The 226th

meeting of SEAC was held in Directorate of Environment, U.P. on

10/07/2015. Following members were present in the meeting along with Secretary,

SEAC:

The Chairman welcomed the members to the 226th

SEAC meeting.

The minutes of 225th SEAC meeting dated 04/07/2015 were confirmed.

The Members of SEAC unanimously taken following decisions on the agenda

points discussed:

1. Group Housing Project at Khasra No-1109, 1110, Vill-Morta, Ghaziabad. Sri

Vijyant Jain, Director, C-10, Ramprastha, Ghaziabad. File No. 2492/SPO-V

The committee noted that consultant to the project could not present their

accreditation/credentials related to QCI/NABET. The proponent was also not ready with their

presentation. The committee directed to appear with complete documents and accreditations.

The committee also directed to submit all approved plans and the matter shall be deferred till

request from the project proponent in this regard.

2. Group Housing “Akansha Basera” No-5, Sector-K, Sushant Golf City, Hi Tech

Township Extension Area, Lucknow. Sri Vinod Tikku. File No. 2531/AD-Sub

The project proponent did not appear. The committee discussed and deliberated that

project fie should be closed and should be opened only after request from the project

proponent. The file shall not be treated as pending at SEIAA/SEAC.

3. Group Housing “Hamony Enclave” No-4, Sector-K, Sushant Golf City, Hi Tech

Township Extension Area, Lucknow. Sri Vinod Tikku, Ex. Director (Project) , File

5. Group Housing Project “Aunipark” at Plot No-INS-02, CHI-V, Yamuna

Expressway, Greater Noida. Dri Dinesh Kumar, GM. File No. 2546/AD-Sub

The committee noted that an application dated 26/08/2014 was made by the project

proponent for environmental clearance of Group Housing Project “Aunipark” at Plot No-

INS-02, CHI-V, Yamuna Expressway, Greater Noida.

A presentation was made by Shri Mahendra Pandey as consultant and representative

of project proponent. Mr. Pandey informed the committee that the project proposal has been

revised and now the built up area as 1,58,088.596 sqm hence, the proposals are not covered

under category 8"b". The committee directed to submit complete revised proposals and to

defer the matter for next meeting for scoping. An affidavit shall also be submitted by the

proponent that no construction work has been yet started on the site.

6. 300 Beded combined hospital at Gata No.41/1,42 Tehsil-Sadar, District-Bareilly- File

No. 2564/DD-Y

The committee noted that an application dated 18/09/2014 was made by the project

proponent for environmental clearance of 300 Beded combined hospital at Gata No.41/1,42

Tehsil-Sadar, District-Bareilly.

A presentation was made by Dr. S.S. Sachan, Deputy CMO, Bareilly, project

proponent alongwith their consultant M/s Sawen Consultancy Services Pvt. Ltd.

The project proponent informed that committee that 25% construction work has

already been undertaken. The committee discussed the matter and deliberated that Hon'ble

NGT in its order dated 07/07/2015 in the matter of S.P. Muthuraman V/s Union of India and

Ors. (Original Application No. 37 Of 2015 (M.A. No. 291, 293 & 294 Of 2015) and Original

Application No. 213 Of 2014 (Ma 755 Of 2014 & M.A. No. 177 Of 2015) has quashed the

MoEF OMs dated 12/12/2012 and 27/06/2013 related to provisions for dealing the violation

matters. In this situation the matter may be forwarded to SEIAA for taking necessary action

in view of Hon'ble NGT decision dated 07/07/2015.

7. Group Housing Project “Gangotri Enclave” at Plot No-8/GH-4, Sector-8, Avadh

Vihar Yojna (Sultanpur Road) Tehsil & Distt-Lucknow. Er. R B Yadav, Ex. Engg.,

CD-15, 2nd Floor, Sector-9, Vrindavan Yojna, Raebarelly Road, LKO. File No.

2731/DD-Y

The committee noted that the matter was earlier discussed in SEAC meeting dated

01/06/2015 wherein the project proponent did not appear. The matter was again scheduled in

SEAC meeting dated 10/07/2015.

A presentation was made by Shri R.B. Yadav, Ex. Engineer, UP Awas Avam Vikas

Parishad alongwith their consultant M/s Sawen Consultancy Services Pvt. Ltd. The

committee discussed the matter and directed the proponent to submit following information:

1. Area details showing proposed uses as residential, commercial, parks, parking, roads,

other services, facilities of the project also in percentage.

2. Maps/plans/services plans approved by Competent Authority.

3. Land allotment letter.

4. The structure design certificate by qualified structure engineer should be submitted.

The structural design certificate should preferably be vetted by IITs/CBRI. Provision

7. Solid waste management and disposal plan with identification of authorized agency. .

8. Plan for 03 m peripheral green shall be provided along the boundary of the project.

9. Plan for Rain water harvesting.

10. Plan for plantation of minimum 300 trees should be submitted.

11. Provision of 100% solar lighting along the road site, stair cases, common places.

12. NOC from Fire Department and Airport Authority of India.

The matter shall be discussed after submission of information as above.

8. Group Housing Project “Bhagirathi Enclave” at Plot No-GH-1, Sector-2B, Avadh

Vihar Yojna (Sultanpur Road) Tehsil & Distt-Lucknow. Er. R L Yadav, Ex. Engg.,

UPAVP, Office Complex, Boothnath Mandir Marg, Indira Nagar, LKO. File No.

2732/AD -H

The committee noted that an application dated 24/12/2014 was made by the project

proponent for environmental clearance of Group Housing Project “Bhagirathi Enclave” at

Plot No-GH-1, Sector-2B, Avadh Vihar Yojna (Sultanpur Road) Tehsil & Distt-Lucknow.

A presentation was made by Er. R.L. Yadav, UP Awas Avam Vikas Parishad

alongwith their consultant M/s E.C. Engineers, Jaipur. The committee discussed the matter

and directed the proponent to submit following information:

1. Area details showing proposed uses as residential, commercial, parks, parking, roads,

other services, facilities of the project also in percentage.

2. Maps/plans/services plans approved by Competent Authority.

3. Land allotment letter.

Lucknow. Er. Ramesh Mishra, Ex. Engg., Div-21, UPAVP, LKO. File No.

2733/SPO-V

The committee noted that an application dated 20/12/2014 was made by the project

proponent for environmental clearance of Group Housing Project “Mandakini Enclave” at

Khasra no. 183, 189, 190, 193, 184, 185, 186, 187, 188, 191, 192, 194, 195 & 196 Avadh

Vihar Yojna (Sultanpur Road) Lucknow.

A presentation was made by Shri Ramesh Mishra, Executive Engineer, UP Awas

Avam Vikas Parishad alongwith their consultant M/s E.C. Engineers, Jaipur. The committee

discussed the matter and directed the proponent to submit following information:

The committee noted that an application dated 24/12/2014 was made by the project

proponent for environmental clearance of Group Housing Project “Alaknanda Enclave” at

Plot No-G-2 & G-3, Khasra No. 217, 228-233, 243-254, 256, 259-266, Avadh Vihar Yojna

(Sultanpur Road) -Lucknow.

A presentation was made by Shri Anil Kumar Mishra, Executive Engineer, UP Awas

Avam Vikas Parishad alongwith their consultant M/s E.C. Engineers, Jaipur. The committee

discussed the matter and directed the proponent to submit following information:

11. Bhaunrat Dam Irrigation Project having CCA 9850 Ha in Mahrouni, Lalitpur. Sri

K.K. Agrawal, Ex.Engg, Irrigation Construction Div-II, Lalitpur. File No.

2641/OSD-T

The committee noted that an application dated 04/11/2014 was made by the project

proponent for environmental clearance of Bhaunrat Dam project, Tehsil-Mehrouni, District-

Lalitpur. Gross Command area for irrigation is 13450 ha & culturable command area is 9850

ha (Existing command 7995 ha and new command 1855 ha). Terms of reference were issued

through letter dated 02/12/2014. Public hearing was undertaken on 25/04/2015 in village-

Bhaunrat, Tehsil-Mehrauni, District-Lalitpur, U.P. under Chairmanship of Shri ADM,

Lalitpur. Final EIA was submitted through letter dated 21/05/2015.

A presentation was made by the project proponent and along with their consultant M/s

CEMC Pvt. Ltd. The proponent, through the documents submitted and the presentation made,

informed the committee that:-

1. The environmental clearance is sought for Bhaunrat Dam project, Tehsil-Mehrouni,

District-Lalitpur. Gross Command area for irrigation is 13450 ha & culturable

command area is 9850 ha (Existing command 7995 ha and new command 1855 ha).

2. Project details of the project is as follows:

3. Bhaunrat Dam Project is proposed for providing irrigation facility for an area of 9850

Ha.

4. The TOR was approved on 15-11-2014 vide letter no. Parya/SEAC/2641/2014

/OSD(T).

5. The baseline environmental studies have been conducted during November 2014 to

February 2015 as per the approved TOR and Draft EIA was submitted to U.P.

Pollution Control Board for conducting Public Hearing.

6. The Public Hearing was conducted on 25-04-2015 in village-Bhaunrat, Tehsil-

Mehrauni, District-Lalitpur, U.P.

7. The Final EIA after incorporating public hearing minutes and action plan has been

submitted for environmental clearance to SEIAA.

8. Jamni Dam Irrigation project already exists on Jamni River which is approximately 20

km upstream of the proposed dam. However, the catchment area of 335 Sq. Km is

untapped which will act as catchment by the proposed project.

9. The District Agriculture Officer has assessed that the project on completion will cater

to an area of 9000 ha during Khariff and 7700 ha in Rabi.

10. Land requirements for the project are 1266.78 out of which 201 Ha is forest land. The

villages Satlinga, Bhaunarat, chaprat, Kisarda, Mudia, Vedpur are impacted due to

submergence.

11. 311 families, 78 Pucca and 347 Kachcha houses will be affected and to be

rehabilitated. Appropriate compensation packages according to the R & R policy,

2007 will be provided to those families who are identified by the committee formed

by govt. for R & R work of this project.

12. The total project cost is Rs. 44003.77 Lakh & a total budget of Rs. 1565.37 Lacs +

6.03 ha land for resettlement purposes would be required for the Resettlement and

Rehabilitation Plan.

13. Total project cost is Rs. 440.Crores and CSR expenditure will be in the form of

providing employment for 100 persons. The drinking water and health Check-up to be

provided. CSR will be 3.557% for social benefits and other services.

14. Forest land is in the active stage of acquisition. The report for this has been prepared

and being investigated by the Forest Department.

15. The project proposals are covered under category 1"c" of EIA notification, 2006, as

amended.

The committee discussed the matter and observed that following provisions have been

prescribed in OM No. J-11013/41/2006-IA.II(I) dated 09/09/2011 of MoEF, Govt. of India

regarding "Consideration of projects for grant of environment clearance under EIA

Notification, 2006, which involve forestland - Procedure to be followed-further

clarifications":

"At the stage of consideration of proposals for EC in respect of projects involving

forestland, the project proponent would inform the respective EACs about the status of

their application for forestry clearance along with necessary supporting documents from the

concerned Forest Authorities. It will clearly be informed to the EAC whether the application

is at the State level or at the Central level. The EAC will take cognizance of the involvement

of forestland and its status in terms of forestry clearance and make their recommendations

on the project on its merits. After the EAC has recommended the project for environmental

clearance, it would be processed on file for obtaining decision of the Competent Authority

for grant of environmental clearance. In the cases where the Competent Authority has

approved the grant of environmental clearance, the proponent will be informed of the same

and a time limit of 12 months, which may be extended in exceptional circumstances to 18

months, a decision on which will be taken by the Competent Authority, will be given to the

proponent to submit the requisite stage-I forestry clearance. The formal environmental

clearance will be issued only after the stage-I forestry clearance has been submitted by the

proponent.

In the eventuality that the stage-I forestry clearance is not submitted by the

proponent within the prescribed time limit mentioned at para (ii) above, the proposal for

environmental clearance will stand rejected and the entire process of obtaining

environmental clearance will have to be initiated de-novo as per the procedure prescribed

under EIA Notification, 2006."

In view of above, the committee directed that compliance to above provisions of OM

dated 09/09/2011 should be submitted in terms of status of their application for forestry

clearance along with necessary supporting documents from the concerned Forest Authorities

prior to further consideration of project. The committee also directed to submit 24 year

records of flood data of the River and excavated Soil management and uses.

The matter may be scheduled immediately after submission of information/documents

as above.

12. Trade Facilitation Centre & Crafts Museum at Bada Lalpur, Varanasi, U.P. Si

A presentation was made by Shri S.Srinivas, NHDC Ltd., project proponent

alongwith their consultant M/s Grass Roots Research & Creation India (P) Ltd. The

committee discussed the matter and directed the project proponent to submit following

information:

1. Physical features within 30 m of the project site with their ownership. 2. Copy of layout plan/maps/services plans as approved by Development Authority.

3. List of proposed activities area wise. 4. Proposed fixed and floating population of the project.

5. Proposal regarding source of water for meeting the water requirement of the project. If ground water is proposed to be used, permission from ground water department should

be taken. Underground water tank for storage of storm water may be provided.

6. Dimensions of ramps and passages proposed for the project.

7. Pathways to connect the building should be explicitly shown on layout.

8. Proposal for rain water harvesting only from the rooftop. Plan for water body with

Kachha base should be submitted for storm water utilization for water recharge.

9. The structure design certificate by qualified structure engineer should be submitted. The

structural design certificate should be vetted by IITs/CBRI. Provision of alarm system,

to timely notify the employees/residents/visitors in case of occurrence of

earthquake/other natural disasters/fire should be provided.

10. Fire NOC to be submitted.

11. 36 nos. of trees are proposed to be cut. Prior permission from Forest Department should be taken alongwith compensatory plantation.

12. Identify authorized agency for Municipal solid waste management and disposal as per law. Submit plan. Location of landfill site to be provided.

13. Plan for provision of 100% solar energy on roads/streets and common places should be submitted.

14. Environmental Corporate Responsibility (ECR) plan along with budgetary provision amounting to 2% of project cost shall be prepared and approved by Board of Directors

of the company. A copy of resolution as above shall be submitted to the authority alongwith list of beneficiaries with their mobile nos./address.

The matter shall be discussed after submission of information as above.

The committee noted that the matter was earlier discussed in SEAC meeting dated

31/01/2015 and 21/02/2015 wherein the project proponent was directed to submit

information. The project proponent submitted information through undated letter received on

28/04/2015. However, Dr. D.C. Gupta, Member, SEAC informed that he has not received the

copies of replies yet. Therefore, the committee directed to defer the matter for next meeting and directed the project proponent to ensure delivery of replies.

14. Group Housing “Ashwaryam” at Sector-16C Noida Extension (Gaur City-2)U.P.

The committee noted that the matter was earlier discussed in SEAC meeting dated

17/03/2015 wherein the project proponent was directed to submit information. The project proponent submitted information through undated letter received on 28/04/2015. However,

Dr. D.C. Gupta, Member, SEAC informed that he has not received the copies of replies yet.

Therefore, the committee directed to defer the matter for next meeting and directed the

project proponent to ensure delivery of replies.

15. Group Housing Project “RG Luxury Homes” at Plot No-GH-07A, Sector-16B,

Greater Noida Sri B K Agrawal, Sr. VP (Operation) File No. 2540/AD-H

The committee noted that terms of reference in the matter were prescribed in SEAC

meting dated 22/03/2015 and EIA have been submitted through letter dated 15/06/2015. The

EIA report was also not submitted to all the members as informed during the meeting,

therefore the presentation could not be made. The committee discussed and directed to schedule the matter as per chronology of 8"b" Category projects.

16. Theme Park, Agra, U.P., Developed by UPSIDC. Sri M L Sonkar, Ex. Engg (HQ),

UPSIDC Ltd., A-1/4, Lakhanpur, Kanpur. File No. 2576/AD(Sub)

The committee noted that the matter was earlier discussed in SEAC meeting dated

25/05/2015 wherein the project proponent was directed to submit following information:

1. NOC from Taj Trapezium Zone Authority regarding the project proposals. 2. NOC from Central and State Departments of Archaeology.

3. Height of the land from mean Sea level and from maximum flood level.

4. No objection from Irrigation Department.

5. Study should be conducted regarding maximum flood level of 100 years.

6. What are the permissible uses of the site as per Agra Master Plan.

7. Plan for use of Solar Energy. Maximum solar energy uses should be explored.

8. Area details showing proposed uses as residential, commercial, parks, parking, roads,

other services, facilities of the project also in percentage.

9. Phase wise project details and proposed activities.

10. What is the total cost of the project and its detail of different phases. Specially Ist

phase details of project to be implemented with cost and recovery system.

11. What will be the Socio Economic impact on Agra town.

12. What is the distance from Taj Mahal of the proposed site. Whether the view of Taj

will be affected. A complete report with necessary supporting documents should be submitted.

13. Permission to be obtained from Central Ground Water Board for drilling of tube well and for making of water works.

14. Minimum 2% provision is to be made under CSR. The detail with of CSR to be

provided with total cost and scheme to be executed in various phases during the

implementation of project. The list of beneficiaries along with project photographs is

to be submitted.

The committee also observed that the project proponent/EIA Consultant has not fully

complied the TOR POINTS like approval of the lay-out plan, conversion of land use from

agricultural to non agricultural, approvals of entire built up areas, obtaining NOC from NRCD, Irrigation Deptt. central water commission, Archaeological Survey of India etc. The

proposed land area is also not fully transferred and some part of it is under Stay of Hon' High court, Allahabad. The proponent has also not provided the details of the proposed built up

area block wise or building wise. The project proponent has not submitted the DPR actually prepared by the project proponents. The EIA report is not well documents and lacks in the

following:

• The Impact Analysis on the River Yamuna, The study of highest flood level/point and

the calculation of the safity distances, Impact on the seasional floods of Yamuna,alternative sources of water like putting water works instead of ground water

utilisation, Thinking of conducting a bandha along the river.

• There are approx. 400 big trees, many old water wells and the hand pumps etc in the

proposed land but nothing has been discussed in this regard. The same should be

covered under EIA.

• Disposal of domestic waste, domestic solid wastes are tentatively discussed and their

final disposal is also not environmentally safe. A comprehensive plan in this regard

should be prepared and submitted.

The project proponent submitted their replies through letter dated 29/06/2015. A

presentation was made by Shri Ashok Kumar Verma, representative of project proponent alongwith their consultant M/s Perfact Enviro Solutions Pvt. Ltd. The committee discussed

the matter and directed the project proponent to submit following information: 1. Regarding replies submitted against query no. 1, the committee noted that minutes of

meeting dated 07/01/2015 of TTZ Authority as submitted by project proponent states that the matter shall be discussed in next meeting of TTZ Authority after obtaining

EIA report. Since, EIA report in the matter has been prepared by the project

proponent, the same should be submitted to TTZ Authority for

consideration/clearance. Clearance from TTZ Authority should be submitted as also

pointed out by Archaeological Survey of India.

2. Regarding replies submitted against query no. 2, the committee noted that the project

proponent has submitted letter dated 13/01/2015 from Archaeological Survey of India

that proposed theme park is outside of the regulated area of central protected

monument of Archaeological Survey of India. But, since this project falls under TTZ

area, clearance from TTZ Authority is necessary. The SEAC observed that since the

clearance from TTZ Authority is very basic prerequisite of siting of this project,

which is also clear from letter dated 13/01/2015 of Archaeological Survey of India,

the project proponent should submit EIA report to Authority for

consideration/clearance from TTZ Authority. 3. Regarding replies submitted against query no. 4, the project proponent has submitted

copy of letter dated 03/01/2015 of Executive Engineer, Irrigation Khand, Hathras, wherein conditional NOC has been provided. However, it is also mentioned in the

letter dared 03/01/2015 that NOC from Lower Khand, Agra Canal, Agra and Irrigation Nirman Khand, Mathura shall also be obtained by the project proponent.

The committee directed that NOCs from all required agencies as mentioned in letter

dated 03/01/2015 of Executive Engineer, Irrigation Khand, Hathras should also be

submitted for consideration.

4. Regarding replies submitted against query no. 5, the project proponent submitted

abstract of annual flood report from Irrigation Department with submission that

maximum flood level of Yamuna River in past 100 year was found to be 154.760 in

1987. The committee observed that document dated 20/08/2014 which provides

"nSfud unh ty Lrj ,oa ck<+ dh lwpuk ¼lwpuk dk lzksr&dsUnzh; ty vk;ksx] y[kuŽ" however, in this documents it is not mentioned that it relates to information for last

100 years. Also, in Colum no. 5 of this information dated 20/08/2014 highest flood

level of Agra is 154.760 m for year 1978 however, the project proponent in his

presentation has mentioned it as year 1987. This mismatch should be clarified

alongwith documents which mentions that the submitted data relates to highest flood

levels for last 100 years. The committee also directed to submit horizontal expansion of flood within last 100 years. The proponent also informed that embankment shall be

constructed along the project boundary towards River Yamuna. The committee directed to submit NOC from related Department. The committee also directed to

submit study regarding the impact of construction of embankment on the other side of River Yamuna. A study of 100 years Flood level in future to be submitted to protect

and plan accordingly. 5. Regarding replies submitted against query no.6, the project proponent submitted that

as per Agra Master Plan, 2021 the land use for the land in question is "Agriculture". Part of the land was acquired by Agra Development Authority for "Planned

Development for 100 M Wide Road from NH-2 to NH-3 and land parcel" and the

balance was acquired by UPSIDC for "Development of Theme Park". The proponent

also informed that Agra Development Authority has informed through letter dated

03/06/2015 that Theme Park/Amusement Park is permitted to be established in the

land in question pursuant to G.O. No. 3150/41-2013-37YO/2012, dated 06/11/2013.

The SEAC noted that letter dated 03/06/2015 of Secretary, ADA states that proposal

for amendment in zoning regulation for establishment of Theme Park/Amusement

park in "Agriculture Land use" of Master Plan has been sent by authority to Govt. The

SEAC directed to submit Zoning regulation/Master Plan as approved by State Govt.

in continuation to letter dated 03/06/2015 of Secretary, ADA. Copy of Govt. Order

regarding 25% use of land for other activities is to be submitted. 6. Regarding replies submitted against query no.8, Activity wise land uses have been

submitted. The committee directed to submit approved plan/layout of the project by competent authority. The project proponent informed that the ADA has no jurisdiction

over the proposed site for approval. The committee directed to submit communication between project proponent and ADA where it has been communicated that ADA has

no jurisdiction over the proposed site for approval. Also, approved activity wise land uses from UPSIDC should be submitted as project proponent submitted that the

project is under jurisdiction of UPSIDC. 7. Regarding replies submitted against query no.9, the project proponent submitted that

first phase is to be completed in first four years from the date of commencements the

committee directed to submit complete development details of first phase alongwith

area chart. Phase wise list of activities alongwith corresponding area calculation

charts should be clearly mentioned and submitted for which environmental clearance

is sought. Plan for services, roads, parking, solid waste management, green/plantation,

structural safety, water management, sewage should also be provided accordingly.

8. Regarding replies submitted against query no.12, arial distance to Taj Mahal from

proposed site is 6.20 KM SW whereas distances via road is approximately 17.2 KM.

The project proponent also submitted calculation to establish that Taj Mahal from the

proposed site of Theme Park can not be visualise. So the view of Taj Mahal will not

affected by this proposed project Theme Park in Agra.

9. Regarding replies submitted against additional queries, the project proponent

submitted an undertaking dated 29/06/2015 by Shri Suresh Kumar, Regional

Manager, UPSIDC Ltd., Agra that UP State Industrial Development Authority is

authorized to approve layout plan of area falling under UPSIDA jurisdiction

accordingly the layout plan of the project shall be approved by the competent

authority of UPSIDA before actual execution of the proposed project. The committee

discussed the matter and directed to submit approved plans to be considered by

committee. The proponent has also not provided the details of the proposed built up area block wise/building wise/activity wise which should be submitted for

consideration. Application should also be submitted to NRCD for NOC and its copy should be submitted to SEAC.

10. The project proponent also submitted that only 26 acre land is under stay from Hon'ble High Court. Efforts are being made to settle the dispute through negotiation

before commencements of the project. The committee directed to submit specific plans on this proposed 26 acres land which is under stay from Hon'ble High Court.

11. Regarding study on impact analysis on the River Yamuna, project proponent submitted that a study shall be conducted by the consultant and shall be submitted.

Project proponent also submitted that tress and old water structure shall be retained to

the maximum extent possible.

The committed directed to submit information regarding above issues

alongwith approved DPR regarding the project. The matter shall be discussed after

submission of information as above.

17. Leather Technology at B-12, Leather Technology Park, UPSIDC, Banthar, Unnao,

The project proponent did not appear. The committee discussed and deliberated that

� Collection

• Segregated waste shall be collected in the different colour coded liners placed

in bins or in coloured plastic bins as Yellow, Red, Blue and Black.

• Door to door collection facility will be provide to health care units.

� Transportation

• Waste shall be transported by 10 fully covered specially designed vehicle (as

per the guidelines of CPCB).

• Separate cabins for driver/staff and the bio medical waste.

• The vehicles will be properly labelled with the symbol of Biohazard as per

schedule III of the Rules and will display the name, address and telephone

number of the Company.

• The inner surface of the waste cabin will be made of smooth surface to

minimize water retention.

• The waste cabin will have provision for sufficient opening from rear side so

that Bio Medical Waste can be easily loaded and unloaded.

• The vehicles will be provided with the first aid kit to handle emergency

situations.

• Mobile phones will be given at all the vehicles for effective supervision and

monitoring of collection and transportation work.

� Treatment

• 3 types of treatment will be provide in biomedical waste management facility-

Incineration, Autoclaving & Shredder.

• Separate rooms for all the three equipments will be made.

� Final Disposal

• Plastic waste after disinfection and shredding will be handed over to

authorized plastic waste recycler.

• Disinfected sharps will be encapsulated on site.

• A non leachate and covered ash pit will be provided inside the CBWTF for

deep burial of Incineration ash.

• Final waste, i.e. incinerated ash will be dumped in the deep burial unit.

8. Wastes management details are as follows:

� Industrial waste management:

• Incineration Ash will be generated as end product which will be dumped into

deep burial.

• Plastic bottles treated from plastic shredder will be given to the recyclers.

• Glass bottles shall be sold to recycler.

• Sharps will be treated in autoclave.

� Municipal Solid waste management:

• 7.5 kg/day solid waste will generate from 50 persons who will be engaged as

staff in operation phase.

• MSW from staff will be treated in Organic waste convertor.

• Used oil from the D.G set and incinerator will be collected in black colour

coded plastic container.

• Waste shall be collected in the leak proof containers at isolated place and then

it will be given to approve vendor of CPCB as per hazardous waste rules,

2011.

The committee discussed the matter and recommended following TORs for

conducting EIA studies regarding the proposals in view of amendment in EIA Notification

dated 17/04/2015:

Additional TORs :

1. Executive summary of the project – giving a prima facie idea of the objectives of the

proposal, use of resources, justification, etc. In addition, it should provide EMP. 2. Justification for selecting the proposed capacity of the incineration facility.

3. Status of project with reference to guidelines of CPCB regarding establishment of Bio Medical Waste Disposal Facilities.

4. Establishment of the facility as per Bio Medial Waste (Management & Handling) Rules 1998 (as amended).

5. Land requirement for the facility including its break up for various purposes, its availability and optimization.

6. Details of proposed layout clearly demarcating various activities such as security,

7. Waste Storage Rooms, Waste Treatment Equipment Rooms/Areas, Treated Waste

Storage Room, Pollution Control Devices like APCS and ETP, ash storage/disposal

area, vehicle washing areas, and others such as admin area, worker’s room, health

centers, greenbelt, etc.

8. Details on collection and transportation of Bio Medical Waste from health care

establishments. No. of vehicles and feature of vehicles, etc.

9. Details of waste storage facilities/rooms.

10. Treated water to be recycled and Commitment of zero discharge is to be submitted.

11. Details of the treatment equipment’s capacity and make.

12. Details of the incineration system – a statement on the compliance to the CPCB

guidelines for common bio medical waste incinerators in respect of waste feed

cutoffs, operating parameters of combustion chambers, flue gas cleaning, ash handling, etc.

13. Details on fuel requirement for incineration. 14. Details on flue gas emissions discharge through stack and proposed pollution control

technologies. 15. Details on residue/ash generation and management.

16. Details of waste heat utilization, if any. 17. Details on wastewater management alongwith zero discharge plans as committed by

the project proponent.

18. Details of the proposed overall safety and health protection measures.

19. Details on source of water and power to the facility.

20. Details of the existing access road(s)/walkways to the designed operations in the site

and its layout.

21. Location of the incineration facility and nearest habitats with distances from the

facility to be demarcated on a toposheet (1: 50000 scale).

22. Landuse map based on satellite imagery including location specific sensitivities such

as national parks / wildlife sanctuary, villages, industries, etc.

23. Topography details.

24. Surface water quality of nearby water bodies.

25. Details on proposed groundwater monitoring wells, locations, frequency of

monitoring, parameters, etc. 26. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of total project cost shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be submitted to the

authority alongwith list of beneficiaries with their mobile nos./address.

27. Action plan for the greenbelt development in accordance to CPCB published

guidelines.

Similarly the waste water calculation should be based on factual facts supported by

the authentic data.

22. Hydro-geological investigations be carried out and obtain permission from Central

Ground Water Authority for withdrawal of ground water.

23. Consider soil characteristics and permeability for rainwater harvesting proposals,

should be made to prevent ground water contamination. Maximize use of treated

water by recycling and utilization of rainwater.

24. Make provision for safety against failure in the operation of wastewater treatment

facilities. Identify acceptable outfall for treated effluent.

25. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

other services and make adequate provisions in the proposal.

29. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

30. Application of renewable energy/alternate energy, such as solar and wind energy may

be described including solar water heating in the guidelines for entrepreneurs.

31. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

32. Identification of recyclable wastes and waste utilization arrangements may be made.

33. Explore possibility of generating biogas from biodegradable wastes.

34. Arrangements for hazardous waste management may be described as also the

common facilities for waste collection, treatment, recycling and disposal of all

effluent, emission and refuse including MSW, biomedical and hazardous wastes.

Special attention should be made with respect to bird menace.

35. Provisions made for safety in storage of materials, products and wastes may be

described.

36. Disaster management plan should be prepared.

37. Traffic management plan including parking and loading/unloading areas may be

described. Traffic survey should be carried out both on weekdays and weekend.

38. Parking provision is to be made for higher ECS worked out either as per state bye-

laws or construction manual of the MoEF

clearly mentioned

51. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

52. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

and signature of Project proponent along with consultant with seal should be submitted,

so as to ensure that no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA

notification of 2006 and the Methods of Monitoring and analysis (Annexure-IV):

Guidance for assessment of representativeness and reliability of baseline environmental

attributes detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which

this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm

along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated

with/involved in the preparation of these reports and the Name of laboratory through

which the samples have been got analysed should be stated in the report. It shall clearly

be indicated whether said laboratory is accredited by NABL or approved under the

6. The project proposal falls under category 8(b) of EIA Notification, 2006 (as

amended).

The committee discussed the matter and recommended following TORs and general

guidelines for conducting EIA studies regarding the proposals:

Additional TORs :

1. Master plan of the area showing proposed project.

2. Submit approved layout plan.

3. Permissible uses of the proposed site as per zoning regulation.

4. Allotment letter from concerned development authority.

5. Physical features within 30 m of the project sites with their ownership.

6. Section details of all road. All roads width to be written with carriage and Right of

way.

7. Area details showing proposed uses as residential, commercial, parks, parking, roads,

other services, facilities of the project also in percentage.

8. Land use approved by the competent authority.

9. Complete Details of facilities to be developed by the project proponent i.e. for which

environment clearance is sought.

10. Use of reflecting paints on roof top and side walls.

11. Details of rain water harvesting are to be given.

12. Provision of 100% solar lighting along the road site, stair cases, common places.

13. A site plan showing the project site and its surroundings with physical features and

topographical details, such as land use, contours and drainage pattern, along with

photographs of the site from all four sides, should be included in the background

information.

14. 10% EWS / LIG housing provision shall be made as per Development Authority bye-

laws.

15. Sanctioned plans/maps regarding the project with all services plans.

16. All plans and elevation sections/all service plan/landscape plan/standard

electrification plan/drainage/sewerage plan.

17. Structural plan is to be submitted signed by qualified structural designer.

18. All service plans like sewer drainage water supply rain water harvesting fire fighting

landscape plan is to be submitted.

19. Examine in detail the proposed site with reference to impact on infrastructure

covering water supply, storm water drainage, sewerage, power, etc., and the disposal

of treated/raw wastes from the complex on land/water body and into sewerage system.

20. Water requirement and water management plan alongwith necessary permissions for

discharge. The water consumption may be made more realistic based on reliable data.

Similarly the waste water calculation should be based on factual facts supported by

the authentic data.

21. Hydro-geological investigations be carried out and obtain permission from Central

Ground Water Authority for withdrawal of ground water.

22. Consider soil characteristics and permeability for rainwater harvesting proposals,

should be made to prevent ground water contamination. Maximize use of treated

water by recycling and utilization of rainwater.

23. Make provision for safety against failure in the operation of wastewater treatment

facilities. Identify acceptable outfall for treated effluent.

24. Details of green belt as a measure for mitigation of dust and noise and buffer between

habitation and proposed project.

25. Landscape plan, green belts and open spaces may be described separately.

26. Study the existing flora and fauna of the area and the impact of the project on them.

27. Examine existing crèche, education, health facilities, police, post Office, Banks and

other services and make adequate provisions in the proposal.

28. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern.

29. Application of renewable energy/alternate energy, such as solar and wind energy may

be described including solar water heating in the guidelines for entrepreneurs.

30. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

31. Identification of recyclable wastes and waste utilization arrangements may be made.

32. Explore possibility of generating biogas from biodegradable wastes.

33. Arrangements for hazardous waste management may be described as also the

common facilities for waste collection, treatment, recycling and disposal of all

effluent, emission and refuse including MSW, biomedical and hazardous wastes.

Special attention should be made with respect to bird menace.

34. Provisions made for safety in storage of materials, products and wastes may be

described.

35. Disaster management plan should be prepared.

36. Traffic management plan including parking and loading/unloading areas may be

described. Traffic survey should be carried out both on weekdays and weekend.

37. Parking provision is to be made for higher ECS worked out either as per state bye-

laws or construction manual of the MoEF

38. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned

39. Provide service road for entry and exit to project site.

40. Use of local building materials should be described.

41. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack

details with provisos of sampling port for monitoring be described.

42. Work out MGLC for the combined capacity of DG sets.

43. Provide for conservation of resources, energy efficiency and use of renewable sources

of energy in the light of ECBC code.

44. Application of resettlement and rehabilitation policy may be described. Project

affected persons should be identified and rehabilitation and resettlement plan should

be prepared.

45. Examine separately the details for construction and operation phases both for

Environmental Management Plan and Environmental Monitoring Plan.

46. Environment Corporate Responsibility (ECR) plan along with budgetary provision of

minimum 2% of the project cost as discussed in meeting shall be submitted on need

base assessment study in the study area.

47. Details of all internal and peripheral roads width.

48. Source and quantity of required water during construction and management of

generated waste water.

49. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

earmarked.

50. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

51. Detailed plan of solid waste management with name and address of authorized

vendors to be submitted.

52. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member Secretary, UP Pollution Control Board and District

Magistrate of related District.

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly

attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is

proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.”

IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

and signature of Project proponent along with consultant with seal should be submitted,

so as to ensure that no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA

notification of 2006 and the Methods of Monitoring and analysis (Annexure-IV):

Guidance for assessment of representativeness and reliability of baseline environmental

attributes detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which

this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm

along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated

with/involved in the preparation of these reports and the Name of laboratory through

which the samples have been got analysed should be stated in the report. It shall clearly

be indicated whether said laboratory is accredited by NABL or approved under the

Environment (Protection) Act, 1986 (Please refer MoEF office memorandum dated 4th

August, 2009). The name project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

i. Affidavit to be submitted for the actual surveys done with detailed photographs of

monitoring etc.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA

8. Proposal for management/disposal of Bio Medical Waste alongwith radioactive

materials, if any. Disposal plan for hazardous waste should also be submitted.

9. Proposal regarding modular STP and guard pond.

10. Section of all internal roads should be provided. Right of way and carriage way width

should be clearly marked on the map.

11. 03 m peripheral green shall be provided around the project inside the project

boundary. According plans should be submitted.

12. The structure design certificate by qualified structure engineer should be submitted. The structural design certificate should preferably be vetted by IITs/CBRI. Provision

of alarm system, to timely notify the employees/residents, in case of occurrence of earthquake/other natural disasters/fire should be provided. NOC from Fire

14. Facilities for attendants of patients. 15. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

The committee noted that the matter was earlier discussed in SEAC meeting dated

01/06/2015 wherein the project proponent was directed to submit following information:

1. Section of all internal roads should be provided. Right of way and carriage way

width should be clearly marked on the map.

2. Copy of receipt regarding the payment made to M/s Power Grid Corporation of

India Ltd. for shifting of HT line alongwith proposed schedule for this work

from M/s Power Grid Corporation of India Ltd. Location of high tension line shifted as per letter from PCCIL photo copy is to be submitted.

3. Minimum 03 m peripheral green shall be provided around the project inside the

project boundary. According plans should be submitted.

4. Plan for use of LPG/CNG based DG sets alongwith commitment of its sources.

5. The structure design by qualified structure engineer should be submitted. The

structural design certificate should preferably be vetted by IITs/CBRI. Provision

of alarm system, to timely notify the employees/residents, in case of occurrence

of earthquake/other natural disasters/fire should be provided. A well defined

evacuation plan should also be prepared and submitted.

6. Submit the certificate issued by Irrigation Department regarding the site is not

under the flood area.

7. Environmental Corporate Responsibility (ECR) plan along with budgetary

provision amounting to Rs. 2.0 crore shall be prepared and approved by Board

of Directors of the company. A copy of resolution as above shall be submitted to

the authority alongwith list of beneficiaries with their mobile nos./address.

The project proponent submitted their replies through letter dated 16/06/2015. A

presentation was made by Shri Mayank Agrawal, authorized representative of project

10. The project proposals are covered under category 8"a" of EIA Notification, 2006, as amended.

The committee discussed the matter and recommended grant of environmental

clearance on the project proposals alongwith general conditions as earlier prescribed by the authority for construction project and following specific conditions:

1. Construction shall be started only after getting prior approval of TTZ authority.

2. 03 m peripheral green shall be provided around the project inside the project boundary.

3. 15% area of the total plot area shall be compulsorily made available for the green belt development including the peripheral green belt.

4. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from National Board Wild Life (NBWL) even if the eco- sensitive zone is not earmarked.

5. Criteria/ norms provided by competent Authority regarding the seismic zone be followed for construction work. Provision of alarm system, to timely notify the

residents, in case of occurrence of earthquake/other natural disasters/fire should be provided. A well defined evacuation plan should also be prepared and regular mock

drills should be arranged for the residents. Rise of stairs should be constructed in a way,

so that it should provide smooth movement.

6. For the treatment for total sewage, a full-fledged STP is to be provided with 20% more

capacity than waste water generated during operation phase.100% waste water is to be

treated in captive STP conforming to prescribed standards of receiving body for

designated use. Monitoring of STP to be done daily till its stabilization.

7. Dual plumbing should be adopted. Recycling of water as proposed shall be undertaken

with regular testing and monitoring of treated water.

8. Dedicated power supply for STPs is to be ensured during operation. Sludge of STP is to

be used in-house as manure and surplus manure should be managed by giving it to end

users. STP shall be suitably located nearest to back side boundary with shortest out let.

Operation and the maintenance cost of the STP shall also be informed along with the

compliance of the E-waste and municipal solid waste disposal. 9. Environmental Corporate Responsibility (ECR) plan along with budgetary provision

amounting to 2% of total project cost shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be submitted to the

authority. A list of beneficiaries with their mobile nos./address should be submitted alongwith six monthly compliance reports.

10. LEDs should be used in all common areas and corridors. 100% solar lighting is to be provided in the open areas/ stairs cases.

11. Parking guideline as per Agra Development Authority should be followed. Parking for

disabled persons should be explored.

12. All entry/exit point should be bell mouth shaped.

13. To discharge excess treated waste water into public drainage system, permission from

the competent authority to be taken prior to any discharge.

14. 100 % provision of Rain Water Harvesting is to be made. RWH shall be initially done

only from the roof top. RWH from green and other open areas shall be done only after

permission from CGWB.

15. An underground Pucca tank for collection/reuse of rain water may be constructed.

16. Height of the stack should be provided based on combined LPG/CNG based DG sets capacity and be 6 m higher than the tallest building.

17. Post project monitoring for air, water (surface + ground), Stack noise of LPG/CNG based DG sets, STP to be carried out as CPCB Guidelines.

18. Crèche to be provided during the construction/operation phase. 19. Provision of separate room for senior citizen with proper amenities shall be made.

20. Protection shall be provided on the windows of the high rise flats for security of residents.

21. Unless and until all the environmental issues are sorted out the occupancy will be restricted and would be only allowed after achieving the Permission from the competent

authority.

22. The project proponent shall ensure that the project site does not attract/infringe any

buffer zone of no activity identified/declared under law.

23. For any extraction of ground water, prior permission from CGWB shall be taken.

24. Sprinkler to be used for curing and quenching and ready mix concrete may be used for

construction.

25. Possibilities of use of treated waste water for irrigation purposes should be explored.

Drip irrigation should be tried upto extent possible. No fresh water will be used for

irrigation purpose.

26. Mobile toilets, safe drinking water facility, sanitation facility and eco friendly fuels etc.

Shall be made available to the temporary residents/workers at the project site including the proper treatment and the disposal of the wastes.

28. Group Housing Project “Pushpanjali Heights” at Mau Rod, Agra, U.P. M/s Paawan

The committee noted that the matter was earlier discussed in SEAC meeting dated

13/12/2014 and in SEIAA meeting dated 12/01/2015 wherein the project proponent informed

that 80% construction work has already been undertaken. The SEIAA directed to take

necessary action as per MoEF OM dated 12/12/2012. In this continuation, Secretary, SEAC

sent a communication dated 03/03/2015 for issuing necessary direction to UPPCB for

initiation of credible legal action in the matter for violation of EP Act, 1986. State Govt.

through order dated 11/06/2015 directed Member Secretary, UPPCB for filing a legal case

for violation of EP Act against the project proponent. Necessary action in this regard is under

process. However, the committee noted that Hon'ble NGT in its order dated 07/07/2015 in the

matter of S.P. Muthuraman V/s Union of India and Ors. (Original Application No. 37 Of

2015 (M.A. No. 291, 293 & 294 Of 2015) and Original Application No. 213 Of 2014 (Ma

755 Of 2014 & M.A. No. 177 Of 2015) has quashed the MoEF OMs dated 12/12/2012 and

27/06/2013 related to provisions for dealing the violation matters. In this situation the matter

may be forwarded to SEIAA for taking necessary action in view of Hon'ble NGT decision

dated 07/07/2015.

24. Hydro-geological investigations be carried out and obtain permission from Central

Ground Water Authority for withdrawal of ground water.

25. Consider soil characteristics and permeability for rainwater harvesting proposals,

should be made to prevent ground water contamination. Maximize use of treated

water by recycling and utilization of rainwater.

26. Make provision for safety against failure in the operation of wastewater treatment

facilities. Identify acceptable outfall for treated effluent.

27. Details of green belt as a measure for mitigation of dust and noise and buffer between habitation and proposed project.

28. Landscape plan, green belts and open spaces may be described separately. 29. Study the existing flora and fauna of the area and the impact of the project on them.

30. Examine existing crèche, education, health facilities, police, post Office, Banks and other services and make adequate provisions in the proposal.

31. Assess soil erosion in view of the soil characteristics, topography and rainfall pattern. 32. Application of renewable energy/alternate energy, such as solar and wind energy may

be described including solar water heating in the guidelines for entrepreneurs. 33. Consider solid wastes, including e-waste in addition to other solid wastes and their

disposal.

34. Identification of recyclable wastes and waste utilization arrangements may be made.

35. Explore possibility of generating biogas from biodegradable wastes.

36. Arrangements for hazardous waste management may be described as also the

common facilities for waste collection, treatment, recycling and disposal of all

effluent, emission and refuse including MSW, biomedical and hazardous wastes.

Special attention should be made with respect to bird menace.

37. Provisions made for safety in storage of materials, products and wastes may be

described.

38. Disaster management plan should be prepared.

39. Traffic management plan including parking and loading/unloading areas may be described. Traffic survey should be carried out both on weekdays and weekend.

40. Parking provision is to be made for higher ECS worked out either as per state bye-laws or construction manual of the MoEF. Comparative chart for previous proposals

and for proposed expansion. 41. Exclusive Parking area in the basement (excluding other facilities) and surface is to be

clearly mentioned 42. Provide service road for entry and exit to project site.

43. Use of local building materials should be described. 44. Consider provision of DG Flue Gas emissions to be treated in a scrubber. Stack

details with provisos of sampling port for monitoring be described.

45. Work out MGLC for the combined capacity of DG sets.

46. Provide for conservation of resources, energy efficiency and use of renewable sources

of energy in the light of ECBC code.

47. Application of resettlement and rehabilitation policy may be described. Project

affected persons should be identified and rehabilitation and resettlement plan should

be prepared.

48. Examine separately the details for construction and operation phases both for

Environmental Management Plan and Environmental Monitoring Plan.

49. Environment Corporate Responsibility (ECR) plan along with budgetary provision of

minimum 2% of the project cost as discussed in meeting shall be submitted on need base assessment study in the study area.

50. Details of all internal and peripheral roads width. 51. Source and quantity of required water during construction and management of

generated waste water. 52. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance

from National Board Wild Life (NBWL) even if the eco- sensitive zone is not

earmarked.

53. Declare/submit the running cost of STP and other environmental management

services (e.g., Municipal Solid Waste Disposal, Green belt Maintenance, Water

Management etc.) in the proposals which are to be including in the allotment letters.

54. The proponent will submit the schedule of monitoring/data collection programme to

the Office of Directorate, Member

General Guidelines:

a. A legal affidavit by the Project proponent on Rs. 100/- non-judicial Stamp Paper, duly attested by Public Notary, stating that:

I. “There is no litigation pending against the project and/or land in which the project is proposed to be set up (please give name & ownership etc. of the project) and that for

any such litigation what so ever, the sole responsibility will be borne by the Project

proponent.”

II. “No activity relating to this project (i.e. name of the project) including civil

construction has been undertaken at site except fencing of the site to protect it from

getting encroached and construction of temporary shed(s) for the guard(s). (if fencing

has not been done, then the same may be deleted).

III. “I/We hereby give undertaking that the data and information given in the application,

enclosures and other documents are true to the best of my knowledge and belief and

I/We am/are aware that if any part of the data and information submitted is found to

be false or misleading at any stage, the project will be rejected and clearance given,

if any to the Project will be revoked at our risk and cost.” IV. Project does not fall under any buffer zone of no-development as declared /identified

under any law.

b. Another legal affidavit by the consultant stating “(a) that the prescribed TORs have been

complied with (to be deleted if not applicable) & (b) that details and the data presented

are factually correct”, as per MoEF circular dated 04.08.2009 is also to be submitted

along with EIA.

c. Current, site photographs viewing towards the project area from four directions

indicating date of photograph taken, direction from which taken, name of the project,

and signature of Project proponent along with consultant with seal should be submitted,

so as to ensure that no construction has been started before the grant of EC.

d. EIA should strictly follow the guidelines prescribed in annexure-III to the EIA

notification of 2006 and the Methods of Monitoring and analysis (Annexure-IV):

Guidance for assessment of representativeness and reliability of baseline environmental

attributes detailed under EIA manual January, 2001 and other guidelines in the matter.

e. The status of accreditation of the EIA consultant with NABET/QCI shall be specifically

mentioned. The consultant shall certify that his accreditation is for the sector for which this EIA is prepared.

f. On the front page of EIA/EMP reports, the name of the consultant/consultancy firm along with their complete details including their accreditation, if any shall be indicated.

g. While submitting the EIA/EMP reports, the name of the experts associated with/involved in the preparation of these reports and the Name of laboratory through

which the samples have been got analysed should be stated in the report. It shall clearly be indicated whether said laboratory is accredited by NABL or approved under the

Environment (Protection) Act, 1986 (Please refer MoEF office memorandum dated 4th

August, 2009). The name project leader of the EIA study shall also be mentioned.

h. The EIA document shall be printed on both sides, as for as possible.

i. Affidavit to be submitted for the actual surveys done with detailed photographs of

monitoring etc.

The Information’s no (a I , II, III & c) asked under the general guidelines is to be

submitted within 15 days from the date of receipt of the letter and remaining of the

information’s is to be submitted along with the EIA

The project proponent also submitted that they had already done the monitoring for

premonsoon season i.e. from March-May, 2015 and requested to accept the monitoring data

to be used in EIA preparation. The committee discussed and deliberated that monitoring data

within validity period as per MoEF directions should be considered. The committee also

directed that since it is an expansion project, the project proponent should submit a

comparative statement on above issues also alongwith EIA report.
