    In 1980, the Deptt. of Environment wasestablished in India. Later on it becamethe Ministry of Environment and Forestsin 1985. EPA,1986 came into force soon

    after the Bhopal Gas Tragedy.

    Objective is, to provide the protectionand improvement of environment. InEPA, article 48A, specify that the Stateshall protect and improve the

    environment.Also, to safeguard the forests and wildlifeof the country. Acc. to sec 51(A) everycitizen shall protect the environment.EPA is applicable to whole India,including J&K.

    Environment It includes water, air,and land and the interrelationship whichexists among and between water, airand land and human beings, other living

    creatures, plants, microorganism andproperty. Environmental Pollutantmeans any solid, liquid or gaseoussubstance present in such concentrationas may be, or tend to be injurious toenvironment.

    Under Sec (3): may constitute authorityor authorities for the purpose of

    exercising of performing such of thepowers and functions; Under Sec (4):may appoint a person for inspection;Under Sec (5): may issue directions in

    writing to any officers or any authorityto comply; Under Sec (6): it empowerthe government to make rules to

    achieve the object of the Act.Under Sec (7): persons carrying onindustry, operation etc. not to allowemission or discharge of environmental

    ollutants in excess of the standards

    PENALITY.

    Whoever Person found to be the cause ofpollution, may be liable for punishment fora term which may extend to five years orwith fine which may extend to one lakh

    rupees or both (Sec 15, 16, 17). If notcomply fine of Rs. 5000 per day extra, stillif not comply for more than one year, thenimprisonment may extend up to 7 years.

    Section 17 specifies that Head of thedepartment/ incharge of small unit may beliable for punishment if the owner /occupierproduce enough evidence of innocence.

    Every rule made under this Act shall be laid, as soonas may be after it is made, before each Hose ofParliament, while it is in session, for a total period ofthirty days which may be comprised in one session or

    in two or more successive sessions, and if, before theexpiry of the session immediately following thesession or the successive sessions aforesaid, bothHouses agree in making any modification in the ruleor both Houses agree that the rule should not bemade, the rule shall thereafter have effect only in

    such modified form or be of no effect, as the case
