2010 ADA Requirements
• Element by Element Safe Harbor. The rule includes a general "safe harbor" under which elements in covered facilities that were built or altered in compliance with the 1991 Standards would not be required to be brought into compliance with the 2010 Standards until the elements were subject to a planned alteration. A similar safe harbor applies to elements associated with the "path of travel" to an altered area.

2010 ADA New Definitions
• Service animal means any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability. Other species of animals, whether wild or domestic, trained or untrained, are not service animals for the purposes of this definition. The work or tasks performed by a service animal must be directly related to the handler’s disability.
2010 ADA New Definitions
• The crime deterrent effects of an animal’s presence and the provision of emotional support, well-being, comfort, or companionship do not constitute work or tasks for the purposes of this definition.

2010 ADA New Definitions
• Miniature horses. (i) A public accommodation shall make reasonable modifications in policies, practices, or procedures to permit the use of a miniature horse by an individual with a disability if the miniature horse has been individually trained to do work or perform tasks for the benefit of the individual with a disability.

• (ii) Assessment factors. In determining whether reasonable modifications in policies, practices, or procedures can be made to allow a miniature horse into a specific facility, a public accommodation shall consider—
• (A) The type, size, and weight of the miniature horse and whether the facility can accommodate these features;

the miniature horse;
• (C) Whether the miniature horse is housebroken; and
• (D) Whether the miniature horse’s presence in a specific facility compromises legitimate safety requirements that are necessary for safe operation.
• (iii) Other requirements. Sections 36.302(c)(3) through (c)(8), which apply to service animals, shall also apply to miniature horses.

2012 FACBC Requirements• Exceptions to applicability of the federal standards.—Notwithstanding
the adoption of the Americans with Disabilities Act Standards for Accessible Design pursuant to s. 553.503, all buildings, structures, and facilities in this state must meet the following additional requirements if such requirements provide increased accessibility:
• (1) All new or altered public buildings and facilities, private buildings and facilities, places of public accommodation, and commercial facilities, as those terms are defined by the standards, subject to this part, must comply with this part.
• (2) All new single-family houses, duplexes, triplexes, condominiums, and townhouses shall provide at least one bathroom, located with maximum possible privacy, where bathrooms are provided on habitable grade levels, with a door that has a 29-inch clear opening. However, if only a toilet room is provided at grade level, such toilet room must have a clear opening of at least 29 inches.
• (3) Notwithstanding the requirements in s. 404.2.9 of the standards, exterior hinged doors must be designed so that such doors can be pushed or pulled open with a force not exceeding 8.5 foot pounds.
2012 FACBC Requirements• (4) In motels and hotels a number of rooms equaling
at least 5 percent of the guest rooms minus the number of accessible rooms required by the standards must provide the following special accessibility features:
• (a) Grab rails in bathrooms and toilet rooms that comply with s. 604.5 of the standards.
• (b) All beds in designed accessible guest rooms must be an open-frame type that allows the passage of lift devices.
• (c) Water closets that comply with section 604.4 of the standards.
• All buildings, structures, or facilities licensed as a hotel, motel, or condominium pursuant to chapter 509 are subject to this subsection. This subsection does not relieve the owner of the responsibility of providing accessible rooms in conformance with ss. 224 and 806 of the standards.
2012 FACBC Requirements• (5) Notwithstanding ss. 213 and 604 of the standards, required
bathing rooms and toilet rooms in new construction shall be designed and constructed in accordance with the following:
• (a) The wheelchair accessible toilet compartment must contain an accessible lavatory within it, which must be at least 19 inches wide by 17 inches deep, nominal size, and wall-mounted. The lavatory shall be mounted so as not to overlap the clear floor space areas required by s. 604 of the standards for the wheelchair accessible toilet compartment and comply with s. 606 of the standards. Such lavatories shall be counted as part of the required fixture count for the building.
• (b) The accessible water closet within the wheelchair accessible toilet compartment must be located in the corner, diagonal to the door.
• (6) Barriers at common or emergency entrances and exits of business establishments conducting business with the general public that are existing, under construction, or under contract for construction which would prevent a person from using such entrances or exits must be removed.

2012 FACBC Requirements
• Accessible Parking Spaces• All spaces must be located on an accessible route
that is at least 44 inches wide so that users are not compelled to walk or wheel behind parked vehicles except behind his or her own vehicle.
• (c)1. Each parking space must be at least 12 feet wide. Parking access aisles must be at least 5 feet wide and must be part of an accessible route to the building or facility entrance. The access aisle must be striped diagonally to designate it as a no-parking zone.
2012 FACBC Requirements Each such parking space must be striped in a manner that is consistent with
the standards of the controlling jurisdiction for other spaces and prominently outlined with blue paint, and must be repainted when necessary, to be clearly distinguishable as a parking space designated for persons who have disabilities. The space must be posted with a permanent above-grade sign of a color and design approved by the Department of Transportation, which is placed on or at least 60 inches above the finished floor or ground surface measured to the bottom of the sign and which bears the international symbol of accessibility meeting the requirements of s. 703.7.2.1 of the standards and the caption “PARKING BY DISABLED PERMIT ONLY.” Such a sign erected after October 1, 1996, must indicate the penalty for illegal use of the space. Notwithstanding any other provision of this section, in a theme park or an entertainment complex as defined in s. 509.013 in which accessible parking is located in designated lots or areas, the signage indicating the lot as reserved for accessible parking may be located at the entrances to the lot in lieu of a sign at each parking place. This subsection does not relieve the owner of the responsibility of complying with the signage requirements of s. 502.6 of the standards.
2012 FACBC Requirements
• 553.513 Enforcement.—It shall be the responsibility of each local government and each code enforcement agency established pursuant to s. 553.80 to enforce the provisions of this part. This act expressly preempts the establishment of handicapped accessibility standards to the state and supersedes any county or municipal ordinance on the subject. However, nothing in this section shall prohibit municipalities and counties from enforcing the provisions of this act.
Changes to the Florida Accessibility Code – 2012 FACBC
• The 1997 Florida Accessibility Code for Building Construction was certified by DOJ, however, the 2012 Florida Accessibility Code for Building Construction must also be reviewed and certified by DOJ. Until the review is completed and DOJ notifies the State the 2012 Code is certified all parties should maintain due diligence to ensure compliance with both the 2010 ADA Standards for Accessible Design and the 2012 Florida Accessibility Code.

FACBC Waiver Availability• The Florida Building Commission may waive
Florida specific requirements of this code. It does not waive requirements of this code to standards below the federal ADA standards on which it is based. Applications for waiver and the criteria for their review are established by Rule Chapter 9N-4, Florida Administrative Code. Current versions of the Rule can be accessed through the Florida Department of State website http://dlis.dos.state.fl.us/fgils/government.html Applications can be found on the Florida Building Commission website www.FloridaBuilding.org
FACBC Waiver Availability• The commission may render declaratory statements in
accordance with s. 120.565 relating to the provisions of the Florida Accessibility Code for Building Construction not attributable to the Americans with Disabilities Act Accessibility Guidelines. Notwithstanding the other provisions of this section, the Florida Accessibility Code for Building Construction and chapter 11 of the Florida Building Code may not be interpreted by, and are not subject to review under, any of the procedures specified in this section. This subsection has no effect upon the commission’s authority to waive the Florida Accessibility Code for Building Construction as provided by s. 553.512.

Common ADA Errors and Omissions in New Construction and Alterations - Parking
Error/Omission The built-up curb ramp projects into the access aisle. The
accessible parking space and access aisle is not level in all directions.
Result When an access aisle has a sloped surface, a wheelchair
may roll away from a car or van preventing the wheelchair user from getting out of the vehicle. The sloped surface also prevents a van-mounted wheelchair lift from being fully-lowered to the access aisle surface.

Error/Omission There is no accessible route from accessible parking to an
accessible entrance. Result
A person using a wheelchair, scooter, or walker has no way of getting from the accessible parking space to the building entrance. Often when there is an inaccessible walkway provided for others, wheelchair users must use a roadway or vehicular route which can be dangerous.

A person who uses a van equipped with a wheelchair lift has inadequate space to lower the wheelchair lift and get out of the vehicle.

provided pursuant to section 502.2, for every six or fraction of six parking spaces required by 208.2 to comply with 502, at least one shall be a van parking space complying with 502.

Common ADA Errors and Omissions in New Construction and Alterations - Accessible Route –Exterior Error/Omission
The pedestrian routes on a site from public transportation stops, accessible parking spaces, passenger loading zones, and public streets and sidewalks to the accessible entrance(s) are not accessible.
Result People with disabilities cannot travel from the site entry
points to the accessible entrance(s). In some cases, people must use vehicular routes which can be dangerous.
Requirement At least one accessible route shall be provided within the
site from accessible parking spaces and accessible passenger loading zones; public streets and sidewalks; and public transportation stops to the accessible building or facility entrance they serve per 206.2.1

Error/Omission Curb ramp that is located across a circulation path has
steep unprotected side flares. Result
People walking across the curb ramp may trip and be injured. People who use wheelchairs can tip over if they accidentally roll over the non-flared sides.
Requirement 406.3 Sides of Curb Ramps. Where provided, curb ramp
flares shall not be steeper than 1:10. EXCEPTION: In alterations, where there is no landing at
the top of curb ramps, curb ramp flares shall be provided and shall not be steeper than 1:12.

406.8 Detectable Warnings. Curb ramps subject to Department of Transportation regulation 49 CFR 37.21 shall have a detectable warning complying with 705. The detectable warning shall extend the full width of the curb ramp (exclusive of flared sides) and shall extend either the full depth of the curb ramp or 24 inches deep minimum measured from the back of the curb on the ramp surface.

Error/Omission Parts of an accessible route with slopes that exceed 1:20 lack
required features including handrails and edge protection. Result
When a walkway or other pedestrian surface has a slope greater than 1:20, it is more difficult to maintain control of a wheelchair. Wheelchair users may also not be able to climb up the sloped route without railings. Lack of edge protection may result in injury if a wheelchair user rolls off the side of the route. People who use a mobility device such as crutches, a cane, or a walker may lose their balance or fall while using a sloped section that does not have handrails or edge protection.
Requirement 403.3 Slope. The running slope of walking surfaces shall not be
steeper than 1:20. The cross slope of walking surfaces shall not be steeper than 1:48.

Adequate maneuvering clearance is not provided at doors, including doors to accessible toilet stalls.
Result A person using a wheelchair cannot open the door without a
clear level area in front of and adjacent to the door that provides a place to maneuver.
Requirement 404.2.4.1 Swinging Doors and Gates. Swinging doors and gates
shall have maneuvering clearances complying with Table 404.2.4.1.
404.2.4.3 Recessed Doors and Gates. Maneuvering clearances for forward approach shall be provided when any obstruction within 18 inches of the latch side of a doorway projects more than 8 inches beyond the face of the door, measured perpendicular to the face of the door or gate.

404.2.5 Thresholds. Thresholds, if provided at doorways, shall be ½ inch high maximum. Raised thresholds and changes in level at doorways shall comply with 302 and 303.
EXCEPTION: Existing or altered thresholds ¾ inch high maximum that have a beveled edge on each side with a slope not steeper than 1:2 shall not be required to comply with 404.2.5.

Error/Omission The shape of the door hardware requires tight grasping,
pinching, and twisting of the wrist to use. Result
The door cannot be opened if the user cannot operate the latch or handle.
Requirement 404.2.7 Door and Gate Hardware. Handles, pulls, latches,
locks, and other operable parts on doors and gates shall comply with 309.4.
309.4 Operation. Operable parts shall be operable with one hand and shall not require tight grasping, pinching, or twisting of the wrist. The force required to activate operable parts shall be 5 pounds (22.2 N) maximum.

Error/Omission Objects protrude into circulation paths from the side or
from posts. Objects that overhand circulation paths do not provide
clear headroom. Result
People who are blind or who have low vision can be seriously injured when they cannot detect and object by using the sweep of their cane.
Requirement 307.2 Protrusion Limits. Objects with leading edges more
than 27 inches and not more than 80 inches above the finish floor or ground shall protrude 4 inches maximum horizontally into the circulation path.
EXCEPTION: Handrails shall be permitted to protrude 4 1/2 inches maximum.

Error/Omission Where toilet rooms or bathrooms are provided, not all public
and common use toilet rooms and bathrooms (including locker rooms and toilet rooms for employee use) are accessible.
