HOPE AND FEAR FOR DWELLERS

INTRODUCTION:-

Slum :- A Slum, has been defined as residential areas where dwellings are unfit for human habitation by reasons of dilapidation, overcrowding, faulty arrangements and design of such buildings, narrowness or faulty arrangement of street, lack of ventilation, light, or sanitation facilities or any combination of these factors which are detrimental to the safety and health.

There are three types of Slums (1) Chawls, (2) Zopadpatties and (3)

Pavement Dwelling.

According to 2001 census of India report, Mumbai is a place where more than half of its inhabitants(54.5%) live in slums

INTRODUCTION OF S.R.S. AND HIS DIRECTOR :-

Adolf Tragler( 1938 – 2014 )

Mr. Adolf Tragler is an Austrian by birth but now an citizen. It 1968, he acquired his Master of Arts in Social Work from Tata Institute of Social Science, Mumbai. SRS is the 1st organisation in slum rehabilitation in Mumbai. They dedicated for slum dwellers for securing permanent homes and improve their lives. Its a non profit organisation. SRS Objectives :- To work for the upliftment of hutment dwellers and other low income groups of Gr. Mumbai, more particularly of Bandra West.To provide accommodation with sanitary requirement for hutment dwellers and other low income groups of Gr. Mumbai, particularly of Bandra West.

SRS Mission :- SRS will maintain and increase service centers in slums area like Balwadis, Creches, Welfare Centers, Clinics, Skill Training Centers, which will reach out to surrounding families and communities to enable and them to a better future. Vision :- “ To improve the quality of life of slums dwellers by strengthening their unity, increase their security, assisting in provision of amenities like water, drainage and a healthier environment, till a comprehensive rehabilitation project under SRA or Rajiv Awas Yojna can be implemented with their consent and participation, giving them legal and permanent homes.”SRS also cares for education health and income generation, especially for women and children.

SRS ACHIEVEMENT :- SRS received award two occasion from

DUBAI INTERNATIONAL AWARD FOR BEST PRACTISES from Dubai Municipality and United Nations Human Settlement Programme, UN- Habitat.

1st slum rehabilitation :- 220 families settled there at own effort at mount mary church in 1970.

1970 - 1975 :- approx 700 slum dwellers settled in various projects.

1975 – 2005 :- approx 7000 families settled. 1000 units constructed by SRS and 6000 units constructed by Govt. With collaboration of SRS.

SRS has been member of numerous taskforce including the Chief Minister Citizen Action Group.

BARRIERS TO ACESS TO JUSTICE FACED BY THE CLIENT

In competencies with the government institution, Lack of legal awareness, No acess to court, No acess to legal aid, Education, Layers fees, Poverty, Lack of social responsibility and unity.

BRIEF OF FIELD WORK DONE AT SRS

WORK DONE – 1ST WEEK We Discussed about the present undergoing projects

carried by the NGO and for next week we made the strategy to go for field work and also to discuss the various perspectives of the laws related to slums including domestic laws.

Observations: The Ngo deals basically with the land laws which are part of both state list and union list. So we need to understand and go through the State slum laws briefly. They are working for slum residents. They also work for improve the quality of slum dwellers by strengthening their unity, increase their security, assisting in provision of amenities like water, drainage and a healthier environment, waste management under the SRA guidelines.

2ND WEEK We studied Guidelines for the Implementation of Slum

Rehabilitation Scheme in Greater Mumbai 1997. In these guidelines we study about Slum Rehabilitation Authority Housing & Assistance Department Government of Maharashtra.

We also Discussed regarding field work projects and also about the legal aid which is going to start in our college and how it could be used as a tool for betterment of slums and other effected people.

Observations: As every slum law was new for us so we were initially facing a lot of problems to understand it. So the task it bit challenging for us to understand it. But we made the initiative to go through the laws roughly first and then into briefly and have started analysing and reading it.

3RD WEEK We did a rough reading of Resettlement and Rehabilition Policy for

Mumbai Urban Transport Project (MUTP). We understand this policy under supervision of Manohar Rajguru sir. He gave us introduction regarding this policy. We also discussed related this policy.

Observations: We studied this policy . This policy working on those people who displace for the major public project . Project related to transportation purposes like flyover, bridge, freeway, reailway etc. . This policy working for world bank project. MUTP project was concepuatalized during the period 1994 – 2002 to meet the increasing transport demands of Mumbai. The project consisted two component

(1) a component for transport infrastructure encompassing engineering and technical aspect of road , rail and bus transportation development and

(2) a resettlement and rehabilitation component for residents and businesses afeected people and displaced by rail and road expansion.

4TH WEEK We discussed regarding powers and duties of slum

rehabilitation Authority. We were then told to go through the annual report of the SRS so that we can understand the ongoing projects carried forward by the NGO and also the projects which have been completed by the NGO.

Observations: The Slum Rehabilitation Society (SRS), founded in 1972-73 by Mr. Adolf Tragler, is a well known and reputed NGO, especially dedicated to serve slum dwellers for improving their lives and securing permanent homes for each family.

There are certain projects also about which we came to know through reading the annual report of SRS.

5TH WEEK We studied Maharashtra State Housing Policy. Policy. We also went to

Government Press, Charni Road for purchased some acts and books after lunch. We purchased some acts and books related slums and law.

On Friday We met a old lady to provide her the legal aid regarding her case. We collected some information regarding the case and some essential documents regarding the case.

We presented our case in LSC and discussed briefly. With Adv. Veena mam and got suggestion to talk to the clients advocate who would be appointed by district legal aid authority.

Observation- We studied this policy. This housing policy drafted on 1st nov. 2006. This policy goal is “Shelter for all”. The objective of this policy is remove shortage of accommodation. The draft has been prepared in a record time of only 3 months. Maharashtra is one of the most urbanized states in the country. This policy provides economic boom for manufacturing and provide shelters and livelihood for incoming population. This policy ensure affordable house to Lower Income Group (LIG) and specially Economic Weaker Section (EWS) in urban and rural areas. It’s also facilitating affordable housing in urban and rural areas for LIG and EWS. It’s also promoting sustainable development of urban and rural growth. It’s also demoralizing slums in cities. It’s also helps to provide house and regulate this sector.

6TH WEEK We reached to agency S.R.S. Then we got to

know that SRS director passed away so office was close that day.

7TH WEEK We discussed Mrs. Puspa Parmar Case and

Mankhurd case. We visited Murgan Chawl with Shilpa Maam. We

met Mr. Anjapuli Rangau. We discussed the condition of chawl and discussed the situation of chawl condition and also of there rehabilitation which is been not done.

We went to Mankhurd also there we met Mr. Prakash. He is president of Ekta Rahiwasi Seva Sangh. We understood the problem of that transit camp. We visit whole transit camp and watched the situation of that transit camp.

7TH WEEK CONT. Observations:- We understood the situation of Murgan Chawl. Young

people of that chawl are drug addict and they are doing business of such illegal things. Children are also involved this type of things. Old people are very serious and causious regarding this issue. Some of people want to do something regarding this type of activity. Actually they are scrap pickers. They are involved criminal activity also.

We went to Transit camp, Mankhurd together for picking case. We tried to understand this case. We found such of things related to the case. We understand the role of NGO, role of BMC, role MRTP and also Reliance power in this transit camp. We found there is scam on the level of NGO and some agency. Sanitation condition was in worst condition. This transit camp situation is very worst. Buildings are in very poor situation. There are water problem, sanitation problem , electricity problem and also unemployment problem. They have no adress proof also. Such things feels very irritating. When we watched the situation of that Transit camp we found lot of young people were teasing us even. We found that they were living in very difficult situation. Even many accidents have also happened in the Link road besides of this transit camp which cause loss of life of many children

8TH WEEK We went SRS office East Goregaon. We dealt with

the cases which related to divorce. We also dealt another case which was related to marriage certificate. Actually lady want to know about procedure of taking marriage certificate.

Observation :- We observed many things of that East Goregaon Slums. There are many wards. One ward population is around 500 family. This slums situation is much better than other slums which we visited before. Education and living condition are much better than other slums. Some legal issues founded there. We observed the social resons of divorce.
