A careful review of the accounts thus amended has since been niade by us,'and we now certify the Statement to be correct, and that it agrees with the Treasurer's vouchers in every particular:

Jt(ne last which relate to the service of the 'Financial Year 1871-:2. ,The' transactions during the same period that belong to the Financial Year to the 30th June 1871, and' which were finally closed on the ,31st December 1871, were all

. included in the Statement, bearing 0ur ce,rtificate, which wa's laid before the Legislative Assembly by the Treasurer on the 18th July 1872. A brief summary, however, of the transactions will be found at page 7 of the present papers, and at the last page a reprint of the Balance She~t to 31st December 1871 has been appended.

5.. We will 'only further' allude to the said cei1;ificate to· state :that we have been pl~ced in a position to remove, to the extent' of £9000, 18s. 8d., the exception we to?k to the paym9nt of £12,000, on 4th 'December 1871, for new silver c0inage. We will now pass on to other topics.· ' , .

. 6. "\Ve feel it incumbent upon us to again draw ~ttention to the difficulti~s experIenced, :and. the unsatisfactory results obtained, in cOl~nection with the audit by us of a portion of the accounts of Shires, Ro~d Boards, and Boroughs. The

. Statutes Nos. 358, 359, provide for two audits of the accounts, viz., one bv two auditors to be appointed as the Acts direct; a second (as to certain pOTtions ~f the .accounts) by the .Commissioners of All.dit. The Statutes themselveiil, however, seem to furnish good grounds for the belief we entertain that the provision respecting the second 'audit was inserted by Qversight, for they distinctly enact that (subject only to a special audit in certain cases) the accounts al,ldited in the manner first mentioned shall be final in regard to aU persons whomsoever.' Neyertheless both descriptions of audit have been carried out up to the present' time, but, as may readily he inferred from what is stated above, with' but little practical utility as regards the second. The first audit being final against all persons, it must depend greatly upon the goodwill of the 10c<1lauthorities,whether the requirements of the

. second shall' be attended to qr not; consequently delay,' inattention, unprofitable and ~ometimes unpleasaut' correspondence, have too fi'equ,ently ensued. For instance, m many. cases the accounts for the year, 1870 did not reach us till }lay 1872; and t~ere are one or two relating to the former year which have never been furnished at all. The accounts for 1871 were also,bllt not .so milch, in arrear, more than one­fourth of the whole not. having, been received prior to the 10th Sep.temher last, of which fourth one-half is still outstanding. Again, the enactment which requires that the money received from main and common road tolls shall be expended with, the approval of the Minister has been c?nstantly neglected, and the approval not obtained till after the first (and so called ,final) audit,- and in 'many instances not. even applied for until after we had disallowed the acconnt because of the. omission. As such disallowance formed no bar to the· payment of the subsequent year's subsidy, it failed, as a rule, to secure a better observance of the law. Fur.ther, inattention to our, Reports upon the accounts (notwithstanding that the soundness of the ,views expressed therein is usually admitted ultimately), is followed by a repetition of faults previously'. pointed out and objected.to, and we beGome involved in much 'unsatisfactory corre­spondence. From the year 1863. to 1867, the inconveniences of which we now complain, though felt, were not so pressing as they have since become ;' for not only were the accounts fewer in number, but our efforts in regard to them were then sustained hy the hope of eventq.ally effecting such improvements as would do away with the difficulties we experienced, Since then, however, the number of the flccounts

. h.as more than doubled; each account is reported upon separately and in detail, and the report is forwarded in duplicate. The examination therefore absorbs a considerable amount of labor, and ought to be productive of some, practical good. It has failed, in our opinion, to accomplish such a result ; and as the resources of our staff are unne­cessarily. and unduly taxed by having to repeat the same objections from year to year, it becomes our duty to suggest that, whenever the said Statutes are amended, the sections which require the a(;counts to be audited by the Commissioners of Audit should, so far, be repealed. In the Appendix will be. found certain correspondence which will, 'to some' extent, illustrate the 'difficulties which are being experienced. The Council of South Barwon refuses to send in any accounts, and theCoullcil of the Borough .of Ballarat East, without absolut~ly refusing to send its accounts, refrains from taking any steps to remove the impediments wh~ch prevent them complying with the law ; which impediments it should be stated were of their ~rwn creation,.' and are within their own power to remedy. The following is an extract from a memorandum upon the subject here treated, which was addressed from this office, :in reply to a communication from, the Honorahle the Attorney-General, on 26th February last :-' . '

" As regards sections 170 t.o i80 {Aqt q58), I think them, on the whole, well designed and carefnlly drawn: Everything appropriate has heen adopted from the Audit Act; but there al'e a fei..v poiuts on whieh experience shows that amendment is required, In the first, place, in section 170, the auditors should be ca}led 'shire auditors.'One, I think, should be nominated, amI b.oth appointf)d, l)ythe Governor, as heretofore; but they should be called by some name such as will distinguish them from the Audit Commissioners.

There have been questions about fees, and about defalcations of shire officers,' which are very embarrassing, when, as is usual, the auditors are called Government auditors; and on all grounds it is quite clear that they should be specifically designated. The name' shire au~itol's' appears to meet all objections. T~e remuner~tion should, I think, be fixed by the Act, and such travelh?g exp~nses, t? and fro, as are ac~ually .mcurred should be allowed. Care should be taken, however, that neighbourmg shires should not each be hable for all the

, travelling expenses of a shire auditor to and from Melbourne. '" • , 'I! • In seetion 179 the recovery of moneys is left to an action upon the special auditor's certificate; but there is no means of enforcing the ordinary audit. 'N ow, .one of the principal reasons ~or the appo~ntment hy Governm~nt of one of the auditors is that the Crown still grants endowments for mam roads, brIdges, &c., and has gIven over the tolls; yet there.is no means provided for enforcing the auditors' disatlowanres, if those tolls, &c., have been misapplied. It is ,quite clear that t.he shire auditors, as well as the special auditors, should report to the Miuister ; and that the Minister Rhould be required to deduct from the next grant payable to the shire a sufficient sum to make good the auditors' unsat.isfied objections in regard to the application of grants of the Legi8la~ure or main or common road tolls." •. • • '.

7. Adverting to the paragraph in our Report dated 10th May 1871 (page'90, Finance Statement, 1870), in -which we ~nude to the difficulty which had arisen in checking the balances payable by holders of licenses under the 42nd section of the Land ..(let 1865 on conversion of their holdings into freeholds, we have now to state that we have received, to pre~ent date, advice of the issue of 12,274 cert.ificates, of which number 7213 have been transmitted to this office for examination in connexion with the .Treasurer's Hevenue Accounts. Over 4000 of these have been completely examined and passed; a~d we h~v~ the ~rati~cation of being able to re~~rt that the whole of the rents for wInch credit was gIven III the 4000 and more certificates have been traced into the ,Public Account. Considering the amount of business performed by the Lands Department, and the fact that rents for allotments may be paid in any part of the colony where either a receiver of revenue or land officer is established, and that the rent of the same allotment is sometimes paid at one office and at other times at another in a different part of the colony, the result now reported is highly creditable, we think, to the department concerned. On the other hand, upon audit of the Revenue Accounts, we are almost daily recovering sums short-paid on the half-yearly rents,

,the most if not all of which short payments, as well as the risk of loss, and the immense number of queries and the correspondence they give rise to, might have been obviated by correct action in the. Lands Department in the first instance. At the same time, we have to acknowledge that the attention of the Land officers to our queries under this head is given with the utmost promptitude.

8. We have again to draw attention to the fact that as yet no revenue has been derived trom the supply of ;water under Act 288. The arrangement agreed to by the Echuca Borough, as mentioned in a previous Report to the Legislative Assembly (10th May 1871), has not yet apparently been enforced. In regard to Castlemaine, understanding that the reticulation of the borough, had been completed, we applied to, the Mining Department to know if any arrangements had been decided upon for col­lecting a revenue from the water to be supplied, and were informed by reply, dated 1st August last, that" the regulations for t4e water supply to Castlemaine are' under the consideration of the Honorable the Minister of Mines." ,

9. In July last it was communicated to us, by the Under Treasurer, that the: Honorable the rreasurer desired to know our views upon the subject of the consolida-· tion of the present Victorian debt, and the conversion into stock of the debentures; which now represent'that debt; and more recently' we received a similar intimation from the same office in reference to the rough draft of a measure bearing upon the' above questions. 'Ve had great pleasure in giving our best attention to the subject .. and communicated our views thereon to the Honorable the Treasurer, in two Reports'l dnted respectively 31st July and 30th September 1872. ,"

10. On 3rd August last an instrument for our certificate was received hy us from the Treasurer, having for its object the transfer to the Consolidated Reienu~ of the Balance on 30th June 1871 at the credit 'of the Pension Fund, Schedule n, Part V., to the Constitution, Act. 'As this fund was the creation of an Act of Parliament, we h~ld t~e opin~on that ~ like authority' only could annihilate it ; but as: our arguments, when the subject had been previously discussed, had failed to induel?! the Treasury. to take the same view, we thought it prudent ,to seek the advice of tliUf!!

Also £288 9s. 3d. of the amcmnt of £290 9s. 7d., paid under Vote 48, ~ubdivision 36, Supplementary Votes for 1869, on account of the Bailiff of the County'Court, Wood's Point, has been recovered-the remainder, £2 Os. 4d., having been made good out of the salary which had become due. ," '

,15; Before concluding this Report it is :q.ecessary to advert to the subject touched upon in the last paragraph of our Report dated 10th May 1871, upon the Finance Accou!lt for 1870. From the 1st September 1871 to 30th June 1872, the' salary of the clerk therein mentioned (Mr. W. IN. Gaggin) ceased to be paid from a salary vote, and was made a charge under head Contingencies. The fact of the change and the reason for making it were not communicated to us formally; but, on becoming aware of it, we concluded that Mr. Gaggin would in future, until duly classified, be paid as an unclassified officer; and as such an arrangement would obviate all objection on our part; we removed the surcharges which we had previously placed upon the salary. Since then, however, Mr. Gaggin has been reinstated in his former position, and the salary which had been paid as a contingency has been transferred to the salary vote; and the,whole question is now in the same position as when mentioned in the Report above referred to. vVe do not think we are entitled to do more in this matter than we have done; and as it is not our duty to carry out the Civil Service Act, and having brought the question fully under the notice of the Legislative Assembly, we do not feel justified in further surcharging Mr. Gaggin's sulary.

16. vVe transmit, in abstract, the Orders in Council granted under the 48th section of the A udit Act; also copies of opinions given by the Crown Law Officers (including that mentione~ in paragraph 10) on two cases stated by us in relation to the Finance Account 1871-2.

This view of the . case I co~bated, and 'expressed my opinion that the amending Act being passed subsequent to their bye-law must necessarily .l'epeal it where inconsistent with its pr:ovisions. The council have sin,ce a,dvised their intention to adhere to their originally expressed views.

This I forwarded to the Borough Council in the expectation that it would influence their determination, but have since received a reply to the effect that they remain of' the same opinion as before expressed, that my requirements are not applicable to their tolls.

- Re South Barwon Main Road Toll Accounts.

If the road is a main road, and if aid is given under section 294, a "Main Road Construction Fund" should be formed as provided for by the Statute. . -

I think that the toll havin!5 been established by a bye-law under the Municipal Act is DO excuse for 'not forming a ~' Main Road Toll Fund." .

, Section 323 of the Boroughs Statute gives power to main~nin tolls lawfully existin/!, and section 325 states that all rates of toll formerly existing are to be deemed to be appointe~ under the llorougfls Statute, and, in my opiniop, the tol} is on the same footing as if it had been'erected under the Borougfls Statute.

I havC,l the honor, in reply to your letter of the 25th instant, to state ~hat it is not possible for the Council of the Borough of Ballarat East to comply with the requiremen[;'Jof the Boroughs Statute, sections 297 and 298. The accounts of the main toll and other roads. hnve not bepu kept separate, and there is no data from which to indicate on the paid vouchers the amounts expended on.the various roads. Even if this could be done, the vouchers are pnsted into books, an!! could llOt be. abstracted there,from without injuring liome and destroying others. Also, the. clerk of works, who could possibly give an approximate estimate of the statement required, has left the service of the council. The council regrets much that, under the circuD;lstances, it remains impossibl~ to make the returns as required. . . .

By the Constitution Act, 18 and 19 Viet., c. 55, sched. D,p!lrt 5, the sum of Four thousand pounds '(f4000) a year was made payable as "Pensions'to-officers' appointed' during good behaviour." By the 51st section, of the Act it was provided that the accumulations of this part should in no case exceed the sum of Te.n thousand pounds (flO,OOO), but, by the Act N.o. 235, this ,restriction on accumulations wa~ repealed, as also was the. direction in section 51 that any balance 'aoove L1O;OOO should revert to the revenue. 4. We had also prevlously received from the Treasury copy of a despatch from the Right Hon. the Secretary of State for the Colonies, in tile following words :- .

"Downing street, 5th December 1871. "My LORD, ' .

"I have to acknowledge your Lordship's despatch, No. 135 of 9th O()tober, requesting that you may be authorized to assent to the return to the Consolidated Revenue of Victoria of the surplus which has accumulated, under the 46th section of the Constitution Act, for providing pensions to officers appointed during good behaviour.

" I see no objection to this !UTangement, and you are authorized to assent to it. " I have, &c.,

" Governor, " KIMBERLEY. The Right Hon. Viscount Canterbury."

5. The Law Officer~ are requested to consider that the Pension Fund, like the rest of the Civil List, was created by the Legislature, and that the Legislature, by the Acts 28 Vict. No. 235, and 34 Vict. No. 391, has dealt with portions of the Civil List. Attention is also requested to the maxim in 6 Reports, 53, "eodem modo quo quid constituitur, eodem modo dissolvitur." We beg to mention also the Act 21 Vict. No. 17, which was thought necessary to abolish funds creatcd by law, but not forming part of the Civil List. Wj3 have only to add, that we have been iJ;lformed, by direction of the Honorable the Treasurer, that tbe amount "has been introduced by the Trea;mrer iuto his Estimates of Revenue, and its inclusion in those Estimates has been assented to by the Legislative Assembly." But this does not appear to mean that any vote or resolution on the subject has been agreed to, 'as there is none such in the journals of the House.

6. The Law Officers are requested to advise whether, without an Act of Parliament, we shall be right ill c~rtifying that the £29,084 is legally available for transfer to the Revenue.

OPINION.

ALFRED J. AGG, Commissioners of Audit.

In my opinion, the sum accumulated (£"29,084) is legally available for transfer to the Revenue. I doubt whether any of the £4000 a year ought ever to have been accumulated. But I think the 29th section of the Audit .Act is applicttble to the case, and such a construction is not inconsistent with the Constitution Act, and is not therefore open to the objection that the Constitution Act can only be altered as provided by the 60th section of that Act. I may refer to the salary provided for the Auditor-General by Schedule D, as illustrating this case. His office was'not abolished by .any Act; but by the Governor, under section 48, and, according to the preamble of the Audit Act, No. 86, his salary became merged in the Consolidated Revenue. So, in my opinion, the £4000, or so much of it as is not available in any year for payment of pensions to the J udges, ~erges in the Consolidated Revenue.
