THE PETHEL GROUP AND NATURAL ELEMENT HOMES
Matching the distinctive personalities of
its clients with the home of their dreams is
a specialty of The Pethel Group. You might
say it is a family tradition. Matthew Pethel
is carrying on his father’s (Freddie Pethel’s)
vision of providing each customer with a
Natural Element Home uniquely tailored to
each lifestyle and dream.
“I believe, like you, that your dream home
should not only reflect your personality but it
should be situated on the land to preserve the
beauty of the landscape. Our homes are much
more than a roof overhead, they are quality
built, aesthetically beautiful and substantial. I
take each project personally, it is a reflection
of who I am,” said Matthew.
Building in Montana and across the Great
North West has offered many challenges for
a construction company with roots in the
beautiful North Georgia mountains. Building
a relationship with local tradesmen and
experts has been a priority. “I have always
made it a point to hire local workers when
building outside of my local confines. Great
Falls and the small community of Belt are both
filled with wonderful people who are friendly,
smart and understand what it takes to build
quality homes. Our recent Montana projects
have forged relationships with talented and
forward thinking tradesmen who have richly
blessed our group.
The Pethel Group is poised to design and
build throughout the North West States. You
Go West, Young Man
7 Volume 57 Farm&Ranch West
are invited to visit the Ranches at Belt Creek
(Montana) to see fine examples of their
Natural Element Homes. Situated about 30
minutes from the Great Falls International
Airport, Belt will show to the prospective land
buyer a rare, shared ranch community that is
visionary and progressive.
When asked why he thought someone
should hire a group of southerners to build
their home here in the West, Pethel smiled
and said, “We are people who aspire to many
of the same things in life that our clients do.
Our word is our bond. When I hand my clients
the keys to their new home, I know that I not
only have a satisfied customer but that I have
also developed a great friendship.”
The Pethel Group believes in the philoso-
phy that face-to-face contact is the best way
to do business. It is a simple principle shoul-
dered by hard-working and dedicated, family
oriented employees and professionals who
love what they do and take great pride in
their accomplishments.
Having aligned itself with Natural Element
Homes, the Pethel Group offers a great
experience when building a new home. “The
process of planning, designing, and building
a home should not be difficult and stressful.
Instead, you should have a pleasurable and
memorable experience,” says Pethel. “This
is why we use Natural Element Homes as
our primary provider of design services
and building materials. Natural Element
Homes is a Tennessee-based company with
manufacturing and supply operations in
several locations, including the North West
USA. Their selection of home designs and
custom design services are wonderful, and
their materials offerings, manufacturing
capabilities, and technical support allow us to
design and build the greatest homes on earth.”
“People who choose a Natural Element
Home want something different, a home that
is a notch above the usual cookie-cutter design
and reflects their taste and lifestyle,” said Pethel.
“We help you create a home that is uniquely
you. You can start with a home plan from our
library, or we can start your design from scratch,
borrowing inspiration from our portfolio of
home designs. We also have Jim Klippel as part
of our design team to meet on your property to
create a custom home design that is perfect for
your building site and for you.”
“If you have property out west and are
planning to build your home of homes or your
home away from home, the Pethel Group may
be your answer,” says Pethel. “Our customers
have the need for a pleasurable, stress-free
experience that is comprehensive in nature.
We are truly a one-stop-shop and provide
everything needed to build a new home. We
have in-house design services, log and timber
manufacturing facilities, and we can build
anywhere in the North West USA. We also
facilitate site planners, interior designers,
lighting professionals, financing options,
solar and geothermal professionals, landscape
architecture, and green building standards.
Everything you need is under our roof!” v

The Ponderosa Mesa Ranch, the jewel of
La Veta, Colorado, sold recently for $2.65
million. The 5,500-square-foot luxury log
lodge and 360-degree views of the Spanish
Peaks and other ranges made this a one-of-a-
kind, top-of-the-mesa retreat. Congratulations
to the lucky buyers and to Jacky Christian of
Capture Colorado on the sale of this stunning
168-acre property (featured in Farm & Ranch
West Volume 55).
From the National Account Manager
Welcome to the 57th issue of Farm & Ranch West!
At more than 530,000 acres, the W.T. Waggoner Ranch in North Central Texas is not a
state, but it could be. The Waggoner, co-listed by Bernie Uechtritz, advisor to Briggs Freeman
Sotheby’s Farm and Ranch Division, is the largest contiguous ranch in the United States,
having been kept under one fence by one family for nearly 100 years. Learn more about this
once-in-a-lifetime opportunity on page 22 (this issue’s cover feature).
There are few more recognizable faces in sports than that of football legend Terry Bradshaw
and we are pleased to feature his Red River Ranch in this issue. Mr. Bradshaw candidly shares
his thoughts on the ranch, as well as some beautiful photography, beginning on page 70. Mr.
Bradshaw also appears on the cover of the recent Texas Farm & Ranch Volume 74.
Whether you currently own property or plan on buying property in the future, the
Rancher’s Corner on the relationship between surface and mineral owners is a must-read
(page 20). Oil industry veteran Robin Forte´ addresses the dominance of the mineral estate
and how it may impact you if you don’t own all of the minerals under your property.
Thanks to those who participated in the Little Boots Contest through Facebook. The
winners (a most adorable group) are displayed in the premiere of the Little Boots feature on page 18. Make sure you like us on Facebook and
follow us on Twitter to see properties right in your news feed and participate in our next contest.
The team at Farm & Ranch Publishing is particularly mindful during this holiday season of our many blessings, certianly including our
readers and advertisers. We wish you and your family a Merry Christmas, a Happy New Year and good ranch hunting and selling in 2015.
Did You Know?…Actor Tom Cruise has listed his massive Colorado hideaway for $59 million. Minutes from Telluride, the home was featured on the Oprah Winfrey Show
in 2008 when Cruise and his then-wife Katie Holmes took Oprah on a tour of the estate. A 10,000-square-foot main residence and a 1,600-square-foot guest
home (with a total of 7 bedrooms and 9 baths between them) rest on 298 acres traversed by a private trail system and surrounded by national forest.

Rancher’s Corner
The DominanT mineral esTaTe: WhaT every rancher shoulD KnoW
By Robin Forte , Owner of Forte Productions LLC
It was a long, long time
ago, shortly after the advent
of private property, that a
landowner sold the surface of his land to a
gentleman rancher and reserved the minerals
thereby creating the first “severed estate.”
Prior to that severance, the estate (surface and
minerals) was “unified.”
My history isn’t too good so this could have
happened before modern private property
came into being. There was the time when the
Monarch just decided who owned what and it
stayed that way until he changed his mind or
a new Monarch came along. That might have
been called “an estate in property at the will of
the King.” There were instances when the King
would give the “land” to Lord A but give Lord
B the right to remove stone from the quarry on
the land. The King had to give Lord B access
(ingress and egress) across the land in order
to remove the stone, lest the ownership of the
stone would be worthless and the stone could
not be quarried (unless Lord A agreed). Also,
Lord A, who owned the surface, had to endure
the scarring that quarrying caused to his surface.
The point is that once the surface and
the minerals were severed (and both were
recognized as property) it was only logical
that the ownership of minerals had to
include the right to access those minerals.
Otherwise, absent the consent of the surface
owner (whether friendly or by coercion or for
money) the minerals would be stranded and
worthless to the owner and of no good use to
the Kingdom.
Common law therefore recognizes the
dominant mineral estate and grants the
mineral owner the right to use as much of
the surface as is reasonably necessary to mine
the mineral whether it be gold or black gold,
such as crude oil. Necessary use of the surface
includes roads, tank batteries, pipelines, pump
jacks, trees and water. However, in spite of the
common law, oil operators have long since
been paying the surface owner for “damages”
and for the right to use water and restoring the
surface after use. In fact the surface owners
have generally been paid quite generously,
usually multiples of the actual monetary
damages. However, money for damages pales
in comparison to money from royalty.
But here we begin to see the makings of a
conflict. The surface owner is inconvenienced
(and the surface “damaged”) and receives a
modest amount of cash then has to look at the
pump jack and have oil workers on his property
regularly while the mineral owner lives in town
or on another ranch and gets magnitudes more
money in the mail for the production.
Folks, as a rule, don’t like to look at ugly
things or be inconvenienced unless those ugly
things (pump jacks for example) are making
them money. If they own the minerals and get
21 Volume 57 Farm&Ranch West
the royalty that pump jack is a thing of beauty;
if not, it is a rusty, noisy, ugly nuisance. The
worst case is when the surface owner owns
none of the minerals. The situation is much,
much more tolerable if the surface owner also
owns some of the minerals and gets some of
the royalty money.
For the surface owner to completely
control the surface he must own 100% of
the minerals. Obviously, the more of the
minerals the surface owner owns, the less
offensive the pump jacks are. But remember,
in many jurisdictions, even if you own 75% of
the minerals you probably will be unable to
prevent use of the surface by the 25% owner.
Certainly, restrictions on surface use
may be included in the deed to limit the
dominance of the mineral estate, but this
needs to be done at the first severance of the
property or it will not bind the mineral owner
who first reserved. Absent a deed restriction
on surface use, the common law will apply.
Both parties to a transfer of property need
to consider the mineral ownership in their
evaluation and understand how the surface
may be shared.
In spite of being dominant, there are real
limits to the use of the surface by the mineral
owner. The doctrine of accommodation was
established in a case called Getty v. Jones in
Texas in 1971 in which it was held that the
oil operator must reasonably accommodate
other surface uses, particularly those uses
already established. In Getty, Mr. Jones had
a circular irrigation system. It seems that
Getty’s pump jacks were so tall as to block
the irrigation system from going in its circle.
Getty said, “gosh we’re sorry but it’s not our
problem.” The court disagreed and ordered
Getty to go to each well site, remove and
reinstall each pump jack after digging up
enough dirt so that when it reinstalled the
pump jacks in the newly created “cellar” they
were low enough that the irrigation system
could pass overhead freely. So the dominance
of the mineral estate is not absolute.
But the surface owner has to be reasonable
too. There is an old Montana case where
the surface owner was not happy with the
damages offered by the oil company so he
met them at the gate, shotgun in hand, and
prohibited entrance of the drilling rig and
equipment. Of course, the oil company
proceeded to get a restraining order against
the surface owner and entered the land. Later
they sued and countersued. The rancher was
awarded $25 for a broken fence and the oil
company was awarded $25,000 for having the
drilling rig and equipment (for which it was
being charged) delayed from entering.
If it is at all possible a purchaser of the surface
should obtain some percentage of the minerals.
This will greatly reduce the otherwise natural
conflict. If one chooses to acquire the surface
with no minerals, he must be prepared to share
his surface with the mineral owner as prescribed
by the common law.
Landowners, being pretty smart, soon
learned that they could sell land reserving all
or some of the minerals. So minerals began to
be reserved a hundred years ago and still are
today. The problem grows and grows – if you
consider severed minerals to be a problem.
As we consider the purchase or sale of any
property today, we must consider severed
minerals and how to best negotiate a deal
satisfactory to the buyer and seller. We must
think about owning less than 100% of the
minerals (which is going to be the case most
of the time) and understand the consequences
thereof. In addition to lack of surface control
(which remember happens anytime you get
ownership of less than 100% of the minerals)
you are giving up a proportionate part of
future lease bonuses and royalty. In many
cases today, since shale-gas and shale-oil
drilling was perfected, the minerals are
worth much more than the surface -
multiples, in fact. So we need to be sure
we’re comparing apples to apples or
dirt to dirt in our negotiations. Land
isn’t just land anymore, if it ever was.
Out West, and by that I mean west
of the border between Kansas and
Colorado (extended north and south) there is
a fair chance the mineral owner will be the U.S
government – which owns about 700,000,000
acres of minerals, the vast majority of which
are in the West.
So just beware of the facts. My Mother shared
with me long ago the saying “you can’t have
everything” which doesn’t exactly apply to my
message until we modify it a bit: you can’t have
everything – unless you buy it. And that means
it must be for sale. In today’s world 100% of
the minerals are hardly ever going to be for sale.
The best solution was suggested in the play
“Oklahoma!” There it was said “the rancher
and the farmer should be friends.” So perhaps
we should say “the rancher and the mineral
owner should be friends.”
But certainly we say the dominance of
the mineral estate should be given careful
consideration when buying your farm or ranch. v

Dan Waggoner, born in Tennessee in 1828, moved to Texas with his family in the mid-1840s. This was a time when much of Texas was open range
and unexplored. Dan took advantage of this great opportunity and founded the Waggoner Ranch in 1849. In later years, W.T. (Tom) Waggoner
created the ranching empire currently known as the W.T. Waggoner Ranch. Owned and operated by the Waggoner heirs, this ranch is a singular
opportunity so rare it only comes along every 165 years.

SSoldier Summit Ranch is an outdoor paradise surrounded by breathtaking vistas of ridgeline landscape with thriving populations of Rocky Mountain
game. Ranging from 7,500 to 8,600 feet, the ranch consists of a vast principal mountain and ridgeline surrounded by seven canyons. The terrain
features a hearty mix of heavily forested slopes and secluded parks dotted with pines and aspens. The Right Fork of the White River flows for 1.5
miles along the property’s eastern boundary and several natural springs are scattered throughout the landscape. A superb stock of elk, including a
large percentage of mature and trophy-class bulls, migrate frequently through this 2,050-acre property. Soldier Summit Ranch offers some of the best
snowmobiling in Utah and multiple trails that begin on the property lead to the vast, surrounding national forest. $3,000,000. Property ID: 48681
WWelcome to House Brand Ranch, located in Morgan and Summit Counties near Croydon, Utah. This 12,300 acre hunting, fishing, and agricultural property
extends from Lost Creek Basin at an elevation of 5,300 feet to mountain tops at 8,000 feet. Irrigated fields produce beautiful alfalfa crops along Lost Creek.
Dry land alfalfa is raised on higher elevation benches. The balance of the ranch includes sage brush covered slopes with groves of Aspen, Oak, and Pine
trees. The property has many outstanding red rock outcroppings, especially in the Cedar Canyon area, some with arches, bowls, and coves. The ranch has
a high degree of privacy and very few people have seen its true beauty. Distance from the Salt Lake International Airport to ranch headquarters is 60 miles.
Distance from Ogden, Utah to the ranch is 40 miles. Distance from the ranch to skiing and recreation in Park City, Utah is 45 miles. House Brand Ranch
has been under the careful stewardship of the Peterson family since 1960. Great care has been taken to preserve and enhance water shares for irrigation
and to identify and develop mountain seeps and springs for game and livestock usage. The Ranch is also home to abundant game. The Seller has enjoyed
a consistent harvest of “trophy” class deer, elk, and moose for decades and most of their hunters are
repeat customers. Additional game that can be observed on the ranch are mountain lion, coyote, turkey,
sage grouse, and chukar. One of the jewels of the ranch is the 3 mile stretch of Lost Creek which flows
through the property. Fishing Utah streams on private property, is by permission only. Therefore the
existing brown and rainbow trout are able to grow to the 18+ inch range without a lot of pressure, and
side canyon streams hold smaller native and brook trout. The offering price of House Brand Ranch is
$22,000,000. Any offer must be accompanied by an earnest money deposit in the amount of $500,000.
Each offer must also be accompanied by the name and telephone number of the Buyer’s private banker
to assist the Seller in determining the Buyer’s financial ability to accomplish the purchase.

Terry Bradshaw is a former American football quarterback who played for the Pittsburgh Steelers in the National
Football League. He has been a TV analyst and co-host of Fox NFL Sunday. He played for 14 seasons with Pittsburgh,
won four Super Bowl titles in a six-year period, becoming the first quarterback to win three and four Super Bowls, and
led the Steelers to eight AFC Central championships. He was inducted into the Pro Football Hall of Fame in 1989. He
is ranked #44 on the list of 100 of the Greatest Football Players ever, and in 1972 threw one of the most famous plays
in NFL history, known as the “Immaculate Reception.”
My Prize Ranch Goes on the Market
Feature Ranch
By Terry Bradshaw
From immaculate reception to immaculate ranch – Terry talks about his horses, hogs, cattle and the therapeutic rewards of ranching, while transforming almost a thousand acres of once-discarded dirt into picturesque serenity for his family, friends and prized livestock.
71 Volume 57 Farm&Ranch West
As the old saying goes, there is a time and place for everything. At my ranch in Thackerville,
Oklahoma overlooking the Red River, I have devoted a lot of time over the last 14 years and a huge
amount of money turning about 740 neglected acres into a place that I am proud to say I love.
My wife, Tammy, tells me that being a Virgo, I have to have everything perfect. Of course, that is
why I married her. She is right that I require perfection, whether it was on the football field when I
was playing for the Pittsburgh Steelers, in the studio at FOX Sports Sunday or at the ranch.
Everything about this ranch is perfect from my sprawling western-style lodge I built for my family
and friends to the care I give my horses to the miles of pipe and cable fencing that surrounds the
pastures to the eight bucolic lakes.
On Building My Ranch
I built it to satisfy my passion for being outdoors, working with animals, particularly horses
and cattle, but also the hogs I raise to feed the hungry. This ranch meets all those needs. I raise
a large herd of cattle and top quality horses on one of the finest spreads you will find anywhere.
More important, in my hectic life of airplanes, television shows, speaking engagements and
meetings, I have to have a spot on this Earth where I can walk out my front door and feel the
peace, but get to anywhere in the country or the world in an hour’s drive to
DFW airport. This ranch has been the perfect spot for me.
It was not always that way. When I first laid eyes on this property, it
was a mess. No one had taken care of it for years. There were a few head
of cattle grazing on it, but mostly the acres were overgrown with brush
and trees. The creek bottoms needed to be cleaned out. The fencing was

mostly gone. There was an old run-down barn
and a worn-out, old school bus. There were no
paved roads, just old tracks. Getting around
the property required four-wheel drive. There
was almost no surface water.
The first time I saw the property, I walked
away. I had looked for ranches all over Texas,
and I didn’t think this one just across the river
in Oklahoma was right for me either. Then on
a whim, I drove up here in my jeep and spent
hours driving over the old trails that Indians
and stagecoaches once used, thinking about the
potential the land offered. I pulled up on one
of the hills, parked my jeep facing the setting
sun. I stood on top of the jeep and looked back
across the river. I decided then
I could build a house on that
spot. I did, and to this day, I
find quiet peace and tranquility
enjoying that setting sun from
my back veranda.
It took me two years to clear
the trees and brush, clean out
the bottoms, erect miles of
fencing and start work on the house and barn.
I knew where I would build the house and the
direction it would face. But other decisions,
like where to build the barns, the arenas, the
paddocks, took more time. What if I built them
in the wrong place? I didn’t.
While I was turning the property into
something special, I was taking every job I
could to pay for it all. Millions of dollars later,
I have created something that is very special.
Just an hour north of Dallas/Fort Worth
Airport and a few minutes from the world-class
Winstar Casino, my ranch has everything for
someone who wants a versatile ranch, who
likes to entertain friends and family and who
needs a place to escape. That person could
take the keys, move in, start raising horses
and cattle, and fall in love like I have with this
ranch. My manager, Chad, who built this over
the years, would like to stay. He’s the perfect
manager for this place.
Lake Murray State Park 2.5 Miles From the Ranch
Lake Murray State Park is Oklahoma’s first and largest state park consisting of 12,500 acres located on the shores of
beautiful Lake Murray. The park’s diverse terrain, exceptional trails and historic sites make Lake Murray State Park a favorite destination among outdoor,
water sport and ATV riding enthusiasts

“Millions of dollars later, I have created something that is very special.”
My house, built
in rustic style,
has tall ceilings,
large fireplaces,
tiled floors, wood
paneling and a lot
of Western decor.
With 8,600 square
feet under a gorgeous green roof, it has six
bedrooms and eight baths. One of my favorite
places to sit to watch the sunset is our outdoor
patio that is more than 1,000 square feet and
has a kitchen and a bar, a fireplace and a fire
pit. I built a pool for my two daughters and
their friends and a two-story doghouse.
The horses have it just as good. There is a
four-stall stallion barn, a 20-stall show barn,
a 50-stall mare barn with a laboratory and
office and a 75 by 140 foot covered arena.
The property also has fenced-in pastures and
paddocks and eight ponds.
I currently have 50 brood mares, three
stallions and 100 Black Brangus cattle. The ranch,
particularly in rainy years, could handle more.
I built trails all over the property so my
family, friends and I can enjoy viewing this
fabulous place on four wheelers, on horses, or
on foot. Once you needed a four-wheel drive
just to get on the ranch—now you can drive a
Ferrari from Highland Park, DFW Airport or
Winstar Casino to my front door on sealed
asphalt at any time of the year.
So you are wondering why I would ever let
go of a place I have put so much of myself into.
This ranch is a part of me. I will miss it. But at
66 years old, it is time to downsize. I don’t have
the time or the energy I once
did to continue working this
ranch. It is a place that needs
to be used by someone who
will care for it as much as I
do, to raise kids, entertain
family and friends and host
great get-togethers.

states of Oklahoma and Texas. There you will see the Red River, and you will also see the 12th largest lake in the United States spanning that border in the area
east of 1-35 and west of 1-75. That’s Lake Texoma, aptly named after Texas and
Oklahoma where it is located.

On Choosing My Broker
I had considered various agents over time but
could never really find the right fit. Then I was
introduced to Bernie through as he likes to say,
“one of his mates in his network,” a guy called
Fandel in Telluride, Colorado. Bernie (who’s
an Aussie) and I hit it off right away when he
came to the ranch. He’s a competitive horseman
and polo player with a background in cattle and
ranching who sells ranch properties all over the
world. He’s also selling one of America’s biggest
and most famous ranches, the Waggoner Ranch
– over half million acres – so I figure he can
certainly handle my ranch!
Bernie brings a team approach with Angie
Nelson and Briggs Freeman Sotheby’s of
