services and Professional Training Programs in the field of Proiect Management, Engineering

Management & construction Management in Energy & Infrastructure sectors in India and

abroad. Under its flagship Bridging the Gap [81'C) Programs - A Not for Profit Initiative,

protecon B]',C also provides Industry specific practical Knowledge & Skills to young engineers

including final year students to make them ready for the industry'

OBIECTIVE OF MOU

,lo setup a vehicle under Industry - [nstitute collaboration in order to enhance the

employability ofyoung / fresh engineers.

AND WHEREAS is mutually agreed as follows:

1. PBTG shall launch the BTG Programs under "lndustry - Institute collaboration" as per

the details provided in Annexure-1 (BTG Program Details). IITR will facilitate all

launching activities to the maximum possible extent at GNEC'

7. PBTG will identify and invite the IITR faculties for conducting the training by engaging

them for lectures/hands on / group discussions to the extent possible depending upon

the requirements of the course and invite them directly as per Institute's norms.

B. PBTG shall sponsor the cost associated with hiring / buying ofrequired softwares.

9. PBTG will enhance the Lecture Room No. B by adding either 2 Nos. additional

projectors / Televisions on side walls in order enhance the legibility of presentation

materials to back benchers.

10. A coordinating committee of the following members shall be constituted to look into the

discipline and other related issues.

(i) Dean, SRIC, llT Roorl<ee - Chairman

iii) Professor-in-charge, GNEC, IIT Roorkee - Member

[iii] Chief Executive Officer, PBTG, New Delhi or his nominee - Member

(ivl Director, PBTG, New Delhi - Member

11. Liabi ities: IITR and PBTG have entered into this MoU in good faith and intentions

Neither party shall be responsible for any liabilities arising out of death, injury or any

Iegal action out of death, iniury or any legal action in respect of field stafl trainees or

any other persons associated with the operationalization of this MOU'

12. Confidentiality: Both parties agrees not to share and divulge any documents /information unless mentioned explicitly, to any third party without prior written

approval by other party. The parties agree that the confidential Information shall

remain the property of the Disclosing Party and the Recipient shall rcturn forthwith to

the Disclosing Party all confidential lnformation upon request and such Recipient shall

ensure that no copies (hard/soft] of such confidential [nformation shall be retained

with the Recipient.

13.Tenure:Bothpartiesherebyagreestoactivelyparticipate&promoteeachother,sactivities for enhancing the employability of young engineers till the actual completion

of class room training during one year from the Mou signing date. The GNEC campus

shallnotbeusedforstage-2onjobtrainingofsixmonths.ThisMoUmayberenewedfurther depending upon the performance of all the batches during one year on mutual

agreed terms & conditions, in writing.

14. Terms of Termination: If for any valid reason, if any of the two parties determine that

the MOU should be terminated prior to satisfactory completion of Tenure, they may

terminate it by giving one [1J month prior notice to the other Party in writing.

15 Settle nt of Disn rte In case of any dispute or differences arises between thee s:parties, the parties shall try to settle the disputes amicably and if the disputes are not

resolved amicably, such dispute shall be the subject matter of arbitration under the

Arbitration and Conciliation Act, 1996 and any subsequent related amendments thereto.

The arbitration proceedings shall be held at Delhi in English. The decision of the

arbitrator on the dispute shall be final and binding on both the Parties. The expenses of

the arbitration proceedings shall be borne equally between the parties herein.

16. Indemnitv: Both parties indemnifo each other to keep other party indemnified and

saved harmless from all losses, damages, expenses, charges, costs, investigations,

complaints and litigation arising as a result of a defect in Services, title or breach ol its

warranties/obligations agreed under this agreement.

17. Miscellaneous:

a. This M0U constitutes the final and entire understanding between the Parties with

respect to this project and any amendments or waiver to this MOU shall be in

writing and signed by both Parties. This M0U may be executed in counterparts and

each such counterpart will constitute the same M0U'

b. No failure or delay by either Party in exercising any of its rights under the MotI shall

bedeemedtobeawaiverofthatright,andnowaiverbyeitherPartyofanybreachof the contract by the other shall be considered as a waiver of any subsequent

breach of the same or any other provision'

Duringthis period, PBTG has enrolled a total of 148 youngengineers out of which 120 trained engineers are currentlyworking with reputed National & International companiesin India & abroad. Balance 28 Nos. trained Engineers arecurrently pursuing training. Based on the current successrate, PBTG intend to increase the quantum considering in-creased demand from the companies who have recruitedour trained engineers in Iast 4 years.
