I wanted to take thisopportunitytorespondtoyourallegationsandtoyourdemandthatIcorrectastatementmadeinmyconfidentialreporttotheElPasoCityCouncil.Thestatementcontainedinmyreportisaccurate.Youobjecttomysentencewhichreads,Ms.WilsonslegalcounselindicatedthatshewasadvisingMs.Wilsonnottocooperatewiththisinvestigationanyfurther.Youremailtome,includedwithyourdemandletter,stated,Therefore,IcannotletMs.Wilsonrespondtoyourinquiryatthistime.Mysummationofyourstatementisentirelyaccurateandyouwillbehardpressedtoprovethatitis,asyouclaim,indisputablyfalse.Yourletterdoesnotspecifythetypeoflegalactionyouarecontemplating,butIsuggestthatitisnotlikelytobefruitfulforyourclient.Firstofall,IhavemadenopublicstatementaboutMs.Wilsonorherwillingnesstocooperate.Thesentenceyouobjecttowasincludedwithintherenditionofalegalanalysisclearlymarkedaswithintheattorneyclientprivilege.Ididnotmakethisstatementavailabletothepublicnorwiththeintentthatitbemadepublic;thedecision towaive the confidentialnatureof this statement lieswith the client. I didnotprovidethisdocumenttothemediaortoanyoneotherthanthemembersoftheCityCouncilandtheCityAttorney.Second,Ms.Wilsonsstatusasapublicfigurewillfurthercomplicateanyclaimsheasserts.Third,itwillbeyourburdentoprovethefalsityofmystatement;asnotedabove,Iamconfidentintheaccuracyofmystatement.Fourth,youwillhaveadifficulttimeestablishingcalculabledamagessufferedbyyourclient.Giventheinherentchallengesthatsuchaclaimwouldface,Isuggestthatpursuingsuchaclaimwouldbefrivolousandintendedtoharassmeandtodistractfromotherissues.AsImentionedduringourtelephoneconversation,IdonotbelievethatMs.Wilsonactedunilaterallyindelayingtheissuanceofthelocalgovernmentcorporationsbonds;Ibelieveherwhenshewritesthatsheactedattherequestofothers.Iwasmerelyseekinghelpinidentifying the parties who are ultimately responsible.
