What is a Will?A Will is a legally binding document that sets out your instructions about what is to happen to your estate (your property, savings and possessions) after you die. It names the people you want to administer the estate (called ‘the executors’) and sets out who you want to inherit your estate.

A Will can also accomplish other things, such as naming guardians for children, setting up trusts to protect children from inheriting when they are too young, setting up trusts to protect disabled children or children from previous marriages.

What is the best time to write a Will?As soon as you own assets, such as bank accounts, a car, or a house, then you should write a Will. You shouldn’t put it off until you are older. If you have young children you should make a Will to appoint legal guardians for them.

What happens if I die without a Will?A set of legal rules sometimes called ‘the Rules of Intestacy’ will apply and dictate who will be entitled to administer and inherit your estate. This might result in your estate passing to family members that you would not want to inherit it. There might be people that you love and support, such as a partner you are not married to, (or in a civil partnership with) or stepchildren, who would not automatically receive anything under these rules.

This could create serious financial problems for your surviving partner who might have to make a complicated and expensive claim against your estate. Even if you are married, or in a civil partnership, your spouse or civil partner might not inherit everything under the Rules of Intestacy if you also have children.

If my circumstances change, do I need to update my Will?A Will should be reviewed regularly and might need to be updated if your family circumstances or financial circumstances have changed, if you have sold property or assets specifically mentioned in the Will, or if people named in the Will have died. If you marry after making a Will, this will usually automatically revoke your previous Will.
