Adverse Possession

Property transactions will often highlight an area of land which has been occupied by the vendor but which is not in fact included in their legal title. Trying to locate and negotiate with the legal title owner of the land to correct the issue may be time-consuming, costly and could result in the demand of a ransom payment.

Our Adverse Possession policy can be used when there is no intention to register the area in question at the Land Registry and offers protection against the cost of defending, settling or compensating if a third party challenges the occupation of the area in question.

Bankruptcy Lender Cover

Whenever a property is transferred at undervalue, or for no consideration, the transaction can be reduced pursuant to Article 312 of the Insolvency (Northern Ireland) Order 1989 if the transferor becomes bankrupt. Lenders are extremely cautious in these circumstances and can be unwilling to release funding until protection is obtained in the form of a Title Indemnity Policy.

Our policy offers comfort to the lender as it offers protection against the cost of defending, settling or compensating if there is a challenge under Article 312 of the Order.

Missing Deeds and Unknown Restrictive Covenants

It is not uncommon for certain title deeds and documentation to be lost throughout the course of a property’s history. This may leave gaps in the chain of title to a property and may result in the vendor being unable to demonstrate their title to the land conclusively.

First Title can provide protection should a third party claim a right to the land in question due to the missing title deeds. A lost deed can also result in uncertainty over the existence of restrictive covenants relating to the property. Our Unknown Restrictive Covenants Policy can insure against the risk of such restrictive covenants being enforced by a third party, where the Insured may be inadvertently in breach of the terms of a missing deed.

Limited Title Guarantee or Lack of Warranties

The sale of property by a receiver or a mortgagee in possession can be challenging as, often the vendor has very limited knowledge of the property and is unwilling or unable to provide the purchaser with full title guarantees and warranties.

This can leave the purchaser blind to any unknown issues which may arise such as fraud, forgery, incapacity of prior owners, and other unknown third party challenges. In short, our policy can replace the missing title guarantees and warranties, giving the purchaser peace of mind and avoiding last minute price negotiation.
