Purpose of Report

To recommend a preferred contractor for the removal and replacement of the Albury Entertainment Centre (AEC) stage.

Background

The Albury Performance Arts Centre was constructed in the 1960s and originally named the Civic Theatre. Eight years later the Convention Centre was opened and named the Civic Hall. Albury City Council built the facility with a view to providing the local community with a cultural and entertainment hub in the heart of Albury’s central business district. In the late 1980s the complex underwent a refurbishment and was renamed the Albury Convention and Performing Arts Centre (ACPAC).

ACPAC was rebranded as the Albury Entertainment Centre in 2009. A major capital upgrade of the venue was undertaken soon after, in 2010, in order to ensure the venue continued to adapt to the changing needs of both the local community and the convention and performing arts industries.

The stage is reaching the end of its useful life with some areas of the floor sagging and becoming a problem for its safe use. Furthermore, sub floor inspections revealed that the area contains two types of asbestos containing products, asbestos cement sheet, and friable asbestos millboard panels.

The project scope includes the removal and replacement of the stage in the main auditorium at the AEC theatre, including the removal and disposal of any asbestos. It is then to be reconstructed with a sub frame made from high strength cold formed hollow steel sections, hot dip galvanized to AS/NZS 4792:2006. A sheet flooring system is then to be affixed to the steel joists and the stage raked to match existing levels.

The period for the project to be completed is 1 January 2018 to 20 March 2018. The facility is booked either side of these dates and it is critical that the theatre is fully available for a function booked for 21 March 2018.

Tenders were invited for Contract No. 17/00587 Remove and Replace Albury Entertainment Centre Stage in a lump sum format and were advertised in the Border Mail, Sydney Morning Herald and on Tenderlink, commencing on 24 October 2017. Tenders closed at 12 noon on Tuesday 21 November 2017.

Based on the scope of the contract, the designs, and investigation into similar upgrades at like facilities, a budget allocation of $220K for the stage replacement (including GST) has been included in the building maintenance budget.

The documents for the tender were downloaded by 17 companies. It was compulsory for vendors to attend at least one of the three facility inspections that were held. A total of six different companies attended over the three briefings.

Tender Assessment

At the close of tenders, submissions were received from the following companies:

Binding Building Pty Ltd, Lavington, NSW; Ultra Project Services, Rutherglen, Victoria; and Southern Cross Developers Pty Ltd, Albury, NSW.

The submissions were evaluated in accordance with Council's Procurement Policy and Guidelines. The evaluation was undertaken in a three stage process beginning with a general conformity assessment followed by qualitative and quantitative assessments. The general evaluation of the tenders was conducted by the contract assessment panel consisting of the Team Leader Assets (Stephen Millett), Team Leader Procurement and Contract Management (Peter Hanes) and the Team Leader Landscape and Building (Stephen Chalmers).

Ultra Project Services, based in Rutherglen, Victoria, employs up to 15 people, including administration personnel, construction supervisors, carpenters, asbestos removalists and demolishers. They are licensed in commercial building, demolition and asbestos removal. Recent works, including both asbestos remediation and reconstruction, include the Chiltern Goods Shed Refurbishment project for VicTrack, refurbishment of seven hangars at RAAF Point Cook and refurbishment of the theatre and the Wally Thompson OAM Club at Kapooka Army Base. Referees rated them as excellent. Local benefit details included employment of local staff, sourcing of materials and sub-contractors locally and information regarding sponsorship of sporting groups and charities. Their program shows the site being handed back on 28 February 2018 which allows a good buffer for any unforeseen issues that may arise during the project.

Binding Building Pty Ltd is based in Lavington and comprises two employees. Recent works have included a new facade for the Hume Bank, restoration works for the City of Wodonga at the Bonegilla Migrant Experience (asbestos remediation and reconstruction) and construction of a new Gold Class Cinema including a bar and catering area for Albury Regent Cinemas. Referees rated them as excellent. Local benefit details included employment of local staff and sourcing of materials and sub-contractors locally. Their program shows the site being handed back on 19 March 2018 which is close to the booking date of 21 March and does not allow for unforeseen issues that may arise during the project.

Southern Cross Developers Pty Ltd are based in Albury and employ 11 staff including project managers, carpenters, bricklayers, surveyors, designers and trade apprentices. Recent works include the terminal extension at the Albury Airport, asbestos remediation works and reconstruction of a defence building at Wirlinga, construction of the Albury Waste Management Recycling Centre and construction of the Trinity College Infants Centre. Their work for AlburyCity has been rated as very high. Referees rated them as excellent. Local benefit details included employment of local staff, sourcing of materials and sub-contractors locally and information regarding sponsorship of sporting groups and charities. Their program shows the site being handed back on 2 March 2018 which allows a good buffer for any unforeseen issues that may arise during the project.

The budget allocation for the removal and replacement of the AEC stage, based on scope and specification, is $220K (including GST). Two of the submissions were within the budget allocation.

As detailed in the table above, the submission from Ultra Project Services was the most favourable, being $13K or 8% more favourable than Binding Building Pty Ltd and $89K or 55% more favourable than Southern Cross Developers Pty Ltd.

In the qualitative assessment, all vendors rated highly in past performance, methodology, capacity and capability. Binding Building Pty Ltd rated marginally lower due to the comparatively later hand-over date, lower number of full time employees available for the project and lack of detail provided regarding benefit to the local region. All vendors were assessed as having the experience, capability and resources to meet the requirements of the tender.

In the quantitative assessment, Ultra Project Services Pty Ltd provided the most competitive bid being 8% more favourable in comparison to Binding Building Pty Ltd and 55% more cost effective than Southern Cross Developers Pty Ltd.

Conclusion

Council invited tenders, in a lump sum format, to remove and replace the Albury Entertainment Centre Stage. The project comprises the demolition and reconstruction of the stage, including remediation of asbestos in the sub floor area, construction of a metal sub frame and installation of a new stage floor.

The qualitative and quantitative assessments indicate that Ultra Project Services Pty Ltd have the experience, capability and resources to meet the requirements of the tender and is the most advantageous submission for Council.

Recommendation

That the Committee recommends to Council that Council accepts the Tender from Ultra Project Services Pty Ltd for the lump sum Contract No. 17/00587 Remove and Replace Albury Entertainment Centre Stage for the contract value of $161,915.03 including GST.

Purpose of Report

To recommend a preferred tenderer for the construction of a new amenities pavilion and stores along with associated electrical upgrades and sports field lighting components of the Lavington Sports Ground redevelopment through a qualitative and quantitative assessment.

Background

The Lavington Sports Ground (LSG) was purchased from the Panthers Group in 2009. Following the purchase, a number of upgrades and refurbishments were considered which led to the development of concept plans for the facility. Council has continued to invest in the facility since 2009 including the purchase of the 4.6ha of land to the east of the facility for the development of additional multi-purpose playing fields.

Council identified the LSG redevelopment as a priority project for the city allocating funding accordingly and seeking matching external funds. In December 2015, Council was successful in receiving $4.025M in funding through Round 2 of the Federal Government’s National Stronger Region Fund for the redevelopment, together with $3.5M committed by Council, $250K from the AFL and commitments from the Lavington Panthers Football/Netball and Cricket Clubs. The redevelopment of the major elements of the facility commenced in late 2016, after the master plan was adopted by Council in April 2016, identifying in excess of $9.5M of capital upgrades. Further funding is still to be sought to enable other elements of the master plan to be completed in the coming years.

At the October 2016 meeting, Council resolved to award the contract for the provision of professional services for the detailed design, estimate of costs and development of construction documentation and specifications for the delivery of the LSG redevelopment to Teilion Architects. This was the first of several tenders planned in a staged process in order to deliver the entire redevelopment project within the scheduled completion date of March/April 2019.

Council staff have been working with Teilion Architects and their sub consultants since that time to progress the various elements of the project and prepare tender documentation for the project components.

The first construction contract for which tenders were called included the following components:

power upgrade construction (including removal of overhead power lines and installation of new sub-station);

demolition and earthworks (area for playing fields and amenities); and construction of additional playing fields and associated infrastructure.

This contract was awarded to Depan Group in June 2017 with works currently underway and programmed for completion in May 2018. Work on this component of the LSG project has unfortunately been delayed due to the discovery of a large quantity of unsuitable soil on site. The

discovery of this material has resulted in a variation to the project scope which will translate into an overall project cost increase for this project element of approximately $2M. These additional project costs will be considered by Council at the December quarterly budget review and it is proposed that these cost variations can be offset by achieved savings in other projects.

The next element of the construction project is to seek a suitably qualified and experienced company for:

the construction of a new amenities building of approximately 400m2, consisting of four change rooms, umpires’ rooms, public toilets, medical room and kiosk (attachment 1);

design and construction of a new ground keeper store (100m2) and cricket store (16m2); and electrical upgrades and sports field lighting installation including new main switchboard, mains

cabling, light fittings to the lighting tower, sports field lighting control system and commissioning and testing.

Detailed designs for the new amenities building were completed in September, with submissions invited in October.

Detailed design plans for the grandstand and extension works are currently underway and will be finalised over the coming months. Additionally, the Pearsall Street upgrade work and new Hanna Street car parking which are also included in the LSG redevelopment, have, and will be, completed internally by AlburyCity.

As per the conditions of the Funding Agreement with the Australian Government Department of Infrastructure and Regional Development, four project progress reports have been submitted by AlburyCity to date, with the first of the six funding payments to be received by AlburyCity in January 2018.

The allocated budget in the Four Year Delivery Program for this project is $9.9M (inclusive of GST), including $4.73M in external funding. The estimated budget for this stage of the project (new amenities construction and electrical upgrades) is $1.79M.

An open invitation for tenders was placed on Tenderlink and advertised in the Border Mail and Sydney Morning Herald on Saturday 21 October and Tuesday 24 October 2017 respectively. Tenders closed at 12 noon on Tuesday 14 November 2017.

Tender Evaluation

At the close of tenders, submissions were received from the following five companies:

Premier Building & Construction Pty Ltd (Wodonga, Victoria); Q1 Constructions Pty Ltd (Wodonga, Victoria); Southern Cross Developers Pty Ltd (Albury, NSW); Adaptive Pty Ltd t/as Dezign Interiors (Albury, NSW); and CBCon Pty Ltd (Albury, NSW).

The submissions were evaluated in accordance with Council's Procurement Policy and Guidelines. The evaluation was undertaken in a three stage process beginning with a general conformity assessment followed by qualitative and quantitative assessments. The evaluation of the tenders was conducted by the Evaluation Panel consisting of Peter Hanes (Procurement and Contract Management Team Leader), Ian Redman (Team Leader Design) and Michael Stanton (Team Leader Leisure Facilities).

As indicated above, all submissions except Q1 Constructions Pty Ltd are deemed conforming tenders. Q1 Constructions Pty Ltd in their submission provided General Qualifications. The contents of these qualifications include no allowance for inclement weather, or provision of a daily rate for prolongation costs. These provisions are contrary to the contract terms and conditions provided in the tender and are deemed to be a counter offer, and therefore Q1 Constructions Pty Ltd's tender is deemed non-compliant and they were not considered any further in this assessment.

Premier Building & Construction Pty Ltd is a local company based in Wodonga. They have undertaken a number of similar projects, including a new amenities building at Holbrook pool for Greater Hume Council, a multi-purpose sports pavilion at Tallangatta for Towong Shire Council and club rooms and sporting pavilion at Urana Road Oval for AlburyCity. Premier Building & Construction Pty Ltd provided a detailed methodology statement outlining the key steps and milestones required to complete the project as well as a construction program indicating 123 building industry days being required from possession of the site to award of Practical Completion. Premier Building & Construction Pty Ltd has the experience and resources to complete this project to a high standard and the obtained referee information supports this.

Southern Cross Developers Pty Ltd is also locally based, in Albury, and has undertaken a number of building projects throughout Victoria and New South Wales. Of note, the Year 12 Centre at Catholic College in Wodonga, an Infants Centre at Trinity Anglican College in Thurgoona and various projects at Blacklocks motor vehicle dealership, including a new showroom. Southern Cross Developers Pty Ltd have recently completed the Albury Recycling Centre and Push Pit at the Albury Waste Management Centre and are currently constructing the Airport Terminal Expansion project for AlburyCity which is due for completion in April 2018. Southern Cross Developers Pty Ltd did not provide a methodology statement, however provided a construction program indicating 89 building industry days being required from possession of the site to award of Practical Completion. Southern Cross Developers Pty Ltd also has the experience and resources to complete this project to a high standard and the obtained referee information supports this.

Adaptive Pty Ltd t/as Dezign Interiors is also a locally based company, from Albury, and has undertaken similar projects including a new amenities building for Wagga Cricket Association, construction of three toilet blocks for the City of Wodonga, construction of the Years 5 and 6 Centre for Saint Monica’s Primary School in Wodonga and the construction of Equex Centre, a junior rugby league amenities building for Wagga City Council. Adaptive Pty Ltd t/as Dezign Interiors also did not provide any detailed around construction methodology. Their submitted construction program indicates 140 building industry days are required from possession of the site to award of Practical Completion. Adaptive Pty Ltd t/as Dezign Interiors also has the experience and resources to complete this project to a high standard and the obtained referee information supports this.

CBCon Pty Ltd is a smaller contractor locally based in Albury and has completed a number of refurbishment projects for the Rydges Hotel Group in both Canberra and Hobart, as well as construction of residential properties and a new warehouse and offices for Gerard Percy Electrics Pty Ltd. CBCon Pty Ltd provided a construction program indicating 114 building industry days being required from possession of the site to award of Practical Completion. However, in their submission they neglected to provide any detail around methodology of construction. Obtained referee information indicates that CBCon Pty Ltd completes projects to a high standard and they have the experience and resources to complete this project.

All four contractors are located in the Albury/Wodonga region and have indicated that a large percentage of materials, plant, sub-contractors and equipment will be sourced from the Albury/Wodonga area.

From the information provided, all companies demonstrate the required management systems, experience and construction plant to provide AlburyCity with a quality product.

As detailed above, the submission from Premier Building & Construction Pty Ltd was the most favourable, being $62K or 3% more favourable than Southern Cross Developers Pty Ltd, $137K or 8% more favourable than Adaptive Pty Ltd t/as Dezign Interiors and $311K or 17% more favourable than CBCon Pty Ltd.

The submission from Premier Building & Construction Pty Ltd is only marginally greater (less than 1%) than the allocated budget of $1.79M for this element of the LSG Redevelopment.

The qualitative assessment indicated that all shortlisted tenderers could successfully deliver this project, with Premier Building & Construction Pty Ltd rating the highest due largely to their submitted detailed methodology statement.

From a quantitative perspective, Premier Building & Construction Pty Ltd provided the most competitive price, being $62K (3%) more favourable then Southern Cross Developers Pty Ltd and consistent with the budget allocation. When considering both the qualitative and quantitative assessments, Premier Building & Construction Pty Ltd provided the best overall tender submission and therefore are considered the most suitable contractor for the execution of this project.

Conclusion

Council purchased the Lavington Sports Ground in 2009 and has progressively updated components as part of an overall master plan process. Recently Council was successful in securing external funding to contribute to this redevelopment. In October 2016, Teilion Architects was appointed to develop designs and estimates.

Council staff have been working with Teilion Architects and their sub consultants progressing the various elements of the project and preparing tender documentation for the various project

components. The second tender for the Lavington Sports Ground redevelopment was awarded to Depan Group in June 2017. Works are continuing on the sports field construction and are estimated to be completed in May 2018.

Council invited tenders for the construction of an amenities pavilion and sports field lighting components of the Lavington Sportsground Redevelopment. Five submissions were received. The scope of works includes construction of an amenities pavilion and stores along with essential electrical infrastructure upgrades and sports field lighting.

The outcome of the tender evaluation process supports that the submission from Premier Building & Construction Pty Ltd provides the most advantageous proposal for Council. Apart from being the least expensive option, Premier Building & Construction Pty Ltd demonstrate to have the necessary experience, expertise, resources and management systems to successfully undertake this project and therefore the acceptance of this tender is duly recommended.

Recommendation

That the Committee recommends to Council that Council accepts the tender from Premier Building & Construction Pty Ltd for Contract No. 17/01805 - Lavington Sportsground Redevelopment – Amenities Pavilion in the lump sum amount of $1,797,642.28 (including GST).
