In the United States, and i 14 California, the President of the United States, the Governor of the State of California, and th 15 Board of Supervisors of the County of Los Angeles, have all declared states of emergency. 16 On March 16, 2020, the Los Angeles Superior Court (Court), pursuant to Govemmen 17 Code section 68115, obtained an emergency order from the Chief Justice of the Californi 18 Supreme Court (Chief). From March 17, 2020 to April 16, 2020, the Court will operate under 19 General Order to process only essential services. 20 On March 20, 2020, the Chief, as the head of the Judicial Council, declared an adviso 21 recommendation on criminal procedure including: 22 23 24 25 26 27 28 (a) Revise, on an emergency basis, the countywide bail schedule to lower bai amounts significantly for the duration of the coronavirus emergency, including lowering the bail amount to $0 for many lower level offenses - fo all misdemeanors except for those listed in Penal Code section 1270.1 an for lower-level felonies. This will result in fewer individuals in county jail thus alleviating some of the pressures for arraignments within 48 hours an preliminary hearings within 1 0 days. (b) In setting an adult or juvenile defendant's conditions of custody

2 including the length, eligibility for alternative sentencing, and surrender date ,

3 the court should consider defendant's existing health conditions, and an

4 conditions existing at defendant's anticipated place of confinement tha

5 could affect the defendant's health, the health of other detainees, or th

6 health of personnel staffing the anticipated place of confinement.

7 In pursuit of the Chiefs policy goals, the Los Angeles County District Attorney's Offic

8 (DA), along with the Los Angeles County Public Defender's Office (PO), the Los Angele

9 County Alternate Public Defender's Office (APD), and the Los Angeles County Sheriff

10 Department (Sheriff), have collaborated on an efficient process for the release of pretrial count

II jail inmates through a stipulation process.

12 To save time and promote social distancing, the parties have stipulated to the following:

All list of cases submitted for release have been vetted by the DA, PD an

APD where the prosecution and defense have agreed on a release;

All defendants on the list waive their appearance; and

All defendants, through submitting a request for release, waive statutor

17 speedy trial (Penal Code section 1382), or statutory speedy preliminary hearing (I

18 day and 60 day rule under Penal Code section 859b ), as 0 of 90 for trial, and 0 of 6

19 for preliminary hearing, on the date selected for return. The reason for the waiver i.

20 to protect the safety of the defendant from the possibility of contracting COVID-19 i

21 the Los Angeles County Jail system,

22 Based upon the stipulation submitted to the Court, the Court hereby makes the followin

All defendants on the stipulated list (Attachment A) provided are release

on their own recognizance;

The Court finds good cause to waive time, based upon the need to protec

the safety of the defendant from possibly contracting COVID-19 while in the Lo

Angeles County Jail system; and
