    INTRODUCTION

    Purpose:

    The exploration, development, and production of gas in the City of Arlington are activities whichnecessitate reasonable regulation to ensure that all property owners, mineral and otherwise, havethe right to peaceably enjoy their property and its benefits and revenues. During the 1

    st

    Quarter of 2014, the City of Arlington, Community Development and Planning Department(CD&P) and the City of Arlington Fire Department (AFD) conducted inspections of gas well padsites within the city limits to ensure compliance with the following: the City of Arlington GasDrilling and Production Ordinance, the Fire Prevention Ordinance and provide gas wellpermittees notice of violations on gas well pad sites.

    Authority:

    In accordance with City of Arlington Gas Drilling and Production Ordinance, Section 3.01 of

    the Inspector of the Ordinance, the City Manager shall designate officials who shall enforce the

    provisions of the Ordinance. The Inspector shall have the authority to enter and inspect anypremises covered by the provisions of the Ordinance to determine compliance with the

    provisions of the Ordinance and all applicable laws, rules, regulations, standards or directives of

    the State. The Inspector shall have the authority to issue any orders or directives required to carryout the intent and purpose of the Ordinance and its particular provisions. Failure of any person to

    comply with an y such order or directive shall constitute a violation of the Ordinance. In accordance

    with the City o f Arlington Fire Prevention Ordinance, Section 1.03, IFC 104.3 Right of Entry,whenever necessary to make an inspection to enforce any of the provisions of the Fire Code.

    NOTICE OF VIOLATION LETTER

    During the dates in the reports listed below, the City of Arlington Gas Well Specialist and FirePrevention Specialist conducted compliance inspections to identify and inform EnerVest

    Operating, LLC (EnerVest) of violations on gas well pad sites within the City of Arlington.Each EnerVest site was inspected and violations documented in the reports attached.

    Section 10.01 and IFC 109.3 Penalty

    A. It shall be unlawful and an offense for any person to do the following:

    1. Engage in any activity not permitted by the terms of a Gas Well Permit issuedunder this Chapter; or the Fire Prevention Chapter.

    2. Fail to comply with any condition set forth in a Gas Well Permit issued under thisChapter or the Fire Prevention Chapter

    B. A person who violates any provision of these Chapters by performing an act prohibitedor by failing to perform an act required is guilty of a misdemeanor; each day theviolation continues shall be a separate offense.

    1. If the definition of an offense under this Chapter does not prescribe a culpablemental state, then a culpable mental state is not required. Such offense shall bepunishable by a fine not to exceed Five Hundred Dollars and No Cents ($500.00).Although not required, if a culpable mental state is in fact alleged in the charge ofthe offense and the offense governs fire safety, zoning, or public health andsanitation, including dumping of refuse, such offense shall be punishable by a fine

    not to exceed Two Thousand Dollars and No Cents ($2,000.00).

    3. If the definition of an offense under these Chapters prescribes a culpable mental stateand the offense governs fire safety, zoning, or public health and sanitation, includingdumping of refuse, then a culpable mental state is required and the offense shall bepunishable by a fine not to exceed Two Thousand Dollars and No Cents ($2,000.00).(Amended Gas Drilling and Production Ord 10-012, 1/12/10) (Amended FirePrevention Ord 12-021, 4/24/2012 )

    EnerVest Operating, LLC is hereby required, per section 5.06 (A) and (B) of the Gas

    Drilling and Production Ordinance and IFC 109.3 of the Fire Prevention Ordinance, to

    correct any noted violations on each corresponding pad site report. Failure to complywith the following stated instructions, and/ or failure to comply with the

    following stated instructions in the future will result in penalties or fines in

    accordance with the Ordinances.
