The meeting commenced at 10.01 am and the Mayor welcomed Council's special guests from
Ipswich City Council, Cr Paul Tully and Mr Jim Lindsay (CEO) to the meeting.

Condolences were expressed on the passing of Mr Michael Refalo to his family and friends.
Mike was a Pioneer Shire Council Councillor from 1982 - 1988 and was on the Water Sewage
Committee who started the process of the pipeline to Seaforth.
Condolences were expressed on the passing of Mr Alf Harradine to his wife Valma, their
family and friends. Alf was a tireless volunteer for the community and a valued member of the
Friends of the Theatre.

9.2 ARMSTRONGS BEACH PETITION AND CARAVAN PARK
ENCROACHMENT

Purpose
To respond to a petition which was formally received by Council at its meeting on 12 February
2014 relating to a request by some residents of Armstrong Beach Community that the
Armstrong Beach Caravan Park is made to comply with Local Law No 4 and to advise Council
that a Permit to Occupy application has been lodged with the Department of Natural Resources
and Mines (“DNRM”) to legalise encroachments by the Armstrong Beach Caravan Park to
which Council comments have been sought.
Background/Discussion
In December 2013 Council staff provided residents of Armstrong’s Beach with an information
notice and warning advising that Council was undertaking dune stabilisation measures in the
area and requesting that residents refrain from mowing in this area.
The information / warning notice is a general notice which emanates from Council’s local laws
enforcement guide. It is 1 step in a 4 part process that begins with general awareness letters
being issued to all residents surrounding a problem area. If the letters are ignored and the issue
remains, compliance notices are issued followed by penalty infringement notices and possible
prosecution.
Around the time of Council issuing these notices a major encroachment was also discovered at
the Armstrong’s Beach Caravan Park. The Caravan Park has sought to legalise its
encroachment by applying to DNRM for a Permit to Occupy over the encroached area within
the esplanade reserve.
The Caravan Park encroachment consists of a number of caravan park sites as well as gardens,
barbecues and other illegal structures, with the residents stating that the caravan park should
also need to meet that same compliance to which they have been asked to meet themselves.

While the residents’ requests and concerns are understandable it must be recognised that
Council does not have the ultimate decision in terms of approval of a permit to occupy as
requested by the caravan park but merely is able to provide its comments to any application
made to DNRM. Additionally, residents with existing encroachments can make a similar
request themselves to DNRM to formalise any such encroachments, although this is not a
preferred course of action.
In terms of Council’s consideration of DNRM issuing a permit to occupy, any consideration
should be based on Council’s needs and concerns beyond local resident concern. Council
officers have investigated the application and have raised the following concerns in respect to
the Application for Permit to Occupy:-
It would be in contradiction of Mackay Regional Council’s Coastal Management
Guidelines 2009 which recommend the following:
- rationalise the extent of maintained lawns and request the removal of
private gardens and belongings from Esplanades and Reserves over a
suitable time period, and encourage local native vegetation to re-
establish in their place (3.1b) and
- the rehabilitation and or/revegetation of coastal ecosystems on
Esplanade and Council tenure with local native species (3.1a)
It would set a precedent for private use of public coastal land
The encroachments including a concrete slab, electrical connections, waste
storage facilities and exotic gardens are not in line with Council’s management
intent for public coastal land (as outlined in the Coastal Management Guidelines
2009)
The encroachments, including the gardens, structures and vehicles contravene
council’s local laws
The encroachments may represent a safety hazard
The general public will be restricted from public coastal land if the permit to
occupy is granted
Some of the encroachments represent significant damage to native coastal
vegetation
The area is adjoining the seaward boundary of freehold lots 31-34 RP714108, being the
Armstrong Beach Caravan Park and is subject to 3 caravan sites illegally constructed on the
esplanade and barbeques etc.
The caravan park has been onsite for over 30 years and the 3 sites which extend over their
boundary onto the esplanade are registered with Council under the caravan parks licence,
although this in itself does not constitute acceptance of the encroachment.

While officers hold the significant concerns detailed above it must also be noted that coastal
caravan parks provide an important service and where possible should be maintained.
Despite the above serious concerns, Council officers believe consent to the Application can be
provided subject to the following conditions being included within the Permit to Occupy.
The permit to occupy should be issued on the basis that no further
encroachments occur.
No additional camp or van sites should be constructed beyond the current 3
sites.
The caravan park upgrade their facilities (BBQ and lighting) to MRC
standards.
The caravan park allow public access to and from the beach through the
caravan park.
The caravan park remove all non-native species from their gardens.
The Permit only be for the life of the existing encroachments therefore once
existing infrastructure can no longer be maintained to a standard that it be
removed in full.
Removal of all infrastructures is undertaken to avoid any further damage to
the beach environment and be restored to a condition similar to that prior to
the construction of that infrastructure.
Consultation and Communication
Parks and Environment, Property Services, Planning and Local Laws officers have been
involved in the assessment of this petition and Councillors have also discussed the response to
the petition as well as visiting the area to discuss with local residents.
A public meeting was held on site on 25 May 2014 which was attended by Councillor’s Casey,
Morgan, Steindl & Bonanno as well as Council’s Director of Community and Client Services
Gerard Carlyon. At that meeting some residents expressed concern about the encroachments
while others were in support of the caravan parks application. There was a large turn out to the
meeting and views appeared roughly evenly split as to support or opposition to the proposal.
In addition to the caravan park encroachment a large range of other issues were raised by
residents including drainage, beach erosion and future fencing projects for the foreshore. These
issues have been followed through and attached to this report is a draft letter to the President of
the Armstrong’s Beach Progress Association detailing response to the matters raised by the
community.
Resource Implications
There are no significant resource implications stemming from this report.
Risk Management Implications
The failure to manage coastal dunes in the Armstrong’s Beach area and elsewhere throughout
the region creates major risks for local landholders who may become more vulnerable to
inundation.

It would be appropriate for Council staff to meet with local residents to reach agreement on
measures to protect the remaining dune area to ensure the best possible outcome for both the
residents and the local environment. Under the Natural Environment Levy projects proposed
for the 2014-15 year there are 3 potential projects in the Armstrong’s Beach area. A
commitment was given to residents at the public meeting on 25 May 2014 that no works would
be undertaken before detailed community consultation had been undertaken and this will be
progressed early in the 2014-15 year.
Conclusion
While the residents’ concerns regarding the granting of a permit to occupy are understandable it
would serve no significant additional positive environmental outcome to reject the application
put forward by the caravan parks owners.
The additional concerns expressed by land owners regarding management of the land adjoining
their own properties would be best addressed by meeting on site with residents to determine an
appropriate fence line whereby residents could mow to in order to allow the revegetated areas
the best possible chance of success while impacting upon the residents amenity as minimally as
possible and it is proposed that this occur as part of the natural environment teams program of
works for 2014-15.
Additionally, the letter attached at attachment 2 will provide the community, through their
progress association, with an update on many of the matters they raised at the public meeting
held on 25 May 2014.

To present to Council for approval, tenders submitted for MRC 2014-004 Provision of Material
Blasting Operations.
Background/Discussion
Mackay Regional Council (Council) issued a Request for Tender (RFT) inviting submissions
for the provision of blasting of materials to support crushing operations within the Mackay
Region.
The current contract for the provision of material blasting operations expired on 30 April 2014.
The proposed commencement date for this contract is 1 August 2014, for a twenty-four (24)
month period with the option of a twelve (12) month extension.
Tenders were invited on 15 February 2014, via Council's website and advertised locally in the
Daily Mercury.
The following submissions were received by the closing time of 10.00am on Tuesday, 11
March 2014:

An initial compliance check was conducted on 21 March 2014 to identify submissions that
were non-conforming with the requirements of the RFT. This included compliance with
contractual requirements and provision of requested information.
All submissions were progressed through to the Qualitative Criteria Assessment on the basis
that all terms and conditions and mandatory requirements of the RFT had been met.
During the evaluation, tenderers were assessed against the nominated Qualitative Criteria. The
weighting attributed to each Qualitative Criteria was:

Local Content 10%
The tender called for a rate per quantity of material to be blasted. In order to provide a tender
price comparison, an estimate of quantities anticipated to be blasted over the next two years
multiplied by the unit rate offered, has been used to calculate the following comparative costs
per annum.

The Qualitative Criteria Assessment was carried out by the Evaluation Panel on 2 April 2014
with the Evaluation Panel scoring the tenders according to the Evaluation Matrix.
All applicants were assessed against the Qualitative Selection Criteria. Specific criteria were
weighted according to their importance as agreed by the Evaluation Panel and published within
the RFT.

A number of Tender Information Requests (TIR) were issued to Xtracan Pty Ltd on 9 April
2014, 11 April 2014, 17 April 2014 and 13 May 2014 to clarify details contained in their
submission. This included confirmation of activities included in their rates offered, Council’s
response to exclusions listed in their submission and requests for additional information as per
the Qualitative Criteria Assessments and Workplace Health and Safety procedures.
A TIR was also issued to Caruana Mining Services Aust Pty Ltd requesting clarification on
their response in relation to key personnel proposed for the contract.
The Evaluation Panel met on 19 May 2014 to discuss the responses received from the TIR’s
issued. Further panel discussions were held on 4 June 2014 to finalise all aspects of the
additional information requested and the pricing schedule.
Caruana Mining Services Aust Pty Ltd were able to demonstrate to the Evaluation Panel their
relevant experience in conducting services of a similar nature and demonstrated that they have
the capacity and resources to undertake the services to the specified quantity and quality as
detailed in the RFT.
The evaluation of the tenders was conducted by:

Consultation was conducted between Civil Operations and Procurement and Plant prior to the
Request for Tender being released as well as during the evaluation phase.
Resource Implications
The utilisation of specialist subcontractor resources provides a cost effective outcome. The
funding for these works is provided for in both Sealed and Unsealed Road Maintenance
accounts for which the manufactured gravel and rock products are used.
Risk Management Implications
The health and safety risks associated with blasting are high. A thorough assessment has been
made of the tenderers’ safety system and records.
The estimated quantities are based on routine road maintenance needs only, that is, it does not
include any allowance for NDRRA works which may be needed.
Conclusion
That awarding of the contract to Caruana Mining Services Aust Pty Ltd for a term of twenty-
four months with the option of a twelve month extension period, commencing on 1 August
2014, represents the most advantageous outcome and demonstrated value for money to Mackay
Regional Council based on their demonstrated understanding of Council’s requirements, their

experience, capacity and resources to provide the services to the specified quantity and quality
as detailed in the RFT.

twelve month extension period, commencing on 1 August 2014, as per their schedule of
rates pricing.

13. CONSIDERATION OF NOTIFIED MOTIONS

14. LATE BUSINESS:
The Mayor advised that an historic event was held yesterday in Mackay, the official launch of
the very first dual sector University for Queensland. The merger of CQ TAFE and CQ
University to create a new comprehensive University will position Mackay well to take
advantage of the educational reform of the Federal and State Governments. We have the
opportunity to transform the educational experience of students - who are our leaders of
tomorrow. Council extended its congratulations to all involved.
Cr Casey attended the O'Keefe Street meeting recently and was asked by some residents to pass
on their thanks to Council on the Longair Street Park and playground.
Cr Morgan wished to congratulate all staff members responsible for the success of the Mackay
Show Sustainability Event held recent at Mackay's Show.
Cr Jones advised she attended on behalf of Council the final event for the Healthy Rural
Communities which was funded by the State Government for the past two (2) years to
encourage residents in the rural areas to lead a more active and healthier lifestyle. Cr Jones
advised that due to forward planning and training most events will continue into the future even
though the funding will not be available, which is a great outcome for these residents.
Cr Bonanno advised that the final piece of City Centre Art work was on display last Friday. He
congratulated all of the artists and staff involved in this process so far.

Cr Bonanno advised Mackay hosted River Sessions on Saturday 28 June 2014 with over 5,000
people attending the festival.
Cr Bonanno attended the 20 Years Celebrations of the Birthing Centre at the Mackay Base
Hospital.
Cr Perkins advised the residents from our sister city Matsuura will be arriving in Mackay on
Monday 7 July 2014 to celebrate the milestone of Mackay and Matsuura's Sister City 25 Year
Anniversary.
