EMTALA Update 2019 CMS’ Most Cited Deficiencies for Hospitals Nov. 15, 2019; 8:30 a.m. to 4:30 p.m. Crowne Plaza Minneapolis West, Plymouth Every hospital that has an emergency department and accepts Medicare and Medicaid patients must follow the federal law and the Centers for Medicare and Medicaid Services (CMS) conditions of participation (CoPs) interpretive guidelines on the Emergency Medical Treatment and Labor Act (EMTALA). Hospitals without emergency departments must comply with EMTALA if they have specialized capabilities. EMTALA can also impact obstetrical patients and behavioral health patients. The federal EMTALA law and the accompanying regulations are complex. This program is structured to make the requirements understandable with the liberal use of examples. The EMTALA manual was updated in 2019 including several survey memos and other documents. These changes include survey memos on psychiatric patients and the Born-Alive Infant Protection Act. This program will cover all of the recent changes and common deficiencies as well as regulations and interpretive guidelines including an expanded section for on-call physicians and the shared and community care plan process. Failure to comply and follow the federal EMTALA for all hospitals, including critical access hospitals, could result in loss of Medicare and Medicaid payments. Fines can be assessed against hospitals and physicians who negligently violate the EMTALA law. Hospitals will need to ensure their policies, procedures and training are adequate to ensure compliance with EMTALA. Who Should Attend Emergency department managers, medical directors, physicians, nurses and education staff, OB managers, behavioral health directors and staff, CFOs, COOs, CMOs, CNOs, nurse supervisors, educators and staff nurses, outpatient directors, compliance officers, legal counsel, risk managers, directors of hospital-based ambulance services, registration directors and staff, on call physicians, patient safety officers and Joint Commission coordinators. Schedule Registration begins at 8 a.m. Program is from 8:30 a.m. to 4:30 p.m. Lunch and two breaks will be provided. Space is limited, so please register early. Speaker Sue Dill Calloway, RN, AD, CPHRM, MSN, J.D., medical-legal consultant, Dublin, Ohio Sue Dill Calloway is currently a medical-legal consultant. She is the past chief learning officer of the Emergency Medicine Patient Safety Foundation. She is also a past director of patient safety and risk management for the Doctors Company. She has been employed in the nursing profession for more than 30 years. Calloway has legal experience in medical malpractice defense for physicians, nurses and other health professionals. Calloway is a member of many professional organizations. She has authored more than 100 books and has published many articles. She is a frequent lecturer on health care issues. Continuing Education MHA has applied for 6.5 continuing legal education credit hours through the Minnesota State Board of Continuing Legal Education.
