ERA-SEETO joint visit on interopearbility, Montenegro – EUlegislation on interoperability

Visit on Authorisation for Placing into Service, Lille – legislationand practice related to APIS, bringing together railway expertsfrom the EU candidate countries

Seminar on the ECM, Serbia – Scope of the ECM certification andthe responsibilities (analysis of the EU ECM regulation 445/2001)

Cooperation through ERA IPA Project Phase II 2012-2013

In-service training programme of the ERA:

- 3 trainees from Serbia, employees of the Directorate forRailways (trained at the premises of ERA for 3 months)

- benefits: trainees acquired practical knowledge in one ofERA field of actifity and obtained professional experiencein the course of their work and function as a linkconnecting the Agency and the Serbian administration forthe benefit of the implementation of the EU railway policy

• Occurence Investigation Centre for three transport modes (air, railwayand waterborne)

• Objective: determination of causes of accidents and not liability (in linewith the EU legislation)

• Accent on prevention of accidents and not on punishment

Major challenges regarding harmonisation with the EU regulatory framework

transpositon of the EU legislation into national rules, especially EU regulation anddecisions (translation in Serbian and technical review) – understanding of the EUlaw, administrative capacities engaged for drafting of the new national rules

implementation of the new regulatory framework – dominant position of theincumbent railway undertaking tending ot impose their own policies and reject thenecessary changes; economic obstacles (for example, understaffed NSA andRegulatory Body)

opening of the railway market – conditions related to the railway infrastructure;national railway company unpreparared for market competition

Reinforcing administrative capacities for drafting legal acts through differenttypes of Pre-accession Assistance (including Twinning and TAIEX)

Reform of the incumbent railway company Serbian Railways

Establishing of the necessary railway institutions aligned with the EU railwaylegislation (independent Railway Regulatory Body, Licencing Authority, NSA,NIB) so as to enhance the opening of the market

Conclusion: important assistance to the Serbian railway sector

Assistance in institution building

Dissemination of best practices
