2013 FICA TAx InCreAse surprIses some TAxpAyers With all the end-of-year hype surrounding the fiscal cliff and the relief that came with New Year’s legislation permanently extending most income tax rates, one change seems to have been veiled by the settling dust: the 2 percent increase in FICA (Federal Insurance Contributions Act) tax. That increase, the result of an expiring provision that was not extended, means that the vast majority of American workers are now receiving about 2 percent less in their take-home pay, an unwelcome surprise to some people.Background In the midst of the last recession a little more than two years ago, Congress passed and the president signed the Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010. This new law included a 2 percent reduction in the Social Security (OASDI) portion of the FICA tax. The provision was designed to help put a little more money into the wallets of American workers during the challenging economic environment of 2011. While the employer portion of the OASDI contribution remained at 6.2 percent, the employee contribution was reduced from 6.2 percent to 4.2 percent. The provision was extended through 2012 by the Temporary Payroll Tax Cut Continuation Act of 2011 and the Middle Class Tax Relief and Job Creation Act of 2012. The reduction was never meant to be permanent, as it put additional financial pressure on the already stressed Social Security Trust Fund. So during the 2012 fiscal cliff negotiations, both Democrats and Republicans agreed that it should expire at the end of the year.Impact of 2 percent Despite media reports warning of the impending payroll tax increase, many Americans were caught off guard when they received their first paychecks in 2013. How much of an impact might the additional withholding have? A family earning $60,000 a year will see their pay cut by about $1,200, or $100 per month, during 2013. Those earning $100,000 will receive about $2,000, or about $167 per month, less. (The maximum amount of an individual’s earnings that is subject to Social Security tax in 2013 is $113,700.) While most experts believe the decrease in take-home pay won’t be enough to cause major economic damage, it may encourage families to cut back on spending enough to slightly dampen the nation’s overall growth. For example, the 2 percent decrease could represent a family’s monthly utility bill, an investment in a college savings account, or a week’s worth of groceries.medicare taxes for high earners Also consider that high earners will need to pay a bit more in Medicare taxes beginning in 2013. Taxpayers will pay an additional 0.9 percent Medicare tax on wages exceeding $200,000 for single/head of household, $250,000 for married couples filing jointly, and $125,000 for married couples filing separately. Taxpayers whose modified adjusted gross income exceeds those same threshold amounts will also pay a 3.8 percent Medicare tax on some or all of their unearned income. These provisions were part of the Patient Protection and Affordable Care Act of 2010, and like the expiration of the FICA reduction, were not affected by the 2012 fiscal cliff legislation. When combined with the 2 percent Social Security increase, the total hit could mean a difference of several thousand dollars a year to some higher-earning taxpayers.Questions? As we get closer to the transmittal deadline at the state legislature, when all the bills that originated in the House pass over to the Senate and vice verse, we are hearing and voting on more and more bills each day in committees and on the House floor.

Here’s just a quick update of a few interesting bills that we’ve considered lately.

Ban on human reproductive cloning (HB 288). We passed it in Judiciary Committee, and then it passed on the House floor 93/7.

Revise Post Adoptive Services Law (HB 367) passed the House 96/4. If enacted, this law will allow private adoption agencies to also provide post-adoptive counseling and support to birth mothers who have relinquished their children for adoption (no cost to the state).

Montana Firearms Freedom Act – Exempt Montana Made Firearms and Ammunition from Commerce Clause (HB 246). This states that a personal firearm, a firearm accessory, or ammunition that is manufactured commercially or privately in Montana and that remains within the borders of Montana is not subject to federal law or federal regulation, including registration, under the authority of Congress to regulate interstate commerce. Passed second reading on the House floor 64/36 and is awaiting third reading before moving on to the

Senate – hopefully!

Authorize Archery Season for Mountain Lion, Bear, and Wolf (HB 74) passed unanimously. This act would grant the Fish, Wildlife & Parks Commission the discretion to set up areas and seasons for archery hunting mountain lion, bear, and wolf in archery hunting seasons. Passed the House unanimously.

Authorize Reciprocal Fishing with Adjoining States on Contiguous Rivers & Streams (HB 366). If this bill becomes law, any person who is properly licensed to fish in a state that borders Montana may fish in any part of a

lake, reservoir, pond, river, stream, or body of water in Montana within 10 miles of the border, if the bordering state grants the same or similar privileges to holders of valid Montana fishing licenses and enters into a reciprocal agreement with Montana. Passed 92/7.

Authorize investor owned livestock slaughter and processing plants (HB 418). This bill will pave the way for a horse processing plant to open in Montana – contributing to the economy and improving the horse market while also providing a humane place for people to take old, injured, or dangerous horses. I am a co-sponsor. The hearing for this bill brought the most people I have yet seen come to Helena to testify. DeaR Dave, I’m a single mom with three young children. I quit my nursing job a few years ago to be a stay-at-home mom, and one year later my husband filed for divorce. The state isn’t keeping him accountable for child support, but now I qualify for food stamps. Do you feel it’s morally wrong to be on government assistance? ~Rebecca

Dear Rebecca, There’s nothing morally wrong with receiving food stamps, as long as you’re not lying about your income or situation in order to receive them. The biggest problem with food stamps, and other forms of government assistance, is many times a person becomes dependent on someone else to take care of them. I don’t want you and your kids to develop a victim mentality and become trapped in a cycle of substandard living. You said you were a nurse before you came home to be with the kids, right? I’d suggest updating your nursing certification, if necessary, and going back to work in your field—maybe even as an emergency room nurse. I know the hours can be weird, but the pay is great. It would really get your income rolling again, plus you could afford to pay someone to look after the kids when necessary. You’ve been through a lot, Rebecca. Life has knocked you around lately, so it’s okay if you need to take food stamps for a little while. But I’d encourage you to start thinking from a long-term perspective as to what it’ll take to move forward and generate a good, livable income for you and your kids. Get into attack mode, take your nursing degree, intelligence and experience, and create a quality life for your family. I know you can do it! ~Dave

DeaR Dave, I made a huge mistake and allowed my sister to use my credit card. She said she’d pay back what she charged, but now she won’t pay the bill. The total was $5,500. Do you have any advice? ~MarieDear Marie, I’m afraid I don’t have anything to give you that will make your sister grow some integrity and character. I used to tell my kids when they were younger not to bust the trust, because that kind of thing is very hard to put back together. I’d be pretty upset about this too. Still, obsessing over it isn’t going to solve anything. And really, when it comes right down to it, you opened the door for this to happen. You really have no one to blame but yourself. If it were me, I’d do whatever it took to pay this off quickly. Put in additional hours at your job or find some part-time work at night and on weekends for a few months. Somewhere along the line I’d also leave my sister a message saying I know she’s not going to pay this, but that everything is forgiven. I call something like this “paying your stupid tax,” and it’s something that all of us have had to pay at one time or another. Learn from the experience, Marie. Loaning money to family or friends can damage the relationship. Keep in mind, too, that she’s probably going to come back around wanting money at some point again. (Family Features) These days, many people are re-evaluating their diets to lower cholesterol and fat. They’re looking closely at foods to eliminate or cut back. One item that shouldn’t be on the chopping block is lean beef.

It may be surprising, but lean and extra lean beef are nutrient-rich sources of protein that complement a low-fat diet. In fact, a study in the American Journal of Clinical Nutrition found that a healthy lean diet that includes lean beef as well as fruit, whole grains, vegetables and nuts, showed similar effects on cardiovascular disease as a similar diet without lean beef. In the study, people using either diet showed a reduction in LDL cholesterol compared to those eating the typical healthy American diet.

Mitzi Dulan, a nationally recognized nutrition and wellness expert and team sports nutritionist for the Kansas City Roy-als, understands that lean meat is an essential part of a healthy diet. “Lean and extra lean beef have tremendous nutritional

benefits and provide more bang for your buck to healthy diets,” said Dulan. “Adding lean beef into meals is a quick and easy way to inject necessary protein in your diet, in a low-fat, heart healthy way.”

Dulan recommends several considerations for using lean beef in a healthy diet:

• Look for beef that is “lean,” which by USDA definition contains less than 10g of fat, 4.5g or less of saturated fat, and less than 95mg of cholesterol per serv-ing. “Extra lean” contains less than 5g of fat, 2g of saturated fat and 95mg of cholesterol per serving. Heat oil in skillet. On medium-high heat, sear meat cubes in skillet until browned on all sides. “I have something for you,” Craig said, “three gentle, longhorns which would fit well as lead steers in your cattle drive operation.” “Well, I’ve always wanted a nice set of steer horns,” I replied. “How much do you want for them?” “Nothing,” he fired back. “Take them; they’re free.” Knowing Craig had fallen on hard times, I offered, “How about I give you one hundred dollars for each one?” “Whatever, I just need them gone because I am out of feed and money. Can you bring your trailer out today?” Craig asked. “Sure; I’ll saddle a couple horses and be out after work,” I answered as I chuckled at my good fortune. The day passed quickly and soon my friend Jeremy and I pulled into the driveway of Craig’s 20 acre hobby farm. There were hog panels strung through the timber and tied to a loafing shed and if the baling twine held, this make-shift corral would serve as a loading chute. We hopped our horses out of the trailer, backed up to the gate, hit the saddle and trotted into the timber searching for the longhorns. Just as Craig had said, the steers were not the least bit concerned by our presence, mostly because they knew they held all the cards. Each steer slowly rose, yawned and curled their tails over their backs as they stretched, as if they had not a care in the world. My first lesson in longhorn management was about to begin. It would take seven pages for me to describe the events of the next two days, so I will just say those three steers were the most polite critters I have ever moved with a horse. Exhibiting no ill will, each would quietly walk into the corral, measure the panel height with their chin and clear it in a single bound before meandering back into the timber. Jeremy and I were sweating, galloping and swearing to the best of our abilities while Craig held the trailer gate chuckling at his good fortune. Eventually, I hauled all three steers to Wyoming, but it would be a stretch to call it a victory because all I did was move Craig’s problem to my place. Over the next three years, two of those fence crawling steers caused me more grief than all the other cows in

my herd. The third steer quickly became my favorite because he was struck by lightning and killed his first weekend in Wyoming. Every time I rode past his decomposing carcass on the hilltop, I chuckled at my good fortune because my headaches had been cut by a full third from a single bolt of light-ning and this brings me to my point. Legislation is like free longhorn steers; it comes with strings attached. House Bill 142, an “act assenting to the federal Dingell-Johnson act of 1950” allows fishing equipment federal taxes to be redistributed to state fish and game agencies. This places roughly four million dollars in Mon-tana’s Fish, Wildlife and Parks budget and 95 House members approved the act. Five of us did not, so sportsman groups will chastise us in the next election cycle for being anti-angler and hating little children. (We are always portrayed as hating children.) The free money in the Dingell-Johnson act is not really free. Take a look. The federal budget is divided into discretionary and non-discretion-ary spending with the latter category, also called entitlements, consuming nearly 100 percent of all federal revenues. This means discretionary spend-ing, subdivided into defense and non-defense is 100 percent borrowed money which is rolled into our 16.4 trillion dollar debt. Therefore, the four million dollar federal fishing gift to our Treasure State is not actually money, it is debt. When the little children discover all the wonderful Fish, Wildlife and Parks programs were funded by debt, burdening them with the cost of their angling activities along with those of their parents and grandparents, they will not be chuckling at their good fortune. Spending has bankrupted our nation and the disease is not quaran-tined to Washington D.C. Every program supported at every level by every official at the request of every citizen, adds to the problem. Think about it. How can you demand elected officials quit spending money when you simul-taneously insist they do so? Our economic predicament is nothing to chuckle about.
