Board of Trustees meeting held January 11, 2011

1. Public Session Call to Order

The Board President (Les McCabe) called the meeting to order at 4:00 p.m. The meeting was held in the Margaret M. Randolph Board Room on the Merced College Campus in Merced.

2. An opportunity was provided for members of the public to address the Board on matters of general district business. No one addressed the Board.

Marilyn provided a presentation on the Child Development Center at Merced College. Discussion occurred.

b. Vice President Cuchna introduced Learning Resources Director, Dr. Susan Walsh.

Library Collection

Dr. Walsh gave a presentation on the Library Collection at Merced College. Discussion occurred.

Dr. Duran explained the California Community College Trustees holds Board elections on an annual basis and they look for individuals who are interested

in serving on that board. Any of our trustees who are interested can complete the nomination form to be submitted. Contact Dr. Duran for assistance.

b. Sabbatical Leave Application – Arguelles

Dr. Tortorici stated that Professor Marcus Arguelles had been approved for sabbatical in spring 2011 by the Board. The location he was to visit during his sabbatical burned down and he is requesting to delay his sabbatical to spring 2012.

MSC (Haden/Lashbrook) to approve the postponement of Professor Marcus Arguelles’ sabbatical leave to spring 2012. Trustee Jordan abstained.

c. Sabbatical Leave Application – Hobbs

Dr. Tortorici said that Professor Lee Anne Hobbs’ sabbatical leave request has gone through the appropriate channels within the District for approval.

She added that there are two other applications which have been returned to the applicants for more information and to be fully completed. If those applications are completed and re-submitted to the committee, they may come forward to the Board for consideration in February.

MSCU (Vierra/Haden) to approve the sabbatical leave of Professor Lee Anne Hobbs.

10. a. To the Board for Information

Dr. Duran stated the Governor released his 2011-2012 state budget and a webinar was held today on the budget. Articles on the budget were provided to the Trustees. There will be a budget workshop in Sacramento this Friday and staff from the college will attend.

Budget Update

Vice President Brewington said the Community College League of California and the Chancellor’s Office are reminding us this budget is preliminary and they are unsure where our system will end up. They are surprised at the $400 million cuts proposed to community colleges. There is no language that allows for us to do a workload reduction, which means we would have to retain our FTE base while still facing the cuts in the budget. The Governor plans to have a special election in June asking voters to extend the taxes passed a few years ago, but it is not likely the extensions will pass. If the tax extensions are not passed, the system will face another $488 million in cuts. Vice President Brewington reviewed some of the areas of concern we have in the budget and how we will be impacted as well as some of the unknown factors that remain in the state budget. It is hoped we will have more information after the budget workshop on Friday. The Budget Committee and

Educational Master Planning Committee will be reviewing the information gathered at the workshop when they begin to meet again. Discussion occurred.

10. a. Information & Questions

Trustees Troost, Lashbrook, and Jordan had nothing to report. From Board Members

Trustee Haden stated with this new Governor the old smoke and mirrors still remain. Trustee Vierra encouraged everyone in the District to take part in the development or updating of our security plan. He looks forward to the presentation on campus security with an example of how an emergency would be handled. Trustee McCabe thanked the staff for the presentations tonight. The Allied Health graduations were delightful.

b. No one present to report. From Academic Senate

Keith Law wished everyone a happy new year and decade. The first date for dinner with the Trustees is February 3 and the faculty would like to have two Trustees attend. The Chief Negotiator said contract negotiations are ongoing and there was good news. There is one outstanding grievance. The Association sees two issues which need to be addressed: one is faculty being compensated for credit by exam and the other is faculty being compensated for program review.

Richard Zeunges said CSEA elections were held and he was elected President for another year. Last Thursday CSEA representatives addressed the management team to discuss the contract and help to improve communication. They were happy with the results and look forward to doing that again. An updated list of jacketed job stewards will be given to Dr. Duran soon to share with the management team. He wished everyone a happy new year.

f. Susan Walsh thanked the CSEA representatives for attending the meeting last week and providing some very helpful information to the managers on campus. She also wished everyone a happy new year.

Superintendent’s Report

11. Future Discussion Items from Board Members

Trustee Lashbrook would like to get input from faculty and classified staff regarding processes at the college and how programs and interactions are happening. She is also interested in having the Board review administrator contracts. She will talk with Dr. Duran on the specifics of her request.

Trustee Jordan has concern regarding retirees not getting full service credit for sick leaves. He will gather more information and discuss this with Dr. Duran and Vice President Brewington.

The Purchasing Office has received equipment from various departments declaring that the equipment is no longer needed or suitable for educational purposes. In accordance with District Administrative Procedure 2240, these items will be made available to other departments within the District prior to the time of their sale or disposal. Merced College uses Ernst Auction Park (License #C2696) for all public sales (private sales, pursuant to Education Code 81452, are still administered by the District’s Purchasing Office). Resolution to Establish Nonresident Tuition Fee Per Unit

Background Information

Provisions of Education Code 76140, as amended by AB 2825, Chapter 789/80, requires each governing board to establish the nonresident tuition fees not later than February 1 for the succeeding fiscal year. The State mandates that a nonresident tuition fee adopted by Boards of Trustees will be equal to the amount, which was expended by the district for the expense of education or the statewide average. The District has the option of selecting the statewide average, the District average cost, the District average cost with 10% or more noncredit FTES, using the cost of a contiguous District, no more than District average cost; no less than statewide average cost, highest years statewide average tuition, or no more than 12 comparable states average tuition when setting its nonresident tuition fee. The contiguous districts for Merced are the Yosemite and State Center community college districts. In prior years, the District has set its nonresident tuition rate at the statewide average, as did Yosemite and State Center, in order to be competitive in the recruitment of nonresident and foreign students. Whereas the District wishes to remain competitive with the other districts, the Administration is recommending using the contiguous district option which will establish the rate of $208 per unit for the 2011-12 fiscal year.

Recommendation/Requested Action

It is recommended that the Board of Trustees establish the nonresident tuition fee for 2011-12 at $208 per unit and adopt the attached Resolution.

RESOLUTION 11-64 TO ESTABLISH NONRESIDENT TUITION FEE PER UNIT FOR FISCAL YEAR 2011-12

WHEREAS, the Governing Board of the Merced Community College District, pursuant to the provisions of the Education Code, Section 76140, as amended by AB 2825, Chapter 789/80 and SB 716, Chapter 985/89, may by majority vote of its membership, establish the nonresident tuition fee for 2011-12 fiscal year. NOW THEREFORE BE IT RESOLVED, that the nonresident fee, as of June 1, 2011, based on selecting the contiguous district option, be established at $208 per unit for fiscal year 2011-12. Resolution 11-65 Declaring February 2011 as Black History Month at Merced Community College District

WHEREAS, The Merced Community College District Governing Board honors the heritage of African Americans and acknowledges their many contributions to our Nation; and WHEREAS, Dr. Carter Woodson established Black History Week in February 1925, choosing a month that marks the birthdays of two important men who greatly impacted the American black population, Abraham Lincoln and Frederick Douglass; and WHEREAS, in the year 1976, the observance was expanded to Black History Month; and WHEREAS, this month holds great significance from the many milestones it contains: on February 23, 1868, the civil rights leader and co-founder of the NAACP, W.E.B. DuBois was born; on February 3, 1870, the 15th

Amendment, granting blacks the right to vote, was passed; on February 12, 1909, the NAACP was founded, and on February 1, 1960, a civil rights movement milestone occurred when a group of black college students began a sit-in at a segregated Woolworth’s lunch counter in Greensboro, North Carolina; and

WHEREAS, all of these events and historic visionary leaders such as Frederick Douglass, Thurgood Marshall, and Dr. Martin Luther King, Jr., blazed a trail for freedom, equality, and opportunity and symbolize why Black History Month is celebrated; THEREFORE BE IT RESOLVED, that the Merced Community College District proclaims February 2011 as Black History Month. Background Information

Merced College will be visited by a team of educational professionals appointed by the Western Association of Schools and Colleges from March 7 through March 10. The team leader will be Dr. Jackie Fisher. It is anticipated that there will be approximately eleven team members representing various faculty and administrative areas. During the coming month we will be assisting with the arrangement of housing, setting up the Team Room, and scheduling numerous appointments with college personnel. These will include members of the Board of Trustees. The team members will inform us who they wish to meet during their time with us. Either Stacey Hicks or Toni McCall will work with you to schedule specific appointment times. The Board Room will be designated as the Team Room. The primary purpose of the visit is to validate the information and evidence that was provided in our self-study. Thus, the team will be quite focused on reviewing our documents and meeting the leaders of our college community or those who participated in writing the study. I also anticipate that they will wish to visit the Los Banos Campus. Attachment: Initial list of team members
