    1. Section 130.203 is amended asfollows:

    Paragraph (f) is revoked and the fol-lowing paragraphs are added:§ 130.203 Definitions.

    (f) [Revoked](t) "Persons residing in the com-

    munity" means any natural person re-siding in the community at the time theapartment house in question was firstoffered for sale and who has maintainedresidency in the community for at least6 months prior to the date of suchoffering.

    (u) "Priority interest" means the in-terest of an occupant of an apartmenthouse which automatically vests in himby virtue of. his being an occupant, andwhich may be (i) retained by an occu-pant for use in conjunction with otherpriority interests in the establishmentof a priority to purchase an apartmenthouse, or (ii) assigned pursuant to sub-section 130.234(d).

    (v) "Entity" means any corporation,partnership, cooperative corporation ortrust, joint venture, association, or groupof occupants.

    (w) "Group of occupants" means twoor more occupants.

    2. Section 130.221(c) is revised to readas follows:

    § 130.221 Residential priorities.

    (c) For Government-owned apartmenthouses:

    (1) First priority. Any occupant, ora group of occupants, or an assignee(whose membership or ownership iscomposed of occupants, or project-connected persons, or persons resid-ing in the community, or-any of theforegoing persons) of the priority inter-ests of such occupants, who or whichhas obtained the priority interest ofat least 60 per centum of the occupantsof the apartment house: Provided, how-ever, That an occupant who has notobtained the priority interests of all theoccupants of the apartment house mustoffer, for a minimum of 15 days priorto his submitting his application forpriority, to the occupants whose priorityrights he has not obtained, the choiceof either joining in the purchase withthe occupant-applicant, or assigning his-priority interest to the occupant-appli-cant on terms and conditions no lessfavorable than those offered to or agreedupon with other occupants.

    (2) Second priority. Any entity whosemembership or ownership consists ofoccupants, or project-connected per-sons, or persons residing in the com-munity, or any of the foregoing persons(provided that such entity has obtainedthe priority interest of at least one oc-cupant).

    3. Section 130.231(a) is revised to readas follows:

    § 130.231 Applifations for priority.(a) All priority rights within each pri-

    ority class, other than rights under§ 130.221 (a)(1), (c) (1) and (2) or(d) (1), shall be invalid unless an appli-cation for the determination thereof, inthe form prescribed by the Commission,is filed with the Commission within 30days after the date on which the propertyin question is offered for sale to suchpriority class or within such period as theCommission may prescribe, in the case ofan offering of lots or acreage tracts to thepriority class provided for in § 130.221(e) or (f). All priority rights under§ 130.221(c) (1) and (2) shall be invalidunless an application for the determina-ttion thereof, in the form prescribed bythe Commission, is filed with the Com-mission within 60 days after the date onwhich the property in question is offeredfor sale to such priority class.

    4. Section 130.232 is amended by des-Ignating the existing paragraph as '(a)and adding a new paragraph (b) as fol-lows:

    § 130.232 Exercise of priority.

    (b) A priority to purchase an apart-ment house may not be exercised by apriority holder (other than an occupant)

    unless, within the time specified by thesales agency, the priority holder hasoffered, for a minimum of 15 days and onterms and conditions no less favorablethan those offered to or agreed upon withother occupants, membership or associa-tion to all occupants of the apartmenthouse in question. In addition to theforegoing, no second priority to purchaseshall be exercised unless the priorityholder, within the time specified by thesales agency, provides evidence that itsmembership or ownership equals at least70 per centum of the housing units in theapartment house, and occupies or agreesto occupy at least 70 per centur of thehousing units in the apartment house.

    5. Section 130.234 is amended by add-ing a new paragraph (d) as follows:

    § 130.234 Transfer of priority.

    (d) Any occupant of an apartmenthouse may assign his priority interesttherein to any other occupant or to anentity whose membership or ownershipis compoted of occupants, project-con-nected persons, or persons residing inthe community. Such assignment may bemade only once unless revoked by theassignor with the written consent of theassignee; provided that, in the case ofa first priority, the assignment shall beautomatically revoked if there is a fail-ure to apply for the priority, to obtainthe priority, to exercise the priority, orto consummate the purchase. Assign-ments and revocations (other than auto-matic revocations) 'shall be made onforms provided by the Commission andshall not be effective until filed with theCommission. Files of assignments andrevocations shall be made reasonablyavailable for inspection by the public.

    6. Section 130.236 is amended by add-Ing the following sentence:

    § 130.236 Limitation.

    Persons who have purchased, either in-dividually or jointly with other persons,a single-family house or duplxe house (ora single-family unit in a duplex house) atLos Alamos pursuant to a priority rightunder the act shall not be eligible toparticipate in the priority purchase ofan apartment house, and if any suchperson is an occupant of any unit of anapartment house, such unit will be con-sidered vacant for the purpose of estab-lishing a priority to purchase the apart-ment house.

    7. Section 130.237 is amended by desig-nating the existing paragraph as (a) andadding a new paragraph (b) as follows:

    § 130.237 Persons applying for deter.minations or exercising priority.

    (b) A priority interest may be as-signed or used by the occupant of anapartment house or, on his behalf, by his

    duly authorized agent, executor, trustee,administrator, or guardian.

    8. Section 130.242(a) (6) is revised to'read as follows:

    § 130.242 Determination of conflictingclaims for priority.

    (a) * * *(6) Conflicting" claims between en-

    tities for a second priority to purchase anapartment house shall be resolved infavor of that entity among suchclaimants which includes in its member-ship the largest percentage 9f the occu-pants of the apartment house in question.If the membership of two or more suchclaimants include the same, and largest,percentage of the occupants of the apart-ment house, such conflicting claims shallbe resolved by lot.

    PART 41-VISAS: DOCUMENTATIONOF NONIMMIGRANTS UNDER THEIMMIGRATION AND NATIONALITYACT, AS AMENDED

    Nonresident Alien Canadian BorderCrossing Identification Cards

    Part 41, Chapter I, Title 22 of the Codeof Federal Regulations is being amendedto authorize consular officers in Canadato issue nonresident alien border cross-ing identification cards under certainconditions to aliens having the status of"landed immigrants" in Canada. A newsection (Q 41.129) is added to read asfollows:

    § 41.129 Nonresident alien Canadianborder crossing identification cards.

    (a) Aliens eligible to apply. Under theconditions prescribed by this section aconsular officer assigned to a consularoffice in Canada may issue a nonresidentalien border crossing identification card,as that tern) is defined in section .101(a) (6) of the Act, to a nonimmigrantalien who satisfactorily establishes thathe (1) has been admitted to Canada forpermanent residence as a "landed immi-grant"; (2) seeks to enter the UnitedStates from Canada and only as a bonafide temporary visitor for business orpleasure as defined in section 101(a)

    (15) (B) of the Act for periods of staynot exceeding 6 months; and (3) isotherwise eligible to receive a temporaryvisitor visa.

    (b) Application for Canadian bordercrossing identification cards. An alienlawfully admitted to Canada as a "landedimmigrant" shall apply on Form FS-257afor. a nonresident Canadian border cross-ing identification card, supporting hisapplication with (1) evidence of his"landed immigrant" status in Canada;(2) a valid, or expired, passport showinghis -origin, identity, and nationality, ifany, and-containing a photograph of thebearer if the alien is over the age of 14;and (3) if the applicant is over the ageof 14, a photograph 11/2 inches square.Personal appearance of the applicantmay be waived at the discretion -of theconsular officer.

    (c) Issuance of border crossing cards.A nonresident Canadian border crossingidentification card shall, consist of aStamp in the format set out in paragraph(d) of this section placed in the alien'spassport or travel document by a consularofficer in Canada. The post symbol andthe, number of each ,card issued shall beentered at the top of the stamp. The"border crossing card shall be numberedserially by each post beginning with thenumber 1 on each July 1. The name ofthe alien to whom the card is issued shall

    *be inserted in the stamp after the word"to" and the date of issuance shall beentered following the words "Issued on".

    (d) Format of Canadian border cross-ing card. The nonresident Canadianborder crossing card shall be in the fol-lowing form:

    (e) Validity. A nonresident Canadianborder crossing identification card issuedpursuant to these regulations may bevalid indefinitely.

    (f) Signature and seal. The consularofficer who issues a nonresident Cana-dian border crossing card shall affix hissignature, and indicate his title in theborder crossing card stamp. The consularofficer shall impress the seal of his officein the lower left corner of the stamp.

    (g) Voidance. A nonresident Canadianborder crossing card shall be canceled bya consular officer if information is de-veloped indicating that the holder ofsuch a card is ineligible to receive a visaor by a District Director of the Immigra-

    tion and Naturalization Service if hefinds that the alien has violated the con-ditions of his admission into the UnitedStates. In voiding such a card the con-sular officer or immigration officer shallwrite or stamp the word "Canceled"plainly across the face of the bordercrossing card stamp. The canceling en-dorsement shall be dated and signed bythe consular officer or District Directortaking the action and shall show thelocation of the consular office or DistrictOffice of the Immigration and Natural-ization Service concerned.

    Effective date: The regulation con-tained in this order shall become effec-tive upon publication in the FEDERALREGISTER. "

    The provisions of section 4 of the Ad-ministrative Procedure Act (80 Stat. 383;5 U.S.C. 553) relative to notice of pro-posed rule making are inapplicable tothis order because the regulation con-tained herein involves foreign affairsfunctions of the United States.(See. 104, 66 Stat. 174; 8 U.S.C. 1104)

    The Mansfield Municipal Airport,Mansfield, Ohio, name has been changedand will require an editorial change inthe description of the control zone, andtransition ayea.

    Since the regulation is editorial anddoes not place additional burden on anyperson, notice and public procedurehereon are unnecessary and the regula-tion may be made effective in less than30 days.

    In- view of the foregoing, the regula-tion is hereby adopted and becomeseffective upon publication in the FEDERALREGISTER. as follows:

    1. Amend § 71.171 of Part 71 of theFederal Aviation Regulations so as to de-lete in the description of the Mansfield,

    PART 97-STANDARD INSTRUMENT APPROACH PROCEDURESMiscellaneous Amendments

    The amendments to the standard instrument approach procedures contained herein are adopted to become effective whenindicated in order to promote safety. The amended procedures supersede the existing procedures of the same classificationnow in effect for the airports specified therein. For the convenience of the users, the complete procedure is republished in thisamendment indicating the changes to the existing procedures.

    As a situation exists which demands immediate action in the Interests of safety in air commerce, I find that compliancewith- the notice and procedure provisions of the Administrative Procedure Act is impracticable and that good cause exists formaking this amendment effective within less than 30 days from -publication.

    In view of the foregoing and pursuant to the authority delegated to me by the Administrator (24 F-R. 5662), Part 97 (14CFR Part 97) is amended as follows:

    1. By amending § 97.11 of Subpart B to amend low or medium frequency range (L/NIP), automatic direction finding (ADF)

    and very high frequency omnirange (VOR) procedures as follows:ADF STANDARD INSTRUMeNT APPROACH PROCEDURE

    Bearings, headings, courses and radials are magnetic. Elevations and altitudes are in feet MSL. Ceilings are in feet above airport elevation. Distances are In nauticalmiles unless otherwise indicated, except visibilities which are in statute miles.

    RevocationThe Federal Import Milk Act prohibits

    importation of milk or cream unless theImporter holds a valid permit from theSecretary of Health, Education, and Wel-fare. Milk or cream is considered unfitfor importation unless the cows have beenexamined within the previous year and

    - found healthy and free of tuberculosisand all dairy farms and plants involvedhave been found to meet certain sanitaryrequirements.

    In a statment of policy (21 CFR 3.56)published in the FEDERAL REGISTER OfSeptember 10, 1966 (31 F.R. 11935), theFood and Drug Administration an-nounced that the provisions of the Fed-eral Import Milk Act apply to "all im-ported milk and cream, whether steri-lized or not." Subsequently, objectionsreceived regarding § 3.56 were referred tothe Department of Justice with a requestfor an opinion. That Department con-cludes that imported milk products inhermetically sealed cans so processed byheat as to prevent spoilage are notsubject to the provisions of the FederalImport Milk Act.

    Therefore, pursuant to the provisionsof said act (sees. 1-9, 44 Stat. 1101-1103,as amended; 21 U.S.C. 141-149) andunder the authority delegated to the

    Commissioner of Food and Drugs by theSecretary (21 CFR 2.120), Part 3 isamended by revoking § 3.56 Importedcanned heat-processed milk productsunder the Federal Import Milk Act.

    This action shall not be construed asexempting such products from any of theapplicable provisions of the FederalFood, Drug, and Cosmetic Act or regula-tions promulgated thereunder.

    Effective date. This order shall be ef-fective upon publication in the FEDERALREGISTER.

    PART 110-ANCHORAGEREGULATIONS

    Mississippi River Below Baton Rouge,La., Including South and SouthwestPasses

    1. The purpose of this document is todelegate authority to the Commander,

    8th Coast Guard District, New Orleans,La., to establish temporary anchorageson the Mississippi River from mile 233at Baton Rouge, La, to Head of Passes,La., and to ratify the actions of theCommander, 8th Coast Guard Districttaken on June 29, 1967, and October 27,1967, to establish and discontinue the useof the following temporary anchorageareas on the Mississippi River:

    a. An area approximately 3,500 feetin length, extending from mile 168.5AEP to mile 169.2 ABP, bounded bythe left descending bank and a line 500feet channeward therefrom. This an-chorage will be restricted to use by amaximum of three ships at any one time;

    b. An area approximately 3,500 feetin length, extending from mile 166.3AHP to mile 167.0 ABP, bounded by theleft descending bank and a line 800 feetchannelward therefrom;

    c. An area approximately 11,144 feetin length, extending from mile 85.0AEP to mile 82.7 AHP bounded on theright descending bank and a line 800feet channelward therefrom; and

    d. An area approximately 9,500 feetin length extending from mile 80.8 AHPtb mile 79.0 A1P bounded by the* rightdescending bank and a line 800 feetchannelward therefrom;

    e. The area described as being in thevicinity of mile 169.5 AHP between theright descending bank and a line drawnparallel to this bank not more than 500feet therefrom, is no longer designatedas a temporary anchorage area and itsuse is discontinued; and

    f. The area described as being in thevicinity of mile 87.5 AHP and mile 85.0A between the right descending bankand a line drawn parallel to this banknot more than 800 feet therefrom, is no

    longer designated as a temporary an-chorage area and its use is discontinued.

    2. On March 30, 1967, a special noticewas published by the District Engineer,New Orleans District, Corps of Engi-neers, Department of the Army, in Navi-gation Bulletin No. 67-53, proposingchanges in temporary anchorage areasbetween mile 166.0 ARP and mile 170.5AHP, Mississippi River. Interested per-sons were invited to file written com-ments about this proposal. No objectionsto the proposal were received. Transferof authority and responsibility for an-chorage areas to the Department ofTransportation has been effected andassigned to the U.S. Coast Guard.

    3. On September 5, 1967, a special no-tice was published by Commander, 8thCoast Guard District, New Orleans, La.,proposing changes in temporary anchor-age areas between mile 87.5 ARP andmile 82.7 AHP, Mississippi River. Inter-ested persons were invited to file writtencomments about this proposal. A hearingopen to all interested parties was held at1400, October 12, 1967, at the office ofthe Commander, 8th Coast Guard Dis-trict, Custom House, New Orleans, La.No objections to the proposed changeswere received.

    Pursuant to Executive Order 10865,an agreement between the Departmentof Defense and the Department of Trans-portation was executed on June 1, 1967,which provides for inclusion of theTransportation Department as a "useragency" in the program. The Office ofSecurity, and Investigations of the De-partment of Transportation has beendesignated as Transportation Depart-ment liaison for industrial securitymatters. The Defense Supply Agencywill perform all cognizant security officefunctions prescribed by the regulationsin behalf of all user agencies. CoastGuard contracting officers will performthe functions specified in, and will havethe authority and responsibilities pre-scribed by Department of -Defense In-dustrial Security Regulations (DoD5220.22R), and Department of DefenseIndustrial Security'Manual (DoD 5_220.-22M), except when the administrativecontracting officer functions are dele-gated or assigned to the Defense SupplyAgency.

    Subpart 11-1.8-Labor Surplus AreaConcerns

    Reports required by § 1-1.807 will beforwarded to the Commandant (FS)within 20 work days after the close ofeach reporting period identified by Re-ports Control Symbol FS--6131.     The following regulations reviseprocedures applicable to the GeneralServices Administration And the publicregarding (1) requests for identifiablerecords by the public pursuant to 5U.S.C. 552 (the "Freedom of InformationAct") and subpoenas or other legaldemands with respect to records held byGSA, and (2) the public use of archives,Federal record center records, and.donated historical materials, as well ascertain structural facilities, under themanagement and administration of theNational Archives and Records Service,GSA.

    PART 105-60-PUBLIC AVAILABIL-ITY OF AGENCY RECORDS ANDINFORMATIONAL MATERIALS

    Section 105-60.00 is revised to clarifythe scope of Part 105-60 so As to indicatecoverage of records managed and ad-ministered by GSA as well as currentoperating records. As revised, the sectionreads as follows:

    § 105-60.000 Scope of part.This part sets forth policies and pro-

    cedures concerning the disclosure andavailability to the public of records andinfornmation held by GSA with respectto: (a) Agency organization, functions,decisionmaking channels, and rules andregulations of general applicability, (b)agency final opinions and orders, in-cluding policy statements and staffmanu.als, (c) operational and other ap-propriate agency records, and (d) agencyproceedings. The part also covers exemp-tions from disclosure of such materials,ikrocedures for the guidance of the publicin obtaining information and inspectingrecords, service of subpoena or otherlegal demand with respect to records,and authentication and attestation ofrecord copies.

    Subpart 105-60.1-GeneralProvisions

    1. Section 105-60.104(a) (3) is addedto indicate expressly that donated his-torical materials accepted by GSA froma source other than an agency of theUnited States Government in accordancewith 44 U.S.C. 397 are not subject to theprovisions of the "Freedom of Informa-tion Act." As added, the section reads asfollows:

    defined in § 105-61.001-4) accepted byGSA from a source other than an agencyof the U.S. Government in accordancewith the provisions of 44 U.S.C. 397.

    2. Section 105-60.106 is revised to referspecifically to the application of the ex-ecutive privilege disclosure exemption torequests for information from the Con-gress. As revised, the section reads asfollows:§ 105-60.106 Congressional informa-

    withholding information from the Con-gress except where executive privilege isinvoked by the President (see §105-60.603).

    3. Section 10.5-60.107 is revised toclarify procedures with respect to re-quests for records of other agencies,heldby GSA. As revised, the section readsas follows:§ 105-60.107 Records and informational

    materials of other agencies.(a) Other agencies' records managed

    and administered by GSA. The availabil-ity of records of other agencies locatedin the National Archives of the UnitedStates and Federal records centers aregoverned by Part 105-61 (Public Use ofRecords, Donated Historical Materials,and Facilities in the National Archivesand Records Service).

    (b) Current records of other agencies.If a request is submitted to GSA to makeavailable current records or informa-tional materials which are the primaryresponsibility of other agencies, butwhich are in GSA for review purposes,the request will be referred by GSA tothe agency concerned for instructions,unless prior instructions have been re-ceived from the agency.

    4. Section 105-60.109 is added to es-tablish procedures to be followed whereit is believed that the records requestedmay be involved in litigation or otherjudicial process in which the UnitedStates is a party, including discoveryprocedures pursuant to the Federal Rulesof Civil Procedure or the Federal Rulesof Criminal Procedure. As added, the newsection reads as follows:§ 105-60.109 Records involved in litiga-

    tion or other judicial process. -Where there is reason to believe that

    any records requested may be involved inlitigation or other judicial process in

Pendingreceipt of advice from that Department,the records involved shall not be madeavailable.

    Subpart 105-60.4-identifiableRecords

    Subpart 105-60.4 is amended by chang-ing the caption from "Agency Records"to "Identifiable Records" and by revis-ing §§ 105-60.4)1, 105-60.402, and 105-60.402-1(a), as follows:

    1. Section 105-60.401 is revised to ref-erence certain procedures under Part105-61 pertaining to the public availabil-ity of records transferred to the NationalArchives and Records Service, GSA, andto cross-reference § 105-60.109. As re-vised, the section reads as follows:

    § 105-60.401 General.Except with respect to the records made

    available pursuant to Subparts 105-60.2and 105-60.3, identifiable records re-quested in accordance with § 105-60.402,or in accordance with § 105-61.101 or§ 105-61.104, will be made promptlyavailable to any person by GSA, unlessnondisclosure is invoked pursuant to§ 105-60.105m2. While the burden of iden-tification rests with the person seekingthe record, GSA will assist to the extentpracticable in this regard. Where it isbelieved that records requested may beinvolved in litigation or other judicialprocess in which the United States is aparty, the procedures set forth under§ 105-60.109 shall be followed.

    2. Section 105-60.402 is revised to setforth the scope of coverage of the section.The revision specifies that records trans-ferred to the National Archives andRecords Service, GSA, are subject to pro-cedures under Part 105-61 and are notwithin the scope of § 105-60.402. Therevision also provides cross-references toprocedures in Part 105-61 applicable tothe public use of records transferred tothe National Archives and RecordsService. As revised, the section reads asfollows:

    § 105-60.402 Procedures for makingrecords available.

    This section sets forth initial pro-cedures for making identifiable recordsavailable when 'requested. These pro-cedures do not apply to records that havebeen transferred to the National Archivesand Records Service in accordance withthe Federal Records Act of 1950 (44U.S.C. 392-401), which include "ar-chives" and "FRC records" (as definedin §§ 105-61.001-2 and 105-61.001-3).The initial procedures on availability ofsuch records are governed by Part 105-61(see §§ 105-61.101 and 105-61.104).

    3. Section .105-60.402-1(a) is revisedto clarify instructions regarding theGSA office to which requests for identi-fiable records shall be submitted by the

    public and to delete obsolete referencesto the National Archives and RecordsService. As revised, the section reads asfollows:

    § 105-60.402-1 Submission of requestsfor identifiable records.

    (a) With respect to identifiable rec-ords located in the GSA Central Office,requests shall be submitted, in writing orin person, to the Director of Information,Office of the Administrator, GeneralServices Administration, Washington,D.C. 20405. With respect to identifiablerecords located in the GSA regionaloffices, requests shall be submitted to theRegional Director of Business Affairs forthe particular region involved at theaddress listed in § 105-60.303(a).
