Five years ago, the Florida Assisted Living Association (FALA) hosted its first Annual Confer-ence and Trade Show at the Daytona Beach Shores. We had 15 speakers and approximately 100 attendees. From those very humble beginnings, we have increased the number of speakers and quadrupled the number of attendees. Our conference has become one of the most sought after events for professional speakers and vendors. This year’s keynote topic will be Exceeding Expec-tations with a Red Carpet Experience! We continue to lead all affiliates around the country with the most diverse, dynamic and largest State Conference and Trade Show for our profession. The 2011 Conference and Trade Show promises to be as much fun and as exciting as any conference we have ever hosted. This year, we gather at The Hyatt Regency Coconut Point Bonita Springs August 9th – 12th with a Hollywood theme where we are the Stars of our profession!

3:30pm – 4:30pm Seminar # 9 – How to Address Memory Decline with a Memory Enhancement Program in your Facility A large percentage of residents residing in an assisted living facility have mild cognitive impairment (MCI). Mild cognitive impairment increases with age from 19% of seniors 65 to 74 to 38% seniors over the age of 85. Most facilities focus on Alzheimer’s, Dementia and many offer memory care. These services are great for individuals with these diseases but too many of our ALF residents are on a journey of memory decline and MCI plays a major role in that process. Many residents seek the services of an ALF because they have difficulty with medication management, managing finances or issues with driving, etc. These problems often signal MCI in seniors over the age of 65. Therefore, a memory enhancement program would be an asset to any facility.

This course will provide you with an overview of a Memory Enhancement Program and lay the foundation for developing your own. A memory enhancement program can: a)allow residents to acknowledge and work on memory issues, b)increase resident independence, c)allow staff and administration to identify residents need for additional personal care services, d)increase residents’ safety and compliance with facility rules and regulations and, e)provide an added bonus to facility recreational programs and marketing efforts. 8:00am – 9:00am Seminar # 11 – Legal Update: Arbitration Agreements and Legislative ChangesFollowing a period of substantial litigation over the use of arbitration agreements in long-term care facilities, the manner in which arbitration agreements are utilized in admission agreements and the language included in such agreements is now well established under Florida and Federal law. This presentation will provide guidance to attendees to ensure that assisted living facilities utilize arbitration agreements in conformity with judicially approved practices. Attendees will receive direction on drafting arbitration agreements and ensuring that resident or their authorized representative are executing those agreements in compliance with current law in order to ensure that the decision to arbitrate by the residents and the facility are upheld.

This presentation will also provide an overview of the legislation undertaken and passed in the upcoming 2011 session of the Florida legislature and any relevant federal legislation that will potentially affect ALFs and the residents they serve. Although the bills that will actually be considered in Florida’s 2011 session are presently uncertain, the 2011 Florida session is likely to significantly impact the long-term care community. Considering this past year’s legislative developments, such as the passage of HB 945 requiring the use of automated electronic defibrillators in ALFs with 17 or more beds, it is likely that Florida’s Congress has more unforeseen legislation that may have significant effects on the long-term care community. Significant anticipated legislation includes the shift toward managed care, tort reform, and deregulation. In the federal realm, the U.S. Congress’s projected changes to the Health Care Reform passed in 2010 along with challenges to arbitration in long-term care may have a substantial impact on current federal statutes affecting long-term care. New legislative often creates or alters statutory and regulatory schemes so that facilities must work rapidly to alter their compliance programs. This presentation will offer guidance in understanding new legislative and suggestions on steps your facility can take to ensure its compliance with state and federal legislation.PRESENTER: Andrew R. 9:15am – 10:15am Seminar # 13 – The “Hot” Labor & Employment Law Issues Impacting Assisted Living and How FALA Members Should RespondWith the exception of the Lily Ledbetter Fair Pay Act, which was the first piece of legislation signed into law by President Obama, labor and employment legislation has taken a back seat in Congress to health care reform and issues dealing with the economy. With health care reform substantially out of the way, at least for now, labor and employee advocates are moving quickly to advance their agenda to the forefront in Washington DC. “Change” in the labor and employment laws is inevitable and, in terms of pending and impending legislation, most the changes have the somewhat overwhelming support of the Administration.

Aside from new legislation and regulations, there are many new faces in positions of authority in the labor and employment arena in the Obama Administration who are committed to much stricter and expansive enforcement of labor and employment laws such as the FLSA, the FMLA, the ADEA, the ADA and many others. It is also no secret that organized labor, especially SEIU which “covets” the healthcare industry, including assisted living facilities, has a “seat at the table” with the new administration. Several federal agencies are focusing on employee classification issues involving “leased” and “temporary” employees and independent contractors. The legislative changes, new regulations and beefed up enforcement emanating from DC and Tallahassee, are having and will continue

to have a disparate impact on our industry. It is imperative that assisted living employers stay on top of labor and employment law developments. In March, the US Senate Special Committee on Aging held a roundtable to discuss assisted living and the role of the federal government, with a focus on regulatory control in the name of resident protections. It is imperative that assisted living regulations remain at the state level and to do that we must have a strong state legislative effort. That means YOU must be involved. Learn about FALA’s legislative priorities and how you can help advance these priorities with your legislators. Get the tools you need to get involved and make a difference. Demystifying the Deposition will explain the deposition process and describe the role of the deponent to create confidence and increase the effectiveness of the deponent’s testimony.
