexes, workcamps,roadprisonsandworkreleasecenterscurrentlyoperatedbytheDepartmentofCorrectionsinManatee,Hardee,IndianRiver,Okeechobee,Highlands,St.Lucie,DeSoto,Sarasota,Charlotte,Glades,Martin,PalmBeach,Hendry,Lee,Collier,Broward,MiamiDade and Monroe counties, excluding Glades Correctional Institution and HendryCorrectional Institution. The request for proposal shall provide for a contractcommencementdateofnolaterthanJanuary1,2012.

    Theprisonmanagementandoperationalservicesdescribed intheBillandsoughtviathisRequest forProposals(RFP)willbereferredtohereinastheServices.Pages102104oftheBillareincludedaspartofthisRFPasExhibitC, ForpurposesofthisRFP,thetwentynine(29)correctional locationsandassigned satellite facilitiesarebundled intoeleven (11)groupsas shown inTable1below,and thesegroupsshallbe referred to in thisRFPasCorrectional Institutions. Table1alsoshows theStateofFloridacountieswherethedifferentCorrectional Institutionsandsatellitefacilitiesare located. TheremaybeinstanceswheretheContractororDepartmentwishestoaddordeleteaCorrectionalInstitutionfromtheContract.Thefollowingshallapply:

    1.1.2. Changes to the correctional institutionmaybe requestedby theContractor,with anestimatedeffectivedatevialetteroremail.Suchrequestwillbefollowedbyaformalcommunication from the Contractor that includes a statement that attests the newcorrectional institution meets all requirements. The attestation statement shall becompleted,signedby theContractor,notarizedandprovided to theDepartment. TheDepartment reserves the right to approve or deny the request upon receipt of theattestation statement. No change will be effective until written approval by theDepartmentsContractManagerisprovidedtotheContractor.

    1.1.3. TheDepartment reserves the right to require the Contractor to change a correctional

    institutionifitisdeterminedtobeinaccessible,inconvenientorunsuitableforprovisionofservices to theoffendersunder theContract. Inaddition, theDepartment reserves theright to add, delete or change correctional institutions upon thirty (30) calendar dayswritten notice in the best interest of the Department. Such changes, additions ordeletionsmaybeaccomplishedby letter.TheContractor shall change the correctional

    institution as soonaspossibleandupon securinga replacement site, shallprovide theContractManagerwithanattestationstatementasdescribedabove.
