Subsequent Claim Section 5103 Waiver Initiative
• A one-time initiative for supplemental live compensation claims pending initial
development
• Approximately 180,000 claims identified with 19,000 of those in Winston
• VA Central Office (VACO) mail the 38 U.S.C §5103 (formerly VCAA) notice
• Claimant given the option to have claim processed with the evidence of record

Process
• Claimant is mailed the special §5103 notice (multiple batches)
• A Veterans Benefits Management System (VBMS) eFolder is established
• A tracked item titled “5103 Waiver Review” is established in VBMS and MAP-D
• RO will ship any paper records associated with these claims to be scanned into VBMS

Claims Processing
• Claimant can submit elections by – Telephone (800-827-1000)– Mail (address found at top of letter)– eBenefits (Premium account)– Email ([email protected]) – Fax (855-329-2821)

Exclusion Reasons
• Reasons the claim can be excused from the initiative: – Claimant has an appeal pending at the time of receipt of the election and the
claims folder is not located at the home RO (excluding the case of a paper claims folder located at the scanning vendor)
– Claim requires a character of discharge determination– Claim requires development for records in the custody of the Veteran’s
Guard/Reserve unit(s), or further evidence from the claimant or an identified private medical provider
– Claim requires any development beyond developing for:• Federal records in the custody of the Federal government • A VA examination
– Claimant fails to report for an examination and requests that VA reschedule the exam.
– Supplemental claim, additional evidence, or a notice of disagreement on any claim is received from the claimant after receipt of the election

• Continue processing claim
