But these same limitations have to comply with “the three step test” (abstract criteria which limit the use of these limitations)

The limitations given by the Directive can ONLY be applied:

1-     in certain special cases,2-      which do not conflict with a normal exploitation of the work or other subject-matter3-      and do not unreasonably prejudice the legitimate interests of the rightholder.

How to restore the balance between the rights of authors and the rights of the larger public interest?

Fair use

4 abstract criteria to take into account:

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit

educational purposes;(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.
