Dutch authorities for plant health issued a notification of phyto-sanitary non- compliance after intercepting the consignment which means that citrus imports from South Africa are now on a trade watch list at EU borders. The threat of a ban is now a step closer as the EU has decided that if more than a certain amount of contaminated exports are found, South African citrus fruit will be locked out of the economic zone. According to the dti, in 2013 about 70% of oranges sold in Europe came from South Africa. At a media briefing last week, Davies said that SA would use “whatever tools it had” to defend its interests. He noted that Europe’s reluctance to compromise on the CBS issue could be devastating for the R8-billion local citrus industry. Frozen potato chips safeguardOn 25 July 2014 the South African Revenue Service (Sars) imposed a final safeguard on frozen potato chips (or French fries), classifiable under tariff subheading 2004.10.20, through two Government Gazette notices. The safeguard is applicable to all countries with the exclusion of those listed in the Government Gazette notices (The list of country names is in this week’s Customs Buzz.)

The safeguard of 40.92% is imposed from 25 July 2014 to 4 July 2015, then from 05 July 2015 to 04 July 2016 a safeguard of 20.45%.

Customs and Excise ActsOn 23 July 2014, the Customs Control Act No. 31 of 2014, and the Customs and Excise Amendment Act No. 32 of 2014, were published in

two separate Government Gazettes. Both these Acts will come into operation on a later date as indicated in Section 944 of the Customs Control Act, and Section 88 of the Customs and Excise Amendment Act.

Iron/Steel Tariff ApplicationOn 18 July 2014, the International Trade Administration Commission of South Africa (Itac) published an application for the proposed increase in “General” rate of customs duty on (i) wire of iron or non-alloy steel: plated

or coated with zinc; (ii) barbed wire of iron or steel; (iii) other grill, netting and fencing, welded at the intersection; and (iv) other cloth, grill, netting and fencing.

Mussel Tariff ApplicationItac has published its intention to amend its recommendation in its Report No.413 to include mussels in the scope of the customs duty. The tariff amendment will include the creation of additional

The SA airfreight industry has been officially granted “green” status under the European Union (EU) ACC3 air cargo security regime which became effective on July 1.

This was announced at an SA Civil Aviation Authority (CAA) meeting last week, where the authority also noted that SA air cargo agents were no longer required to implement the expensive validation process

to have free movement of cargo to Europe.

“For the industry to take full advantage of this status,” David Alexander, GM of compliance services at Professional Cargo Security, told FTW, “it needs to fully comply with SA’s Part 108 security rulings. And the members should all be known consignors or regulated agents.”

This, he added, would

prevent the delays to air cargo that occur when shipments originate with non-compliant sources, and need to be X-rayed and cleared by a third party body before the carriers will accept them.

South Africa’s contentious customs bills have been given the presidential go-ahead and were published in the government gazette two weeks ago.

D-day for implementation, however, remains unknown and will be announced by presidential decree in the government gazette once the supporting customs rules are in place.

According to a spokesman for the South African Revenue Service (Sars), the Customs Duty Bill was published first as the Customs Duty Act, 2014 (Act No. 30 of 2014) in the Gazette of July 10 following the president's go-ahead, while the Customs Control Bill and the Customs and Excise Amendment Bill were in the process of being

published. By the time FTW goes to print this will have been done.

This means the bills are now an act of Parliament and officially the new customs law of the country despite not yet being operational.

“The bills will only become operational once the president has advised on a date,” said the spokesman. It is uncertain when this will be as the process around the rules guiding the acts has only just kicked off, with the first industry comment expected this week.”

The first ten chapters

of the rules were published earlier this month with a due date of July 29 for all external comment.

Once all the comments have been processed the president will be

approached to decide the final date for the new legislation to become effective. The process has, however, significantly speeded up and it is rumoured that the new law will be operational as

soon as 2015.According to Clifford

Evans, a customs adviser for Ceva Logistics, who has read the first ten chapters

of the rules, there have been no big surprises so far.

“There are some technical issues that industry is commenting on and would request changes for,” he told FTW.

One such item was the rules stating that all records relating to the customs bills have to be stored on the premises of the business for a period of time.

“That is very difficult with limited physical storage space for most companies and so one can expect that the industry would request from Sars that they rephrase that to allow for off-site storage facilities and electronic storage as well,” he said. “Another technical issue that has come up is that importers, according

to the rules, will have to provide documents within one day of requests being issued by customs. That is very difficult to do as one might receive the document only days after it has been issued. It would be understandable if Sars requested that a response be submitted within a day of receiving the documentation rather than within a day from the date issued, which is unreasonable.”

Sars has called on the freight and logistics industry to take cognisance of the published rules and regulations and to ensure comment is received within deadline by July 29, 2014.

The process around the rules guiding the acts has only just kicked off, with the first industry comment expected this week.

Independent groupage operator CFR Freight has launched a new technology portal – branded EON – that offers its customers instant access to key information.

“It enables customers to obtain information like port details, vessel location details, tracking information and sailing schedules electronically within seconds,” says general

manager Lee Schoeman. “They need no longer waste valuable time on telephones or websites trying to obtain the information,” he said.

And customer take-up has far exceeded initial expectation, says Schoeman. “Going forward EON will become our customers’ primary method of accessing pertinent information from CFR.”

The banking industry has put its money where its mouth is in terms of investment in Africa – and that’s good news for economic expansion.

“Both local and international banks are increasingly focused on the opportunities African growth can give them,” said Janine Myburgh, president of the Cape Chamber of Commerce and Industry. “Bankers and government officials believe that as ordinary workers gain access to basic

banking facilities, and the emerging middle classes access more sophisticated financial services, there should be a feedback loop to greater spending and consumption, and hence further economic expansion,” she said.

Speaking at the third Doing Business in Africa seminar organised by the Cape Chamber and aimed at growing Western Cape exporting into Africa, Myburgh said financial institutions seemed to be far

more committed to the region and its success than many other sectors. “Cross-border banking will have significant benefits for companies looking to expand their African operations,” she said.

And she believes now is the time, with Nigeria having rebased its figures for gross domestic product in April this year and overtaken South Africa as the biggest economy on the continent – coupled with the downgrading of South

Africa by several international organisations.

“Bloomberg economist, Jim O’Neill, recently pointed out that the whole of Africa had an annual output of only perhaps $2 trillion, which was comparable to India or Russia. “And yet, despite this, the region is viewed as the global investment darling,” Myburgh said. “Despite the slightly gloomy South African picture, we must take the opportunities north of our borders more seriously.”

Becoming a successful exporter, distributor and retailer in Africa did not happen overnight for Shoprite Checkers. It was the result of a long-term strategy and investment in which many lessons were learned and much patience was required.

But despite the many challenges – like labelling in Portuguese for the Angolan market, port congestion and endless documentation for customs and border crossings – the company has firmly established a foothold in the continent.

“Going into Africa requires perseverance first and foremost,” said a Shoprite spokesman. “It

is also not about making profits quickly. Successful operations require investment and long-term commitment to the countries you are entering. You also have to be keenly involved in monitoring the market and know when to expand.”

He said the decision to export into Africa was therefore more about affordability than anything

else. “You have to know how much pain you can afford to take and for how long. Formalised market research does not really exist in many countries and an educated guess is called for. Yes, you can send people to investigate the market and you can gather information, but you never really know until you try.”

He said understanding

that there was going to be success and failure was another important aspect to remember.

Using South Africa as its base, Shoprite Checkers has been growing its African operations over the past few years, sourcing products both locally and internationally.

“We invested in centralised distribution centres that are state of the art as we feel this gives us a competitive advantage and allows for a more efficient supply chain,” he said. “In Africa one is reliant on road transport. Transport in Africa is costly and it is a factor one has to take into account. Where we can we use local transporters within a country and we ship to the closest port and then move the goods by road, while airfreight is used as well – particularly for perishable products that have a short shelf life.”

For Shoprite it is about making smart choices that ultimately see the goods moving more efficiently.

“There are challenges

in Africa that cannot be underestimated. Export compliance is a major constraint, with each country having its own set of rules and regulations. One has to be able to accommodate the rules of these countries efficiently and effectively. We have spent much time on this as we believe being able to do this well does create a competitive advantage.”

Keeping up to date with legislation is also important.

“For us success in Africa has been a long and slow process which included us taking control of our own supply chain. That is the only way we could ultimately contain costs to remain competitive.”

MBABANE – At a time when the Citrus Growers’ Association (CGA) is lobbying for an extension of the US trade initiative the African Growth and Opportunity Act (Agoa), CGA’s Swaziland members stand to lose out due to President Obama’s removal of the country from the list of Agoa beneficiaries.

“Expulsion (for Swaziland) is a setback,”

Justin Chadwick, CEO of the CGA, said in response to a query from FTW.

“Swaziland does not have access to the USA and so no fruit is sent there at the moment. South Africa only has access from the Northern and Western Cape,” said Chadwick.

The operations of the Durban-based CGA are financed from dues paid by growers. One current

project is to help convince the US to extend Agoa beyond 2015. Swaziland growers are CGA members and their dues have contributed to this effort with an eye on future access to the lucrative US citrus market.

“Both Swaziland and the rest of South Africa have sent in market access applications,” said Chadwick.

Agoa largely benefited

Swaziland’s textile industry. However, citrus is an example of another Swazi product that would benefit from duty-free access to the US market offered by the trade scheme. Swaziland was removed from Agoa eligibility in May, with the official announcement coming in June, because government would not adjust its domestic labour and human rights laws

and policies to conform with international accords on these topics to which Swaziland is a signatory.

Swaziland’s citrus growers may yet receive market access for their product, and shipments may still be made there in future if approval is received. However, regular duties will have to be paid on the fruit.– James Hall

Fortunate Mboweni, South Africa’s Young Freight Forwarder of the Year 2014, will represent the Africa/Middle East region in October this year as one of the Final Four regional contestants competing for the title of the International Young Freight Forwarder of the Year Award for 2014.

The winner will be announced at the Federation of Freight Forwarders Associations (Fiata) annual congress in Istanbul, Turkey from October 13-18 this year. The award comprises two weeks of practical and academic training, one week of academic training in London, one week of practical training

based in one of the TT Club’s regional centres (London, Hong Kong or New Jersey) plus one year’s free subscription to the International Transport Journal (ITZ), Switzerland and International Freighting Weekly (UK).

Mboweni, an imports controller for airfreight at Bidvest Panalpina Logistics (BPL) completed her dissertation on the challenges of transporting abnormal loads and the complexities associated with the handling of highly sensitive radioactive cargo. She included case studies based on BPL’s own experiences.

She told FTW she has been with BPL for seven years, having started at

the company through a learnership and has been studying throughout her career, having recently achieved a Level 5 qualification. “I am now looking at doing a national degree or diploma as I’ve seen how it can change one’s life. Quick-thinking and a risk management plan saved a Namibian freight company from losing almost R500 000 in a ‘change of banking details’ scam which reportedly cost Namport R1.2 million earlier this year.

The scammers send out an email letter, on the scammed company’s letterhead, advising customers of a change of banking details. The unsuspecting customers then transfer funds owing into the new account.

Gert Liebenberg, owner of the Windhoek-based Hardap Freight Services (HFS), told FTW that the serious crime unit at the Namibian Police Force (Nampol) had told him that a syndicate was operating the scam, confirming that there had been several other incidents where companies had lost large amounts of money

letter – on an old company letterhead with the old physical address – advising them that the company’s banking details had changed and that all payments needed to be made to the new account. “Our clients, The Namibian, owed us close to half a million rand as we handle the country-wide distribution of the daily newspaper,” he said.

The circulations and operations manager at the newspaper, Hofney Kanadjembo, received the letter and was aware that HFS had a policy that only Liebenberg himself notified of any major account changes.

“Another reason I was suspicious was that the e-mail address was off – it was a generic Google one,” said Kanandjembo. HFS had also just recently changed banks from Standard Bank to the Bank of Windhoek which was another red flag for him and he immediately contacted Liebenberg directly.

Liebenberg has opened a case

of fraud with Nampol and it has emerged that the fraudulent account number – 1006 390 0775 with branch code 051 001 – is from Absa bank in South Africa, and not Standard Bank as advised in the scam letter. He told FTW it was “possible” that the syndicate relied on inside knowledge but that it was not proven at this stage.

Chairman of the Bankers’ Association of Namibia, Christo de Vries, said that the association was aware of the scam. He noted that a quick response from clients and their reporting of the various scams enabled the banks to respond more quickly and warn other clients as well. “Unfortunately Phishing scams are on the increase and therefore the Bankers’ Association will continue to create awareness amongst the clients of banks on the different types of financial fraud. This will ensure that clients are more alert and are able to recognise fraudulent schemes and scams.”

Increasing volumes in the run up to Christmas is high on the agenda of SACO Shipping, the German agent of neutral groupage operator CFR Freight, following a slow-down in the first half of the year.

Speaking to FTW during a recent trip to the country, Jörn Mecklenburg said there had been a drop in volumes in the first half of the year which could be attributed mostly to the exchange rate.

“The euro is strong and the rate of exchange is not encouraging imports,” he said. “The decrease has not been dramatic but we have seen volumes drop. We are, however, optimistic that

this will change and that the second half of the year will see volumes improve.”

Growing business on top of that is the ultimate aim. “We have a vested interest in South Africa as it is our entry point into the growing African market,” he said. “Despite lower volumes into South Africa we have seen this market grow consistently over the past few years.

He said the growing middle class not only in South Africa but also across Africa boded well for the future and the continent was being watched and monitored closely by international companies such as SACO

Shipping as more and more countries were opening up for trade.

“But success on this continent is dependent on a good local partner and we have found that in CFR,” he said.

“Visits by CFR agents to South Africa highlight the strategic importance of South Africa as a gateway to Africa,” said CFR general manager Lee Schoeman.

“Despite tough trading conditions we continue to develop additional direct services into and out of South Africa and we have plans to expand into Africa,” he added.– Liesl Venter

Any European Union (EU) and US sanctions against Russia are unlikely to have any sort of direct impact on SA-Russia trade, according to trade analyst Duncan Bonnett of Liz Whitehouse & Associates.

“Anyway, our trade with Russia is pretty small,” he said.

Indeed, the department of trade and industry (dti) statistics revealed that in 2013 SA exported just under R3.9 billion of goods and services to Russia, the bulk of which were oil products, chemical products, transport equipment, machinery, food and agricultural products, and wood.

And SA imported a margin over R3.6bn – mostly metals (aluminium being a prime one), wood, fertilisers, foods (in the form of fruits and vegetables), raw materials, and alcoholic and non-alcoholic beverages.

Also, Bonnett told FTW, the proposed sanctions are only asset freezes and travel bans aimed at individuals in President Vladimir Putin’s inner circle – and, in the US case, at companies linked to these individuals. However, US politicians are currently debating a new round of even tighter sanctions

In the EU, members of European parliament (MEPs) have also called for heightened sanctions, and the bloc’s foreign ministers for measures that could hit “access to capital markets, defence, dual-use goods, and sensitive technologies, including in the energy sector”.

But up to now, the EU

has tended to shy away from extending sanctions to include major Russian companies. The reason, according to much of the European media, is a worry that Russian President Vladimir Putin could respond with economic penalties of his own. It is felt that this would be a problem for European industry in several countries if Russia were to retaliate with energy sanctions – like cutting off vital gas supplies.

“If the sanctions were applicable to EU and US companies operating in this country – mostly in the automotive and energy sectors – it might have an effect on these companies,” said Bonnett.

“But I can’t think they’d be doing their Russian business from here.”

He also rejected the likelihood of sanctions affecting SA mining companies which are developing projects in Russia, or the limited financial services involvement with

Russia in this country.

“I don’t think we’ve got a dog in that fight,” Bonnett quipped.

A policy briefing called “Russia–SA Relations” – presented to the SA Institute of International Affairs (SAIIA) last year – reveals in some

detail the involvement between the two states.

The development of mineral resources – particularly diamonds, gold, manganese, platinum group metals, and rare earth elements, it said, is one of the most promising areas of bilateral co-operation.

That’s according to Paul Runge, managing director of Africa Project Access, who questions the advantage that South African companies hold other than that they may understand the African landscape a little better than their global competitors – and are slightly closer to the action. “We have never seen project f lows in Africa at the level we’re seeing them at present and the world’s big players are after the business. Collaboration is key for South African companies and therefore the best

advice is that they must learn to hunt in packs.”

Runge said while projects were taking off from east to west and from north to south, local business should be wary of complacency thinking that because they understand the African landscape they have an advantage.

“If you go to the coal fields in Tete in Mozambique right now you would be forgiven for thinking you had walked into the United Nations as there are so many international players on the ground.
