CHAPTER 3
DEPARTMENT SERVICES
SECTION 12. Department Services.—Except as otherwise provided by law, each Department
shall have Department Services which shall include the Planning Service, the Financial andManagement Service, the dministrative Service, and whenever necessary the !echnical and
"egal Services.
SECTION 13. Planning Service.—!he Planning Service shall provide the department witheconomical, e##icient and e##ective services relating to planning, programming, and pro$ect
development, and discharge such other #unctions as may be provided by law. %here the wor& o#
the department does not call #or substantial planning and programming, the Planning Service
shall be constituted as a single unit without subdivisions. %here substantial primary data'gathering is essential to the operations o# the department, a statistical unit may be constituted as
part o# a technical service.
SECTION 14. Financial and Management Services.—!he Financial and Management Services
shall advise and assist the Secretary on budgetary, #inancial and management matters and shall per#orm such other #unctions as may be provided by law.
SECTION 15. dministrative Service.—!he dministrative Service shall provide the
Department with economical, e##icient and e##ective services relating to personnel, legalassistance, in#ormation, records, delivery and receipt o# correspondence, supplies, e(uipment,
collections, disbursement, security and custodial wor&. )t shall also per#orm such other #unctions
as may be provided by law.
SECTION 16. !echnical Service.—%henever necessary, one or more technical services shall beestablished to ta&e charge o# technical sta## activities essential to a department and which cannot
be allocated to the three other services or to the bureaus.
SECTION 17. "egal Service.— "egal Service shall be provided where the operations o# the
department involve substantial legal wor&, in which case the dministrative Service shall nothave a "egal Division. !he "egal Service shall provide legal advice to the department* interpret
laws and rules a##ecting the operation o# the department* prepare contracts and instruments to
which the department is a party, and interpret provisions o# contracts covering wor& per#ormed#or the Department by private entities* assist in the promulgation o# rules governing the activities
o# the department* prepare comments on proposed legislation concerning the department* answer
legal (ueries #rom the public* assist the Solicitor +eneral in suits involving the Department or its
o##icers, or employees or act as their principal counsel in all actions ta&en in their o##icialcapacity be#ore $udicial or administrative bodies* and per#orm such other #unctions as may be
provided by law.
%here the wor&load o# the department does not warrant a "egal Service or a "egal Division,there shall be one or more legal assistants in the ##ice o# the Secretary.
