    BOATS AND YACHTS (extract)

    APPLICATION

    This document is an extract from the Rules for statutory certification of boats and yachts (Pravila za statutarnu certi-fikaciju brodica i jahti), published in Croatian Official Gazette No. 82/2010, specifying requirements for safety equip-

    ment for recreational crafts (boats and yachts) which are applying for the registration under Croatian flag.

    The Rules are integrally dealing with safety aspects relevant for the design, manufacture, certification and surveys ofboats and yachts, also incorporating provisions of EU Directive 94/25/EC, as amended by EU Directive 2003/44/EC.

    However, this document does not contain all the provisions contained the Rules, as only relevant parts have been trans-lated in English. Parts of the Rules which are not contained in this document can be obtained upon request.

    For easier reference, and in addition to the requirements contained in the Rules, EXPLANATORY NOTES (framed and

    indicated in green) are added, giving the additional explanations to the specific requirement.

    5. TECHNICAL

    REQUIREMENTS FOR

    STATUTORY CERTIFICATION

    OF CROATIAN FLAGGED

    YACHTS

    5.1 APPLICATION AND

    DEFINITIONS

    5.1.1 Requirements of this section apply to the yachts

    for personal or commercial use and are additional to essentialtechnical requirements given in the Rules, Chapter 2, Section

    2.

    EXPLANATORY NOTE:

    Requirements from the Rules, Chapter 2, Section 2 are notrelevant for existing and second-hand yachts and yachts notcomplying with Directive 94/25/EC.

    5.1.2 For definitions see the Rules, Chapter 1, Sec-tion 3.

    EXPLANATORY NOTE:

    Relevant definitions from the Rules, Chapter 1, Section 3

    Yacht - recreational craft for personal or commercial use,having hull length greater than 12 meters, having facilities andaccommodation for extended navigation, authorized to carrynot more than 12 passengers, excluding crew.

    Persons onboard yacht - total number of persons onboardyacht, including crew members and passengers.

    Hull length- length from aft end of the after most point to theforward end of the foremost point of the integral part of the hullmeasured parallel with waterline corresponding to the fullyloaded condition with full stores and maximum allowed loadonboard.

    Navigation area I international unrestricted navigation in allseas and waters accessible from the sea.

    Navigation area Ia international unrestricted navigation in allseas and waters accessible from the sea, with maximum al-lowable distance from than land not more than 20 Nm.

    Navigational area II international navigation in the Adriaticsea.

    Navigation area IIa international navigation in the Adriaticsea, with maximum allowable distance from than land notmore than 12 Nm.

    Navigation area III national sea water navigation and navi-gation in territorial sea of the Republic of Croatia and watersaccessible from the sea.

    Navigation area IV navigation in sheltered waters, such asports, bays, river mouths and lakes, such as, but not limited to:Bay of Lim, Bay of Raa, Bay of Katela, Bay of Klek-Neum,Lake of Prokljan (including mouths of Krka River to the Capeof Jadrija), Rijeka Dubrovaka and River Neretva.

    5.2 SURVEY DURING

    CONSTRUCTION FOR YACHTS

    HAVING HULL LENGTH UP TO 24

    METERS

    EXPLANATORY NOTE:

    Requirements from this paragraph (para. 5.2) are not relevantfor existing and second-hand yachts and yachts not complyingwith Directive 94/25/EC.

    5.3 TECHNICAL REQUIREMENTS

    FOR YACHTS HAVING HULL LENGTHUP TO 24 METERS

    Yachts having hull length up to 24 meters, apartfrom technical requirements stated in the Rules, Chapter 2,

    Section 2, are to be in compliance with additional technicalrequirements as stated in 5.3.1 to 5.3.6.

    EXPLANATORY NOTE:

    Above stated requirements are not relevant for existing andsecond-hand yachts and yachts not complying with Directive94/25/EC.

    Tonnage measurement of yachts is performed

    in accordance with the Rules for tonnage measurement of

    marine objects.

    5.3.1 Requirements for anchoring, mooring

    and towing arrangements

    5.3.1.1 General requirements:

    Below stated requirements are intended for

    temporary anchoring of the yacht within harbour or shelteredarea. Anchors and chains are designed neither to hold theyacht off exposed coasts in rough weather, nor to stop the

    yacht when sailing. Requirements stated in the Rules, Chap-ter 2, 2.4.8 are to be complied with also.

    EXPLANATORY NOTE:

    Requirements stated in the Rules, Chapter 2, 2.4.8 are notrelevant for existing and second-hand yachts and yachts notcomplying with Directive 94/25/EC.

    5.3.1.2 Anchors:.1 The anchor masses given in Table 5.3.1-1

    are for high holding power anchors

    When a fisherman type of anchor is fittedthe mass given in Table 5.3.1-1 is to be

    increased by 25 %, but the diameter ofthe chain cable needs not to be increased.When the yacht has an unusually high

    windage (high freeboard, large super-structure or large rigging) the mass of the

    anchor and diameter of chain cable are to

    increased above the requirements statedin Table 5.3.1-1. For yachts having un-

    usual or non-conventional forms (catama-rans, trimarrans, etc.) the anchor and

    chain cable size should to be consideredon the case-by case basis.

    .2 Anchors are to be rigged ready for use.An anchor windlass is to be provided ifthe anchor mass exceeds 30 kg.

    5.3.1.3 Anchor cables:

    .1 The length of the chain cable should beappropriate to the navigation area, but

    generally should not be less than 4 timesof the yacht hull length, or 30 meters,whichever is greater, for each of the an-

    chors..2 Chain cables may be replaced by syn-

    thetic ropes or steel wires. In that case,the length of the chain cable between the

    anchor and the rope or wire should be not

    less than 10 meters or 20 % of the totallength, whichever is greater.

    5.3.1.4 Towlines and mooring lines:

    The yacht is to be equipped with at least withfour mooring lines with the length not less than the yacht hulllength. Furthermore, the yacht is to be provided with at least

    one towing rope with length of not less than four times ofhull length.

    5.3.2 Life-saving appliances

    Life-saving appliances, if not explicitly statedotherwise, are to comply with requirements from the Rules

    for statutory certification of sea-going ships, Part 18 - Life-saving appliances.

    EXPLANATORY NOTE:

    Navigation area I international unrestricted navigation in allseas and waters accessible from the sea.

    Navigation area Ia international unrestricted navigation in allseas and waters accessible from the sea, with maximum al-lowable distance from than land not more than 20 Nm.

    Navigational area II international navigation in the Adriaticsea.

    5.3.2.1 Yachts of the navigation area I shall be

    equipped as follows:.1 At least two inflatable liferafts, each of

    them of such aggregate capacity to ac-commodate the total number of persons

    on the yacht, complying with the SOLAS

    requirements and equipped with SOLASA Pack;

    .2 Lifebuoy with buoyant lifeline, lifebuoywith self igniting light and smoke signal;

    .3 Lifejackets with lights, for every personon board yacht;

    .4 Lifejackets with lights, suitable for chil-dren (for every child on board yacht);

    .5 12 rocket parachute flares;

    .6 6 hand flares;

    .7 2 buoyant smoke signals;

    .8 Thermal protective aids for every personon board yacht (SOLAS type);

    .9 User instruction posters, on or in the vi-

    cinity of the life-saving appliances;.10 Training manual;

    .11 One copy of the life saving signals;

    .12 Two safety belts (sailing yachts only).

    5.3.2.2 Yachts of the navigation area Ia and II shall be

    equipped as follows:.1 Inflatable liferaft or liferafts, of such ag-

    gregate capacity to accommodate the totalnumber of persons on yacht, complyingwith the ISO:9650-1, pack 1 require-

    ments;.2 Lifebuoy with buoyant lifeline, lifebuoy

    with buoyant lifeline and igniting light;.3 Lifejackets with lights, for every person

    on board yacht;.4 Lifejackets with lights, suitable for chil-

    dren (for every child on board yacht);

    .5 4 rocket parachute flares;

    .6 6 hand flares;

    .7 2 buoyant smoke signals;

    .8 Thermal protective aids for every person

    on board yacht, with at least two of thembeing SOLAS type;

    .9 User instruction posters, on or in the vi-

    cinity of the life-saving appliances;.10 Training manual;.11 One copy of the life saving signals;

    .12 Two safety belts (sailing yachts only).

    5.3.2.3 Yachts of the navigation area IIa and III shallbe equipped as follows:

    .1 Inflatable liferaft or liferafts, of such ag-gregate capacity to accommodate the total

    number of persons on yacht, theISO:9650-1, pack 2 requirements. In the

    case that the yacht is engaged on voyages

    exclusively from 1st of April till 31st ofOctober it is allowed that the yacht is

    equipped with inflatable liferafts havingsuch aggregate capacity to accommodate

    not less than 60 % of total number of per-sons on board, and in addition to that witha tender boat having capacity to accom-

    modate the rest of the number of totalpersons of board;

    .2 lifebuoy with buoyant lifeline and ignit-ing light;

    .3 Lifejackets for every person on boardyacht;

    .4 Lifejackets suitable for children (for

    every child on board yacht);.5 6 hand flares;.6 2 buoyant smoke signals;

    .7 2 thermal protective aids being SOLAStype;

    .8 User instruction posters, on or in the vi-cinity of the life-saving appliances;

    .9 One copy of the life saving signals;

    .10 Two safety belts (sailing yachts only).

    5.3.3 Radio equipment and navigational aids

    5.3.3.1 Radio equipment:

    .1 The radio equipment installed on a yacht

    shall be capable of fulfilling the func-tional requirements with respect to dis-tress and safety communications when

    the yacht is at sea.The radio equipment should provide

    transmitting yacht-to-shore alert, yacht-to-ship alert, as well as transmitting andreceiving during rescuing, and receive

    navigational and meteorological warn-ings.

    .2 The yacht shall be fitted at least with ra-dio equipment as defined in Table 5.3.3-1.

    .3 Aerials should be mounted as high as ispracticable to maximise performance.

    .4 In addition to the main source of energysupply, the separate reserve battery capa-

    ble to work of at least 3 hours of all de-vices connected to it shall be provided.

    This battery shall be positioned above thewaterline. Adequate battery charger

    should be provided on a yacht..5 An adequate label with call sign and

    MMSI shall be posted close to DSC radio

    equipment, as well as the poster with in-structions for use in case of distress. Shortand unambiguous operating instructions

    shall be posted close to two-way VHF ra-diotelephone apparatus for survival craft.

    .6 All radio equipment on yacht, which iscapable of automatically incorporating of

    the yacht position in the distress alert,shall be automatically provided with thisinformation from an internal or external

    GNSS receiver, whichever is installed.

    5.3.3.2 Navigational aids:

    .1 Yachts shall be fitted at least with navi-gational aids as given in Table 5.3.3-2.

    NOTES:

    1. Magnetic compass or repeater should be situated so that to be clearly readable by the helmsman at the main steering position.

    Each yacht, except when navigating in navigation area III and IV, is to be provided with the table of the residual magnetic com-pass deviation. Compulsory compensation of the magnetic compass, except for yachts navigating in navigation area III and IV,

    should be carried out every three years.2. Signalling light shall be waterproof.* Needs not to be in accordance with IMO performance standards.

    5.3.4 Prevention of pollution from yachts

    5.3.4.1 Prevention of pollution by oil:

    .1 This requirements shall apply to allyachts.

    .2 Discharge of oil and oil-containing mix-

    tures:It is not permitted to discharge oil and oil-

    containing mixtures into the sea. All oil-containing mixtures shall be collected onboard and treated in accordance with the

    provisions of 5.3.4.1.3..3 Collection and treatment of oil and oil-

    containing mixtures:a) It shall be possible to collect oil and

    oil-containing mixtures from the ma-

    chinery space, as well as from other

    space, by a fixed pump (mechanicalor hand-driven) with pipelines to aholding oil tank(s) having suitable

    capacity. Installation shall be separatefrom the bilge system and other over-

    board discharge valves.b) Tank(s) stated in 5.3.4.1.3 a) may be

    of a fixed type provided with pipelineand standard discharge connection to

    shore facilities.c) For yachts of in navigation area III

    and IV the use of receptacles with ca-pacity of not more than 25 litres isallowed.

    5.3.4.2 Prevention of pollution by sewage:.1 New yachts with hull length of up to 24

    meters manufactured on or 1st January2006 or after, carrying more than 15 per-

    sons are to comply with requirements ofEN ISO 8099:2000 - "Small craft - Toiletwaste retention systems".

    .2 New yachts, irrespective of their hulllength, and carrying more than 15 persons

    are to comply with the requirements fromthe Rules for statutory certification of

    .3 Existing yachts with hull length of up to

    24 meters, and carrying less than 15 per-sons, manufactured before 1st January2006, and equipped with toilets having

    direct overboard discharge, are to be pro-vided with holding tank and dischargeconnection to shore facilities, not later

    than first scheduled survey in 2007.In cases where there are two or more toi-

    lets, sewage holding tank and dischargefacilities is to ensured for at least one

    toilet which is exclusively to be usedwhen the yacht is sailing in areas where

    overboard sewage discharge is prohibited.On all other toilets posters with the fol-

    lowing text are to be placed: "USE OFTHE TOILLET WHILE THE CRAFT IS

    AT BERTH OR ANCHORAGE IS PRO-HIBBITED".

    .4 Existing yachts from 5.3.4.2.3, manufac-tured before 1st January 2000 may be ex-

    empted from the requirement for the in-stallation of the sewage holding tank, un-der presumption that it is possible to

    prove in documented manner that, bytaking into account the year of manufac-ture, retroactive installation is either tech-

    nically or financially unjustified with re-spect to the total value of the yacht.

    .5 Existing yachts irrespective of their hulllength, carrying 15 or more persons shall

    comply with the requirements stated in5.3.4.2.2 not later than 27th September

    2008..6 In any toilet system, only products that

    are not harmful to the marine environ-

    ment may be used for disinfecting andother purposes.

    .7 Areas where sewage discharge is prohib-ited are sea areas within 0,5 Nm from the

    nearest shore, island or fish farms withsea depth less than 10 meters, including

    sea areas defined in the Rules, Chapter 1,Section 3, 3.27.5.

    ing discharge the yacht should be in navi-gation.

    5.3.4.3 Prevention of pollution by garbage:

    All yachts are to comply with requirements

    from the Rules for statutory certification of sea-going ships,Part 22 - Pollution prevention, Chapter 6 - Prevention ofpollution by garbage.

    EXPLANATORY NOTE:

    Disposal into the Adriatic sea of all plastics, including, but notlimited to, synthetic ropes, synthetic fishing nets, plastic gar-bage bags, and all other waste, including paper products, rags,glass, metal, bottles, crockery, dunnage, lining and packingmaterials, is strictly prohibited.

    5.3.4.4 Antifouling systems:

    Organotin compounds (TBT) which acts as

    biocides shall not be applied in antifouling systems on allyachts.

    5.3.5 Medical equipment onboard yachts

    5.3.5.1 Yachts shall be equipped with medical equip-

    ment according to the provisions of the "Pravilnik o mini-malnim zahtjevima i uvjetima pruanja medicinske skrbi nabrodovima, brodicama i jahtama" (N.N. 14/2008) (Ordinance

    o minimum conditions and requirements for providing of themedical care on ships, boats and yachts (Off. Gazette

    14/2008)).

    5.3.6 Requirements for yachts navigatingduring summer season in the extended

    navigation area

    5.3.6.1 Yachts in navigation area IIa, which are fromthe 1st April till 31st October navigating in territorial waters

    of Republic of Croatia, Montenegro, Slovenia and Italy, up toVenice within maximum allowable distance of 12 Nm fromthe nearest shore are to comply with the requirements for de-

    sign category A, B or C (according to Directive 94/25/EC) orequivalent.

    With respect to compulsory compensation of

    magnetic compass requirements as for yachts navigating innavigation area III and IV are to be applied.

    5.3.6.2 For yachts in navigation area II, which are from

    1st April till 31st October navigating by crossing the Adriaticsea the following is to be fulfilled:

    .1 yachts are to comply with the require-ments for design category A or B (ac-cording to Directive 94/25/EC) or

    equivalent;.2 yachts are to be equipped as for naviga-

    tion area IIa, with following additionalrequirements:a) two-way VHF radiotelephone appa-

    ratus for survival craft or survivalcraft radar transponder is to be pro-

    vided;

    b) 4 parachute rocket flares are to beprovided;

    c) inflatable liferaft(s), of such aggre-gate capacity to accommodate the to-

    tal number of persons on yacht (com-plying with the requirements for

    navigation area III) is (are) to be pro-vided.

    With respect to compulsory compensation ofmagnetic compass requirements as for yachts navigating in

    navigation area I and II are to be applied.

    5.4 TECHNICAL REQUIREMENTS

    FOR YACHTS HAVING HULL LENGTH

    GREATER THAN 24 METERS

    REQUIREMENTS FOR

    STATUTORY CERTIFICATION

    OF CROATIAN FLAGGED BOATS

    6.1 APPLICATION AND

    DEFINITIONS

    6.1.1 Application

    The requirements of this section shall apply toall boats, irrespectively on their final use. For additional re-quirements for boats built for personal use see the Rules,

    Chapter 4, Section 4.

    6.1.2 Definitions

    For definitions see the Rules, Chapter 1, Sec-tion 3.

    EXPLANATORY NOTE:

    Relevant definitions from the Rules, Chapter 1, Section 3

    Boat - floating unit intended for sea-going navigation, which isnot a ship or yacht, with length greater than 2,5 meters, or withtotal power of propulsion engines greater than 5 kW. The termboat does not comprise:.1 Crafts belonging to other sea-going vessel for the purposeof recovery, rescuing or performing of works..2 Canoes and kayaks, gondolas and pedalos.

    .3 Sailing surfboards, powered surfboards, personal water-crafts and other similar powered crafts..4 Racing boats, i.e. boats intended solely for racing.

    For the purpose of these Rules this term excludes the follow-ing:.1 Experimental vessels..2 Submersibles..3 Air cushion vessels..4 Hydrofoils.

    6.2 SURVEY DURING

    CONSTRUCTION

    EXPLANATORY NOTE:

    Requirements from this paragraph (para. 6.2) are not relevantfor existing and second-hand boats and boats not complyingwith Directive 94/25/EC.

    6.3 TECHNICAL REQUIREMENTS

    Boats, apart from the requirements stated in the

    Rules, Chapter 2, Section 2, are to be in compliance with theadditional technical requirements as stated in 5.3.1 to 5.3.6.

    Tonnage measurement of boats is performed in

    accordance with the Rules for tonnage measurement of ma-rine objects.

    6.3.2.1 Anchoring, mooring and towing equipment

    6.3.2.1.1 General requirements:.1 Below stated requirements are intended

    for temporary anchoring of the boatwithin harbour or sheltered area. Anchorsand chains are designed neither to hold

    the boat off exposed coasts in roughweather, nor to stop the boat when sail-

    ing. Requirements stated in the Rules,Chapter 2, 2.4.8 are to be complied with

    also.

    EXPLANATORY NOTE:

    Requirements stated in the Rules, Chapter 2, 2.4.8 are notrelevant for existing and second-hand boats and boats notcomplying with Directive 94/25/EC.

    6.3.2.1.2 Anchors:

    .1 The anchor masses given in Table6.3.2.1-1 are for high holding power an-

    chors.When a fisherman type of anchor is fittedthe mass given in Table 6.3.2.1-1 is to be

    increased by 25 %, but the diameter ofthe chain cable needs not to be increased.

    When the boat has an unusually highwindage (high freeboard, large super-

    structure or large rigging) the mass of theanchor and diameter of chain cable might

    be increased above the requirementsstated in Table 6.3.2.1-1. For boats hav-ing unusual or non-conventional forms

    (catamarans, trimarrans, etc.) the anchorand chain cable size should to be consid-

    ered on the case-by case basis.6.3.2.1.3 Chain cables:

    .1 The length of the chain cable should beappropriate to the navigation area, but

    generally should not be less than 4 timesof the boat hull length, or 30 meters,

    whichever is greater, for each of the an-chors.

    .2 Chain cables may be replaced by syn-

    thetic ropes or steel wires. In that case,the length of the chain cable between theanchor and the rope or wire should be not

    less than 20 % of the total length.

    6.3.2.1.4 Towing and mooring lines:.1 The boat is to be equipped with at least

    four mooring lines with the length notless than the boat hull length, but in no

    case less than 5 meters. Furthermore, theboat is to be provided with at least onetowing rope with length of not less than

    four times of hull length. The diameter ofthe towing rope shall be not less than thediameter required for the spare anchor

    rope.
