An independent financial assessment of the activities of Civil Constructions Pty Ltd was carried out covering the key areas of business structure and financial operations. The financial assessment rated Civil Constructions Pty Ltd as "strong". Full details of the submitted tender prices are contained in a separate confidential attachment. Since the commencement of this tender, at the December 2012 Council meeting there was a further resolution to: Endorses that unspent funding from the TIF program be suspended and that the Council consider using these funds to fund an urban redevelopment program, including the development of the Georges Riverbank areas and Liverpool Weir and other future actions resulting from the strategic review of the city centre. Since this particular project is partially funded from TIF and as Bigge Park is an integral part of the City centre and will be considered in the strategic review, it would be appropriate to defer proceeding with this Bigge Park upgrade until this review is completed.

FINANCIAL IMPLICATIONS: This project will be funded through Section 94 in accordance with the 10 year Contributions Expenditure Strategy.

RECOMMENDATION: That Council:

1. Rejects all tenders submitted.

2. Notes that the City strategic review be completed before considering any further proposed upgrades to Bigge Park.

3. Keeps confidential the attachment pursuant to the provisions of Section 104(2Xc) of

the Local Government Act 1993, as this information would, if disclosed, confer a commercial advantage on a person with whom the Council is conducting (or proposed to conduct) business.

EXECUTIVE SUMMARY: The current Contract WT1384 for the supply of bulk materials for civil construction was used for the purchase of ready mixed concrete, of which had three suppliers. After the first contract term, two suppliers have declined to extend the contract for an additional 12 months term, therefore resulting in only the one supplier causing Council operational difficulties. It is the intention to enter into a contract with suitably experienced and competent suppliers for the supply of ready mixed concrete. This report advises Council of the outcome of the tender process and recommends that none of the tenders received be accepted.

DETAILED REPORT: Tenders were invited publicly through the Sydney Morning Herald on 7 and 14 August 2012 and Council’s eTendering portal from 7 August 2012. Tenders closed at 3:00pm on 30 August 2012, with the following submissions received:

EVALUATION OF TENDERS: A Tender Evaluation Committee (TEC) was formed to determine the tender evaluation criteria. The Tender Evaluation Committee met prior to the close of tenders and agreed on the weightings of the published evaluation criteria. Submissions were referred to the Senior Business Administrator to assess in regard to the OH&S criteria. The tender submitted by Advanced Mini Crete was found to be generally satisfactory under this criterion. A check of the Australasian Legal Institute Database shows two breaches of the previous OH&S Act, where the tenderer Hy-tec Pty Ltd was fined for workplace deaths. As Hy-tec Pty Ltd does not satisfy the OH&S criteria, the Senior Business Administrator has no confidence in recommending the company’s ability in fulfilling the OH&S requirement over the contract period and therefore the tender submitted by the Hy-tec was excluded from further consideration. Given the above, Advanced Mini Crete is considered to be the only company which satisfies both conformance and OH&S criteria. Considering the day to day operational needs, it was decided it would be an advantage for Council to award the tender to a panel of suppliers. Accordingly, it is the Tender Evaluation Committee’s conclusion that none of the tenders received be accepted and to have the tender re-submitted.

FINANCIAL IMPLICATIONS: Council has sufficient funds allocated for the purchase of ready mixed concrete materials in its current 2012/2013 budget and ongoing funding allocation recommendations will be made to Council as part of future Operational Plans.

RECOMMENDATION: That Council:

1. Decline to accept any of the tenders.

2. Advise of the outcome to all the tenderers.

3. A new tender be called for the Supply of Ready Mixed Concrete.

CHILDREN'S CENTRES AND MUSEUM COMMUNITY STRATEGIC PLAN REFERENCE:

URBAN DEVELOPMENT IS CONSISTENT WITH SUSTAINABILITY PRINCIPLES

EXECUTIVE SUMMARY: It is Councils intent to enter into a design and construct contract with a suitable contractor for the purpose of replacing the air conditioning systems at multiple children’s centres in the Liverpool LGA and at the Liverpool Regional Museum. With a total of seven children's centres being nominated for replacement along with the Liverpool Regional Museum, this Tender was split into four portions A, B, C and D. With the available funding, Council will be proceeding with Portion A of this Tender only, which comprises of the complete replacement of air conditioning systems to Casula Pre-School, Holsworthy Children's Centre and Prestons Children's Centre. Tenders were invited publicly through the Sydney Morning Herald on 1 September 2012 and 4 September 2012 and Council’s e-Tendering portal from 1 September 2012. Following a detailed evaluation of the submissions received, the tender submitted by ABT Construction and Fitout is considered to offer the best value to Council and this report recommends that Tender WT2202 - Air Quality Upgrade to Children's Centres and Museum be awarded to ABT Construction and Fitout.

DETAILED REPORT: The purpose of the project is to replace multiple air conditioning systems that have passed there economical lifespan, with new systems that are compliant with the Building Code of Australia and relevant Australian Standards and increase energy efficient to multiple sites. The delivery timeframe of this project is to be completed over the 2013 Easter holiday period to avoid disruption to the Centres. This is the only period in the Children's Centres calendar within the 2012/2013 financial year that provides sufficient facility closure to enable the work to be undertaken.

The Tender was separated into Portions A, B, C and D to enable part delivery subject to tenders received. The recommendations in this report apply to the award of Portion A of this Tender only, which comprises of the complete replacement of air conditioning systems to Casula Pre-School, Holsworthy Children's Centre and Prestons Children's Centre. EVALUATION OF TENDERS: A Tender Evaluation Committee (TEC) was established to assess the tenders received. A preliminary assessment of all tender submissions was carried out to check for compliance with the requirements of the tender documents. This assessment found that only two of the four tenders received were conforming. Tenders submitted by Ryan Wilks Pty Ltd and Eagle Air Conditioning Pty Ltd were non-conforming and as such were not considered further. The conforming tenders were then assessed in detail by the TEC against the weighted criteria predetermined prior to the commencement of the assessment process. Reference checks were then completed on the two conforming tenderers to determine past performance in contracts of a similar nature. Following a detailed evaluation of the conforming tenderers against the full criteria, it was demonstrated that the tender submitted by ABT Construction and Fitout represented the best value for Council. An independent financial assessment of the activities of the two conforming tenderers was carried out covering the key areas of business structure and financial operations with the following results.

Integral Electrical Engineering Pty Ltd received an unsatisfactory result, but ABT Construction and Fitout received a satisfactory result with past performance demonstrating the financial capabilities to carry out the proposed contract. A confidential tender attachment is provided under separate cover containing the tendered amounts submitted by all tenderers pursuant to the provisions of Section 10A(2)(c) of the Local Government Act 1993, as this information would, if disclosed, confer a commercial advantage on a person with whom the Council is conducting (or proposes to conduct) business.

FINANCIAL IMPLICATIONS: The lump sum tendered price for Portion A of $174,113.00 (inclusive of GST) from the recommended tenderer for the delivery of the upgrade of Air Conditioning Systems at multiple Children's Centres, is fully funded from grant funding through the Waste and Sustainability Improvement Program (WaSIP) initiative and will be delivered in the 2012/2013 financial year.

RECOMMENDATION: That Council:

1. Accepts Portion A, the Tender submitted by ABT Construction and Fitout WT2202 -Air Quality Upgrade for Children's Centres at a lump sum price of $174,113.00 (inclusive of GST).

2. Notes that the delegated Council officer will finalise all details and sign the Letter of

Acceptance, giving it contractual effect, in accordance with their delegation.

URBAN INFRASTRUCTURE MEETS THE NEEDS OF A GROWING COMMUNITY

EXECUTIVE SUMMARY: The Western Sydney Regional Organisation of Councils Ltd (WSROC), under the auspices of its Supply Management Group, prepared and conducted a group procurement tender for Road Rehabilitation and Asphalt Services. Tenders were invited on Saturday 16 June 2012 for the following period supply contracts:

Supply Deliver and Lay Asphalt Asphalt Pavement Reconstruction Crack Sealing Mill and Fill Profiling Pavement Restoration Surface Preservation, Enrichment or Rejuvenation Spray Sealed Bituminous Surfacing Stabilisation and or Unbound Pavement Reconstruction

Tenders closed at 12:00pm Wednesday 25 July 2012, with submissions being received from the 20 companies listed under Attachment A. Issue of the tender followed an extensive review and enhancement of the similar preceding WSROC group contract for Asphalt Supply and Associated Services. To date, Council has employed the previous WSROC contract along with a suite of in-house asphalt pavement rehabilitation and bitumen services supply contracts for delivery of its annual road maintenance and reconstruction programs.

This report recommends that Council accept the WSROC group tender WR03-12/13 for Road Rehabilitation and Asphalt Services to supersede the existing WSROC group contract and Council's current suite of similar road maintenance, rehabilitation and reconstruction contracts.

DETAILED REPORT: Liverpool City Council has participated in the current WSROC group tender for Road Rehabilitation and Asphalt Services, to realise the potential benefits offered to participating members through contract acceptance, including but not limited to:

Standardisation of Specifications and Contract Conditions Reduced Tendering costs Improved Work Planning within Council Collaboration on work across councils Efficiency gains for Contractors in the use of work teams and plant Reduced material and contract labour costs for both Contractors and Councils Normalisation of regional inflationary price adjustment mechanisms Availability of back-up contractors.

Council has to date combined the use of in-house contracts with the existing WSROC group contract for provision of road rehabilitation and asphalt services in the delivery of its annual road maintenance and reconstruction programs. Acceptance of the current contracts offered under the WSROC group tender will enable a rationalisation of contracts currently utilised by Council. The contract parts under the WSROC group tender have in the main been offered to tenderers as ranked “closed panel” contracts whereby the Contractor positioned first in the preference order is expected (but not guaranteed) to be requested to undertake the works in the first instance. Council may choose to review overall contract performance on a quarterly basis in accordance with agreed key performance indicators and reserve the right to adjust the preference order as a result of the review. For the remaining Contracts a number of Contractors have been selected for an “open panel” listing whereby Contractors will be allocated individual works based on the tendered rates, suitability and availability, according to the specific merits of the project. To ensure a close alignment of the proposed WSROC group contracts, with currently accepted Liverpool City Council practices, two LCC representatives have actively and regularly participated in the WSROC tender creation process, throughout the review and development period.

EVALUATION OF TENDERS: Prior to the closing of the tender period, a Tender Evaluation Panel (TEP) was formed comprising of a nominated representative from each WSROC participating member Council as well as WSROC Supply Management Group members.

A Probity Adviser was appointed to provide advice to the TEP on probity matters and to assist the TEP in ensuring that all tenders were analysed fairly, uniformly and transparently. The Probity Adviser was not a member of the TEP and did not engage in any evaluation activity. The Probity Advisor did not have a conflict of interest with any of the tenderers and reported directly to the Chairperson. Also, prior to the closing of the tender period, a tender evaluation plan was developed which set out the guidelines for assessment of the submitted tenders. The tender evaluation plan outlined and detailed the:

Roles and responsibilities of the TEP Tender submission and opening procedure(s) Treatment of non-conformance Application process for criteria weightings Scoring methodology Evaluation process stages Value For Money (VFM) Price assessment Risk Analysis methodology.

As documented in the tender evaluation plan, the tender analysis was performed utilising both quantitative and qualitative criteria. Following this process, a preferred tenderer ranking was established for all closed panel contracts. Individual participating Councils were hence afforded the opportunity to review the resultant rankings, against local experience and logistic factors such as typical Council annualised volumes and the proximity of asphalt plant locations. Further risk assessment of short listed tenderers was undertaken by way of extensive financial assessments carried out by Corporate Scorecard and through comprehensive reference checks. On this basis, a final preferred tenderer ranking was established and published in the Tender Evaluation Report, for each of the individual participating councils. DECISION MAKING PROCESSES ARE TRANSPARENT AND THE COMMUNITY HAS OPPORTUNITY TO BE INVOLVED

EXECUTIVE SUMMARY: Council, at its meeting held on 20 August 2012, resolved to place on public exhibition and obtain community comment on the Draft Permit Parking Policy for a period of 28 days and be provided with a further report in November 2012 following the public exhibition period. This report outlines the pubic exhibition process, the number of submissions and comments received, amendments to the draft permit parking policy, pricing and parking permit allocation.

DETAILED REPORT: Council, at its meeting held on 20 August 2012, resolved to approved to place the policy on public exhibition, promote the public exhibition in the local media and on Council’s website and provide a report back to Council.

In line with the above Council resolution, the Draft Permit Parking Policy was placed on public exhibition from Wednesday, 19 September 2012 to Wednesday, 17 October 2012 and promoted through local newspapers and Council's website, with hard copies being available at Council's Administrative Building and Central Library.

In addition, properties that will be affected by the introduction of the Liverpool City Centre Stage 2 ticket parking machine installation, and that may receive benefit from the introduction of the Draft Permit Parking Policy, were individually notified in writing of the public exhibition period and invited to provide comment on the Policy. Following the public exhibition period, three responses were received and are as follows: Address Comment Response to resident Nuwarra Road, Moorebank Remove all parking meters Resident has been advised

of Council's parking strategy to secure the long term viability of Liverpool City Centre and other Council initiatives.

Castlereagh Street, Liverpool Request for parking permits Resident advised that ticketed parking does not apply in this street and therefore the Draft Policy does not apply at this time.

Bigge Street, Liverpool Request for parking permits Resident advised that ticketed parking does not apply in this part of Bigge Street and therefore the Draft Policy does not apply at this time.

Recommend Approach for the Allocation of Permits As some residents find it more convenient to park on-street instead of utilising their own off-street parking space and most residents would like to park within close proximity of their residence, a review of the number of properties that may be eligible for parking permits and available on-street parking spaces was undertaken for entire length of Bathurst Street. The investigation revealed that, based on the available on-street parking spaces in Bathurst Street, Council would not be able to provide each resident with a parking permit and also accommodate short term (on-street) parking for businesses. The number of residential/commercial units along Bathurst Street compared to the available on-street parking spaces is shown below. Based on the available on-street parking spaces, only one parking space is available for every five units and this would impact upon the churn of vehicles. This in turn could impact upon the businesses in Bathurst Street as their customers would have difficulty in finding on-street parking in close proximity to the business. Bathurst Street contains 13 ticket parking machines. Allocating parking permits for all available on-street parking spaces could potentially provide minimal or no return on investment as the ticketed parking spaces could be permanently occupied by vehicles displaying parking permits. The issuing of permits to all eligible residents could lead to the expectation that on-street parking is a right and place demands upon Council to satisfy this demand, irrespective of the costs, even though residents may have access to off-street parking. In view of this, it is recommended that only residents with no off-street parking are provided with one Resident Parking Permit. Eligible residents who are provided with a Resident Visitor Parking Permits would be restricted to the time limits that apply to the street. This will ensure equitable on-street parking spaces for road users. In this regard, the Draft Policy has been amended to indicate that the resident parking scheme will be used where residents have no off-street parking. Amendments to Liverpool City Council Draft Permit Parking Policy As indicated above, at the end of the exhibition period, Council only received three responses. None of the responses suggested changes to the Draft Policy. The very low community response has not provided Council with any opportunity to amend the Draft Policy with community input. The amended Draft Policy is in line with the Roads and Maritime Services' mandatory Permit Parking procedures. The Policy deals with the implementation of the following classes of parking permits: Park in a ticketed parking space

Business parking permit Resident parking permit Resident Visitor parking permit Non-Profit organisation permit.

Park in a No Parking zone, permit holders excepted

Parking permit for non-community organisations including businesses Parking permits for community organisations.

The only change to the Draft Policy relates to the Resident Parking Scheme as outlined above, with eligible residents being those with no off-street parking.

Parking Permit Pricing Resident and Resident Visitor Parking Scheme The cost to issue a Parking Permit is estimated at $35 per permit. To assist eligible residents who are directly effected by ticketed parking, it is recommended that permits are provided free of charge in the first year and full cost recovery applies in subsequent years. Business Parking Scheme Currently, Council provides business parking permits which allow parking in "No Parking" and "Council Permit Holders Excepted" zones for $1,000 per annum. In addition, the Draft Policy proposes a business parking permit which would allow the permit holder to park in ticketed parking spaces in the City Centre. In the report considered by Council on 20 August 2012, the value of a ticketed parking space was estimated at $4,850 per annum based on potential full-time occupancy of a space. However, based on the current average occupancy in George, Macquarie and Northumberland Streets, the actual return per ticketed parking space is estimated at $2,700 per annum. It is recommended that the annual fee for a Business Parking Permit is set $2,700 which can be paid in two instalments per year. Non-Profit Organisation Permit Council currently provides parking permits for non-profit organisations at a cost of $20 per annum. In line with the other permits, the cost of this permit is to be set at $35 per annum.

FINANCIAL IMPLICATIONS: Based on the recommended implementation of the Draft Permit Parking Policy the financial implication to Council would be minimal.

RECOMMENDATION: That Council:

1. Receives and notes the report. 2. Adopts the amended Draft Permit Parking Policy and associated fees. 3. Install appropriate signage in consultation with RMS for the implementation of the

resident parking scheme. 4. In the first year provides parking permits to eligible residents free of charge and

thereafter applies full cost recovery. 5. Includes the introduction of the Permit Parking Policy in its communication strategy
