tim $2.50(Continued from page one.) patrons of the schools of Mountain Home took the time and interest in attending the meeting and no one who has the real interest of the schools of Elmore county at heart could well afford to miss this opportunity of listening to the inspiring addresses given by these noted educators of our state. It was an affair that all the state of Idaho is interested in and why should not those who are in responsible positions take an interest in it.
At the close of the session a county organization was perfected to be known as the Elmore County Trustees Association, State Superintend- ant, Miss S. Belle Chamberlain, wisely suggested to those present that it would be no more than right that the officers for the ensuing year be chosen from those trustees in the county who had shown their interest in tire work sufficiently to attend theiWE- *n"M; 111 j 1''s

rest of the trustees in thecount; a goodly number of the representative ■ ntrymen to take some steps toward preparing the land for cultivation, but all that he did was to drag a railway iron across some six acres of ihe entry. Under the showing made in the testimony, we are obliged to hold he did not comply with the law in the matter of cultivation and improvement.
“We think this case comes fully within the rule laid down. This en- tryman failed to comply with the law. His acts were a mere pretense of compliance, both as to residence and ns to improvement. His entry thus became subject to contest, and under such conditions the right of the contestant is as well settled as the •ight of the entryman. When an en- t»y is legitimately subject to contest because of the failure of the entry- man to comply with the law, the contestant has a right to have it candled unde" his contest, and thus
secure a preference right to secure the land for J^mself. The department, ip our judgment, fully estab. lished this rule by the two decisions to which we have referred.
“We hold the allegations of contest have been sustained, and that the entry should have been cancelled.”
