    This is further to your telephone conversation with Ms. Nathalie Trepanier and your email ofSeptember 23, 20 ll, requesting clarifications on your obligations under the CoJ?flict ofInterest Codeji!r Members of he House ofCommons (the "Code"), specifically as a result of your recentappointment as a member of the Standing Committee on Canadian Heritage (the "Committee").

    As disclosed to my office during a meeting regarding your compliance with the Code, youhave a Composer-Program Music contract with the CBC and under the terms of this agreement, youretain the full copyright and are responsible for acquiring ru1y licences.

    As you are aware from your discussions with Ms. Trepanier, under the Code, a Member isconsidered to further his or her own private interests when the Member's actions result, directly orindirecily, in an increase or preservation of the value of one's assets, or in an increase in one'sincome either from employment, a contract or a profession. Section 8 of the Code states that "whenperji!rming parliamentary duties and fimctions, a Member shall not act in any way to ji1rther his orher own private interests .. ."

    In this instance, your contract with the CBC is considered a private interest and as a result,Section 13 prohibits you fiom participating in debate or from voting on matters specifically relatedto CBC's funding or plans and priorities that may affect your private interest. If the matter inquestion is of general application or affects CBC as one of a broad class, you would not beprohibited fiom participation.

    As indicated in Section 12 of the Code, if present during consideration of a matter before theHouse or the Committee that could affect your interest, you should disclose orally or in writing thegeneral nature of your private interest at the first opportunity to the Committee and the Clerk of theHouse who will then forward it to our Office for filing with your public disclosure documents .

    On September 26, 2011 you informed Ms. Trepanier that one of the Committee's Agendaitems for the upcoming meeting of September 27, 20 II was on funding cuts to the CBC.Consequently, you informed Ms. Trepanier that you would abstain from participating in this matterand advise the Clerk in writing of your private interest as well as the Chair of the Committee.In closing, I would like to acknowledge receipt of a copy of the Clerk's September 27, 2011

    letter to you acknowledging your disclosure to her and to the Chair of the Committee. This letterwiil be deposited with your public disclosure documents which will be available for publicinspection in my Office and on the website.Should you have any questions or require fmther clarifications, do not hesitate tocommunicate with my Office.
